SPECIAL MEETING OF TBE CITY COUNCIL
NOVEMBER 27, 1985

The Schertz City Council convened in Special Workshop Session,
Wednesday, November 27, 1985, at 7:00 p.m. in the Conference Room
of the Municipal Complex, 1400 Live Oak Road, Schertz, Texas.
The following members were present: Mayor Earl W. Sawyer,
presiding; ~harles B. Sharpe, Hal Baldwin; Ray Stanhope, and Ken
Greenwald. Absent: Mr. Adolph Aguilar. ,Staff present were City
Manager Jimmy G. Gilmore and City Secretary June G. Krause.
1.1 HEARING OF RESIDENTS: No one wished to be heard.
12 Consideration of Zoning Change .74 - Live Oak Road ,Joint
Venture No.1. After introducing this item Mayor Sawyer read a
memo from Mr. Aguilar in which he said he recommended disapproval
of this request for rezoning. Also Mayor Sawyer said he had
talke~ witb tbe Peeks and. they said they approved of the request.
Council discussed the pros and cons of the request, such as there
has already been commercial designations on Sche~tz Parkway and
Jack Hays aoulevard so why spot zone in between. Mr. Sharpe
said he did not agree with Planning and Zoning's reason for
~ecommenc:Ung Qisapproval"., w~ich is that .the. zoning does not
conform to our Master Plan. Mr. Sharpe contends that a "aster
. Plan is just that - a plan subject to change.
Mr. Richard Reece, one of the property owners ,said that they had D
contacted ev.~yorie of the property owners prior to the hearing
except one in Arizona. ,Be showed .on a drawing that most of the
adjoining. property own.rs were not against the rezoning but did
have concern about what would go in there. Mr. Reece said that
the Zoning Ordinance protects the surrounding property owners4ty
restricting height, side yards and privacy fences, as well as
sign rest r ict ions. Mr. Reece said they did not feel East Live
Oak Road was good residential property.~d if they could not get
it rezo.ned they were going to have a real problem with it.

Mr. Gilmore said his feelings were that the property is enclosed
on both sides by commercial and although there is nothing wrong
with putting residential between commercial, how many residences
could you put in that area. The other alternative to
Neighborhood Services is a PUD that way you have the
opportunity as it is presented to decide if this is what you want
in there.
~~~. Re~ce ,eaid that one of the adjoining property owners who is a
dentist has indicated that some day he would like to put his
office there.
Mayor Sawyer had to leave temporarily so Mr. Baldwin took over
chairing the meeting.

~fter discussion, it was Coucil concensus to place this item on
~he next agenda stating that they would support 300 foot deep
~rontage for Neighborhood Service and leave the rest of the
~creage as is.
#3 Discussion of Street/park Improvements.
~eferring to the Streetlpark Department plan made in 1983
~ntitled "A 1.8 Million Dollar Dream", Mr. Gilmore explained that
~here are some areas listed in the plan that call for seal
~oating. With all the problems the City had previously on seal
coating, Council might want to consider a one inch overlay
~nstead. If so, you can add 8 to 10 per cent to the costs listed
~n page 5 of the plan. Mr. Gilmore said he has talked with Tom
derlitch, primarily about our portion of Schertz ParkwaY1 but
'f we can come up with a figure that we feel we can live with,
r. Anderlitch will set up several different options for
~inancing.

~ouncil asked Mr. Gilmore to make a list of the streets and
~pproximate costs for each project in order for Council to set
priorities. Mr. Gilmore suggested getting the engineer at the
next workshop with good prices on seal coating versus overlay.

~r. Baldwin turned the meeting back to Mayor Sawyer.
kega, rding our parks, Mayor Sawyer said the biggest problems we
~ave are drainage and electric, with emphasis on drainage.
~r. Greenwald is working with a college of engineering and is
~rying to get several students involved so that one group could
~ome up with a drainage plan and another construction ideas to
~nclude turning the ballfields around.
gr. Gilmore suggested changing our ordinance again to ~et
evelopers to donate park land, now that the Supreme Court ru11ng
as been overturned.

ttr. Sharpe suggested having four separate issued at the bond
~lection (1) streets (2) parks (3) drainage and (4) whatever is
~eeded - auxiliary fire station, etc.
ttr. Baldwin said he realized that there are more needs than the
~ity could possibly fund but we really need to do something with
fM 78.

15 CITY MANAGER'S REPORT: Mr. Gilmore said that last
! Tuesday and all day this Tuesday he was involved wi.th being
I deposed on the Green Valley Water case. Since then, through a
I second party, it is Mr. Gilmore's understanding that Green Valley
iwants to negotiate. If Council wants the City Manager 'to ,pursue
hthis,. ,he suggested, ,the first m.eeting be with the Mayor.

Ii>.- - . The" Fi-re Department received a card of thanks and a small
!donation from the people who recently had a fire. The firemen
were at the fire one and one half minutes after leaving station.
E. Barshop got his final plans for his infrastructure.
F. The Highway Department ar"e upping their schedule on the
drainage problems on FM 3009. Also they are sending in their
recommendation.to Austin .for the overpass.. Mr. Ehlers will send
us .' a letter' to give to' the 'develope'rs so' they can get. their
,funding. . _ ," - -'

G. Mr. Gilmore said he will be meeting with New Braunfels, GBRA,
CCMA and one other on. sewer discharge. -New Br.aun,f.e-ls~ is going to
disagree. The meeting will be February or March at the earliest.
It' would behoove ~s to get developers\to write the State and say
there is a need for the sewer plant. We need all the support we
can get. Without sewer, it will slow down development on 135.
H. Mr. Gilmore announced the following: San Antonio Shoe
opening is Friday the 29th; Garden Ridge Pottery is expanding and
Country Corner is being sold.
16 ITEMS BY COUNCIL: Mr. Stanhope suggested that when the
Cibolo Creek dries out we should get the railroad company out to
take care of the ties that are drifting down. Also the light on
the entrance to Schertz sign still has not been fixed.
Mr. Greenwald reported that if Council has no objection, BVYA
would like their contract updated just as is. Mayor Sawyer
suggested this be on the next workshop.

Mr. Greenwald reported that in January Jim Bardin's son, who is 0
working on his Eagle Scout badge, ,will be working on landscaping
at City Ball.
Mr. Greenwald asked if we could contact the Bexar County Sheriff
alld see if they will check the traffic at FM 1518 and FM 78.

at BAMC. They had a meeting w1th RandOlph and ate concerned
about the type of services - so not only are we concerned but
others are too. The man pointed out that there is not much point

.7 ITEMS BY MAYOR: Mayor Sawyer said he had written the
letter to San Antonio Councilmen Thompson and Webb with copies
going to the base commander and Mayor Cisneros. Mr. Sawyer also
read a letter from Coralea Fenner to Councilman Thompson on this
deannexation.

Mayor Sawyer reported that our police department had just made a
drug bust and picked up five pounds of marijuana, several weapons
and the individuals are in jail. Our Police Department is doing
a fantastic job.
