ccreg 11-04-1986 266 REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 4, 1986 , The Schertz City Council convened in Regular Session, Tuesday, November 4, 1986, at 7:00 p.m. in the Council Chambers of the Municipal Complex, l400 Live Oak Road. The following members were present: Mayor Earl W. Sawyer, presiding; Charles B. Sharpe; Hal Baldwin; Ray Stanhope; Adolph Aguilar and Ken Greenwald. Staff present were City Manager Jimmy G. Gilmore and City Secretary June G. Krause. After welcoming everyone to the meeting, Mayor Sawyer called on Ms. Sharon Fruge, President of the Schertz Business Club, for a presentation. Mrs. Fruge, on behalf of the Business Club, presented a plaque to Norma T. Althouse honoring her as "Employee of the Quarter" for the period July through September 1986. Mayor Sawyer said she could be easily recognized because Norma is the one that is always smiling. She is secretary to the Planning Coordinator and has received praise from the Planning & Zoning Commission members for her expertise in minute writing. Mayor Sawyer then read a proclamation and presented it to School Board member Tom DeKunder, which proclaimed the week of November 16 through 22 as "PROUD TO BE SCUCISD WEEK" to celebrate the school district's 25th anniversary. #l APPROVAL OF MINUTES: Mr. Greenwald moved to approve the minutes of the Special Meeting of October l5, and Regular Meeting of October 21, 1986. Mr. Baldwin seconded the motion, which carried with the following vote: AYES: Councilmen Sharpe, Baldwin, Aguilar and Greenwald ABSTAINING: Mr. Stanhope, he was not present for either meeting. NAYS: None #2 BEARING OF RESIDENTS: none #3 ORDIRARCE:' Mayor Sawyer introduced an ordinance and read the caption as follows: AN ORDINANCE BY THE PROVISIONS OF ARTICLE 10lla, REVISED CIVIL STATUTES OF TEXAS, TO REGULATE THE LOCATION, HEIGHT,' BULK, NUMBER OF STORIES, AND SIZE OF BUILDINGS; OPEN AREAS; LOT COVERAGE; DENSITY AND DISTRIBUTION OF POPULATION; THE USES OF LAND, BUILDINGS AND STRUCTURES; TO REQUIRE OFF-STREET PARKING AND LOADING; AND FOR SAID PURPOSES TO DIVIDE THE ~: ~\, I I ! I DI D D 267 r- CITY INTO DISTRICTS OF SUCH NUMBER, SHAPE, SIZE AND CHARACTERISTICS AS MAY BE ADVISABLE TO CARRY OUT THftSE' REGULATIONS; TO PROVIDE FOR IT'S ENFORCEMENT; TO PROVIDE FOR A BOARD OF ADJUSTMENT; AND TO PRESCRIBE PENALTIES FOR THE VIOLATION OF IT'S PROVISION. Mr. Greenwald moved to approve the first reading of an ordinance regulating zoning in the City of Schertz. Mr. Stanhope seconded the motion. Mr. Greenwald asked if the City Attorney had a copy of this ordinance and was told yes. Mr. Sharpe stated that this ordinance does not have a non- alcoholic district. All agreed. Mr. Stanhope wanted to thank the Planning and Zoning members for all the work they did on this ordinance. Mayor Sawyer then called for a vote on the motion and said motion carried as follows: I I I AYES: Councilmen Baldwin, stanhope, aguilar and greenwald. NAYS: Councilman Sharpe #4 APPOINTMENTS: Mayor Sawyer advised that he had a recommendation from the Chairman of the Housing Authority Board and wished to appoint Paula Thies and reappoint Warren Klebig. Mr. Aguilar moved to appoint Paula Thies and Warren Klebig as members of the Housing Authority Board with their terms expiring December 1988. Mr. Greenwald seconded the motion, which carried with the following vote: AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and Greenwald. NAYS: None #5 CITY MANAGER' S REPORT: A. Mr. Gilmore said he had placed in each packet a recommendation on a water base rate increase, for information to be discussed at the next workshop. B. Also there is a letter received from the School District thanking the City departments for participating in the school's snake dance, bonfire and homecoming. There is also a PTA news bulletin in which they thank the various departments and the City for our support. C. Concerning the Veteran's Day parade on Saturday in Universal Ci ty, all Councilmen have been invited to sit on the viewing -- stand with their wives. The organization needs to know who will be participating. i l 268 D. Just for information, the City has started work on Wiederstein Road, putting in culverts, opening drainage and putting in base material. 1his project will take about two weeks 0 and the people involved have been notified as parts of the road will be closed at different times. #6 ITEMS BY COUNCIL: Mr. Greenwald reported that he, Ray Stanhope, Chuck Sharpe and Hal Baldwin attended the Guadalupe County Appraisal District meeting. He said that after two hours of discussion the Board finally agreed to amend their budget to comply with the State law. The adjustment will be about $35,000 to allow for two appraisers, etc. to get the job done on time. Mr. Greenwald said the Seguin ISD and our School Board were also there in support of this cause. It was a tough decision to amend their budget and go back for $35,000 but it was needed to be fair. Mr. Aguilar mentioned that the Guadalupe County Literacy Council received some grant money and our library is the sponsor. They will be using the money to hire people to tutor adults that need it. We need to get the word out to any adult that needs tutoring. Mr. Aguilar announced two seminars that will be held at the library, the first on Tax reform will be held November l3th from 7:00 to 9:00 and the second will be on November l8 from 7:00 to 9:00 and the subject will be Financial Planning. Mr. Sharpe reminded Council of the training session on November 13th in Kerrville for those interested in Economic Development. There will be several vehicles car pooling and it would be important for someone from the City to go. Mr. Sharpe asked if the City Manager had received any information back on the drainage or retention pond in Savannah Square. It was suggested that our engineer be present at the next workshop to discuss this. o Mr. Sharpe askedthe.Clty Attorney if there is an update on the Mangum case. Mr. Harris said that depositions were scheduled and there is talk of a settlement. He said he would talked with his associate David Jones and get a written update. Mr. Sharpe said he noticed two "menu" type signs on Live Oak Road and asked if they were legal. Mr.. Gilmore said they are legal and of a temporary nature. Mr. Greenwald said the sign ordinance allows them under certain circumstances. #7 ITEMS BY MAYOR: Mr. Sawyer said he had received a letter from Forbes Management requesting that the City press on in getting a sewer permit for the I 35 area. Mr. Forbes is requesting a meeting sometime in January to talk about sewage. 0 Mr. Sawyer said that if we can, we should strike an agreement with New Braunfels but if not, then we should pursue our on permit. iii'! .;t.-d: .'; II... r I i ~ I ~ 269 Mayor Sawyer announced that he will not be at the parade in Universal City on Saturday ,because we have something going on in our City. He will be attending the Senior Citizen Bazaar and awarding prizes for booths, etc. He said he was signing a letter to the Postal Department asking them to keep Greenshire in the Schertz delivery. #8 ADJOURNMENT: Mr. Stanhope moved the meeting be adjourned at 7:26 p.m. The motion was seconded by Mr. Greenwald and unanimously carried.
