REGULAR MEETING OF THE CITY COUNCIL

~he Schertz City Council convened in Regular Session, Tuesday,
July 1, 1986, at 7:00 p.m. in the Council Chambers of the
Municipal Complex, 1400 Live Oak Road, Schertz, Texas. The
following members were present: Mayor Earl W. Sawyer, presiding;
Hal Baldwin; Ray Stanhope and Ken Greenwald. Absent: Councilmen
Adolph Aguilar and Charles B. Sharpe. Staff present were City
Manager Jimmy G. Gilmore and City Secretary June G. Krause.
I #l APPROVAL OF KIRJTES: Mr. Greenwald moved to table
I'action on the minutes of'the Special Session of June 11, 1986 and
Regular Meeting of June l7, 1986 as the minutes were not
I'available. Mr. Stanhope seconded the motion, which carried with
the following vote:

b. Mr. Ed Mazian of Deer Haven called Council attention to the
Ipotential hazard created by the street markings in front of our
~unicipal building. The double yellow stripes goes to the left
land then there are no markings. Mayor Sawyer informed Mr. Mazian
ithat the City is trying to get bids on street stripers now.

#4 ORDINANCE: Mayor Sawyer introduced and ordinance and
the caption as follows:

ORDINANCE NO. 86-A-l5
AN ORDINANCE PROVIDING FOR THE EXTENSION OF
THE BOUNDARY LINES OF THE CITY OF SCHERTZ,
TEXAS, BY THE ANNEXATION OF A TRACT OF LAND
CONTAINING 5143.729 ACRES MORE OR LESS, OUT
OF BEXAR COUNTY.
Mr. Greenwald moved to approve, on final consideration, the
ordinance on the proposed annexation of 5134.729 acres of land
more or less out of Bexar County. Mr. Baldwin seconded the
motion, which carried with the following vote:
AYES: Councilmen Baldwin, Stanhope and Greenwald.
NAYS: None
Mayor Sawyer said we are happy to have the residents of
Schirmerville as citizens of Schertz. They petitioned San
Antonio to release their area about one year ago, since San
Antonio could not furnish them services. We feel we can furnish
them some of these services.
#5 ORDINANCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:

ORDINANCE NO. 80-S-l3, ARTICLE III, SECTION

Mr. Baldwin moved to approve, on final consideration, an
ordinance amending the subdivision ordinance section on Street
and Traffic Control Signs. Mr. Stanhope seconded the motion,
which carried with the following vote:

I #7 BANDIT SIGNS: Mayor Sawyer introduced Mr. SuIt of Crow
pevelopment who had requested time to speak on this item.

r. Sult said they were the first to request to put up bandit
igns on FM 3009 on the weekends. He said they were granted
pproval limited to ten each for Thistle Creek and the builders.
n June, Planning and Zoning rescinded the approval for the
evelopers, saying they were in error originally.

Mr. SuIt went on to say that the builders need to sell their
~ares and the developers also need to sell their wares. He said
he would like for the Council to overrule this decision by the
f&Z and allow them to erect their signs.
Mayor Sawyer said the reason the P&Z rescinded the request was
~ecause they feel the ordinance does not permit the developers
rut does allow the builders to erect these bandit signs.
~r. Greenwald mentioned that Mr. SuIt was given authorization for
puilders signs; but the ordinance prohibits signs for those not
~ithin the city limits.
ayor Sawyer said Council had invited our attorney out to this
eeting because they felt there might be possible litigation from
Fome. of the builders. This will be discussed in executive

S. Baldwin asked if any other developers have signs on FM 3009.
en told there were none, he said then we are not just being
rbitrary. Mr. SuIt agreed the Council was not being arbitrary.

Mr. Stanhope asked if Mr. SuIt had his signs up on IH35 and FM
~8. Mr. SuIt said they did but he still feels they are losing
~usiness. Mr. SuIt did say that he appreciates the Council
ellowing him to have his big sign at the corner of East Live Oak
road and FM 3009.
I #8 EXECUTIVE SESSION: Mayor Sawyer called an executive
~ession under Article 6252-17 of Vernon's Texas Civil Statutes,
$ection 2 (e) for two items: A. possible litigation regarding
sign ordinance; and B. possible litigation regarding flood
faters. The session was called at 7:l8 p.m.

Mayor Sawyer announced that with regard to the possible
litigation regarding the sign ordinance, our legal staff needs
more time to study the ordinance before making a statement. With
regards to the possible litigation regarding flood waters, this
is a unique problem and legal staff needs full reports from CCMA
and our engineer. Mr. Gilmore is instructed to arrange an early
meeting.
#9 CITY MANAGER'S REPORT: A. We will have the amended
sign ordinance for the next workshop.
B. Received a letter from the Guadalupe County Judge. The
County is now working on their budget and have asked that the
City of Schertz prepare a written funding request for SAFES and
the Library.
C. Mr. Joe Tudyke of Wiederstein Road has been in several times
to discuss conditions of Wiederstein Road. We have leased a
machine and worked both this road and Maske Road. Mr. Tudyke has
suggested seal coating the road.
Mayor Sawyer said we will ask Mr. Tudyke to be on our Bond
Committee. Mr. Gilmore said we have increased our police patrol
in that area also, especially on the weekends.
D. Mr. Stanhope made a written report on the meeting he attended
in Arlington. It is a very good report.
E. Mr. Gilmore suggested that Council consider the possibility
of passing a weight limit for East Live Oak Road. This road was
not built for handling 18 wheel trucks weight. Council asked
that this be on the next workshop agenda.
#lO ITEMS BY COUNCIL: Mr. Greenwald reminded everyone to
plan to attend the 4th of July Jubilee .
Mr. Stanhope said he attended service at the Baptist Church and
they put on a real good time for elected officials.
Mr. Stanhope said there is a residence on Maple that has about 40
chickens, plus other fowl and animals. The stench is terrible.
Mr. Gilmore said this is being addressed now.
Mr. Baldwin asked the condition of Officer Gilbert. Mr. Gilmore
reported that about 2: 30 a .m. on Monday, Off icer Gilbert was
handling traff ic on the I35 access road and had stopped to
investigate a suspicious person. He was hit by a pickup truck
that failed to stop. He was able to use his walkie to call for
help. He will be in the hospital for two or three more days for
observation, no bones broken. We have no leads on the pickup nor
the person he stopped to investigate.

Mr. Baldwin asked about stop signs in the Schirmerville area.
Mr. Gilmore said he has had the street people out there placing
signs and they will be ordered and placed as soon as can be. Mr.
Gilmore said he is planning to ask the citizens of that area to a
meeting soon to meet with all our supervisors to get acquainted
and be able to ask questions, give them emergency number
stickers, etc.
Mayor Sawyer asked if the City had received the resolution from
San Antonio releasing that area. Mr. Gilmore said they have
passed the resolution and should be sending it to us today.
Mayor Sawyer asked that a police officer go to that area at least
once each shift. Mr. Gilmore said the police have been
instructed to stop and talk with the people to get to know them.
