REGULAR MEETING OF THE CITY COUNCIL
AUGUST 4, 1987
The Schertz City Council convened in Regular Session, Tuesday,
August 4, 1987, at 7 :00 p.m. in the Council Chambers of the
Municipal Complex, 1400 Schertz Parkway, Schertz, Texas~ The
following members were present: Mayor EarlW. Sawyer, presiding;
Charles B. Sharpe; Hal Baldwin; Ray Stanhope; Adolph Aguilar and
Ken Greenwald. Staff present were City Manager Jimmy G. Gilmore
and City Secretary June G. Krause.
PUBLIC HEARING: The Ci ty Council will receive input from the 'PI?, t.F)
public on the proposed annexation of approximately 383.4 acres of /Jq
land out of Bexar County. Mayor Sawyer explained this proposal
is at the request of the Boeck family. It is a one owner piece
of property that has just been released by San Antonio.
There were no ci tizens present wishing to speak pro or con on
this subject. Mayor Sawyer then declared the public hearing
closed at 7:02 p.m.
#1 EXECUTIVE SESSION: Mayor Sawyer called at executive
session under Article 6252-17 V.T.C.S. to discuss with the (1,1o~~
attorney a possible agreement on the Green Valley litigation. J~/
r- The Regular meeting was reconvened at 7:23 p.m.

Mr. Greenwald moved

NAYS: None
Attorney Bob Newman explained that the City is dividing up the
contested territory with Green Valley Water Supply Corporation.
He said we will keep the portion along I-35 and Green Valley is
going to continue serving their customers outside that area. We
will service all new customers in the area and Green Valley will
take the ones outside our ETJ. Their customers will stay with
Green Valley as long as the usage remains the same.

Mayor Sawyer said we feel this is an equi table settlement for
both Schertz and Green Valley. This will be presented to Green
Valley in the very near future for their consideration.

#2 HEARING OF RESIDENTS: Mr. Mazian stated he addressed
Council almost a year ago c'oncerning the striping of streets,
especially the school crossing designations; and school is about
ready to start and they are still not painted.
Mayor Sawyer explained that the City had ordered a striping
machine, it came in without parts so it was sent back. We are
now going out for bids again. Mayor Sawyer said that all
Councilmen will agree with Mr. Mazian, that it does need to get
done.
#3 APPROVAL OF MINUTES: A. Special Meeting of July 15.
B. Special Meeting- of July' 20 and C. Regular Meeting of July
21, 1987.

Mr. Greenwald asked that the fourth paragraph of item #4 of the
minutes of July 21st be corrected as follows: "Mr. Baldwin asked
about the time limit on phase II. Mr. Greenwald said that
according to ordinance, phase II must be started within six
months of the completion of phase I or the zoning reverts."
Mr. Baldwin asked that the date of the BVYA dinner as explained
in paragraph 3 of item #9 of the minutes of the meeting of July
15 be changed to Thursday~ rather than Friday as listed.
Mr. Baldwin also requested that the first sentence of paragraph
three of Item #4 of the minutes of July 15th be changed as D
follows: "Mr. Baldwin said he would I ike to see the Ci ty
designate Pheil Street "No Parking"."
Mr. Baldwin also asked that the second paragraph under the
heading Street/Parks in the minutes of July 20 read as follows:
Mr. Stanhope asked if we were killing vegetation rather than
cutting. Mr. Gilmore said no that we use retardant."
Mr. Sharpe asked to delete the last sentence of the third
paragraph of item #2 of the minutes of July 15, 1987. Mr. Sharpe
also asked to clarify by showing the computers referred to in the
second paragraph of the section on POLICE were pOlice computers.
Mr. Sharpe also asked that the last sentence of the fourth
paragraph under LIBRARY of these minutes be changed to read as
follows: "Mr. Gilmore added that they are very protective of the
money. "
Mr. Aguilar moved to approve the minutes of the meetings of July
15, 20 and 21, 1987 as amended. Mr. Baldwin seconded the motion,
which carried with the following vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.

AN ORDINANCE BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, AMENDING ORDINANCE NO. 84-
F-21, SECTION XXIX - WATER RATES ESTABLISHED,
AS SET OUT IN EXHIBIT 4, PARAGRAPH C - RATES
OUTSIDE THE CORPORATE LIMITS OF THE CITY;
ORDINANCE 83-F-7, SECTION XXXIX - PENALTY FOR
DELnQUENCY AND SECTION XL - DISCONTINUANCE
OF SERVICE FOR FAILURE TO PAY; AND REPEALING
ALL ORDINANCES IN CONFLICT.
Mr. Baldwin moved to approve the final reading of an ordinance
amending ordinances 84-F-21 and 83-F-7. Mr. Greenwald seconded
the motion, which carried with the following vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.

Mr. Sharpe moved to approve an ordinance amending the subdivision
ordinance by adding an exhibi t "D" Flood Study of Dietz Creek.
Mr. Stanhope seconded the motion, which carried as follows:

#6 APPOINTMENT: Consideration of appointing new member to
the Planning and Zoning Commission.

#7 WASTE MANAGEMENT: A. Consideration of extending the
time limit to October 31~ 1987 on the variance to allow Waste
Management to have a mobile office on their property on Jack Hays
Boulevard.
Mr. Baldwin moved to approve, once more, the estension of the
time limit to October 31, 1987 on the variance to allow Waste
Management to have a mobile office on their property on Jack Hays
Boulevard. Mr. Stanhope seconded the motion, which carried as
follows:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
B. Consideration of designating the classification of commercial
hand pickup service as residential rates.
Mr. Stanhope moved to designate classification of hand pick-up
service the same percentage rate as residential. Mr. Baldwin
seconded the motion, which carried as follows:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
#8 ORDINANCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:

Mr. Greenwald moved to approve the first reading of an ordinance
amending the sign ordinance on Shopping Center and Mall signs.
Mr. Stanhope seconded the motion, which carried with the
following vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
#9 CITY MANAGER'S REPORT: Mr. Gilmore provided copies of
the Street and Parks priority list for Seal coating streets to be
studied and discussed at the next workshop.
Mr. Gilmore also provided various bid specifications for
equipment Council has agreed to purchase for the Streets/Parks
department. This also will be discussed at next workshop.

#10 ITEMS BY COUNCIL: Mr. Aguilar said the Library has
continually increased their circulation, which is now over 4,000.
The Board also wants it known that this and all I ibraries buy
books contrary to what was said in the newspaper.
#11 ITEMS BY MAYOR: You have received a copy of letter
from the Live Oak Mayor written to Steve Simonson thanking him
for the help he furnish them on their sign ordinance. Mayor
Sawyer said we are getting our staff involved in helping other
cities.
Mr. Sawyer said he has given out more swimming pool passes this
year than in any of the last five years, mostly to the children
of the Library summer reading program.

Mr. Aguilar noted that our Literacy Council is recognized even in
the National publication.
