REGULAR MEETING OF THE CITY COUNCIL JUNE 17, 1986 The Schertz City Council convened in Regular Session, Tuesday, June l7, 1986, at 7:00 p.m. in the Council Chambers of the Municipal Complex, 1400 Live Oak Road, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presiding; Charles B. Sharpe; Hal Baldwin; Ray Stanhope; and Ken Greenwald. Absent: Adolph Aguilar. Staff present were City Manager Jimmy G. Gilmore and City Secretary June G. Krause. PUBLIC HEARING: Mayor Sawyer explained the purpose of the public hearing was to receive citizen input on the proposed annexation of approximately 29.l76 acres of land out of Comal County. This originated with a request for annexation by Forbes Management, the owners. The land is located on IH 35 between Hubertus Road and FM 482. There were no citizens wishing to speak either pro or con on this issue, nor did any of the Councilmembers have any remarks. Therefore Mayor Sawyer closed the public hearing at 7:0l p.m. #1 APPROVAL OF MINDTES: Mr. Sharpe moved to approve the minutes of the Special Meeting of May l4th, Special Meeting of r-- May 28th and Regular Meeting of June 3rd, 1986. Mr. Stanhope seconded the motion, which carried with the following votes: AYES: NAYS: Councilmen Sharpe, Baldwin, Stanhope and Greenwald. None #2 HEARING OF RESIDENTS: Mayor Sawyer introduced Mr. Dennis Hayes, sponso~, and Ian Englefield, a Life Scout who is present because he is working toward becoming an Eagle Scout. There were no citizens wishing to speak. #3 RESERVE OFFICER: Mayor Sawyer called on Corporal Bundy, who introduced Larry Webb seeking appointment as a Police Reserve Officer. Cpl. Bundy advised that Mr. Webb has just completed the l45 hour reserve officer course and was recommended for appointment by three creditable persons. The Police Department staff feel that Mr. Webb will make a fine Reserve Office for the City of Schertz. Mr. Baldwin moved to appoint Larry Webb to the Police Reserve Force. Mr. stanhope seconded the motion, which carried with the following vote: r--- AYES: NAYS: Councilmen Sharpe, Baldwin, Stanhope and Greenwald. None i i ~ 168 Mayor Sawyer said he has known Larry for a long time and told him that the City Council will be happy to have him work for the 0 Ci ty. The Mayor went on to say that we all appreciate his volunteering to be a part of our city. #4 ORDINARCB: Mayor Sawyer introduced an ordinance and read the caption as follows: ORDINANCE NO. 86-F-l2 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING ORDINANCE NO. 8.3- F-7, SECTION XLII B~4 FIRE HYDRANT, CONNECTION FEE, DEPOSIT AND USER CHARGE; ADDING SECTION XLII 0 PRIVATE FIRE PROTECTION WATER 'SERVICE LINE CONNECTIONS, REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT. Mr. Greenwald moved to approve on final consideration an ordinanc.e amending Section XLII B. 4 of ordinance 83-F-7. Mr. Stanhope seconded the motion, which carried as follows: AYES: NAYS: Councilmen Sharpe, Baldwin, Stanhope and Greenwald. None #5 ORDIRARCB: Mayor Sawyer introduced an ordinance and read the caption as follows: o ORDINANCE NO. 86-A-13 AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEXATION OF A TRACT OF LAND CONTAINING 4l. 744 ACRES MORE OR LESS, 'OOT OF GUADALUPE 'COUNTY. Mr. Stanhope moved to approve final consideration of an ordinance on the proposed annexation of 41.744 acres out of Gaudalupe County. Mr. Baldwin seconded the motion, which carried with the following vote: AYES: . Councilmen Sharpe, Baldwin, Stanhope and Greenwald. NAYS: None #5-A ORDINANCE: Mayor Sawyer introduced an ordinance amending the zoning ordinance and read the caption as follows: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING THE ZONING ORDINANCE NO. 79- S-15, BY REZONING 77.19 ACRES OF LAND OUT OF o .. ~.... Mr. .~harpe seconded the motion. r. Sharpe said he would like to discuss again, as we have in . orkshop so many times, the subject of zoning so much to R-5. He isaid we should encourage developers to zone large lot sizes because on the small lots you are unable to site a house without ~aking trees down. This is something that is going to affect the Fity for years. Greenwald moved, saying it was his pleasure to make the ~otion, to approve the first reading of an ordinance on the proposed annexation of 5428.993 acres out of Bexar County. Mr. fharpe seconded the motion. ~ayor Sawyer said we have received word f rom San Antonio that I;hey are making final reading on the deannexation of this land rnd will turn it over to us by July l, 1986. ~r. Gilmore said we have passed the word to SAFES, the Fire and ~olice Departments that it will be ours after that date. NAYS: None o #9 VARIANCE REQOEST: Mayor Sawyer said that Mr. Parker has asked for a variance to the set back for Pecan Grove Park. Mr. Sharpe moved to approve the Planning & Zoning recommendation for denial of the request to vary the setback from lO feet to 6 or 7 feet. Mr. Greenwald seconded the motion. Mr. Sharpe said the point he wanted to make sure of is that we did hot make them remove the mobile homes that are already tied down. Mr. Greenwald agreed saying that Mr. Gilmore has told them that the 22 that are there can stay but if they are removed then the replacement will have to meet the ordinance set back requirements. Mayor Sawyer then called for a vote on the motion, motion carried with the following vote: AYES: NAYS: Councilmen Sharpe, Baldwin, Stanhope and Greenwald. We have a meeting with the r- Home Owners Association in Northcliffe Thursday, the 19th, in their Clubhouse. Everyone at the last meeting had heard rumors that Schertz would just go out and annex them without telling anyone so we assured them we had no intention of doing that. ,.---. ~ Mayor Sawyer, who had attended the last meeting also, said that they were invited out there without really knowing what the people had in mind. There were some that wanted to incorporate, some wanted annexation by Schertz and some liked the way they are now. They asked a lot of questions and we feel we made a few converts. Mr. Gilmore said that as far as annexing them was concerned, they could see the benefits but wanted to know how it was going to hit them in the pocketbook. B. Mr. Gilmore said he has called a Bond Committee meeting for next Wednesday, our workshop night, because that is the only night that Mr. Anderlitch had free. He said he sent Mr. Anderlitch some priorities for projects so that he could work out some schedules for tax increases, etc. C. Received letter from Tom Vickers, Bexar County Judge praising our Volunteer Fire Department for their help. D. As requested by Council, staff approached Southern Pacif ic Railroad to see if there was a possibility of getting some right of way from them. They replied that they had forwarded the request to Dallas office but feel the project is feasible. We have taken action and are continuing to work out some means of widening FM 78. Mr. Baldwin asked if the City has done anything or do we intend to help control dangerous chemicals that go through town. Mr. Gilmore replied that the Fire Chief says that seminars will be set up to discuss this and try to develop some type of plan. The Railroad is aware and they are trying to help the cities. Mr. Stanhope asked if the City has a plan and was told that we do have a plan and that according to the State our plan is the best one in the state. Mayor Sawyer explained explained about being involved with two of the exercises held by Emergency Management - one was state wide Twister II, the last one was a simulated tornado and we evacuated the senior citizens on that one. He said the State has complimented Ed Melton to me on both occasions. On the last one our city staff were involved. Afterwards, the State has a de- br ief ing to find out what happened, what went wrong or right, iwhat questions were asked, etc. Mayor Sawyer said that Ed Melton Ihas asked to join with Universal C1ty to get one truck equipped, complete with uniforms, for a chemical type accident. 172 Mayor Sawyer introduced Mr. Paul Brown, saying that he had spent the day with Mr. Brown on the industrial tour. Mr. Brown, from Ohio and representing Forbes Management, informed Council that he and his partner have just purchased additional land on IH35, at Hubertus Road, and hope to do something with the land that everyone will be proud to have in our city. He expressed his appreciation to Schertz, saying that they have gotten nothing but excellent cooperation from staff, who are ~retty efficient. He said Schertz is a darn nice place in which to conduct business. He said he enjoyed the tour and had suggested that it be an annual affair. #11 ITEMS BY COUNCIL: Mr. Sharpe said it looks as if they are putting up a fence~in the front yard at 2804 Cedar Lane. Also there is a house in Woodland Oaks that is for sale by Realty World and the weeds are about neck high. This is at 2700 Lockwood. Mr. Sharpe asked if the str~eet that had the damage has been dedicated to the city. Mr. Gilmore said the street is being fixed by the contractor. o Mr. Sharpe mentioned that there are some big gouges in some of the streets. Mr. Gilmore said there was a meeting last week D concerning these gouges and they are being addressed. Mr. Baldwin said that there is a lot of erosion on East Live Oak Road. Mr. Gilmore said that although the Highway Department put the road in, right now it is our problem. We had a lot of damage due to the heavy rains and have set pr ior i ties to get these fixed. Mr. Baldwin announced that Mr. Ray Corbett died this past week and the family has started a memorial fund in his name and the funds will be used for improvements to Ray Corbett School. Mr. s'tanhope referred to the Streets and Parks monthly report and ask if the gallons and mileage were correct for the sweeper and is the low mileage a seasonal problem. Mr. Gilmore said it is seasonal but the figures given do not sound correct . He will check. #12 ITEMS BY MAYOR: Mayor Sawyer said he had the privilege of attending the Greater Randolph Metrocom tour and thought it was well thought out. He said that Mr. Brown would probably write a letter of commendation and that the Mayor had written Mr. Chadwick thanking him. Mr. Sawyer said there was an offer from Major Toothaker to take 0 video pictures' of the 'areas that we would like for bonding purposes. Then we would have the tapes for an organization that might be interested.
