SPECIAL MEETING OF THE CITY COONCIL
OCTOBER 1, 1986
The Schertz City Council convened in Spe'cia1 workshop Meeting
W~dnesday, October 1, 1986 at 7:00 p.m. in the Conference Room of
the Municipal Complex, 1400 Live Oak Road, Schertz, Texas. The
following members were present: Mayor Earl W. Sawyer, presiding;
Charles B. Sharpe; Hal Baldwin; Ray Stanhope; Adolph Aguilar and
K~n Greenwald. Staff present were City Manager Jimmy G. Gilmore
and City Secretary June G. Krause.
, #1 BEARING OF RESIDENTS: Mr. Carl Bugosh of 1020 Dimrock
in. Woodland Oaks asked about-the lack of different traff ic signs
in his subdivision. He listed several intersections that needed
e~ther yield or stop signs.

M~. Gilmore said we do not stockpile traffic signs because of the
e*pense involved. The signs are on order now. The new
sUbdivision ordinance will make it so that the developer puts in

#2 Discussion of invitation to join the South Texas Chamber
o~ Commerce.
M~yor Sawyer said that the City advertises in their brochure now
a~d he did not really think we should join, as we belong to the
lQcal Chamber of Commerce.
M~. Sharpe said that the last few years we have placed an ad and
y~u do not have to be a member to do that.
M~yor Sawyer took a concensus of Council and the decision was not
t~ joint the South Texas Chamber of Commerce.

#3 Discussion of Woodland Oaks drainage.
M~. Gilmore said over the past few months and before, some
Pfoblems have arisen over drainage. They are going to have to
P$.t some of the drainage underground and are in the process of
w~rking out the plans on this right now. We are hoping to have
tl(lem under construction on this drainage within a month. Some
dfainage will be brought out the front on FM 3009 and some Will
b, brought out the back. It has been really been a mess up
t~ere. The drainage problem is recognized and their engineer is
w~rking on it at this time.
Mt. Morley Brinkerhoff showed pictures of his residence and that
of Buddy Jackson and others of the pooling of water when it

rains. He said he has been told by Gemcraft as far back as 1985
that plans to alleviate the problem were being made. Later they
said it was not their problem - to see the developer. They were
told that 1 August 1986 was the target date to begin construction
to correct the drainage problems. To date nothing has been done.
The also said that when they started work on Phase 2, the problem
would be addressed. Well, they are working on Phase 2 now and
the problem still exists.
Mr.. Jackson said the developer was allowed to come in and make a
mistake and the homeowners were not going to wait another two
years to solve this problem. He said they had come to Council to
ask for help.
Mr. Gilmore said he is suppose to get the construction plans the
following week and construction on this is to get under way very
shortly. Mr. Gilmore invited those present to call him and come
by his office to view these plans. He said he thinks the problem
has been worked out now.

Mr. Jackson asked who is responsible for keeping the ditches
cleared and cleaned. Mr. Gilmore said when the City accepts
them, we will be but right now it is the responsibility of the
developer.
Mr. Curtiss Gunther said he has been there since January 1986.
He said he has called the developer several times and he said he
is going to put a road in there. Mr. Gunther said he wanted to
know how since there is a house already built there. He lives
right next door to the ditch.

When the Mayor asked if the City could stop the developer from
developing, Mr. Gilmore said 'we have him on hold on a lot of
things now.
Mayor Sawyer said that this Council would stay on top of this
problem. He said that regarding cleaning the ditch, Council can
ask Mr. Gilmore to give him a citation on that.
.4 Discussion of Guadalupe County Appraisal District Plan.
Mr. Greenwald said that he, Mr. Sharpe and Mr. Stanhope went to
the meeting on this subject; and based on the reappraisal this
year; he does not see any way the City is going to get a roll by
next October. Their plan shows the hearings will be in August
and there is just no way they can complete everything to get a
roll to us by August.
Mr. Baldwin said he had talked with Mr. Morris who said the Board
has stripped him so tigh.t on his budget that he cannot hire any
more people.
Mr. Sharpe said that he had asked Mr. Morris repeatedly if he had
enough money to get the job done on tiine. He doe~ not seem

co~cerned with the law. Mr. Sharpe saia that he did not sense
thft anyone had cut his budget.
Mr ~ Baldwin agreed that he did not see how Mr. Morris c.an do the

Mr ~ Aguilar said the City should do' $iOlfi'E!'t.hing to voice our
di~agreement.
Mr.. Greenwald suggested the City senti th.e Appraisal Board a
le~ter saying we do not agree with their plan and suggest that
th~y amend their budget to allow for more appraisers.
Mator Sawyer agreed to approach it that way by sending a strongly
wotded letter asking them to hire sufficie"nt people to comply
with the law and send copies to all entities in their taxing
jut i sdiction'.
#5 Discussion of the proposed sign o'rdin,ance.
ColjIncil concensus was that since th'eirsu9gestions had been
inforporated in the ordinance, they woulCl b'e ready to vote on
th~s ordinance at the next meeting.
#6 Discussion of the proposed zoning Ordinance.
Mator Sawyer said that this ordinance ha,s be'e'n recommended by the
P14mning and Zoning Commission members and th'e proposed changes
have been underlined.
Mr. Sharpe brought up adding a zoning district for alcoholic and
no~-alcoholic beverages.
Mr ~ Gilmore suggested that the ordinance say that all
Nefghborhood Service areas be marked so that if alcohol is
wanted, then have to have a specific use permit.
Co~ncil discussed at length whether to add another district on
thfs or use specific use permits. ... At the conclusion of
di~cussion, Mr. Aguilar, Mr. Stanhope and Mr. Greenwald preferred
tolrequire a Specific Use Permit; with Mr. Sharpe and Mr. Baldwin
pr~ferring an additional district.
#7 Discussion of amending the Mobile Home Ordinance.
Mr ~ Gilmore asked if Council felt th'e ordinance should be
st~icter. He also suggested a better definition of RVs.
Mator Sawyer said he thought Council sho'uld not make any changes
tolthe Mobile Home ordinance that would or might hurt our court
ca~e unless we have Mr. Harris' advice.
It i was brought out that the only reaSon for this amendment is
thqt it is the normal time to review the ordinance.

.8 CITY MANAGER'S REPORT: A. Mr. Gilmore had copies of a
letter the Mayor. signed to send to AACOG regarding Green Valley's
application for a loan. There has been articles in the
newspapers about this. Mr. Gilmore said word has come back that
the only reason Schertz is contesting this is because we want to
harass them.

B. Mayor Sawyer and Mr. Gilmore are scheduled to meet with the
FmF~ people on Thursday at 2:00 p.m..
C. Mr. Gilmore said he met with the attorney assigned by TML on
the Parker Case for 2-1/2 hours. He said they will go to court
Fr iday on a Change of Venue. The attorney said that after
reviewing our ordinance, he feels we have a pretty good case.
D. Mr. Gilmore said that on Friday he would be on depositions
all day on the Parker Case. The attorney is hoping to get it in
State Court within three weeks and in Federal Court not long
after. Mr. Gilmore said he felt much better after talking with
this attorney.
E. The City Manager said he has been back negotiating with Mr.
Bindseil and Mr. Ackermann. The engineers from Woodland Oaks are
involved now and it is looking better all the time. Mr. Gilmore
said he thinks he has Mr. Ackermann just about ready as far as
drainage and road is concerned. Also have been talking with
other developers on the road.
19 ITEMS BY COUNCIL: Mr. Aguilar asked if the police,
while driving around, could keep staff up on the problems with
the weeds in drainage ditches, etc.

Mr. Aguilar said that when it comes to street lights, the
ci tizens don't know what to do. Mr. Gilmore said staff is
working on getting a sheet out to include that information.
Mr. Sharpe reported on a meeting he attended in Austin on the
TEXEL program. ' The thrust of the pro'gram was to get familiar
with the businesses and see what their plans are and be available
to help them if necessary. Mr. Sharp'e suggested setting up a
"Business Appreciation Week".
Mr. Sharpe said in connection with drainage, when the City
approved Savannah Square one of the things that was approved was
a retention pond. They have one but Mr. Sharpe said he did not
think it would retain much water. Mr. Sharpe suggested having
our engineer calculate that again and see if it is really going
to retain any water. Council concensus was to have Mr. Ford look
at it to see if it is what it was suppose to be.
Mr. Sharpe asked if the people putting in the restaurant had 0
gotten a permit. Mr. Gilmore said they are Clearing land but he
did not think they had obtained a permit as yet.

Mr.i Sharpe announced that the Guadalupe County United Fund Drive
is i in process. He said he was disappointed with the
paiticiPation by the City last time. He said he would get some
ad itional brochures listing all the agencies that the Drive
he ps.
Mr~ Stanhope asked if Larry's Automotive bought the lot next door
to I them as there are some vehicles being parked on the lot with
fo~ sale signs on the cars.
Mr~ Baldwin said he always thought the P&Z checked on cul-de-sacs
tolbe sure there was enough room to turn a fire truck but on the
Elf Whitney one, there is not enough room to turn a school bus.
He1said he did not know what the solution would be. Mr. Gilmore
wa$ to check into this.
Mr~ Sharpe said he was talking with Mayor Little of Cibolo who
as~ed if the Joint Coordinating Committee was going to be
re4ctivated.

Mr~ Baldwin mentioned the latest Corridor Report, saying that it
ha$ so many errors in it that it is almost embarrassing.

ad4 to what has'already been discussed.
