REGULAR MEETING OF THE CITY COUNCIL
JUNE 3, 1986
The Schertz City Council convened in Regular Session Tuesday,
June 3, 1986 at 7:00 p.m. in the Council Chambers of the
Municipal Complex, l400 Live Oak Road, Schertz, Texas. The
following members were present: Mayor Earl W. Sawyer, presiding;
Charles B. Sharpe, Hal Baldwin, Ray Stanhope, Adolph Aguilar and
Ken Greenwald. Staff present were City Manager Jimmy G. Gilmore
and City Secretary June G. Krause.
PUBLIC HEARING: After welcoming everyone to the meeting, Mayor
Sawyer opened- the public hearing, being held jointly with the
Planning and Zoning Commission, to receive citizen input
regarding two zoning changes. He then turned the meeting over to
P&Z Vice Chairman Bob Andrews.
Mr. Andrews explained that the first public hearing was on ZC#8l
to rezone the COR property from Pre-development to General
Business. The land is bounded by Borgfeld Road on the North,
Jack Hays Boulevard on the West, FM 78 on the South and the
landf ill on the East. Mr. Andrews said they would receive
comments from the public and then the Planning and Zoning will
have lO days in which to make a recommendation to the City
Council, wno will act on the zoning at their next regular
meeting. He then asked Mr. Simonson to point out on the map the
location of this property.
Mr. Steve Simonson, after showing on the map the location of the
property, said that three letters were sent out to adjoining
property owners. No replies were received.
Mr. Andrews asked if any citizen wished to speak pro or con on
this rezoning. No citizen came forward. As there were no
comments from P&Z members or the Councilmembers, Mr. Andrews
closed this public hearing at 7:03 p.m.
Mr. Andrews immediately opened the public hearing on the rezoning
request by Mr. Larry Thomas to rezone 77 acres of Northwood
Subdivision. The breakdown of land use is approximately 4.7
acres to Office and Professional; 11.7 acres to MUlti-Family and
the remaining acreage broken into R-5B and drainage. Said land
is located approximately l650 feet east of Jack Hays Boulevard,
bordered on the south by Green Valley Road; on the west by the
Kermit Harborth property; on the north by Green Valley Joint
Venture and on the east by the Frederick Schlater property. The
property is currently zoned R....l. Mr. Andrews said the same
procedures would be followed for this request as for the previous
one.
Mr. Simonson said 15 letters were sent out, with four being
answered and one verbal response. There were four people in
favor of the rezoning and one opposed.

Mr. Sharpe asked the size of the R-5B lots. Mr. Andrews said
~hey were 50 x 100 feet and were not zero lot line.
~r. Aguilar asked the average square feet of each unit.
~ndrews said no plans for houses had been submitted as yet.
Mr. Sharpe said he felt the City is getting a lot of small lots.

#3 ORDINANCE: Mayor Sawyer introduced an ordinance and

#3A ORDINANCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:
AN ORDINANCE
PROVIDING FOR THE EXTENSION OF THE BOUNDARY
LINES OF THE CITY OF SCHERTZ, TEXAS, BY THE
ANNEXATION OF A TRACT OF LAND CONTAINING
4l.744 ACRES MORE OR LESS, OUT OF GUADALUPE
COUNTY.
Mr. Stanhope moved to approve the first reading of an ordinance
on the proposed annexation of 41.744 acres of land out of
Gaudalupe County. Mr. Aguilar seconded the motion, which carried
with the following vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
#3B EXECUTIVE SESSION: Mayor Sawyer called for an
Executive Session under Ar-t'icle 6252-17 V.T.C.S. to discuss a flU
lawsuit involving Cibolo Water Contract, with Attorney Richard
Harris, at 7:17 p.m.
The Regular Session was reconvened by Mayor Sawyer at 7:42 p.m.
Mayor Sawyer said the executive session was called to discuss a
possible lawsuit that involved the Cibolo Water Contract. The
City had received a letter from Mr. Harp, Cibolo City
Administrator, saying that the City of Cibolo and the City
Council are asking the City of Schertz to drop the in~unction
against them and Green Valley. They asked to cancel the1r water
contract with the City of Schertz.

Mr. Sharpe moved to approve the request from Cibolo to cancel the
Schertz-Cibolo Water Contract effective immediately. Mr.
Stanhope seconded the motion.
Mayor Sawyer explained that this was a request by the City of
Cibolo, not Schertz. He then called for a vote on the motion,
said motion carried as follows:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None

#4 CITY MANAGER'S REPORT: A. Mr. Gilmore gave each
Councilman a copy of the outline f or the Economic Development
Plan that Council had requested he prepare. He said he feels
that this speaks to the need of an Economic Development plan and
Cornmi ttee. Mr. Gilmore asked that this be on the next workshop
agenda.
B. The Community Recorder has an article on the front page
regarding Schirmerville. This is a very good article.
Mayor Sawyer read a letter he was sending to Mayor Cisneros of
San Antonio, saying we are keeping San Antonio up to date on
actions Schertz is taking.
Mr. Gilmore said he had talked with Mrs. Fenner and she said that
there has been two or three calls to the San Antonio Fire
Department and they say "you are no longer in our city". Our
SAFES unit went out there and San Antonio EMS said it was their
patient and for SAFES to leave.
Mr. Greenwald suggested sending a copy of the letter to Mayor
Cisneros to the Base Commander.

C. Mr. Gilmore called attention to copies of letter from the
District Attorney which says the Appraisal District does have to
reappraise and one f rom the Distr ict' s own attorney that says
maybe you don't have to reappraise.
#5 ITEMS BY COUNCIL: Mr. Sharpe said that the City should
get a resolution setting forth our displeasure that the Appraisal
District did not do reappraisals this year and that for next year
they have time to get it done. Should be sent to the indiviaual
board members. The Seguin people have discussed about collecting
taxes for all entities but until they can appraise, they should
not get into anything else.
Mayor Sawyer asked the City Manager to work up a resolution
similar to one the School District passed.
Mr. Baldwin advised that although the rains caused the attendance
to be less, the Senior Citizen Appreciation Day activities went
well and everyone had a very nice time. He thanked everyone for
their help and participation.
Mr. Stanhope asked the date of the next Bond Committee meeting
and was told it would be held the next week.
Mr. Aguilar referred to the proposed bond elections and said we
should channel our thoughts toward something that can be
produced, that is feasible.

Mr. Aguilar agreed that the Appraisal Distr ict should not even
consider collecting taxes - just maintaining appraisals is enough
for them to do.

Mr. Aguilar said the Library Board and Humane Society cannot
thank everyone enough for everything that was done to support n
their auction and dance.

Mr. Greenwald said he had a meeting with the Eagle Scout this
same evening at 6:30 p.m. and he is starting to work up his plans
on landscaping this property. The Scout Master had asked him to
wait until school was out to get started.
#6 ITEMS BY MAYOR: Mayor Sawyer said he would like again
to point out to staff that when there is a joint meeting of
Council and Planning and Zoning on zoning, to have the area
outlined on the map. Mr. Baldwin said he had asked that Council
be given the same packet on zoning that the P&Z receive - it
contains names of those receiving letters and responses, a map,
etc.
Mayor Sawyer said he understands that SAFES did not request funds
from the United Way budget and that money was available.
A reminder that the Volunteer Fire Department S~pper will be held
this Saturday - June 7th - at the park pavilion.
Mr. Gilmore said he had a meeting with all the land owners in the
West Dietz Creek area to discuss drainage. The meeting was to
get them all together and come up with some plan for drainage.
Two engineers for the parcels that are wanting to get going are 0
putting together data for a drainage plan from Maske Road all the
way down to Dietz Creek. We will have another meeting after the
packets are put together so that we will be assured that it will
work when it is ready to be put in.
#7 ADJOURRIIERT: Mr. Aguilar moved that the meeting be
declared adjourned at' 8: l2 p.m., the motion was seconded by Mr.
Baldwin and unanimously carried.
