REGULAR MEETING OF THE CITY COUNCIL
NOVEMBER 19, 1985
he Schertz City Council convened in Regular Meeting Tuesday,
ovember 19, 1985, at 7:00 p.m. in the Council Chambers of the
unicipal Complex, 1400 Live Oak Road, Schertz, Texas. The
ollowing members were present: Mayor Earl W. Sawyer, presiding;
har1es B. Sharpe; Hal Baldwin; Ray Stanhope; Adolph Aguilar and
en Greenwald. Staff present were Jimmy G. Gilmore, City Manager

fUBLIC HEARING: Mayor Sawyer' opened the public hear ing, held
~ointly with the Planning and Zoning Commission, and related the
urpose as being to receive input from the public on a rezoning
equest by Live Oak Joint Venture No.1 for a 14.65 acre tract of

ervice District (NS). The Mayor then turned the hearing over to

r. Yarling announced that first there would be a briefing by
ity staff, then a presentation by the applicant, then hear from
he citizens. He asked that each citizen step to the podium and
ive their name and address prior to speaking. Mr. Yarling said
hey would hear everyone that wished to speak because once this
earing is over with, neither P&Z nor the Council would receive
any further input.
Ir. Steve Simonson explained that this land fronts on the north
ide of East Live Oak Road, approximately 497.1 feet east of
aske Road and approximately 2,882.3 feet west of Jack Hays
oulevard. Mr. Simonson said staff feels that with general
usiness on the proposed Schertz parkway and FM 3009, making this
~eighborhood Service District will make a nice blend and keep
within our plan. There were nine letters sent to property owners
within the 200 feet and only one answer was received. This from
the people directly across the street from this land and they

*r. Bill Deal of Brendler-Dave Associates, Inc. , spoke
~epresentingLiVe Oak Venture No.1. He said they are asking for
eighborhood Service District for this property because (1) the
ity is, implementing the Master Plan of putting in Schertz
Parkway and they feel East Live Oak Road is a thoroughfare which
is more conducive to Neighborhood Service than residential. (2)
the site is so close to two existing business developments and
(3) we feel that with the extension of the secondary or collector
foad through the site, it would be in concurrence with the Master
Plan and would give another egress for Woodland Oaks. In
$ummation with the existing zoning and improvements that are
froposed, this land warrants more than residential but is not,
~n their opinion, general business.

Mr. Sharpe asked what type of buffer would' be provided between
the businesses and residences. Mr. Deal said they plan to allow
a green space to the north but he also saw a need for one of the
east. Answering further questions of Council and paz, Mr. Deal
said he did not know when development would start, he would like
to see it start the next day but the market conditions dictate
timing.
Mr. Yarling informed the citizens that all their comments. would
be taken into consideration when the Planning and Zoning
Commission and Council are deciding on this request. The PIZ
have ten days in which to meet and make a recommendation to
Council, who will vote on the issue at their next regular meeting
after that.
There being no further comments from the public, Mayor Sawyer
declared the public hearing closed at 7:47 p.m. and called for a
short, recess. .
The Regular Meeting was reconvened at 7:55 p.m.
II APPROVAL OF MINUTES: Mr. Aguilar asked that the l.at
sentence of item 14 and item IS on page No. 295 of the minutes of
October 30, 1985 be deleted. Mr. Sharpe asked that the sentence
beginning RRealizing the urg.ncyR in the second paragraph of item
17 on page No.'296 be de"leted. .Also No. 5 of item 7 on page 296
should correctly read R5. Approve an overlay district similar to
the FM 3009 Overlay, which would encourage development and yet
protect the nostalgic value of Schertz Parkway and help the City
of Schertz. A fask force to study the situation should be formed
where four out of the ten members are developers.. Th. last
sentence of item 17 on page 297 should "correctly read. "Mr.' Thomas
agreed, adding that the developers would be responsible for their
own sewer and drainage problems.R
Mr. Stanhope moved to approve the minutes of the Special Meeting
of October 30, 1985 and the regular meeting of November 5, 1985
as amended. Mr. Greenwald seconded the motion, which carried
with the following vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None

A. Mr.
presented
Director.
Cross, representing the Veterans of Foreign Wars
$200 checks to both the Fire Chief and the SAFES
B. Mayor. Sawyer called Betty-Ann Kent forward and presented her
with an Advance Animal Control Certificate, stating that she was
one of three in the. San Antonio area who passed and received this
certificate and the other two were veterinarians.
C. Mr. Wolters, representing the Schertz Business Club,
presented June Krause with the Employee of the Quarter Award and
plaque for the quarter ending September 1985.
12 HEARING OF RESIDENTS: Mrs. Coralea Fenner addressed
Council concerning their continuing try for deannexation from San
Antonio of the area south of Randolph Air Force Base. She noted
that in San Antonio's latest proposal, their group got everything
they had requested but it was directly opposite to what they said
they would do for Schertz.
liMaYOr Sawyer said that when people come here for a public
hearing, we expect them to keep their word. If we -accept this
proposal, there. is nothing to, say that they won't change their
t,minds ,again. - Mayor Sawyer told Mrs. .Fenner .that staff would .try
I to set up another meeting with the Councilmen involved.,
After further discussion, it was Council concensus to write
letters to Councilmen Thompson and Webb asking them to honor
their earlier. agreement to. include FM 1518 in the area for
Schertz. Mrs. Fenner said she would draft a letter from their
property owners as well. Mayor Sawyer said we have kept our word
to move out FM 1518 in preparation to annexation and we feel-San
Antonio has not kept their part of the agreement..
13 ORDINANCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:
ORDINANCE NO. 85-D-22
AN ORDINANCE ESTABLISHING SPBED LIMITS ON
F~M. ROAD 2252 FROM THE SOUTH CITY LIMIT
NORTHERLY TO, THE NORTH CITY LIMIT, AND
REPEALING ALL ORDINANCES IN CONFLICT.
Mr. Greenwald moved to approve on final consideration an
ordinance setting speed limits on F.M. 2252. Mr. Baldwin
seconded the motion, which carried as follows:

OF CONAL COUNTY TO LIGHT INDUSTRIAL (Ml) AND
REFLECTING SUCH CHANGES ON CERTAIN ZONING
MAPS IN. ACCORDANCE WITH THE SCHERTZ ZONING

Mr. Greenwald moved to approve on final consideration an
ordinance rezoning an 11 acre tract out of Guadalupe County ZC
.71 to Neighborhood Service J;>istrict and a 191.9, acre tract out
of Comal County ZC .73 to Light Industrial. Mr. Stanhope
aecol)ded the motion, which carried with ,the..following vote:
AYES: Councilmen Sharpe, Stanhope, Aguilar and Greenwald.
Mr. Baldwin voted aye for ZC .73 and Nay for ZC '71.
, .5.., . AGREEMENT: Mayor Sawyer said this is an agreement to
accept in.. substance a proposal made by Venture in the Schertz
parkwa,y D~velopment. He said'Mr. Thomas has agreed to all that
Council had asked to be changed.
Mr. Sharpe moved to accept the agreement in substance with Joint U' \
Venture on the Schertz Parkway Development. Mr. Aguilar seconded
the motion, which carried with the following vote:
AYES: ,Councilmen Sharp~, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
.6 EXECUTIVE SESSION: None needed.
.7 CITY MANAGER'S REPORT: A. Mr. Gilmore said he had
spent the day before being deposed for the case with Green Valley
and it will continue the following week. We have no further
ideas as to when this will come to court.
B. Have discussed Schertz parkway with the Highway Department
and have asked them to include this in their Urban Roads Program
and to include this on the other side of I 35 in the future. It
looks very good according to Mr. Ehlers.
C. Barshop should start their construction next month.
D. . KeEtbler should be turned over to Keebler the second of
December. We are doing final inspections now.
E. San Antonio Shoe opening will be the end of the month.

F. There is a good possibility that in the future Forbes
Management will donate 3 or 4 acres for our needed sewer plant.
17 ITEMS BY COUNCIL: Mr. Sharpe said that last Saturday
there was a meeting welcoming REACT - 6 to 10 cities in the area
were involved.
Mr. Sharpe asked the status of the sidewalks for Sebastian
Apartments. Mr. Gilmore said he had sent them a letter but had
no reply.
Mr. Sharpe said the Schertz-Cibolo Coordinating Group Meeting had
been canceled and the next meeting would be in January. He said
he talked with Mayor Little about Cibolo extending their Main
Street to I 35 and that they need to get their request into the
State.
Mr. Sharpe announced a meeting to Wednesday night at the McQueeny
Lions Club on the tax rollback.
Mr. Baldwin said he is glad the bridge and road is finally opened
to Dobie School and should save the School District money.
Mr. Stanhope asked if there was anything new on the Cibolo Creek
bridge. Mr. Gilmore said he had not received anything back from
them on the repainting.

, Mr. Aguilar said he noticed that when we have public hearings we
get comments from the people that received the letters. He asked
what it would take to let all citizens know what is going on
other than the notices posted on the bulletin board. Council
discussed different ways that had been tried in the past to no
avail. No solutions were forthcoming.
19 ITEMS BY MAYOR: Mayor Sawyer said he had asked Mr.
Baldwin to attend a luncheon at Randolph Air Force Base for him
on the Smokeout. He thanked Mr. Baldwin for taking care of these
things that happen during the day.
110 ADJOURNMENT: Mr. Baldwin moved the meeting be
adjourned at 8:22 p.m. Mr. Stanhope seconded the motion which
carried unanimously.
