ccswks 09-10-1986 228-" ----.-- SP&:IAL SIBSIOR OF THE CITY cOORCIL SEP'lBlBm 10, \ 1986 o The Schertz City Council convened in SpeCial Workshop Session, Wednesday september 10, 1986, at 7:00 p.m. in the Conference Room of the Municipal Complex, 1400 Live Oak Road, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer; Councilmembers Charles B. Sharpe; Raymond Stanhope; Hal Baldwin; Adolph Aguilar; and Kenneth Greenwald. Staff present were City Manager Jimmy G. Gilmore and Deputy City Secretary Alice Austin. II BEARING OF RESIDPB.IS: Mr. Bill Neller of 305 Koch Street addressed the council concerning abuse of a dog at 814 Curtiss. He advised that he had heard the dog whining and upon checking found the animal tied with a short piece of rag. At approximat~ly 8:30 he had heard a noise of chairs being turned over and found the same animal in his back yard -with a 4 foot piece of rope and a 4 foot piece of 2 x 4 tied to him. He advised that he had called to have the animal control come out and pick up the animal and was told that they only came out in an emergency situation after hours. Be was advised to fasten the dog up and the animal control would pick it up the next morning. He untied the animal from the 2 x 4 and it ran away. Mr. Neller also addressed council concerning a new program described in the August issue of Readers Digest. The program is called "Have you tagged your child today". Mr. Neller advised 01' that he had ordered 25 to show to the school and he felt that if . the school did not want to by them that he had approached the VFW and they would by them. He said he felt that the tags would help a child in an emergency situation. 12 Consideration, of P&Z recommendations on vacating Beacon Street south of Curtiss. It was explained that the property was used for a utility easement. A suggestion was made to give the property to the lady who's propertY,it abutted. #3 Discussion of a resolution of Noncompliance, Schertz Modular Park, Unit I. Mr. Gilmore explained that letters had been sent to Mr. Parker advising him that no permits would be issued for the disputed area until the violations have been corrected. Be explained that Mr. Parker had done things in the park even violating the variance that council had granted. The Resolution will be filed with the plat in the County to warn potential buyers of the restrictions. Political Signs to allow signs to be displayed 6' days prior to the election. C ange: Article VI, Section 2. To prohibit the parking of a vertising vehicles or trailers on public right-of-way or on p blic property. To limit parking of advertising vehicles or t ailers on private property to no longer than 48 hours without a p rmit. I ctange: Article VIII, Section 7, Bench Signs to allow them on p ivate property with proper maintenance. Not allow them on P1blic right-of-way or public property. Sharpe requested that this item be passed and if time allowed d"scussed after other items had been taken care of. #6 Discussion of annexation along FM 482 and FM 2252. Mr. Gilmore advised that annexation of this area would allow the city control over what is built in the area. Mr. Baldwin ask if we were going to have a restraining order placed against us if we d~ annex the area. Mr. Gilmore said that he felt that if we had went back at them before the city could have won. C ncensus of Council was to proceed with annexation procedures. , 230 .7 CITY MANAGER'S REPORT: Mr. Gilmore asked Council if they wanted to put the City's 1/4 page ad in the Chamber of Commerce Membership directory. Cost would be $75.00. Consensus of Council was yes. Bids for drainage under FM 3009 would be let sometime this month by the state. Mr. Gilmore requested that City go out at same time for Crest Oak Drainage. He advised that we may be able to get the same contractor as the state and save some money. Mr. Aguilar asked if we had the release from Mr. Simmons for Circle Oak. Mr. Gilmore advised that we had not yet received the release but it was in the works. o Concensus of Council was to go out for bids. Mr. Gilmore advised that council had been given a copy of request for final modification of 1985/86 Budget. He explained that the jump under Animal Control was because of contractual and the problem causing the increase had been taken care of. The increase to street & Park was due to vandalism in the park and break-in at the pool. Council requested that the final modification be brought to them next year when they were working on budget. They advised that a closer year end estimate would aid them in budget preparation. Mr. Gilmore advised Council that the budgeted tax figure had been l~J. i given to the City by the Appraisal District and was in error. He advised that the figure would place the city approximately 7 million dollars short. He advised that a 3% increase will not bring in the budgeted amount, it would take a 6.8% increase. Council agreed that they preferred not to increase to the 6.8%. Mr. Gilmore advised that he could adjust some other items of income to cover the $20,000 dollars needed therefore not requiring any increase except the 3% originally requested. Concensus of Council was to go with 3% or .4128 per 100. Mr. Gilmore advised that the individual involved with the ambulance might settle out of court. He advised that we were asking for the full amount plus attorney fees. Mr. Gilmore advised that the FBI has been out and talked to two policemen concerning a civil rights complaint filed by two people in the apartments. .8 ITFMS BY COUNCIL: Mr. Aguilar asked if the City had a list of handicapped people. Mr. Gilmore said he wasn't sure but he thought SAFES had a list. Mr. Sharpe advised that Commissioner Jim Brannon's grandson had died. Mf" Gilmore said he would have John Bierschwale check this out. M. . Sharpe advised that he had attended a program given by TEXCEL c ncerning helping existing businesses. He said that it was v tal to get to know local businessmen and let them know that we a preciate them being here. He advised that statistics show that 8 % of new business comes from expansion of existing business. A other part of the program concerned grants. He advised that t ere were many private foundations which have money for w rthwhile projects. Need to check into some of these f undations. I I M~.. Sharpe advised that the Chamber of Commerce was working to s t up a training session on Economic Development. He said he w uld like to encourage Mr. Gilmore, Steve Simonson and the m mbers of council to attend. I Mr. Sharpe advised that Monday night the appraisal district would bf looking at their budget. This would be the last time for i put. Mr. Baldwin said we need assurances that the appraisal d'strict budgeted enough money to fund appraisals. I M~. Sharpe requested that the area around the dumpster on Main at the tire shop be inspected and a larger dumpster be required if nFcessary. The area was very unsightly. M . Stanhope advised that the City of Schertz had been mentioned i Time Magazine by a former resident. . Baldwin asked if the accidents on Jack Hayes Boulevard had b en pass ed on to th e ,State. Mr. Gilmor e said that th is was e'ther in the works or already in the mail. Mr. Gilmore advised t at we were picking up a counter as the last count was taken in t e wrong area.. He advised that copies would be sent to Mr. K. mple and Mr. Ehlers. i M~" Baldwin asked if a letter had been sent to the house at R ndolph and Brooks concerning the bushes. He advised this was a very dangerous condition. Mr. Gilmore advised he had passed the i formation on to the Inspection department I M~. Greenwald advised council of an article where the Edwards group were getting into the business of controlling the aquifer. T ey are attempting to limit the amount of water being pumped from the aquifer. ! M~. Greenwald also advised that an aLticle in the Seguin Gazette sated that the County would not maintain county roads within 100 feet of the Clty limits. I I M~YOr Sawyer and Mr. Gilmore both explained that the paper was i error. The city will be notified 90 days prior to when the c unty will be working on a road that continues into the city 232 limits. If the city wishes the county will continue into the city limits and the city will reemburse the county for the work done within the city limits. Mr. Greenwald advised that the people in Lone Oak are attempting to replace the entry sign. He ask if there was any possibil~ty of city participation. Mayor Sawyer explained that the city could not participate because it would set a precedent for other subdivision signs. #9 ITDIS BY MAYOR: Mayor Sawyer advised that the City of Schertz was being considered by Walmart but it might fall through. He advised that some of our advertising was paY1ng off and if groups would like to be shown around arrangements could be made. Mayor Sawyer advised that Mr. Greenwald had accepted as the City's representative to the U.S. Constitution Bi-Centennial Committee. Mr. Gilmore advised that we would be going out for bids on Schertz Parkway. A meeting with Mr. Bindseil has been arranged to explain what is happening so he may make a determination on the benefits to him. Advised we would be going to court November 1 to condemn the lots on l3the row. We should iook at condemnation proceeding for those on this end. He also advised that Mr. Ackermann had not responded to correspondence sent to him. Mayor Sawyer ,asked if Mr. Gilmore had explained that the insurance lawyers had taken over the case for those named in the lawsuit.
