( I ~ 161 SPECIAL MEETING OF THE CITY COUNCIL JUNE 11, 1986 The Schertz City Council convened in Special Workshop Session, Wednesday, June ll, 1986, at 7:00 p.m. in the Conference Room of the Municipal Complex, l400 Live Oak Road, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presiding; Charles B. Sharpe; Hal Baldwin; Ray Stanhope and Ken Greenwald. Absent: Adolph Aguilar. Staff present were City Manager Jimmy G. Gilmore and City Secretary June G. Krause. PUBLIC HEARING: After welcoming everyone to the meeting, Mayor Sawyer gave the purpose of the public hearing as being to receive input from citizens on the proposed annexation of approximately 29.l76 acres of land out of Comal County. The land is located on IIH-35 between Hubertus Road and FM 482. There were no citizens wishing to speak for or against this annexation, nor any Councilmembers wishing to speak on this ,subject. Mayor Sawyer declared the hearing closed at 7:02 p.m. i I #l HEARING OF RESIDENTS: Mr. Gene Hall from Lone Oak ISUbdivision addressed Council -concerning a problem of sewage back :up in his home. He also had a complaint, along with other people [that live in his neighborhood, about the odor from CCMA's sewer [plant. Mayor Sawyer said the list had about l20 names of people ithat are objecting to the odor. IMr. Hall had some pictures to back up his complaint about the [sewer backup and over flow that was in his house and yard. He Isaid this is the third time he has appeared before a Schertz ICouncil. He said he does not have flood insurance. He has lived Ithere for about 15 years. He was concerned about the excess iwater in and under his home and had an estimate of $8000 to have lit attended to. He said that both he and his wife took tetanus ishots, although no one suggested that such precautions should be [taken. After giving some of his ideas of how the problem could ibe helped, Mr. Hall said that if he could not get some relief Ifrom the City of Schertz and CCMA, he will be prepared to go to lcourt. He said he did not feel he should be the scapegoat for Ithe City of Schertz on this problem. i IMayor Sawyer said he knew that the City of Schertz has fixed Mr. .Hall's sewer one time in the past. I [Mr. Stovall, who lives on River Road, said he agreed with Mr. iHall that this is not the first time, they have this problem levery time it rains it happens to one of the people in that area. I I IMr. Halls said the sewer line has been replaced by the city I sever al times. IMr. Gilmore said that according to his map, Mr. Hall's residence Iwas in the 500 year flood plain. The City did go there in 1984 162 and spent somewhere around $1400 to improve the sewer system in that area. We dropped the line, because prior to that it did not 0 have any drop in it. He said he did have the crew go out and shoot elevations - the sewer line to the outfall line has 9.96" fall. This should handle about l.4 million or llOO gallons per minute. The capacity of the sewer line could not carry the amount of water that came in, the manhole had to be lifted. The problem was that with the extremely heavy rain, there was more water than the sewer could release. The State was notified. In answering questions of Council, Mr. Gilmore said the whole system was overloaded - not just Lone Oak- with the record rain that we had. CCMA had a man at the plant dumping. This was not unique to Schertz, Randolph, San Antonio, Universal City and Converse all had similar problems. Mr. Baldwin said that there is valve to keep water from backing up into a water system. Is there a back flow valve to keep sewage from flowing into their house. Mr. Gilmore was asked to checR with the engineer to see if this would be feasible. Mayor Sawyer said that the petition on the odor has gone to CCMA and that he feels Mr. Gilmore has sufficient information to see what can be done on this problem. There being no further comments, Mayor Sawyer called for a short recess at 7:43 p.m. o Mr. AGUILAR ARRIVED AT 7:50 P.M., when the meeting was reconvened. #2 Discussion of an ordinance amending the water ordinance concerning fire hydrants and fire protection lines. Mayor Sawyer said that the first reading of this ordinance has been passed; and since there was no further discussion, this should be an agenda item for the l7th of June. #3 Discussion of amending the zoning ordinance by rezoning the COR property, located on FM 3009, to General Business. Mr. Sawyer advised that the public hearings on this had been held and this would also be on the next agenda. #4 Discussion of setback variance request of Mr. Parker - Pecan Grove Mobile Home Park. Mr. Gilmore said the setback line for Mobile Home parks is lO feet. There are several mobile homes that are placed closer than the required distance. At a meeting, with the Mayor present, Mr. Parker was told that the ones already there could remain, since the Inspector had approved them, but any new ones would have to 0 meet the requirements of the ordinance. i:,,/~~~JJ:<gr:~'i'" . 1!JiI:. / I 163 ~ Mr. Greenwald said the problem is that the gas line was offset along the easement line; but that is not our problem. The Gas Company will not allow you to built over the top of the line or even skirt over it. Mr. Gilmore said he did not know if the inspector knew where the gas company was putting their line because we do not inspect where they put their line. Mayor Sawyer said the agreement was that those that are already in place can remain but when they are moved out, they will be replaced with the proper 'setback according to ordinance. Mr. Greenwald said that if the mobile homes are placed closer thanlO feet, people will be walking right up to the trailer. After a thorough discussion by Council and Mr. David North, who represented Mr. Parker, Mayor Sawyer said he was hear ing that about 4 to 1 of the Council does not want to grant a variance. This will be on the next agenda. #5 Discussion of Economic Development Committee Plan. Mr. Sharpe said we need people on this committee that can take advantage of the training the State offers, such as TEXCEL. r-- Mr. Gilmore explained that this is a basic guideline f or the committee. He said he feels we could get the State people to come down here for meetings. Also Mr. Naylor offered to discuss industrial development and perhaps Barshop has someone also. Mr. Gilmore said his problem is going to be finding a coordinator from staff as this is going to be one of the more important committees. Council felt Mr. Gilmore should be the coordinator for this committee. They also felt it was a good plan and as it is used, it can always be changed or modified to meet needs. #6 Discussion of programming water billing to accept donations to Fire, SAFES, Library, etc. Mr. Tom Yarling of Thomas Software discussed with Council the possibility of adding a line to the water billing to allow citizens to donate in monthly increments to the City Department of their choice. Mr. Gilmore said he felt it best to get the opinions of the various department heads first. Council agreed we should first see if the various departments wanted to solicit funds. #7 Discussion of a proposed sign ordinance. -- Mr. Gilmore advised that the proposed sign ordinance had gone to the City Attorney, who has sent back his recommendations. ( 164 After Council discussion, Mayor Sawyer suggested sending the U"--' proposed ordinance back to Planning and Zoning and have them incorporate the recommendations into the ordinance. #8 CITY MARAGER'S REPORT: Mr. Gilmore reported that Mr. Bindseil had returned a certified letter to Mr. Greenwald and the letter was almost word for word the same as the one received from Mr. Ackermann. There will be another meeting with Bindseil and Ackermann and the Woodland Oaks people the next day to discuss drainage, etc. Mr. Gilmore said that after this meeting, he would like to have Council permission to present this to the lawyers. He said he did not know about the cost nor did he have any suggestions as to getting their cattle back and forth across Schertz Parkway. After further discussion, Mayor Sawyer asked Mr. Gilmore to make them a written offer for their land of whatever our attorney thinks sufficient. Received a letter from Dr. Tull, Veterinarian, and she is asking to hold a class in Schertz for about 20 people on July 8 or 9th and would most likely be during the day. Mr. Gilmore said it seemed to him our Library Conference room would be ideal. They also would like the Mayor to say a few words at the meeting. C. As you know, the subdivision ordinance is being looked at by P&Z. They have come to us with a recommendation about street signs. I think we should get this recommendation in the present ordinance and then it will be incorporated into the new version. This will be on the next agenda, with Council permission. D. Have a recommendation from P&Z and they are unanimously recommending rezoning 77.l9 acres of land, Northwood Subdivison. The preliminary plat shows that 4.7 acres are to be Office and Professional, 11.7 acres of Multi family and the remaining will be single family R5B and drainage. Mr. Greenwald advised that this is another Larry Thomas project. He showed pictures of what the Office & Professional portion 0 would look like. With reference to past discussions on the 5,000 II square foot lots, steve Simonson did some color coding on some recent plats that shows that even though developers ask for these ~, '~~~~'~-" ',.tA(),. r-- r- r- I I l 165 ~5B size lots, very few of the lots are under 6,000 feet. It rorks out to larger lots because of the drainage and topography. ~r. Gilmore said that he knows Council has discussed the smaller ots several times but he is at a loss to understand the problem. arge lot subdivisions do not pay for themselves. The way they are building now, the lot size does not have that much to do with ~he size of the house. I kr. I #9 ITEMS BY COUNCIL: Mr. Stanhope referred to the FM 78 By ass and showed on the map a route he prefers - crossing FM l5l8 (would take two bridges) back around Lone Oak and come back in at M 3009. But still make FM 78 four lanes. If we widen FM 78, he only thing we are doing is moving traffic - if we go with a y Pass, we open some different areas. I bayor Sawyer suggested not talking about selling bonds for FM 78 iOf you want to go with a by pass. We had talked about by passing oth Schertz and Cibolo in the past and no one wanted it. About he only thing diff erent with Mr. Stanhope's suggestion is the lover leaf he recommends for FM 3009. i i ~r. Greenwald suggested that Mr. Gilmore call Mr. Ehlers to see ~f they would even consider going with FM 3009. kr. Sharpe asked why we could not go with just plain four lanes for FM 78 and not have a left-turn lane - that would not take so Fuch right of way. . Mr. Stanhope asked why we can't get the weeds on the east ide of Cibolo Creek chopped down and cleaned up. If we have ots with weeds other places in the City, we get them to cut the eeds, so why can't we get those people who own to the middle of he creek to cut the weeds. At least we can ask them to clean hat area. ~r. Sharpe - A. To follow up on FM 78, is it mandatory to have a ~eft-turn lane? Mr. Gilmore will check with Mr. Ehlers. t. He noticed that half of the barrier at the low-water crossing as gone. Mr. Gilmore said that an l8 wheeler came across and truck it and just kept going. We are checking on it now. 166 C. Do we fine people for driving into floods - that drive around barriers. Mr. Gilmore said yes. D. Is Mr. Parker going to put up a stop sign coming out of Pecan Grove. Mr. Gilmore said Jerry Graham met with him and showed him where to put the signs. E. Mr. Sharpe asked for Thomas about dish washers other Council members said directed to be sent. Mr. Monarch Homes. a copy of the letter sent to Larry causing problems. Mr. Gilmore and they did not think the 'letter was Sharpe asked that one be sent to F. When is Larry Thomas going to start on phase II that is suppose to have the retention pond. Do not know for sure. Mr. Aguilar - A. Is there a parking sign about parallel parking at the new shoe shop on First Street and FM 78. Mr. Gilmore said yes, the sign is in place but people have been ignoring it. B. Mr. Aguilar reported on a meeting of the Transportation Task Force that he attended on Friday concerning all th~ improvements and changes that will be taking place. He said the new District Engineer was not aware of all the things that Schertz has planned for the I 35 area or FM 78. There will be a public hearing on the 25th at the Selma Church concerning the cross-overs at Selma and FM 3009. C. Mr. Aguilar announced that there would be an Austin-San Antonio Corridor meeting on Friday and that he would attend that before he leaves for vacation. Mr. Greenwald asked if any inroads on billing the people that were 'responsible for the damage to the ambulance had been made.
