ccreg 12-17-1985 35 ,.-- r REGULAR MEETING OF THE CITY COUNCIL DECEMBER l7, 1985 he Schertz City Council convened in Regular SeSSion, Tuesday, ecember 17, 1985, at 7:00 p.m. in the Council Chambers of the unicipal Complex, 1400 Live Oak Road, Schertz, Texas. The ollowing members were present: Mayor Earl W. Sawyer, presiding; harles B. Sharpe; Hal Baldwin; Adolph Aguilar; and Ken reenwald. Absent: Councilman Ray Stanhope. Staff present were ity Manager Jimmy G. Gilmore and City Secretary June G. Krause. .1 ORDINANCE: The Mayor introduced an ordinance and read ~he caption as follows: ORDINANCE NO. 85-A-24 AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEXATION OF A TRACT OF LAND CONTAINING 34.5 ACRES MORE OR LESS, OUT OF COMAL COUNTY. ~r. Greenwald moved to approve on final consideration the rdinance on the proposed annexation of 34.5 acres of land out of oma1 County. Mr. Baldwin seconded the motion, which carried , ith the following vote: r- AYES: Councilmen Sharpe, Baldwin, Aguilar and Greenwald NAYS: None ! #2 PUBLIC BEARING: Mayor Sawyer opened the public hearing ajnd explained the purpose Qf the hearing was to receive input ~rom the publ ic on the rezoning of 62.98 acres of land from ~redevelopment and General Business to Light Industry (M-I) Qistrict. Said land being located approximately 2,106 feet East qf FM 1103 on the North side of I 35. He then turned the hearing qver.to.Mr. Bob Andrews., Vice-chairman of the Planning and Zoning qommlsslon. ~r. Andrews went over the procedures of the hearing, saying that ~irst we will ask ~taff to give a physical location on the maps, ~lOng with briefing on the rezoning request. Then he will ask he citizens to cQme forward, give tbeir names and addresses, and hatever comments they may have on the request. After that the qhair will entertain comments from members of the Council and ~&Z. Then the Planning and Zoning Commission has ten days in ~hich to make a, recommendation to Council. There will be no ~urther comments received after the close of the hearing. ~r. Steve Simonson pointed out on the map the physical location oif the acreage in question. Mr. Simonson said staff recommends ~he Light Industrial (M-l) zoning, which will be compatible with t~at area. ~ 36 Mr. Andrews then asked if any citizens wished to speak on this rezoning request. o A. Mr. Percy Hansmann, Box 6585, New Braunfels, Texas, said that he has land adjoining this particular property and he does not want his land rezoned. It is used for agriculture and he does not plan to sell it. Mr. Andrews assured Mr. Hansmann that the City was not thinking of rezoning any property but the 62.98 acres involved in this request. There were no other citizens wishing to be heard. There were no comments from the City Councilor the P&Z members. Mayor Sawyer declared the public hearing closed at 7:07 p.m. .3 APPROVAL OP RIIIJ'l'BS: Mr. Greenwald moved to approve the minutes of the Regular Meeting of November 19, 19851 the Special Meeting of November 27, 19851 and the Regular Meeting of December 3, 1985. Mr. Sharpe seconded the motion. Mr. Baldwin asked to abstain as he had not read the minutes but that would have made it necessary to pass on approval of minutes as Mr. Aguilar was abstaining on one set of minutes. Mayor Sawyer asked for a few moments delay in order for Mr. Baldwin to read the minutes. Mayor Sawyer then asked for a vote on the motion, which passed as follows: AYES: Councilmen Sharpe, Baldwin and Greenwald NAYS: NONE ABSTAINING: Mr. Aguilar on the Special meeting of November 27, 1985, but voting aye on the other two sets of minutes. Radio Communication bid Mr. Baldw in moved to accept the bid Professionals, in the amount of $16,585.82. the motion. from Communication Mr. Aguilar seconded Mr. Grotzinger, Sales Manager for Communication Professionals explained that the water/wastewater and Streets/Parks Departments are moving onto a different channel. Appl ications have been applied for and approved by the State. This is an excellent channel - the nearest one using it is Bay town. The men ,ill be able to communicate from south of Se~uin to Dilly or Pleasanton. It will mean that if one of the men 1S in San Antonio at a parts warehouse, he can call back to the shop on his walkie and talk with them. Greenwald moved to accept the bid for the utility tractor ~i th front - end loader and reach mower of Brookside Equipment Sales, Inc. in the amount of $24,741.00. Mr. Sharpe seconded the Ptotion. Mr. Baldwin asked ~quipment and Mr. rarks Department. ~r. Aguilar asked about maintenance, since the firm is in lIouston. Mr. Gilmore said maintenance would be taken care of blose by. 1 ~he Mayor then called for a vote on the motion, which carried as follows: which department would be using this piece of Gilmore advised that it was for the Street and AYES: Councilmen Sharpe, Baldwin, Aguilar and Greenwald. NAYS: None 16 CITY DEPOSITORY: Mr. Gilmore explained that every two uears the City goes out for proposals on their depository. Our pank was the only one to send in a proposal, and it had only two ~inor changes from the last proposal from them. ~r. Sharpe moved to approve the Schertz Bank and Trust as the epository for the City. Mr. Greenwald seconded the motion, hich carried with the following vote: AYES: Councilmen Sharpe, Baldwin, Aguilar and Greenwald. NAYS: None , 17 RESOLUTION: Mayor Sawyer introduced and read the paption on a resolution as follows: ! RESOLUTION NO. 85-R-16 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, 'TEXAS, SETTING A TIME, DATE AND PLACE FOR PUBLIC HEARINGS PURSUANT TO THE PROPOSED ANNEXATION OF 21.19 ACRES OF LAND, MORE OR LESS, OUT OF GUADALUPE COUNTY. ire Baldwin moved to approve the resolution setting public earings for the proposed annexation of 21.19 acres of land for anuary 7, 1986 and January 21,1986. Mr. Aguilar seconded the ~otion, which carried with the following vote: 38 AYES: Councilmen Sharpe, Baldwin, Aguilar and Greenwald NAYS: None .8 RBSOL1nIOR: Mayor Sawyer introduced and read the caption on a resolution as follows: RESOLUTION NO. 85-R-17 A RESOLUTION REQUESTING THE S~ATE HIGHWAY AND PUBLIC TRANSPORTATION COMMISSION TO DECLARE AN EXISTING DRAINAGE EASEMENT APPURTENANT TO F.M. 3009 IN GUADALUPE COUNTY, TEXAS SURPLUS TO THE NEEDS OF THE STATE. , . ' Mr. Greenwald moved to approve the resolution requesting the State Highway Department to declare existing drainage easement surplus. Mr. Aguilar seconded the motion. Mr. Gilmore said that the City does not have to pass an ordinance to accept the other easement, all we are doing is agreeing to the Highway Department switching easements. The motion before Council carried with the following vote: AYES: Councilmen Sharpe, Baldwin, Aguilar and Greenwald. NAYS: None .9 ORDlRARCB: Mayor Sawyer introduced and read the caption on an ordinance as follows: AN ORDINANCE . BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, BE ~EW>BD' BY REVISING SECTION 18-91 PARKING PROHIBITED, OF SAID CODE. Mr. Aguilar moved to approve the first reading of an ordinance amending the traffic code. There are only two minor changes from last year's. , l. r. Greenwald then moved to approve the contract with Buffalo alley Youth Association for the Baseball season of 1986. NAYS: None I i #12 MOBILE HOME SUBDIVISION FEES: Mr. Gilmore said these ~ees are as discussed at workshop-$40.00 for the initial annual ~icense fee, plus $1.50 per each occupied space. If at any time !Uring the year the park is sold, there will be a fee for this ransfer of $15.00 unless it is at the time of renewal, then it ,ould be the regular $40.00 renewal fee. *r. NAYS: None #13 EXECUTIVE SESSION: None needed. .14 CITY MANAGER'S REPORT: A. Everyone received a copy of ~he Business Journal. I $. Tomorrow at 1:30 p.m. there will be a demonstration of street ~epairs. Meet at the Municipal offices and go to the site. I ~. The Fire Department has invited Council down after the ~~eeting for tamales after this meeting. ~I 115 !TEllS BY COUNCIL: Mr. Greenwald asked concensus of ouncil to allow Mr. Gilmore to shut down the city offices at oon on Christmas Eve. Council concensus was yes. , ~r. Aguilar said he would not be able to attend the January 7th ~eeting. I ir. Sharpe asked Mr. Gilmore to see that a stop sign is placed at he intersection of the entrance of Savannah Square and FM 3009. Iso the stop sign at Colony and Mitchell was knocked down and eeds to be replaced. ~r. Sharpe said he had asked the City Secretary to check to see f we are a member of the Austin-San Antonio Corridor. We found here we paid and joined in April of 1985 but we still are not on heir list of members. There seems to be some feeling that this rea is not participating but they have several memoers listed nder San Antonio. 40 Hr. Sharpe gave a brief summary of the tax roll-back committee activities. There will be a short radio program at 8: 30 a.m. this coming Saturday on the roll-back. Mr. Sharpe said last week's Herald had a scathing editorial on citizens of Schertz. He said he had written a reply since he felt that he was a part of the meeting in question. Mr. Sharpe said that whatever he does as Councilman or citizen, he does not want to bring discredit to the City. Mr. Baldwin said he did not go to the meeting but he felt that each time Mr. Sharpe speaks, he should make it clear that he is not speaking as Councilman but as a citizen. 116 I~ BY RAYOR: Mayor Sawyer wished everyone a Merry Christmas and Happy New Year.
