SPECIAL MEETING OF THE CITY COUNCIL

The Schertz City Council convened in Special Workshop Session, LJ
wednesday, October 15, 1986, at 7:00 p.m. in the Conference Room
of the Municipal Complex, 1400 Live Oak R'o'ad, Schertz, Texas.
The following members were present: Mayor Earl W. Sawyer,
presiding; Charles B. Sharpe; Adolph Aquilar and Ken Greenwald.
Absent: Councilmen Hal Baldwin and Ray Stanhope.
#1 PUBLIC BEARING: Mayor Sawyer explained that the public
hearing was being held to receive citizen input on the proposed
annexation of 121.906 acres of land out of Comal County. The
land is located to a depth of 250 feet either side of the center
line along FM 482 and FM 2252.
As there were no citizens wishing to sp'eak on the proposal, Mayor
Sawyer declared the hearing closed at 7:01 p.m.
12 BEARING OF RESIDENTS: till' . Willman asked what was
planned toward completing the review of the proposed zoning
ordinance. Mayor Sawyer asked that this item be placed on the
next workshop agenda.
#3 Discussion of streets in new subdivisions.
Mr. Sawyer said that Mr. Sharpe had mentioned this item at the j""----"\!
last meeting, saying that some of the streets seem to be falling
apart. U
Mr. Sharpe said that in Woodland Oaks there are about three
places where there are dips in the streets that seem to be
Sinking.
Mr. Gilmore said there is suppose to b'e s'ome major work done in
that subdivision.
MR. BALDWIN ARRIVED AT 7:05 p.m.
Mr. Gilmore said the streets were put in by the developer and
then when they came in to build hous-es, they brought in big
equipment with teeth in front that did some damage. We did get
on them about it and they are going to repair the biggest ones
but it would cause more trouble than we have now to fix the small
ones.
Mr. Sharpe advised that when a developer cuts streets, the City
should charge them a large amount of money if they come in after
a year or so to do it. Mr. Sharpe asked what the streets are
going to look like in ten years when they are falling apart in
just over one year.

Mr. Gilmore said he believed this would be taken care of in the
new subdivision ordinance. He said it is not the peo.ple that

build the streets that cause the trouble as much as the ones that
~uild the houses.
IMr. Sharpe asked what kind Of control does the City have from our
engineer on the tests that are made on the streets.

iMr. Gilmore answered that we did not get reports but the engineer
1maintains them in his office. These tests are done by an
independent firm. Mr~ Gilmore said he does know that compaction
tests are taken but he did not know the number of holes required.
Mr. Aguilar posed the question that if the streets are accepted
by the city and then later someone lays a sewer line and there is
a crack, who pays. Mr. Gilmore explained that the person that
put in the sewer line would pay. He reminded Council that we
have exac~ly that situation on the south side of FM 78.
Mr. Baldwin asked what would happen if the City did not accept
the streets. Mr. Gilmore said the City has to accept them within
one year as there is a year's warranty.
Mayor Sawyer said that once the City accepts the streets, we
should insist that anyone putting in utilities would have to bore
under the streets. He suggested taking a good look at the new
proposed subdivision ordinance to be sure this is in it.
#4 Discussion of S.A.F.E.S. service to Randolph AFB.
Mr. Gilmore had copies of a Memorandum of Understanding that
Randolph had sent back to us. He said he had one of the SAFES
personnel call Randolph as a new resident of the base and the
Clinic told them there is a doctor until eight 0' clock and he
will see people by appointment after five. If an ambulance is
needed, the person should call the Clinic and they will make
arrangements. They say they have a twenty-four hour phone
service for this purpose. This Memorandum of Understanding is
almost the same thing they have expounded on several times. Mr.
Gilmore said he feels it is the best we are going to get out of
them. .
Mr. Aguilar said he understands that they will be sent a bill
when called but they feel that they cannot put that in the
agreement.
Mayor Sawyer said he feels everyone wants to see SAFES on
Randolph but we don't want to give it to them free.
Mr. Aguilar said he understands that we will charge them just for
going on the base; if no transport is required, we get the fee
but it stops there. If transport is required, then we bill the
patient.
Mr. Gilmore said that is right - just like we do everyone else.
This gives the City an argument if one of the other cities
complains.

#5 CITY MANAGER'S REPORT: A. Speaking of good relations
with the Air Force, we received several letters from the nU
International Training Officer thanking us for our hospitality
and training we furnish the international trainees when they
visit. We need to order some additional give away items for the
next visit. .
B. We have a request from Planning & Zoning for a public hearing
for a Specific Use Permit for the Christian Church in Oak Forest
subdivision. They have 43 acres and it is our understanding that
they plan to build a school later. The only problem is in them
having to drive through the residential area to get to their
property.
Mr. Greenwald said P&Z gave them two alternatives - one to buy
easement 'and widen Crest Oak or two, come out the back side and
tie into Widerstein Road.
Council said to set up the-public hearing.
C. P&Z has also requested a public hearing on some recommended
changes to the Zoning Ordinance to include accessibility for the
disabled and handicapped as this would make more of an emphasis
on the people when they came in for permits.
D. P&Z has also asked to rezone the area in front of Northcliffe
from pre-development to general business.

E. The police force has brought up the possibility of a canine
program. One of the officers has a trained animal and wants to
set up the program. After discussion, Council wanted some costs
figures before committing.
F. Green Valley Water Supply Corp. has submitted a revised
application for a loan. They would drop the grant portion but
ballooned the other proj ects. Mr. Gilmore said he has been
working drafting a letter to answer the revised application.

Mr. Sharpe asked what approach the City will take on the Board
member who has political conflict. Mr. Gilmore said there was a
recommendation that the City does not submit a letter to the
Board on that issue as it could solidify the Board members.
G. Mr. Gilmore said he had talked to one of the developers in'
regards to school land. The developer said he would be
contacting the school district and start talking to them. This
would be in the area of Savannah Square. He made the statement
that he feels he can make a offer that is reasonable.
H. Mr. Gilmore said they would be taking depositions on Friday
on the Parker Case. II

;- Parkway. One of them says we are not offering them enough money.
offered $10,000 plus fences. Mr. Harris recommends
condemnation. Concensus of the Council is to go with the
condemnation.
#6 ITEMS BY COUNCIL: Mr. Greenwald said he h~d picked up
literature at TML on the National League of Cities that is being
held in San Antonio in November. There are a lot of good
seminars sessions - things that possibly city staff could go to.
Mr. Baldwin agreed that anytime there is one in San Antonio, we
should take advantage of it. Mr. Greenwald briefed Council on
some of the seminars he attended atTML.
Mr. Greenwald also reminded staff to call to obtain signed copies
of the re$olutions after being signed by TML Board.
Mr. Gilmore advised that Mangum has declared bankruptcy so now
all we can go after is the bonding company. We hope to go after
them in January. Mayor Sawyer said that if Mangum has any
assets, we should file for our share.
Mr. Greenwald said he also stopped by a couple of displays on
striping equipment. He suggested Mr. Gilmore look at the
literature, write the specifications and order a striper.
~ Mayor Sawyer asked that this be an item for the next workshop
agenda.
Mr. Greenwald said that P&Z had given tentative approval for
Greenshire Oaks Unit I for all R-l lot sizes.
Mr. Baldwin asked the status of the Bond committee findings.
Mr. Gilmore said Mr. Anderlitch is working on the information to
hand out to citizens. Mr. Baldwin showed a brochure by Mr.
Duffield that was very informative for citizens. Mr. Baldwin
said that if we don't have anyone on staff to do something like
this, then the City should hire someone. During the discussion
on bonding, ~r. Baldwin said he was just not sure $2,000,000 was
going to take care of the City's needs for five years.
Mayor Sawyer said the main thing we want is to seal coat roads
that are deteriorating. We are not talking about building major
roads, strictly preservation.
Mr. Gilmore said it was his understanding that streets would be
separate, water separate and FM 78 separate, with projects
listed.

Mr. Sharpe said that the only negative thing in our city is that
10% of our ad valorem taxes comes from 10 top businesses. If one
goes under, then that could offset our tax structure.

Mr. Sharpe also said that one of our top priorities should be a n
grant for Schirmerville area. Mayor Sawyer said we are working lU'
on that now. Farmers Home Association said to apply but they
cannot assure that we would get it. We n~ed to survey to see if
the average income is lower than $ll ,40'0. Mr. Gilmore agreed and
said that we have all the instructions from Farmers Home on how
to do it and have started the process.
Mr. Sharpe said at TML he stopped at several places that make
signs and they all said there was nO problem with delivery.
Mr. Sharpe said one of the things he enjoyed when we had the
Schirmerville people in was having the department heads here for
briefings. Mr. Sharpe suggested that we have the department
heads meet with Council at least quarterly. After further
discussion, it was agreed that the departm'ent heads should be
present at regular meetings rather than workshops, which are
rather lengthy, on a quarterly and rotation basis.
Mr. Aguilar said that he noticed that someone had bent the new
library sign on FM 78.
Mr. Gilmore advised that concerning th-e street in front of
Buffalo Country, the Water Department found about four holes in
the pipe. The department will have to go in at night and replace
this. The pipe is on order now.
#7 ITEMS BY MAYOR: Mayor Sawyer said he felt the TML
meeting was successful where all learned something.
