ccswks 03-12-1986 82 #1 BEARING OF RESIDERTS: Mr. Bill Neller reserved time to discuss the animal control ordinance along with Mrs. Liz Mueller, who will be late in arriving. #2 Representative of Cibolo Valley Jaycees to address CounciL Mayor Sawyer said they had called and canceled this discussion. #3 Discussion with Planning and Zoning Commission on FM 3009 entrances and Schertz Parkway. After asking the P&Z members to join Council at the conference table, Mayor Sawyer explained that Council had discussed the number of entrances on FM 3009 and Council asked for this joint meeting. Mr. Gilmore said that he had put together some slides to show 0 what the overlay district ordinance has done and what some of the P&Z members and staff had been able to do with it, with comparisons of the requirements without the overlay district. Taking the General Business Zoning, the Overlay District requires the following: A. landscape buffer 20 I wide saving trees and use of native grasses encouraged; B. Mr. Gilmore showed slides which showed what entrances were already on Jack Hays Boulevard prior to the overlay district; what has been approved since - mostly on the West side. Mr. Sharpe said he was the one that brought up the fact that the City is not doing what we had planned for FM 3009. He stressed that he was not against the P&Z, they are doing a good job but 0 maybe Council did not convey exactly what they intended. Mr. ,"I.;,lI!iIIllI' i,.,,'J.:';;"~>>' 83 r-- Sharpe pointed out that even if the property owner has the right to one access, in the case of the Lone star property, they could have use Woodland Oaks rather than another entrance on FM 3009. The same applies to the property at Elbel and FM 3009, they could have used Elbel for their entrance rather than FM 3009. There was discussion about platting an access road joining several pieces of property and having entrances off this access. P&Z members said that developers are not leaving very much land for commercial development - they have to get houses going to get some of their money returning fast. Mr. Gilmore pointed out that we could insist that developers put in access roads but they can file against the City on condemnation of the access road and force the City to pay for the road. Mayor Sawyer pointed out that you must have two entrances to a subdivision, because of fire safety for one thing. The City has had that policy every since Village 3 and 4 were put in with one entrance. ,.-- Don Wilson of P&Z said one of the things they attempted to do was to determine not only the number of entrances but how close together they should be. The developer next to Payless will only be able to put in an entrances so many feet from the current one. Mr. stanhope pointed out that with FM 3009 being a four-lane road, the traffic will be less, especially with the completion of Schertz Parkway. Mr. Baldwin said it was his opinion that Council was not so concerned with major development on FM 3009, that Council wanted to retain the "Country Lane" look. Mr. Andrews said that developers will put a contract on a piece of property for ninety days to give them time to look at the restrictions and if they don't feel it would be profitable, they will let the contract go. You are not going to get development to corne out here if you say no more entrances on FM 3009. If we want growth in our City, we must take into consideration the cost of that land because if we do not we will not have any development. Mr. Stanhope said he feels P&Z is doing a good job going on a case by case basis. Maybe we should make developers plat 300 feet for commercial instead of 200 feet. Mr. Aguilar said he felt that P&Z understands and believes the same as Council. He said he thought P&Z knows what is meant by the ordinances and that they should be able to decide on each r- case. ~ 84 Mr. Gilmore said the key thing according to the overlay is to let P&Z negotiate. n U Mayor Sawyer said what he got from the discussion is that three of the Councilmembers agree that they want businesses to have their right to limited entrances. Do you want P&Z to continue as they have been doing. Mr. Aguilar, Mr. Greenwald and Mr. Stanhope said yes they do. #4 Discussion of amending the Zoning Ordinance to include Air Installation Compatible Use Zone. Mayor Sawyer said this addition to the ordinance is to protect the flight pattern at Randolph, changes that will protect the Air Installation Compatible Use Zone. They recommend repairing the tank and accepting the bid from D Brothers, Inc. for the painting and repairing. #6 Consideration of an ordinance setting speed limits on ~M o 482. Mr. Gilmore pointed out on the map the short portion of FM 482 within our city limits. The Highway Department is setting the speed limits and need our permission to set it inside the City. #7 Discussion of public hearing on March 18th on a request by Sanders and Leon to rezone 3.56 acres on Elbel Road from R-2 to Neighborhood Services. Mayor Sawyer asked if Council had any objection to this being on the next agenda. Council did not object. 18 Discussion of Transfer of Appropriations. Mr. Gilmore explained that this is a normal procedure every two or three months during the budget year. Some of the changes are because of growth and some because of the increased costs of nil insurance. Mayor Sawyer recognized Mrs. Mueller and Mr. Neller, who wished to discuss the animal control ordinance. Mrs. Mueller said some citizens were extremely upset when they went to the shot clinic and found out the City tag fees have gone up to $7 -each animal and also that they would have to register again next October. Also they were told that they were not accepting checks. Mr. Stanhope said he had been contacted several times about these same things. Council discussed various aspects of the ordinance, including fees,and annual requirements and decided to have this item on another workshop to fully discuss it. Mrs. Mueller also asked about doing some modif ications at the Shelter and being told no. Mr. Gilmore said anytime they wanted to do anything at the shelter to modify it, they should please come to him and they could work it out. ~ #10 CITY MANAGER'S REPORT: A. If you check the monthly health report, you will note that we did shut down an establishment this past month until corrections were made. B. He called attention to an extract from the Zoning News that speaks to changes or decisions that have come out of Supreme Court on zoning cases. C. Mr. Gilmore said he had the map and legal description on the proposed annexation around Gutierrez. A new law states that if you surround an area, then you must include it in the annexation. Council was not sure about annexing the whole thing and asked that Mr. Gilmore get metes and bounds that only took in the CDR property along Borgfe1d Road and FM 3009 to FM 78, staying outside of Gutierrez' property. D. Mr. Gilmore showed copies of two water bills one we currently use and one he would like to change to. Council agreed to the change. r- E. Because of the recent newspaper articles, Mr. Gilmore asked if Council wanted to continue with the policy that all news releases go through the City Manager. Council said yes. This will be an item for the next agenda. F. Have received a request from the Bluebonnet Square Dance Club to waive the deposit fee for a dance they have planned at the ~ 86 Community Center for March 29th for students and members. Council agreed to drop the deposit fees. G. Thursday night there will be a Schertz Parkway meeting at 7:00 p.m. - Mr. stanhope and Mr. Greenwald are members of this committee. #11 ITEMS BY COUNCIL: Mr. Greenwald asked to let Mr. Jim Harden discuss landscaping the front of the Municipal BUilding. Mr. Harden said first the City would have to put in water and sprinkler system. He said he will donate the plants and get the Eagle Scouts to plant them. Mr. Harden said he would come meet with Mr. Gilmore to discuss details. Mr. Greenwald said the junk yard is starting up behind True Performance again. Mr. Greenwald said he believed Council gave Sycamore Creek permission to have their sign up for six months and if the time is up to have them take it down. If time not up, then they need to fix it up. Mr. Greenwald also said there seemed to be a proliferation of signs on the railroad property. Mr. Greenwald said he was asked about excessive water usage by a citizen. Mr. Gilmore said to have the man come in and we would check it out. Mr. Krause explained that the meter readers do check and if excess ,usage, they do notify the owners and if flooding, they turn the water off. The 19th of April at 9:00 a.m. is the opening day for BVYA Softball season Mr. Greenwald announced. Mr. Baldwin asked the status of the Sportman's Cafe Building on FM 78. Mr. Gilmore said the owner of the Bicycle Shop would like to buy the property but right now he is putting all his money into the building of his new shop. Mr. Baldwin said the Sabastin Apartments started trenching for their sidewalks and then quit. Mr. Gilmore said he is in the process of finding out about that. Mr. Stanhope asked if the ice cream trucks have to be inspected by the Health Officer. Mr. Gilmore will check. Mr. Sharpe said he stopped a guy selling something and asked to see his permit. The man said it was in the van that had dropped him off. Could the police have a list of the permit holders. Mr. Gilmore said each person that obtains a permit are told that they must have the permit on their person to be legal. Sharpe also suggested that we need a method of tagging signs :I'as to whether they are permanent or temporary in order to keep ,current with them. I I IMr. Aguilar asked the outcome of the signs on the corner of FM 113009 and East Live Oak Road. Mr. Gilmore said they have to find out who is in charge of the land. IMr. Aguilar asked if someone selling wood has to have a permit. Mr. Gilmore said yes, it they go door to door. ! #12 ITEMS BY MAYOR: There is a vacancy on the Housing IAuthority. Mayor Sawyer said he would like to appoint Mrs. Stanhope.
