SPECIAL MEETING OF THE CITY COUNCIL
APRIL 9, 1986
The Schertz City Council convened in Special Workshop Session,
Wednesday, April 9, 1986 at 7:00 p.m. in the Conference Room of
the Municipal Complex, l400 Live Oak Road, Schertz, Texas. The
following members were present: Mayor Earl W. Sawyer, presiding;
Charles B. Sharpe, Hal Baldwin; Ray Stanhope; Adolph Aguilar and
Ken Greenwald. Staff present were City Manager Jimmy G. Gilmore
and City Secretary June G. Krause.
# 1 HEARING OF RESIDENTS:

#2 ORDINANCE: Mayor Sawyer introduced an ordinance
canvassing the retUrns and declaring the results of the General
Election of April 5th and asked that it be declared as an
emergency to comply with State law.
Mayor Sawyer asked to hold this

Mr. Greenwald moved to declare the ordinance canvassing the
election returns as an emergency measure. Mr. Stanhope seconded
the motion, which carried with the following vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.

#3 SWEARING-IN CEREMONIES: City Secretary June G. Krause
gave the oath of office to the declared winners in the April 5th
election as follows: Earl W. Sawyer as Mayor; Charles B. Sharpe
as Councilman Place l; and Hal Baldwin as Councilman Place 2.
#1 HEARING OF RESIDENTS: A. Mr. David Good of 1516
Chestnut Drive said he lives at the end of a dead-end street and
the speeding traff ic is ter r ible. He suggested the Council
consider speed bumps to slow down the speeding cars. Mr. Good
mentioned that had he had time, he would have gotten a petition
signed with those citizens concerned. Mayor Sawyer told Mr. Good
that they would see that there was more police patrols in the
area and that he would asked the City Manager to look into the
possibilities of speed bumps. Mr. Good said there really was no
particular time or group causing the problems.
B. Mr. Ty Brisgill informed Council that Woodland Oaks
Subdivision is about 80% complete in the first unit and as yet no
traffic control signs have been installed. Mr. Gilmore said the
signs are on order.
#4 Mr. Tom Harm to discuss BVYA tournament security.

First Mr. Harm extended invitations to all to attend the Opening
Day Ceremonies at 9: 00 a .m. on the 19th of Apr il. He said a
formal invitation would be forthcoming but he wanted to extend
Ipersonal invitations to all.

Mr. Harm said BVYA has been awarded the South Zone Tournament, to ~.
take place the last week in July. In the past, some U
Councilmembers have helped sell hotdogs etc. and he hopes they f,
will again. People like to have the tournaments here because of
all the nice things the City does for them, such as pool passes.
However right now there is a problem with the lighting system on
the fields and they need help in getting the lights realigned.
Mr. Gilmore said that GVEC will be down there soon and will
contact BVYA so they can be there to show them just what is
needed.
Mr. Harm went on to say that there is an appearance that the
Parks Department personnel does not want to cooperate with BVYA.
The adult softball field is in bad shape and it has been implied
that the City has no intention of doing anything about fixing it.
Mr. Greenwald mentioned that the contract outlines who will do
what and there are other people that use the field. Mr. Harm
says it appears there has been no maintenance all year and he
asked for help from Council in this respect.
With regards to security, Mr. Harm said they need to assure Pony
Baseball that police patrols will be available - one uniformed
man on duty at all times after dark. He again asked the City to
help provide this security.
#5 Mr. Dennis Hayes to present the audit for year ending 0
September 30, 1985.
Mr. Hayes said he appreciated the opportunity to address Council
and wanted to thank all employees who assisted him, especially
Al ice Austin. He went on to say that Mr. Gilmore has done a
superb job of management and the Council is to be commended.
Mr. Hayes then went through the audit explaining certain items,
saying that the audit is divided into three sections
Introduction, Financial and Statistical. Mr. Hayes and Mr.
Gordon Armstrong both answered questions of Council concerning
the audit.
Mr. Hayes concluded by saying thef would come to the next meeting
to give a short synopsis at the t~me of approval.
Mayor Sawyer asked to return to item #2 as the ordinance
itself had not been approved. He then read the caption as
follows:

#6 Discussion of awarding bid on "Plant piping to
acogdoches water storage tank".
. r. Sawyer referred to the engineer's recommendation to award the
fid to South Texas Construction for the pr ice of $26,667.00.

179 - discussion of Mr. Simmons request to rezone
of land on Jack Hays Boulevard to Office and
ayor Sawyer said that we have had a request from Mr. Simmons to
ezone this property and it seems that when Mr. Simmons bought
his land, he bought developable property. We have had a public
earing on this request and the hearing was continued in the
lanning and Zoning meeting and it should not have been according
~o our ordinance.
~' r. Baldwin said he understands the concerns of the people who
ive in the area; but Council has fought this battle several
imes and it is time something is done with the property. Mr.
aldwin said he felt Office and Professional would be the best
fse of this particular land.
r. Aguilar said that when this was brought up eight years ago,
he park question was brought up. We asked ~r. Simmons if he
ould dedicate some land in his development for a park. He said
hat if this front land was left for development, he would
edicate some land in the back for a park so tha~ the kids would
ave some place safe to play and he did that.

Mr. Sharpe said that at about the time Mr. Simmons bought the
property for development, the Highway Department took about 75
feet for right of way. He offered this front land to the City
but the City did not want it because of having kids play so close
to the highway.
Mr. Greenwald said there is a drainage problem and Mr. Simmons
will have to get an engineer to comply with our ordinance.
Mr. Baldwin agreed with the people who said they did not want a
board fence separating this property from their property and this
should be changed even if it means a variance to the ordinance.
Mr. Sharpe said most of the citizens that came to the public
hear ing brought up traff ic problems and Council has addressed
that by opening up Schertz Parkway. You can only address it so
far and even though Mr. Sharpe said he would like for this land
to stay the way it is, Council is going to have to let Mr.
Simmons do something with this property.
Mayor Sawyer said that people just do not like zoning and that
zoning should be done at the beginning like Schertz Parkway was
done.
#9 Discussion of setting public hearings on the proposed
annexation of 41.744 acres out of Guadalupe County.
Mayor Sawyer reminded Council that they only wanted to annex the
COR property and not the landfill.
When Mr. Greenwald asked the rationale for not annexing the rest
of this area, Mr. Baldwin said why waste our percentage of
annexing on land that you cannot do anything with for years.
Mayor Sawyer instructed Mrs. Krause to set up public hearing
dates.
#lO Discussion of a resolution to acquire land for
drainage.
Mr. Gilmore explained this refers to property that is needed for
drainage on FM 3009. We went to the Ripps and asked them to swap
land for this drainage and made several attempts to talk with
them but they would not discuss it. The State Highway
representative tried to talk with them and they still would not
discuss it. We need the easement and the only way now is through
eminent domain. This will not provide drainage for any
individual develop.mertt but will help. Barshop because they cannot
cont1nue with their development unfil they know which d1rection
the drainage will go.
#11 Discussion of an ordinance amending the Health
Ordinance by adding a penalty clause.

r- Mr. Gilmore said our ordinance has no penalty clause. Currently
we can only shut down an establishment. For a minor violation,
that is a little drastic.
#l2 EXECUTIVE SESSION: None needed
#l3 CITY MANAGER'S REPORT: A. Concerning the
Schirmerville area, from the metes and bounds published San
Antonio is annexing the north side of 1-10, including the access
road which seems is what they want to control. We contacted
their planning department and they said that is what they are
doing. We asked them to send us maps of the annexation.
Mayor Sawyer advised that he would send a letter to the San
Antonio City Council and let them know that we want them to stay
with what they originally agreed.
B. The City has received a request from the South Texas Chamber
lof Commerce wanting to know if we want to participate in the
'South Texas magazine with an ad, similar to what we did last
year. Mr. Sharpe agreed that the City should have an ad in the
magazine but change it a little. Mr. Gilmore said we have had
two or three inquiries from out of state from the advertisement.
C. The Planning Committee for Schertz Parkway has delayed the
r--- April 17th meeting because three or four members will be out of
town. They plan to have Doyle Hines of GVEC at the next meeting
to talk about underground electric. Right now the jurisdiction
is divided between CPS and GVEC but we want to see if CPS will
let GVEC have south of 1-35. The Schertz Parkway plans are
approximately 90% complete. One of the big hangups at the
beginning was that the entrance to 1-35 was only to be a 60 foot
easement - now we have 80 foot easement. There are about four
Ilots on which we have not received easements. We need three full
lots for drainage easements.
Mayor Sawyer said with regards to the two at this end of Schertz
Parkway, we need to go back to the one that said "maybe" and let
him know that time is up.

Mr. Gilmore said his understanding f rom previous instructions
from" Council was to contact both men again to come in to talk
with the Mayor - allowing them 3 or 4 weeks for a response and
then send another letter giving them 7 days.
Mayor Sawyer said let us send a registered letter giving them a
certain number of days to reply and if no reply, we will take it
to mean a negative reply and follow up from there.
Mr. Sharpe asked if the City has given up action to get GVEC to
put Jack Hays utilities under ground. Mr. Gilmore said that when
Mr. Hines was before Council, fie was talking about some easements
on the back of the property so that they could put up poles and

run lines underground. In talking with them about Schertz
Parkway, we can negotiate this land.
#14 ITEIIS BY COUNCIL: Mr. Aguilar reported that the
Library Book Sale would be the weekend of April ll-l3. Again
this year, they will be selling books by the inch.
Mr. Sharpe advised that in the latest TML magazine there is a lot
of tax information on cities and Schertz is not listed.
Mr. Sharpe said he went to the County Appraisal District meeting
on Monday and they agreed to hire some additional appraisers to
try to get the work done at least by October. They will be
sending out letters to all entities on how the rollback will
affect an increase in each portion.
Mr. Sharpe also said he had attended the County Commissioners
meeting and they have frozen all funds effective Monday of this
week.
Mr. Gilmore said that the County Tax Off ice will no longer be
able to send an employee to our office for title transfers, etc.
Mr. Sharpe also said about 50% of the people who came to vote,
drove in the wrong way. We need to get the parking lot marked
much better.
Mr. Sharpe said there are no street
Oaks, Savannah Square or Oak Forest.

developers put then in.
Answering Mr. Sharpe's question, Mr. Gilmore said that it was his
understanding that the State would be improving FM 78 through
Cibolo to FM 3009.

Mr. Sharpe asked about the tour of Schirmerville area that the
Council and Planning and Zoning is to make. Mayor Sawyer asked
Mr. Greenwald and Mr. Baldwin to firm up a date and
transportation.
Mr. Sharpe said he ran into a gentleman from Green Valley and he
wanted to have another meeting with Mr. Gilmore and Tom
Anderlitch. Mr. Sharpe said he told the man that our Council
only wants to meet wifh their complete board. Mr. Gilmore said
he received a call from Mr. Anderlitch stating that the man had
called Tom asking to set up a meeting the next day. Mr.
Anderlitch told him to call Mr. Gilmore. Mr. Gilmore told Mr.
Anderlitch that we do not want any more meetings until it is with
our complete Council and their complete board. Mr. Anderlitch
said he really doesn't have any business at such a meeting.
Mr. Stanhope asked if the dog kennels were ever sprayed to
control ticKs and fleas. Mr. Gilmore said Mr. Graham was to talk
with the people that did the swimming pool.

Mr. Stanhope said the P&Z minutes indicated that Vaughan did not
want a big sign but would use bandit signs. Will he police them
or will the City have to. Mr. Gilmore said both probably - if he
doesn't remove them, then of course we will have to.

Mr. Baldw~n brought up the widening of the br idge and FM 78.
Mayor Sawyer said that would be one of the items for the Bond
Committee.
Mr. Greenwald said that Mr. Harm of BVYA has signed contracts for
several tournaments, which will fill up the month of July. What
Mr. Harms wants is park security. Last year they came in at the
Ilast minute and Mr. Greenwald said he told them this time that
ICouncil will expect them to fund the security. There is a need
'for a policeman down there but they should pay for it. If we
want to continue giving pool passes as in the past, Mr. Greenwald
would take care of that.
Mr. Greenwald said there was a long discussion at P&Z regarding
the cut on FM 3009 for the Lone Star Store. Apparently no matter
what we put on the recorded plat, the Highway Depar.tment can
change it.
Mr. Gilmore said the City is going back to the State and tell
them as long as it is in our city, we will control the cuts. We
r- need to send a letter to Ehlers with copies to Seguin and New
Braunfels that we have identified a serious traffic problem that
Ithey have created and demand that the speed limit on FM 3009 be
Icut immediately.
I'Mr. Greenwald said there have been several discussions about the
drainage at Woodland Oaks. Mr. Gilmore said they are trying to
Iredesign it and it is being worked on now. Mr. Greenwald asked
iwhy the engineer did not catch this earlier - if he cannot catch
Ithese things then it is time we get a new drainage engineer.
Mayor Sawyer said he had lost a lot of faith in Mr. Ford after
this error.
Mr. Greenwald asked if any headway had been made in a striping
machine. Mr. Gilmore said he had two bids on purchasing one from
about $4600 to $4800. It is more expensive to have someone do
the work.

I #l5 ITEMS BY MAYOR: Mayor Sawyer asked for names from
Icouncil members for the Bond Committee and received the
following: Dave Calvert, Rita Bullock, Saraf in Martinez, Ron
IHarris, Ruben DeLaFuente, Bob Carter, Bud Humphries, Dick
Toothaker, Jim Kavooras. Mayor Sawyer added J.L. Stewart and Liz
Mueller and asked that at the Tuesday night Council meeting one
of the agenda items be to form a Bond Committee.
Also the item of selection of a Mayor Pro Tem should be on the
.next agenda.

Mr. Sawyer said he had received a letter from the Her.ald and they
are ready to publish a newcomers guide for this year and want to
know if the City wants to participate. Concensus was yes.
After reading the annual report from the Housing Authority, Mayor
Sawyer said they seem to be a little bit more professional with
Mr. Cyr as Chairman.
