SPECIAL MEETING OF THE CITY COUNCIL
MAY 14, 1986
The Schertz City Council convened in Special Session, Wednesday,
May 14, 1986, at 7:00 p.m. in the Conference Room of the
Municipal Complex, l400 Live Oak Road, Schertz, Texas. The
following members were present: Mayor Earl W. Sawyer, presiding;
Charles B. Sharpe; Hal Baldwin; Ray Stanhope; Adolph Aguilar and
Ken Greenwald. Staff present were Jimmy G. Gilmore and City
Secretary June G. Krause.

PUBLIC HEARING: Mayor Sawyer opened the public hear ing and
welcomed everyone present. He gave the purpose of the hearing,
saying it was to receive input on the proposed annexation of
approximately 4l.744 acres of land out of Guadalupe County. Mr.
Sawyer explained this land is located on Jack Hays Boulevard
bordered by Borgfeld Road, FM 78 and on the east by the Gutierrez
landfill.
As there were no citizens wishing to speak nor any questions or
comments from Council, Mayor Sawyer declared this hearing closed
at 7:02 p.m.

PUBLIC HEARING: Mayor Sawyer immediately opened this hearing and
explained the purpose was to receive input on the proposed
annexation of approximately 5428.993 acres of land out of Bexar
I County. This land is known as the Schirmerville area.
In answer to a citizen's question, Mr. Gilmore explained that
this land does not include the east side of FM l5l8.
Mr. Aguilar asked if the City had received any word from San
Antonio regarding their deannexation of portions of this area.
Mr. Gilmore said nothing in writing since Mayor Cisneros' letter.
However they called and said they would be sending the metes and
bounds where they were releasing the frontage road to Schertz.
They will be sending a letter of agreement to be signed.
Mr. Baldwin asked if we had checked into the development right
behind Randolph Air Force Base. Mr. Gilmore said we had written
them telling them about the development of storage area but have
heard nothing back from them.
Mr. Sharpe said at least we have gone on record that this was
there before we annexed.
Mr. Baldwin asked if we would have a time problem if San Antonio
does not get the paper work to us soon. Mayor Sawyer said if it
does, we will jus"t. ""back off and start the public hear ings over
again.
r- There being no further comments, Mayor Sawyer declared the public
hearings closed at 7:07 p.m.

#1 BEARING OF RESIDERTS: Mr. Johnny Smith, Executive Vice-
President of the Cibolo Valley Jaycees introduced Mr. Miller (the
outgoing president) and Mr. Tim Sullivan the incoming president.
Mr. Smith then showed plans for a Cibolo Valley Jaycee Community
Center, saying they have been working on this for three years.
He invited everyone to the ground-breaking ceremonies on Monday,
May 19th at ll:OO a.m.. The project is located right across Fm
l5l8 from the Scout Hut. He said it is their intention to make
this building available to the community for dances, large
functions, etc. There will be one large meeting room that will
hold 500 people and a smaller one for about lOO people. In
addition there are offices and small meeting rooms, with parking
for about 300 cars. Mr. Smith said the target date for moving in
will be August 1, 1986. This is a $496,000 project that will be
coming into the city, to be used by all area cities and the
Chamber of Commerce. He said they are trying to get some
conventions to come in.

Mayor Sawyer thanked them for coming in.
2. Mr. Gerald Brown asked Council their feelings on covenants.
Mayor Sa~er explained that the City does nothing on covenants or
deed restrictions, the City has no authority. Mr. Sawyer told
Mr. Brown that he as a citizen would have to do what he deemed
necessary.
Carlene Scott asked about how long it will be before the City 0
amends the ordinance concerning the list of types of businesses .
that can go in office and professional. Mayor Sawyer said it
first had to go through Planning and Zoning then to legal and
back to Council and it could take six months or more.
Mr. Brown said their concern is that Mr. Simmons is not going to
develope this land but sell it. Again he said that they do not
wflnt anything on this land but they are trying to work with
Mr.Simmons and will meet again with him the evening of the l5th.
He said they are probably going to take Mr. Simmons to court.
#2 Discussion of variance request by Mr. Kendall.
Mayor Sawyer said we have had the public hearing on this variance
request where the gentleman wants a two foot side year setback
variance. Council agreed this should be an agenda item.
#3 Discussion of an ordinance on the proposed annexation of
41.744 acres of land out of Guadalupe County.
Mayor Sawyer said this is the land on Jack Hays Boulevard in
front of Gutierrez landfill. This item is ready for the agenda.
#4 Discussion of setting public hearings on zoning for the 0

A. COR Property - 4l.744 acres

Mayor Sawyer suggested June 3, 1986 for these public hearings.
Mr. Gilmore said the Larry Thomas property is on Greenfield Road
in back of the Harborth property. No one objected to t:h~ Jun~

#5 Discussion of street striping.
Mr. Gilmore said he had gathered some information on either
str iping the streets inhouse or having the job done. He had
several proposals on having it done from $5799 to $6529 and this
would be a one time only. The same work was estimated at about
$ll,757 to buy the equipment and do the work in house and we
would have the equipment for repeat jobs.
Mr. Greenwald said if we do this like we do with the road borer,
it would pay for itself in a short period of time by renting it
out.

Mr. Stanhope said he also felt we would be money ahead by
purchasing the equipment and renting it out. Mr. Gilmore said we
iwould not do the work in another city during normal duty hours.
iMr. Baldwin asked the City Manager to get cost information on
Irenting the equipment.
#6 Discussion of Economic Development Committee.

IMr. Sharpe said he asked for this to be put on the agenda. We
need to look at restructuring the committee, get new people or
Isomething. One of the things this committee needs is to get a
~harge as to what they can and should be doing.
IMaYOr Sawyer asked the City Manager to get something in writi1\g
Isimilar to what we have for P&Z, setting out duties and goals.

~r. Sharpe recommended each Councilmember submit names for this
~ommittee - people genuinely interested in the city. With more
~nd more people coming into the city, Mr. Gilmore just does not
~ave time to take them around and tell them about the community.

Mr. Gilmore said he felt he could come up with guidelines in
~bout two weeks. Mr. Greenwald said he felt we should know what
~s expected of the committee before asking someone to become a
~ember.
i #7 City Manager's Report: Mr. Gilmore reported on the
following:
r- ~. On the Ripps easement, we have a date of May 23 for this to
go to the Land Commission. Our attorney went out to talk with

the Ripps, and now the attorneys ask us to see them one more time
as the Ripps feel there really has not been an offer made. Mr. 0
Gilmore said he talked with Mrs. Ripps and offered $2500 for the I
easement. They said $2500 is completely out. Mr. Gilmore said
he then offered $3500 and Mr. Ripps informed him that Mrs. Ripps
was looking at a larger settlement. Mr. Gilmore said he would
like permission to go as high as $5500 because if we have to go
to condemnation, the City will have to pay everything - both
attorneys, engineers and the total costs. Council discussed the
easement at length, including alternate ways of handling the
flooding. Mayor Sawyer advised Mr. Gilmore that Council does not
have any problem with him going as high as $6000 in his
negotiations.
B. Updating on the upper end of the right of way for Schertz
Parkway, there were three pieces of property that would be
inundated - one we bought and now one says a developer told him
he could get $60,000 for his property. Mr. Gilmore informed the
owner that a benchmark had been set as we have already paid $3500
for one piece of property just like his.
C. Have given Council some suggested changes for our water/sewer
ordinance, amending our f ire protection costs. This is for
Council consideration and to be discussed at the next workshop.
D. Also received copies of San Antonio ordinances restricting
alcoholic beverages in various zoning districts for future 0:
discussion.
E. It is getting close to budget time again and we need to get
with the other cities with regards to SAFES budget. Salaries
have gone up because of not being able to get day-time people and
insurance coverage has gone out of sight. We cannot get the
other cities to establish an estimated population and have to go
with what they approved for last year, so we need to increase the
per capita costs from $3.l5 to $3.35 for the next budget. Mr.
Gilmore said he would like for the Council to start talking to
those city people concerned. If we could use the estimated
population, the $3.l5 figure would probably be suff icient. We
have not increased in two years. We also will get Marion
involved this year. Evidently the letter we sent to Guadalupe
County made some difference - they are discussing increasing
SAFES allotment for next budget. We have begun to build a very
small capital improvement for SAFES - about $2000.
F. a letter from AACOG concerning a seminar for newly elected
officials.
G. letter from the Good Sheppard Catholic Church thanking City
and Council for working with tnem on their festival.
H. Although we did not get the answer we were looking for, we
did get' a letter from the State Highway Department.

#8 ITEMS BY COUNCIL: Mr. Aguilar said the Library Board is
thinking very seriously about bricking their building. They have
some money but not enough and would like a letter of credit or
some type of help from the City, they would pay it back.
Mr. Sharpe mentioned the citizen group appointed to work on
bonding. Mr. Gilmore said he is coordinating a meeting with Mr.
Anderlitch now. Mayor Sawyer suggested the meeting should
include not only the committee, but Council and key staff members
to involve as many people as possible. After that have a meeting
of the committee members and Council. We should send a letter to
each member of the committee thanking them for accepting the
appointment and giving the date of the meeting.
Mr. Sharpe said the signs are still at the bank. Mr. Gilmore
said he checked and those signs do not belong to the City but to
the bank. Mr. Sharpe said they gave them to the City but he
would check again.

Mr. Sharpe mentioned that he is meeting with the United Fund and
he did not see a request from SAFES. Mr. Gilmore said that would
-- come from the SAFES side of the organization rather from the City
employee.
Mr. Stanhope asked if the city has a policy to check street
signs. He found one that was down and in the street, which he
took to the police department.
Mr. Stanhope questioned the dumping of asphalt in the Cutoff Park
area. Mr. Gilmore said he would check, he was not aware of the
asphalt, only street sweeper dumping.
Mr. Stanhope asked if the City is still waiting to hear from the
doctor regarding amending our animal control ordinance and tag
rates. Mr. Gilmore said we were but there is no problem changing
the fee for tags but does Council want to do it this year or wait
until next year. Mayor Sawyer said that Dr. Harborth cannot
handle tags on a January to January basis - only one year from
date of issue or rabies shot. Council agreed to change the tag
rates back commencing with July l, 1986.

Mr. Stanhope also asked Mr. Bill Neller of the Human Society if
he had any information on sealing the walls at the shelter. Bill
said he had checked several places to no avail but would check
with Negley Paint next. Mr. Gilmore suggested they call Mr. Dick
Barnes and tell him the problem and ask his recommendations.
Mr. Baldwin announced that the Senior Citizen Appreciation Day is
rescheduled for May 3lst. He reminded Council of their
commitment to donate for this.

Mr. Baldwin said the School Distr ict had received a copy of a
letter sent to Guadalupe County Appraisal District from their Of
attorney. . He advised them that postponing the reappraisal is
illegal. They are going to get another attorney's opinion. They
will have to make a decision within the next two weeks. We might
want to discuss this with Mr. Howe.
Mr. Greenwald referred to the meeting on the 28th with Mr. Ehlers
and asked why not invite all business owners that front on FM 78.
It would be good to get them involved.
Mr. Sharpe said he would deliver letters to each of them. He
also suggested sending a press release to the Herald.
Mr. Greenwald asked Mr. Sharpe if there were any dates for a
meeting with the joint planning committee meeting with Cibolo.
Mr. Sharpe said he has not had time to revive it but he feels it
had merit. Perhaps we should send a letter to Cibolo and see if
they are interested.
Mr. Greenwald asked about the street light at the entrance to
Woodland Oaks. Mr. Gilmore said there is a work order in, but
they are having problems with that one and the one at Webster and
FM 3009. Also the light in front of Oak Forest is on order.
Mr. Greenwald said he noticed in the paper that Bexar County has 0
gone in for $30,000 for Rittimann Addition. Mr. Gilmore said the
'Mayor of Rittimann' (Mike DeLeon) and he had been working on
that for three months. Mike wrote letters to the Commissioners
and the Judge listing several projects and he is in contact with
the COG. The allocations are for the next three years.
Mr. Greenwald said there was a lengthy discussion at P&Z meeting
about bandit signs on FM 3009. Our ordinance allows, them but
the developers are taking advantage of us. Mr. Greenwald
recommended paying inspectors two hours overtime and have them
pull the illegal signs and give citations - after two citations,
pull their permit.
Mr. Gilmore said P&Z should be getting the new State regulations
on signs at their next meeting. We just got a copy from Richard
Harris. The new large sign across from Northcliffe is an illegal
sign and is to be taken down. Also the farmer's market signs for
the place in Cibolo are illegal and we are after them about them
now.
#9 ITEMS BY MAYOR: Mayor Sawyer said the Community Council
of the Randolph Region wants to form another EMS group. He said
he is trying to get two people on the committee. He said he
would like Hal Baldwin and Jeff Duffield.

Mr. Sawyer asked about the condemnation for Schertz parkway. Mr.
Gilmore said Gemcraft people have met with Mr. Ackermann and

Binseil and they asked if the City would meet with them one more
time before starting condemnation. The developers are working on
r- a letter of agreement as~o how much it will cost each one to put
the road in. This is unique, it doesn't happen very often.
Mr. Gilmore said there are still four people on the other end of
the proposed parkway that we are unable to locate. The couple
that we bought the lot from made a decent recoupment on their
property and this put a benchmark in the event we have to go into
eminent domain.
Mayor Sawyer said he and Mr. Sharpe went to the parade in Cibolo
and it was very nice - would rival our July 4th.
Mr. Gutierrez has invited Council to tour his proposed landfill
on the l7th.
Also Mayor Sawyer said he did meet with Dr. Steele regarding the
land for a tank site on East Live Oak Road. Dr. Steel said he
would have to get with his Board. Mayor Sawyer said he told him
we would like Ehe land for nothing but are wi~ling to pay.
#lO ADJOURNMENT: There being no further discussion, Mayor
Sawyer declared the meeting adjourned at 9:43 p.m.
