( ( r ( ( 7/ R I REGULAR SESSION OF THE CITY COUNCIL FEBRUARY 18, 1986 , The Schertz City Council convened in Regular Session, Tuesday, February 18, 1986, at 7: 00 p. m. in the Council Chambers, 1400 Live Oak Road, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presiding; Charles B. Sharpe; Hal Baldwin; Ray Stanhope; Adolph Aguilar and Ken Greenwald. Staff present were City Manager Jimmy G. Gilmore and City Secretary June G. Krause. ,\ '\ " Mayor Sawyer welcomed everyone to the meeting and introduced Mrs. Sharon Fruge, president of the Business Club, who presented a plaque to Betty A. Tyler. Mrs. Tyler was honored as being selected as nEmployee of the Quartern. Mrs. Fruge also presented a large plaque to Mayor Sawyer showing all the honored nEmployees of the Quartern for the past two years. PUBLIC BEARING: Mayor Sawyer explained that the two public hearings were 'zoning hearings held jointly with the Planning and Zoning Commission. He then turned the meeting over to Mr. Bob Andrews, Vice Chairman of the P&Z. Mr. Andrews explained that the first public zoning hearing - ZC 176 - was on a request by C.P. Vaughan, Vaughan Homes, for rezoning a 10.113 acre tract, now zoned R-5, and a 10.406 acre tract, now zoned R-2. It was requested that these two zonings be reversed so that the R-2 zoning be appl ied to the 10.113 acre tract and the R-5 zoning be applied to the 10.406 acre tracts. Mr. Andrews also explained the procedures for the hearings; first will be comments and location from city staff, then any comments from the person requesting the hearing and lastly any comments, either pro or con, from the citizens. After the close of the hearings, there will be no further comments received by either the Planning and Zoning Commission or the City CounciL All comments will be taken into consideration and the P&Z have ten days in which to make a recommendation to the City Council, who will take action at their next regular meeting. Steve Simonson, Planning Coordinator, explained the location of these two tracts of land, saying the request was for a flip flop in zonings. As there were no citizens wishing to speak on this request, this public hearing was closed at 7:06 p.m. B. ZC 177 - Mr. Andrews said that this hearing concerned a request by C.L. Kucherka for zoning 'change for two parcels of land located along FM 3009, one a 1.337 acre tract and the other a 1.367 acre tract, both currently zoned Office and Professional; and it is requested the two tracts be rezoned Neighborhood Services. 1ft? ( C (( I I Mr. Simonson said that two comments were received as a result of the letters of notification. Both parties stated that they did not wish the zoning to be changed. Again, as there was no one present wishing to speak on this subject, the hearing was closed at 7:07 p.m. Mayor Sawyer called for a short recess at this time in order for the P&Z members to depart for their own meeting. The Regular Meeting was reconvened at 7:14 p.m. 11 APPROVAL OF MINDTES: Mr. Sharpe asked that the 5th, 6th, and 7th sentences. of the fourth paragraph of the minutes of January 29, 1986 be corrected to read as follows: "There are 24 people on the board, six members from San Antonio .SAMA and six from the Austin SANA, five from outside; five from the AACOG and five from the Austin COG. Mr. Edwards said he was hired as the first Executive Director. They currently have committees on Water, Utilities, Transportation, Economic Development and Cultural Arts Events.~ Mr. Aguilar asked that the first sentence of the fifth paragraph of the minutes of the January 29th meeting be corrected to read as follows: "Mr. Aguilar said that when he and Mr. Sharpe return from the Corridor meetings they always brief Council, especially on the panel discussions which he feels are great." Mr. Aguilar also asked that the last sentence on page five of the minutes of the meeting of January 29th be corrected to read: "A letter was received by Mr. Sharpe from Al Notzon concerning the census committee meeting in February and will only have until the end of March to get the report in." Mr. Stanhope moved to approve the minutes of the Special Meeting of January 29, 1986 and the Regular Meeting of February 4, 1986 as amended. Mr. -Greenwald seconded the motion, which carried with the following vote: AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and Greenwald. NAYS: None 12 BEARIIIG OF RESIDEftS: None 13 ORDIRARCE: Mayor Sawyer introduced an ordinance and read the caption ,as ,follows: ORDINANCE NO. 86-A-4 AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES - OF THE CITY OF SCHERTZ., TEXAS, 'BY THE ANNEXATION OF A TRACT - OF LAND CONTAINING 21.19 'ACRES MORE OR'LESS, OUT OF GUADALUPE COUNTY. "" " . (C ( lIe I ........ I Mr. Aguilar moved to approve on final consideration an ordinance on the proposed annexation of 21.19 acres of land out of Guadalupe County. Mr. stanhope seconded the motion, which carried with the following vote: AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and Greenwald. NAYS: None 14 ORDINANCE: Mayor Sawyer introduced and read the caption on an ordinance as follows: ORDINANCE NO. 86-D-5 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING SECTION 18-19 PARKING PROHIBITED, OF SAID CODE Mr. Greenwald moved to approve the final consideration of an ordinance prohibiting parking on the northeast side of Lookout Road. Mr. Baldwin seconded the motion, which carried as follows: AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and Greenwald. NAYS: None IS RESOLUTION: Mayor Sawyer introduced a resolution and read the caption as follows: RESOLUTION NO. 86-R-2 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ; TEXAS, STATING THE CITY OF SCHERTZ HAS NO PLANS TO ANNEX SOUTH OF INTERSTATE HIGHWAY 10 Mayor Sawyer said that the City Council of San Antonio had requested this resolution be passed by Schertz. Mr. Sharpe moved to approve the resolution saying Schertz has no plans to annex south of Interstate 10. Mr. Aguilar seconded the motion, which carried as follows: AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and Greenwald. NAYS: None .6 BXBCOTIVE SESSION: Mayor Sawyer called for an Executive Session under-Article 6252-17 Vernon's Texas Civil Statutes, Section 2(e) concerning litigation at 7:21 p.m. - 1/;O ~ ( ( ( I r The Regular Meeting was reconvened at 7:28 p.m. Mr. Greenwald moved to authorize the Mayor sign a letter in relation to a legal suit. Mr. Stanhope seconded the motion, which carried as follows: AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and Greenwald. NAYS: None Mr. Sharpe explained that the purpose of this letter is to ask Green Valley Water Supply Corporation if they are serious in turning over their water corporation to Schertz. .7 CITY MANAGER'S REPORT: A. Have received a letter from the State concerning a litter-enforcement program, which will be on the next workshop. B. Regarding the no parking on I 35 access, especially in front of Bussey's, we have had numerous phone calls from people protesting and they even conf ronted our off icers. Mr. Gilmore suggested "Tow Away" signs be placed under the "No Parking" signs. The parking on the access roads still presents a safety hazard and traff ic hazards. The ordinance does not have to be modified, just put up the signs so people will know that their vehicles may be towed away. Council concensus was to place the signs. ..,. C. Have received our annual request from the Church of Good Shepherd to place banners over Main Street and Live Oak Road and place signs at the church and Aviation at the low water crossing. .8 ITEMS BY COUNCIL: Mr. Sharpe asked what could be done about the increasing numbers of roadside vendors - it seems we put up no parking signs and they just move to another location. Mr. Gilmore said that is correct - they just move to another location. However, we do have an ordinance now and they will be brought into court. Mr. Sharpe reported on the recent meeting of the Austin-San Antonio Corridor Council. The speaker was the director' of Economic Development Commission. The Corridor Council is putting out a brochure to show the assets of the corridor. Also there will be a Japanese delegation visiting the corridor the 17th through 19th of March with a similar schedule as the last one; but this time starting f rom San Antonio and going north and should be in New Braunfels on the 18th about 2:30 in the afternoon. r- r- ( ( ~Jr; Mr. Sharpe said he saw in the paper where the Seguin-Guadalupe County Hospi tal District was planning on a five million dollar "y addi tion to the hospi to1. It may behoove the Council to inv ite Mr. Ritchie to one of our workshops to let him know how we feel about the expansion. ll:r. Sharpe said he feels we really need someone to be a liaison with that group. Mr. Sharpe also reported on the Census meeting he, Mr. Gilmore and Mr. Baldwin attended in Seguin. Mr. Baldwin announced the Jamboree at 3:00 p.m. at the V.F.W. on Sunday tOheip SAFES. Mr. Stanhope asked about the signs up on I 35 and asked if they were in compliance. Mr. Gilmore said three were not and he has turned them over to Mr. Richard Harris. We are pursuing this to get them down. Mr. Stanhope had a letter from the San AntonicJ Metropolitan Health District concerning controlled quarantine for animals. He said that Dr. Harborth had asked him to br ing it to Council's attention. Mr. Aguilar reported a nice time at the Saturday night auction and dance held by the Library Board and Humane Society. He said they took in about $2500 to be split between the two organizations. \ #9 ITEMS BY MAYOR: Mayor Sawyer reported the people from the Shirmerville area on Sunday. of the questions and requests they have for the very nice meeting. on meeting with He listed some C.ity. It was a Mr. Sawyer had received a letter from the Kiwanis Club, who want to hold a bike-a-thon in our City. Mr. Gilmore to take care of the details. He had also received a letter from the City of Dallas regarding crime. Mayor Sawyer stated that there had been some people present earlier that wanted to hear Council's views on the Gutierrez landfill site. At the last meeting Council passed a resolution saying that we support the site providing it meets all State requirements. The State will be having public hearings and if anyone has something to say, that would be the time to express your views. Gutierrez's landfill off Jack Hays Boulevard will be closed sometime in September. What we face without another locations close by is increased costs to the consumers.
