ccreg 05-20-1986 146 REGULAR SESSION OF THE CITY COUNCIL MAY 20, 1986 The Schertz City Council convened in Regular Session, Tuesday May 20, 1986 at 7:00 pm in the Council Chambers 1400 Live Oak Road. The following members were present: Mayor Earl W. Sawyer, presiding; Charles B. Sharpe, Raymond Stanhope, Hal Baldwin, Adolph Aguilar and Kenneth Greenwald. Staff present were Jimmy G. Gilmore, City Manager and Deputy City Secretary, Alice Austin. PUBLIC BEARING: Mayor Sawyer opened the Public Hearing at 7:00 pm. He explained that the purpose of this hearing was to receive input on the proposed annexation of approximately 5428.993 acres of land out of Bexar County. The area being roughly bounded by Randolph Air Force Base on the north, FM 1518 on the east, I-IO on the South and Weichold Road and Binz-Engleman Roads on the west. He explained that the area was known as Schermerville and that this was the final Public Hearing to be held. Mr. Gilmore advised that he had agreement between San Antonio and the did contain everything that had been of Schertz ETJ to Lower Seguin Road. II APPROVAL OF IIINOTES: Mr. Baldwin made a motion to approved the Minutes of the Special Meeting of April 30, 1986 and the Regular Meeting of May 6, 1986. Mr. Stanhope seconded the motion. Mr. Sharpe requested the minutes of Special Session April 30, 1986 #8 para 5 be changed from June 24th to read June 17th. Mr. Greenwald requested the minutes of Re~ular Session of May 61 1986 #9 A. line ~ "to be taxing on signs be changed to read to be appraising on signs". Mayor Sawyer called for a vote to approve the minutes as amended. The motion carried as follows: AYES: Council Sharpe, Stanhope, Baldwin, Aguilar and Greenwald. NAYS: None o o 12 HEARING OF RESIDElft'S: None 13 VARIANCE REOJES'l': Mayor Sawyer explained that Mr. 0 Kendall was reqUesting a 2 foot side yard setback variance. He owns two homes at the site. NAYS: None #4 ORDINANCE: Mayor Sawyer introduced an ordinance and the caption as follows: II ORDINANCE NO.86-S~ AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING THE ZONING ORDINANCE NO. 79-S-15 BY REZONING 2.087 ACRES OF LAND IN OAK FOREST, UNIT 4, OUT OF GUADALUPE COUNTY AND REFLECTING SUCH CHANGE ON CERTAIN ZONING MAPS IN ACCORDANCE WITH THE SCHERTZ ZONING ORDINANCE. ~r. Baldwin made the motion to approve the Ordinance amending the ~oning Ordinance No. 79-S-15 by rezoning 2.087 acres in Oak Forest Unit 4 to Office and Professional. Mr Sharpe seconded the ptotion. ~r. Greenwald explained that Mr. Simmons would have to build very xpensive Garden Homes to comply with current zoning. Mr. Baldwin sked if council would be setting a precedence by approving this brdinance. He advised that the zoning ordinance needs to be Irewritten to be able to exclude some types of businesses. ~r. Gilmore explained that if a new ordinance is passed prior to ~ew construction the new ordinance would apply. rayor Sawyer called for a vote which carried as follows: [ AYES: Council Sharpe, Stanhope, Baldwin, Aguilar and Greenwald NAYS: None ! #5 RESOLUTION: I baptioned as follows: I I i Mayor Sawyer read the entire resolution RESOLUTION NO. 86-R-IO,K A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, SETTING A TIME, DATE AND PLACE FOR PUBLIC HEARINGS PURSUANT TO THE PROPOSED ANNEXATION OF 29.176 ACRES OF LAND, MORE OR LESS, i OUT OF COMAL COUNTY. , ~R. Greenwald made the motion to approve the resolution setting Ipublic hearing for the proposed annexation of 29.l76 acres of 148 land out of Comal County. Mr. Aguilar seconded the motion which carried with the following vote: AYES: Council Sharpe, Stanhope, Baldwin, Aguilar, and Greenwald. NAYS: None nl U #6 CITY MANAGER'S REPORT: Mr. Gilmore advised that he had included in Council's packet a copy of the preliminary Sign Ordinance. He explained that they had been looking into renting street striping equipment and hac been unable to find a company that would rent one. Mr. Gilmore pointed out the letter from Division of Emergency Management concerning an Advanced Emergency Management Workshop on June 4-6. He advised that Ed Melton was on the agenda and that anyone who could attend would be welcome. Mr. Gilmore also advised that there would be and Economic Development Commission Workshop. Tom Anderlitch would be giving a talk on bonding at 7 pm, 5-2l-86 to which all department heads, boards and commissions had been invited. #7 ITEMS BY COUNCIL: Mr. Aguilar asked what they were going to build in the front part of the Trailer park development in the D. northwest part of Schertz. Mr. Greenwald advised that this area was general business. Mr. Stanhope asked that the trees being cut down and bulldozed down to the creek be looked into. He also advised that the Sign Ordinance had no penalty amount and there needed to be a dollar amount of penalty in the ordinance. Mr. Sharpe said that the Inspectors need to make a list of all signs and show those that have acquired a permit. Mr. Baldwin advised that Senior Citizen Day would be May 3l and those wishing to help should come around 6 pm Fr iday and 8 am Saturday. Mr. Sharpe advised that he had contacted Mr. Ross about doing something to the Community Center and Mr. Ross would be submitting something. Mr. Sharpe said that he had toured Pecan Grove Trailer Park and that Mr. Parker would probably be coming in requesting a variance. One this discussed was parking pads. He advised that the city's people should keep on top of things in the trailer park. Mr. Aguilar asked if something could be done about the landowner 0 behind Gutierrez land fill. Mr. Gilmore advised that the city had no jurisdiction and the problem had been turned over to County Judge Sagebiel. Mr. Sharpe said that bad accident at Jack Hays and Antler Drive shows the need to send a letter to the Highway Department pressing them to change the speed limit. Mr. Gilmore advised that the Highway Department would be out in approximately a month to do a traffic count at 3 location on Jack Hays. #8 ITEMS BY MAYOR: Mayor Sawyer advised that the Bond Committee had been formed and that after the meeting Wednesday night they would be getting together with the committee so that they could get citizen input on the types of bonds the citizens feel the city need. He asked Council to discuss the importance of bonding at community meeting they attend. Mr. Gilmore advised that he would have a prioritized list of needs. Mayor Sawyer advised that he would be leaving the City on May 28 for Hobbs, New Mexico and would not be at the workshop meeting that night. - I Mr. Aguilar advised that there was a need for a stop sign at Silvertree where it comes out onto Jack Hays Blvd. #9 ADJOURNMENT: On a motion by Mr. Stanhope and a second by Mr. Sharpe the meeting was adjourned at 7:44 pm.
