The Schertz City Council convened in Special Workshop Session,
Wednesday, July 9, 1986, at 7:00 p.m. in the Conference Room of
the Municipal Complex, 1400 Live Oak Road, Schertz, Texas. The
following members were present: Mayor Earl W. Sawyer, presiding;
Ray stanhope, Adolph Aguilar and Ken Greenwald. Absent:
Councilmen Hal Baldwin and Charles B. Sbarpe~ Staff present were
City Manager Jimmy G. Gilmore and City Secretary June G. Krause.

12 Discussion of an ordinance providing notice to City
Council of property damage.
This ordinance is one prepared by TML, who asked that we approve
it to comply with our insurance program. Mayor Sawyer asked that
this ordinance be on the next agenda; and in the meantime secure
our legal advise.
13 Discussion of an ordinance on the proposed annexation of
29.176 acres of land out of Comal County.
Mayor Sawyer advised this is the additional property requested
for annexation by Forbes Management. This also to be on the next
agenda.
14 Discussion of recommended changes to P&Z Rules of
Procedures.

Mr. Aguilar had some questions concerning the difference between
taxpayer and renter; and it was determined that a renter in the
long run is a taxpaper.
MR. BALDWIN ARRIVED AT 7:08 P.M.
Mr. Aguilar also question section 207 on voting. It appears that
the Chairman must vote. Mr. Wilman said that was for
clarification since now the question always arises as to whether
or not the Chairman is to vote.
Mr . Gilmore had deleted the phrase .owners of real estate in the
cityR from Section lOl Organization, saying this is a breach of
one's civil rights.
Council wished to add RdR to Section l03 E. (2) Expiration of
term of office.
There being no further discussion, Mayor Sawyer asked that this
be on the next agenda.
IS Discussion of the possibility of approving a weight Of
limit on East Live Oak Road.

Mr. Gilmore said the problem is that we have large trucks driving
on that road and it was not designed for heavy vehicles. He said
he did not have a suggested limit as yet but would check for a
recommendation. Council briefly discussed various weight limits
on different types of roads.
#6 CITY MANAGER'S REPORT: A. The week of July 2lst, we
will have people assigned to get the park in good shape for the
tournament. Also BVYA has asked that they change the color of
the park to blue and gold. They will buy the paint and we will
paint the bleachers, etc. We were going to have to paint anyway
but were going to use the green. Also we will have to get word
to them that BVYA is responsible for keeping the restroom and
concession clean.
Mr. Stanhope said that if BVYA is making a profit, then some of
that profit should come back to the city. Mr. Greenwald advised
that even though they may make a profit from the tournament, that
money is used throughout the year for their programs.
B. Received a letter from Judge Sagebiel asking that the City
put something in writing requesting funds from the County Budget
for both SAFES and the library. Sent a letter asking for $40,000
for SAFES and $2l,000 for the Library.
C. Received a new proposed franchise agreement from Entex. The
current one is expiring this year and about the only difference
is the new one is for 30 years rather than 25 years and they have
new paragraphs setting out the payment of the 2% gross tax.
D. As discussed with our attorney, CCMA is meeting Thursday
night to discuss Mr. Hall's flooding problem. If there is a
settlement, it has been recommended that the City pay one half
and CCMA pay one half. Attorney Harris will do the paper work.
The two engineers have met and now all information will-go to the
, CCMA Board Thursday night.
E. Mr. Gilmore gave out the proposed. budget for fiscal year
1986-87, Which includes a schedule of workshops. If anyone has
questions concerning the budget, stop by Mr. Gilmore's office
where he has all the backup material and he will be glad to
discuss it. Mr. Gilmore said that because of the growth of the
City, he has asked for several additional employees. This budget
is prepared using a 3% tax increase (whiCh amounts to one cent).
The employee increases include tenure and they go into effect on
January 1, 1987. The Court cases are eating into the water
budget. Mr. Gilmore asked Council to continue studying
information given them concerning' water rates. We need to
increase the base rate. Mr. Gilmore briefly went over portions
of the budget with Council.
#7 ITEMS BY COUNCIL: Mr. Greenwald said that with the new
Council in-New Braunfels, perhaps it is time we go back to them

and discuss the ETJ on the 500 feet between our cities on IH35.
Mr. Gilmore said that 500 foot is really New Braunfel's as we
went to their ETJ when we annexed.
Mr. Greenwald said that we should send a letter to Mr. Morris of
the Appraisal District saying that we do not even want to
consider letting them collect taxes for us.
Council discussed this issue, with Mr. Baldwin saying that if the
school district and cities ever have enough confidence in the
appraisal district, it could save each money. Mr. Baldwin said
the County Tax Assessor/Collectors across Texas want to take over
the Appraisal Districts but that would really be bad because the
County Tax A/Cs are elected officials and they may not be
qualified.
Mayor Sawyer said to write to Mr. Morris and tell him we do not
want to discuss them collecting taxes for us now or in the
forseable future.
Mr. Stanhope asked if there was any provision whereby we could
cut the grass on the right of ways and bill the State. Mr.
Gilmore said no.
Mr. Stanhope also mentioned that there are large trucks pulling
up across FM 78 from the Golden Cue at noon and parking there
while they' go in to eat. It could be a traffic hazard besides
being in a no parking zone.
Mr. Baldwin asked if Woodland Oaks is beginning their second
phase. Mr. Gilmore said they are coming in with plats but have
not started yet. Mr. Baldwin then asked if unit one was built
out. Mr. Gilmore said that Gemcraft Homes has bought the last 40
lots. Mr. Gilmore said that Savanna Square is already cutting
the road clear through to Schertz parkway. Also Greenshire is
starting.
Mr. Gilmore said Pecan Grove came in for addition permits and was
refused any permits until they come in and indicate what slabs
they wish to designate for RVs.
Mr. Greenwald said we will probably be hearing from Pecan Grove
on replatting. They have a section that is suppose to be for RV
park already on the ground that does not meet the platting. They
are changing the engineering. Mr. Gilmore advised that they went
in and did c~nstruc~ion without looking at the plans.
Mayor Sawyer said he felt Council should let our City Manager go
with the ordinance. Mr. Sawyer said he thought what Mr. Gilmore
was worried about is that Council would back down and not abide
by our ordinance. Mr. Gilmore needs Council assurance that they
will abide by the ordinance. Council agreed and indicated they
intend to stand by our ordinance.

Mr. Baldwin said his problem with Mr. Parker is that if somebody
does not serve him with papers, he will continue to bring
trailers in. Mr. Gilmore saia he has told Mr. Parker that if he
brings in one trailer, we will put a Cease and Desist order on
him.
Mr. Baldwin said he had sent out letters to all the people that
helped with the Senior Citizen Day activities, and thanked Mrs.
Krause for getting the letters typed.
Mr. Aguilar mentioned that in the summary Mr. Stanhope did of the
Arlington meeting, it says 'whenever the number of persons
meeting equals a quorum, it is illegal'. Mr. stanhope said that

some signs saying where the library is located - they were
furnished by someone. The signs have come in but they have not
been put up. Mr. Gilmore said he was not aware they were in but
would see that they get placed.

Mr. Aguilar said he was sorry he was not present for the 4th of
July Jubilee but he was told that there was a lack of things for
children. He said the reason he brings it up is that it seems
the City should take a larger part in this celebration. The
Business Club is getting less members all the time. The idea of
this Jubilee is to keep people off the roads during the holiday.
We should give the people something more.
Council agreed, although some felt the 4th of July was not a good
day to have something of this type. But if it is to continue,
the planning should be started now for next year. Mr. Gilmore
said in talking with the Business Club, they are not even wanting
to do it any more. Now would be a good time to go to them and
ask them to release it to us.
18 ITBIS BY MAYOR: Mr. Sawyer said he had talked with Paul
Daivs of the Herald News telling him we have not been getting a
lot of publicity. He said the paper is going to change again and
Mr. Davis feels he will have more control. The Mayor said he
talked about some of the really big things Schertz has been doing
that are not even mentioned. Mr. Davis promised to do better by
us.
Mayor Sawyer said Council needs to really look at the water base
rate. Also capitol recovery fees are too low, they should be
increased to at least $750. Mr. Gilmore said he was getting some
r- information on that and would be bringing it to Council.

Mayor Sawyer said he had received a letter from CCMA as~ing us to
back them on' getting the drainage behind CCMA instead of in
front. He read a letter of support. he was sending oat.
Mr. Sawyer mentioned there seems to be' an extra large number of
junked cars in the City. He said he did not think the pOlice are
looking to see if that have up to date stickers, etc..
The City received a letter froin Northcliffe Fire Deplutment
thanking us for coming up there to discuss mutual problems. .

Mr. Aguilar announced that on July 24th, the Library will have a
party for all' children bp'rn 'in 1986. The children "ifl be 9'iy~n
some type of S esquicenteriial certificate of birtp~.
Mayor Sawyer said he had met with Mayor Kerkow of Universal City.
They discussed the area on FM ISl8. in Universal c:ity's m'J.
Mayor Kerkow said he did not "think his people would go for him
giving away the area without getting something in return. 'He
talked about something with water in Selma. He seemed to be very
amenable to pulling back but don't know what we have to trade.
Mayor Sawyer said he would be meeting with the Council of Mayors
the next night and he intends to appoint Jeff Duffield as our
representative to the E.M.S... ,
Mr. Greenwald mentioned that there is a ~ady running ~ compu~er
service inCibolo and her pickup and drop off point in Schertz is Dr
listed as the Schertz small pavilion. It is stated that way in
her advertisement.
Mr. Sawyer said we should send the Health Officer to the house on
Maple Drive where they have so many chickens, ducks, etc.- the
stench is overpowering.
