The Schertz City Council convened in Regular S ess-ion, Tuesday,
August 19, 1986, in the Council Chambers of the Municipal
Complex, 1400 Live Oak Road, SChertz, Texas, at 7:00 p.m. The
following '.embers were present: Mayor Earl W. Sawyer', presiding7
'Charles B. Sharpe; Hal Baldwin7Ray stanhope; Adolph Aguilar and

minutes of the Special Meeting of July 30, 1'986'.' Mr. Greenwald
seconded the motion, which carried with the following vote:

Mr. Aguilar moved to approve the final consideration of an
ordinance rezoning 43.613 acres of land out of Comal County. Mr.
stanhope seconded the motion, which carried as follows:

Greenwald.

Mr. Greenwald moved to approve the final consideration of an
ordinance authorizing the City Attorney to furnish legal defense
to the members of the Council, P&Z and other city officials. Mr.
Aguilar seconded the motion, which carried as follows:

OF THE VARIOUS DEPARTMENTS AND FOR VARIOUS
ACTIVITIES AND IMPROVEMENTS OF THE CITY; AND

!Mayor Sawyer said this budget has been worked on by the Council
~t several meetings and appears to be a very good budget.
. r. Sharpe moved to approve the budget which begins October 1,
1986, in the amount of $2,905,542. Mr. Baldwin seconded the
,motion. ,
~ayor Sawyer explained that this amount is a cut of $13,125 from
!the proposed budget.
~r. Sharpe agreed that the amount given was a reduction of
$13,125, saying that he had a lot of trouble with this budget.
This equates to about one cent ,on tax. rate, which is what this
budget was based on.

~r. Aguilar said one of the big things Council had with the
ibudget was the Streets and Parks Departments. This is the first
!year the departments have been divided. This coming year we
IShoUld maintain clear records so that it will be easier to work
with the budget next year. These two departments had tremendous
lincreases. Mr. Aguilar said he did agree that the two
idepartments should be separated.

r. Baldwin said he was also concerned with the Streets and Parks
and he is still not convinced it is justified. He said the
olice and water departments did not increase near as much. He
said he felt" the cu,t Mr. Shar~e has recommended is essential.
r. Baldwin said he di~ not thlnk the public would support this
ouncil if they did not make every effort to cut where the can.

Mr. Greenwald asked Mr. Sharpe where he got the cuts. Mr. Sharpe 0
said he went back two or three rears and compared budgets';; " Mr.
Sharpe said he feels this wi 1 still let the City provide
services and keep costs down.
Mayor Sawyer called for a vote of the Council and the motion
carried as follows:
AYES: Councilmen Sharpe, Baldwin, Stanhope, and Aguilar.
NAYS: Councilman Greenwald.
.6 CIft ~1Il'S RJIP01lI1':. A. There will be a meeting with
the developers next week to' discuss drainage on East Live Oak
Road to Dietz 'Creek. The Highway Department is letting bids on
FM 3009 and we have to have our plans coincide with theirs.
B. Two subdivisions came in with plans to start construction of
their second units - Savanna Square and Woodland 'Oaks.
.7 I'!rJIIS, BY COURCIL: Mr. Sharpe asked if the meetings on
drainage will "include' the two properties Ackermann and Bindseil.
Mr. Gilmore said no, only the ones that are cooperatin9. We have
gone out with additional letters to those two men because we had
no response to the first letters.
Mr. Sharpe' asked if the electrical would be underground on 0
Schertz Parkway. Mr. Gilmore said we have not gone that far yet
but it has been talked about.. The electric company has to have
easements on the back end of the properties. One of the problems
is the division of services between GVEC and CPS.
Mr. Greenwald said they are looking at obtaining the rear
easements and just have overhead for commercial and industrial.
"r. Baldwin said he made a trip to the back of the trailer park
(Pecan Grove) at the reques~ of residents. The rQad out the back
is narrow and the residents are concerned about the amount the
traffic has increased. The road is full of ruts and in terrible
condition. Mr. Baldwin said that on the maps, it looks like part
of that road is in the city limits.
Mr. Gilmore said that it is only an easement, not a road. At
first- Mr. Parker was, going to block the entrance from the park;
but .sinc~ that time he says that he has as much right to use it
as anyone. Our attorney agrees that he is right.
Mr. Baldwin said the man sat right here and said he would keep
that road closed. E'leryone agreed.
Mr. Aguilar asked why the City could not put up a barrier. Mr.
Gilmore explained, that the City can't .because we do DOt own the 0'
property. Then Mr. Aguilar asked if we could ask the owners if
n could put up a gate so that it could be opened in case of

emergencies. Mr. Gilmore said he knows of nothing the City can
do.

Mr. Baldwin asked the status of the sign (advertising Pecan
Grove) on FM 78. Mr. Gilmore said that Mr. Harris has all the
reports and we should have something right away. Answering
furth er questions by Mr. Baldwin, Mr. Gilmor e said th e man did
not get a permit; but we have about two dozen signs along FM 78
that do not have permits either. We are gathering information on
them all.
Mr. Sharpe said that several months ago, Council had asked for an
inventory of all signs in the city, including the ones covered by
the Grandfather clause. mr. Gilmore said we 'did not have the
inventory as yet but if Council wants to put a higher priority on
that project, we will certainly get it done.
Mayor Sawyer polled Council and the majority wanted this to have
a higher priority, to start work on the inventory by the
following week.
Mr. Baldwin said that one more time he would like to emphasize
that if we are not getting information back from the City
Attorney, he thought we should consider getting someone else to
take care of some of the little things that tiappen around the
city. He said he has all the respect in the world for Fulbright
and Jaworski, especially Richard Harris, but if they are so busy
r- that they can not help us, then something should be done. Mr.
i Gilmore said that there is only one Municipal Attorney in the
southwest and reminded Council that they appoint the attorney.
Mr. Stanhope said he wanted to say thanks to Mr. Gilmor e and
staff for preparing the budget.
Mr. Aguilar asked if during discussions on East Live Oak Road and
Dietz Creek, were they going to talk about moving the flow to the
back of CCMA. Mr. Gilmore said no, that this meeting was
concerning the other side of FM 3009. Mr. Aguilar asked if there
was any information concerning changing the flow. Mr. Gilmore
related that there is some favorable discussing coming out now.
Mr. Greenwald asked that concerning the drainage at Oak Forest,
is there any way we could pay the State to do this or at least be
included in their contract. Mr. Gilmore said there is a
possibility.
18 ITEMS BY MAYOR: Mayor Sawyer said he felt Council has
passed a good budget.

Concerning City Attorney Harris, Mayor Sawyer said if Council is
not happy with Mr. Harris, when he comes to the next Council
meeting to discuss with him their concerns. The firm has some
young attorneys that might be able to work with us.

Mayor Sawyer added two items to the Bell Ringer list, namely,
Sign Ordinance and Sign Inventory.
