SPECIAL MEETING OF THE CITY COUNCIL
NOVEMBER 26, 1986
The Schertz City Council convened in Special Workshop Session,
Wednesday, November 26, 1986, at 7:00 p.m. in the Conference Room
of the Municipal Complex, 1400 Live Oak Road, Schertz, Texas.
The following members were present: Mayor Earl W. Sawyer,
presiding; Charles B. Sharpe; Hal Baldwin; Ray Stanhope and Ken
Greenwald. Absent: Adolph Aguilar. Staff present were City
Manager Jimmy G. Gilmore and City Secretary June G. Krause.

#2 Discussion of needed space for Neighborhood Services
with the Housing Authority representatives.
Mayor Sawyer said he had asked the Housing Authority Board and
Mr. Freeman to this meeting to listen to Mrs. Barnes and Mrs.
Hyatt regarding needed space.
Mrs. Hyatt said they were asking that the Council and Housing
Authority Board might work together to see that Mrs. Barnes has a
little more room to work. She said there seems to be some space
available if they were allowed to use it on Wednesday mornings
when it is not being utilized and then move her things back out.
Mrs. Hyatt said ideally it would be best to have separate space
for her to work all the time.
Mayor Sawyer said the Council intends to try and get a storage
building but other parts of the city functions need storage also.
He said they may be able to rent storage in other parts of town
for Mrs. Barnes as well as other departments. Mr. Sawyer said
the other problem is that in the Housing Authority building, Mrs.
Barnes does not have enough space. Mrs. Barnes said she has very
little room now.
Mr. Cyr, Chairman of the Housing Authority Board, said the
agencies that use the room have been there - he didn't know how
long. There are five agencies that have been allocated space.
All of them were given a letter asking them to come in and sign
up for space. Of the five, Mrs. Barnes was the only one that did
not reply. He said their argument is that each one has X number
of feet in the building for their operation and they don't want
other organizations coming in and hanging clothes around, etc. in
their space.
Mrs. Hyatt asked if they could not pull the accordion curtain
that is there and moved some tables around, Mrs. Barnes could use
part of their space when they are not there.
Mr. Freeman said the area Mrs. Hyatt was talking about is
~ allocated to two different organizations and they will not move
in any furniture if it is violated. The Housing Authority has
agreed to this office space and has guaranteed their security.

There followed a discussion between the Council members and Mrs.
Hyatt and Mr. Freeman about the allocations and use of the
buildings.
One member of the Housing Authority Board said he had 20 years on
the board and have not seen any agency come to the Board with a
problem. Now they come to this meeting and the Board is suppose
to make a decision when nothing has gone to the Board.
Mayor Sawyer said we just wanted to get everyone together to see
if we could come up with an equitable solution. We would like to
have enough space for everyone that needs it. Mrs. Barnes has
been a volunteer that does good job for the city. We just wanted
the Board to know that the City is concerned about space
allocations that are equitable.
Mrs. Barnes said she did get the letter Mr. Freeman referred to
and personally took it to the office.
Mr. Cyr said the program is valid but it is redundant because
RECAP is already doing the same thing. He said if Mrs. Barnes is
dissatisfied, RECAP is willing to take over this operation.
Martha Wright of RECAP said they had asked Mrs. Barnes if she
would work with RECAP - five days a week from 2 to 4, which in
her estimation would have more control. She said she has watched r 11,
every wednesday and the same people come every week and take out
bags of clothes. She said RECAP keeps records on all the people
and their income, etc.
Mr. Stanhope said he felt if the City could get the building that
is for sale on Randolph Avenue, it would solve a lot of problems.
Mr. Sharpe said the reason RECAP was formed is that there are a
lot of needy people in the area but a lot of them aren't and just
try to get something everywhere they can for resale. With the
control RECAP has, you might be able to serve more people.
Mrs. Barnes said it would take several people to keep records on
the donated items she has.
Mr. Freeman suggested that this be investigated further and put
it on the next agenda.
Mayor Sawyer said he would like to give the Housing Authority an
opportunity to take a good hard look at the space.

run this five days a week.
Again, Mayor Sawyer said to give the Housing Authority Board time 0
to look at this and come back after Christmas with their
recommendations.

One other item the Board Chairman wanted to bring up is that the
Housing Authority Board members are not covered by liability
insurance. Mayor Sawyer said he had discussed with Mr. Gilmore
who would check about putting their board under the City's
program with them reimbursing the City. The City can ill afford
to have volunteers being sued.

The Housing Authority Board would also like to recommend another
board member as Paula Thies has written declining the
appointment. Mr. Cyr has recommended Ann Vick. Mayor Sawyer
then thanked the Board members for coming for this discussion.
He also thanked Mrs. Barnes and Mrs. Hyatt for their concern,
saying the Council is going to try to work something out.
The Mayor then called for a recess at 7:32 p.m.
The Special Meeting was reconvened at 7:37 p.m.
13 Discussion of Specific Use Permit request No. 86-1.
Mayor Sawyer said the Planning & Zoning has recommended the
Permit be denied for the following reasons: l. A Specific Use
Permit when issued is for one specific use and with a time limit.
So far, we have been informed of at least three uses for this
acreage. 2. Plans presented to the Commission indicat'e the
development is a major development which will require detailed 0
plans for streets, lighting, sidewalks, curb and gutters, I
drainage, water and sewer lines, entrance and exists, all the
planning for the construction for a subdivision. 3. Plans
presented for the 43.128 acres does not conform with the City's
Comprehensive Plan for this area. The P&Z vote was 4 ayes, I nay
and I abstention.
Mayor Sawyer then asked Council if they were going to be ready to
vote on this item at the next meeting and Council indicated they
would. Mayor Sawyer told the Oak Forest residents present that
Council does not take any formal' action at workshops, merely
discuss each item to be voted on at the next meeting.
#4 Discussion of an ordinance regulating coin-operated
machines.
Mayor Sawyer said this is a proposed ordinance Mr. Gilmore
brought up to bring in a little extra revenue and to regulate
this type machines.

Mayor Sawyer said that Mr. Stanhope had brought up about citizens
being able to purchase coin telephone machines and placing them
in malls and reap the benefits. Mr. Gilmore said because of
Bell's leasing the lines, we still get the franchise portion.
Mr. Baldwin said that he feels that if we get the franchise, we
should charge the man a fee too.
Council concensus was to put the telephone coin-operated machines
in the ordinance as requiring a permit.
#5 Discussion of an ordinance regulating signs.
Mr. Gilmore said there is a memo in Council packets explaining
some of the questions that have been brought up regarding the
sign ordinance. Article II, 8 addresses types of flashing or
blinking lights and we do not allow them. 9 is very confusing
the way it is worded - we need to clarify it. Also Section 4
under Article V has put a bind on the staff to place Crime watch
signs. We would place them on our own post but not on personal
property. - the intent is different from what it says.
Mr. Gilmore said that Section 5 Free-Standing Signs creates
problems in trying to follow the restrictions. There followed a
lengthy discussion about this particular section with most of the
__ Council saying they saw nothing wrong with the way it was
written.
Mayor Sawyer suggested bringing this back to another workshop for
more discussion before going to ordinance amendment.
#6 Discussion of renewing BVYA Contract.
Mayor Sawyer suggested asking Cris Frias, President of BVYA, to
come to a meeting to discuss this contract with Council. The
City has had problems with the contact person.
Mr. Gilmore said he would like to put in the contract who the
contacts will be and to whom the contact should be made. We need
one place of contact and one or two people designated from BVYA.
We need to discuss if the concession is making a profit, should
they be paying the electricity. We should look at costs but the
big problem is contact.
Mr. Greenwald agreed, saying the names or positions of contact
should be in the contract.

Mr. Gilmore said if they can be self-supporting, then the
contract should be like SAFES, etc. We should look at the cost
and see if it is time to put them on a paying basis.

Mr. Baldwin said he looks at BVYA as being part of the City
because if they weren't doing this, then the City would have to
pay to have it done.
Mayor Sawyer said that we have a contract that says 90 percent of
the kids have to be from Sch~rtz. During the baseball season,
they make a profit but during the other programs, the baseball
profits pays for those.
Mr. Stanhope said he thinks they do an outstanding jOb but some
of the things they do need to be looked at.

Mayor Sawyer said that as soon as Mr. Gilmore gets more factual
information, let us look at it again.
#7 CITY MANAGER'S REPORT: A. We are looking at various
catalogues for new chairs for the Council Chambers. Will have
some comparisons for you later.
B. The portable type signs Council wanted to advertise the
election will cost $68 per month each. We need to know how many
and where they should be place.
After Council discussion it was concensus to display them from
the lOth of December through January lOth and place one in front
of the CODDllunity Center. one at the corner of Main Street coming [~11i,
up from the Cibolo Creek and the other could be moved around,
starting at the Library.
Mayor Sawyer suggested at least the week before the election
Council should contact some of the business people on FM 78 to
see if they would put something on their present signs. Also
Council should approach different organizations and ask to speak
to them.
The City employees should be asked to get involved and we should
put a message about the election on each water bill.
C. Mike DeLeon received a letter from the Bexar County
Commissioners. They are still active in trying to get something
for Rittimann Addition.
D. Received a letter from the Southern Pacific Railroad
concerning mowing of right of way. We have sent for necessary
documents to see if we can mow the right of way and have them pay
us.
E. Have a letter and resolution in regards to Mobile Home Park.
There are several items that they in in non-compliance with.
Would like to have the resolution passed stating that they are in
non-compliance and this will be filed with the plat at the County 01
Court House. There were two pages of violations.

Mr. Gilmore said that Richard Harris and the TML attorney would
be at the Tuesday night meeting to discuss this with Council.
F. We received a letter from Kirby asking that we establish an
agreement with them on our sewer machine on emergency basis.
They agreed to pay $90 for the first hour as we do with Marion.
G. Mrs. Krause had a conversation with Mayor Little this week
and he asked if the contract for us to do their water/sewer
repairs was still in effect. We sent them a proposal in 1983 but
inever received a signed copy back. Council concensus was to not
enter a contract with Cibolo.
H. Last Saturday night one of our officers wrecked a police car
answering a back-up call from Cibolo. Backup calls are suppose
to be officer in trouble but this one was not an emergency. In
three months, we have had 26 officer back-up calls and they are
not really emergency back-up calls. The other night their
officer had a warrant from Bexar County to serve and called for
backup - he later brought the man in by himself. When the
accident happened, the streets were wet and our officer said he
was going about the speed limit. The accident is being worked by
the Highway Patrol so we will get an unbiased report. We had the
Chief to define back up and sent a letter to Cibolo over the
Mayor's signature.
#8 ITEMS BY COUNCIL: Mr. Greenwald: At the P&Z meeting
the previous night, the church people brought in master plans and
that was one of the things that helped turn it down. They had
very elaborate plans. In the future P&Z is going to be sure
anyone asking for a public hear ing has their plans before that
time. One of the things discussed was if the Industrial
Development Committee or the Chamber of Commerce might work with
these people to find a location in this area.
Mr. Baldwin asked if the City needs to get back with Cibolo to
iron out our differences or not. Perhaps we need to reactivate
the Coordinating Committee. Mr. Sharpe said Mayor Little had
approached him so he brought it to Council. Mayor Sawyer
suggested that he contact one of their Councilmembers.
Mr. Baldwin announced that the Buffalo Football team would be
having their regional playoffs on Friday and tickets are
available.
Mr. Stanhope said he thought that Mrs. Barnes definitely has a
problem but he was not sure the City should continue with her
program. Mr. Gilmore said he felt that the Housing Authority and
RECAP want to get rid of her. Mayor Sawyer suggested giving the
Housing Authorlty Board time to see what they can come up with.
Mr. Stanhope said he thought FM 78 looks really good.

Mr. Sharpe said that concerning the discussion Council had about
the drainage in Savannah Square, he thought the engineer was very
cavalier and did not know what was going on up there. He
requested we keep the tape of that meeting. Mr. Sharpe said he
was contacted again about the little bit of rain we received and
flooding. The theory of no more water than was there previously
is not working. Add that as a bell ringer.
Mr. Stanhope said he had talked with Mr. Hall, who had the sewer
backup problem in Lone Oak. He said we had agreed to put in a
manhole but it has not been done as yet. Mr. Gilmore said he
thought it had been done but he would check on it.
#9 ITEMS BY MAYOR: Mr. Sawyer said he rode with one of our
-officers Saturday night and he thinks the City is in good hands.
Also Mr. Sawyer said he had dinner with the Guadalupe County
REACT group. They have become more of a social group now but
they do a tremendous amount of good for the ROTC.
Mayor Sawyer announced the Annual Christmas Tree lighting for
December 4th at 6:00 p.m.

At ll:OO a.m. on December 4th, there will be a ground breaking at
the VFW. He invited everyone down to the ceremonies.
with Council concurrence, I have a letter to Rogers Cable Systems 0
agreeing to permit them to change the company name. Council
concensus was to allow the change.
Mayor Sawyer read a letter proposed to be sent to GVWSC making a
formal offer to purchase their system. The letter will not be
sent until after taking depositions next week.
Mayor Sawyer asked Council for their input for names of somebody
we could support for the Guadalupe County Appraisal District. He
mentioned Mrs. Koch and Doreta Burkett was suggested by the
School Board. Mayor Sawyer said he told them if the School Board
would get behind Mrs. Burkett, then the City will also. We need
to see how many votes the School Board needs and give the rest to
our County Commissioner to see if he can get someone else from
this end of the County. Mr. Howe did a good job but he does not
want to run again.
Mr. Brandon asked Mayor Sawyer for a name to put on the Hospital
Board and Mayor Sawyer suggested Nancy Scott. Mr. Baldwin said
he felt either Carlene or Don Scott would be better.
Mr. Baldwin said the School District is thinking of some positive
things to build up reputation of the district. One
recommendation made was thaf the name be changed from SCUC ISD to
a single name.
