REGULAR MEETING OF THE CITY COUNCIL
SEPTEMBER 15, 1987
The Schertz City Council convened in Regular Session, Tuesday,
September 15, 1987, at 7 :00 p.m. in the Council Chambers of the
Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The
following members were present: Mayor EarlW. Sawyer, presiding;
Charles B. Sharpe; Hal Baldwin, Raymond Stanhope; Adolph Aguilar;
and Ken Greenwald. Staff present were Jimmy G. Gilmore, City
Manager and Alice Austin, Deputy City Secretary. Planning and
Zoning Members present were: Bob Andrews, Chairman; Ty Brisgill,
Merwin Willman, Randy Grisman, Mary Marshall and Keith Van Dine.
P & Z staff present was Steve Simonson.
Mayor Sawyer opened the meeting and welcomed all of the visitors.
He then presented a proclamation to SAFES administrator, Tom Funk
who was accompanied by SAFES personnel Mary Lou Malone, Pete
Young, Sherry Brown and Jimmie Nowels. The proclamation
proclaimed the week of September 20-26 as Emergency Medical
Services Week. Mayor Sawyer congratulated SAFES on the superior
service they performed.

PUBLIC BEARIRG: Mayor Sawyer opened the public hearing to
receive input On the rezoning of the Schermerville area' from Pre-
development (P.D.) to Residential/Agricultural. He then turned
the meeting over to Bob Andrews, Chairman of the Planning and
Zoning Commission.

Mr. Andrews advised that the area in question was bordered by FM
1518, IH 10 Access Road, Weicold Road, Bienz Engleman, Ware-
Seguin and Lower Seguin Roads. He advised that the city was
attempting to zone this area to keep it as close to the way it
currently is as possible. He advised that the procedure for the
public hearing was as follows: Briefing by staff, input from
citizens, questions and input from Council and Commission.

The majority of the citizens along Lower Seguin Road and FM 1518
voiced their concern for the businesses they were currently
operating. They were advised that if the are was zoned
Residential/Agricultural it would not interfere with their
businesses unless they sold the property. If the properties were
sold, the new owners would the have to have the property rezoned
to General Business to continue operation of a tius1ness. These
citizens were against the zoning to Residential/Agricultural and
requested if they were zoned to consider zoning these areas as
General Business to begin with.
r- Several citizens expressed their approval of the proposed zoning
and advised that they had asked for this type of zoning to
protect the area.

Mr. Sharpe adv is ed the city needed more spec if ic inf orma t ion on
properties located in this area to determine if portions of the
area should be zoned General Business.
Mr. Aguilar advised that we did not want to get into spot zoning.
He also said that he was very pleased with the comments from the
citizens and that the city ,needec:J, h<e1p from t:he citizens to
provide the best zoning for an area.
Mr. Andrews thanked the citi~ens for their input and turned the
meet ing back over to Mayor Sawyer. Mayor Sawyer adjourned the
public hearing at 8:19 p.m.

made the motion to approve the Minutes of the Special Meeting of
Augus t 26, 1987 and the Regu la r Meet ing of September 1, 1987.
Mr. Baldwin seconded the motion.
Mr. Baldwin requested the Minutes of August 16, 1987 be changed
to reflect that he was not absent, Mr. Aguilar was abjent.
Mayor Sawyer called for a vote as amended which carried as
follows:

Stanhope (for the meeting of September 12, 1987)
NAYS: None
ABSTAINING: Mr. Aguilar for both meetings and Mr. Stanhope
for the meeting of August 26, 1987.

ordinance providing for the extension of the boundary lines of
the City of Schertz, Texas by the annexation of 383.4 acres out
of Bexar County. Mr. Aguilar seconded the motion' which carried D

A RESOLUTION BY THE CITY COUNCIL OF THE
CITY OF SCHERTZ, ~EXAS DIRECTING THE TAX
COLLECTOR TO CHARGE $10 FOR EACH TAX
CERTIFICATE ISSUED AFTER SEPTEMBER. 1,
1987.
Mr. Sharpe made the motion to approve the resolution directing
the Tax Collector to charge $10 for each tax certificate issued
after September 1, 1987. Mr. Baldwin seconded the motion which
carried with the following vote:
AYES: Councilmembers Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
19 CITY KABAGER'S REPORT: Mr. Gilmore advised that he had
received a letter from GRASP but was not sure what it was for.
Mr. Sharpe advised that this was just for information to keep the
City posted on what GRASP was doing and how many citizens were
being served.
Mr. Gilmore advised that Mr. Hardin of the Planning and Zoning
Commission had submitted his resignation to take a position on
the CCMA Board of Directors.

Mr. Gilmore advised that someone had contested the City's
application for Sewage Discharge Permit and that the Water
Commission would be setting up a hearing. He also advised that
we would attempt to contact the people contesting and try to meet
with them.
#10 ITEKS BY COUBCIL: Mr. Baldwin advised that the
Bicentennial Signing of the Constitution ceremonies would be held
at Samuel Clemens High School at 2:00 p.m. on the 16th.
Mr. Aguilar thanked all the council for filling in for him in his
absence.
Mr. Greenwald advised the V.F.W. had canceled their October Fest
because there were too many other functions scheduled for that
weekend.
Mr. Sharpe advised the Guadalupe County United Fund-United Way
was getting under way. He challenged City Council to participate
at a higher rate than any other Council.

by the Police Department.
