ccswks 10-10-1985 284 SPECIAL MEETING OF THE CITY COUNCIL OCTOBER 10, 1985 o The Schertz City Council convened in Special Session, Thursday, October 10, 1985, at 6: 00 p.m. in the Conference Room of the Municipal Complex, 1400 Live Oak Road, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presiding; Hal Baldwin; Ray Stanhope and Ken Greenwald. Absent Charles B. Sharpe and Adolph Aguilar. Staff were City Manager Jimmy G. Gilmore and City Secretary June G. Krause. #1 HEARING OF RESIDENTS: none #2 Discussion of School Board request to grant them a Food Handler's Permit without charge. Before calling for discussion, Mayor Sawyer read a memo from Councilmember Sharpe regarding this item. In his memo to the Mayor, Mr. Sharpe said he was not in favor of excusing the school district from paying for medical inspection. "This would be another "cost of doing business" for them. It is only a miniscule portion of their budget - Mr. Brehm's letter implies that the city does not have to levy taxes also." Mayor Sawyer said he agrees with Mr. Sharpe. Mr. Baldwin said that in doing business between two taxing entities, usually they try to do these things without charge. 0 The City has been giving the school no-fee building permits for years. Mr. Stanhope asked if we would be opening pandora's box by letting one not pay - then perhaps the church or someone would come in and want to get a permit free. When asked if the school charged BVYA for the use of the gym, Mr. Baldwin said only $1 per hour for electricity but they do not charge them for use of the ball fields. Mr. Gilmore suggested that since the inspections are $9.00, would it be acceptable to just charge for the inspections. As a taxing entity, give them the permit free and then just charge for the inspections. After taking a concensus, Mayor Sawyer said the City would send them a letter stating that we will only charge them for the inspections. It will probably only take one inspection a year because the school really keeps their cafeterias clean. #3 Discussion of possible condemnation of property. Mayor Sawyer said the property under discussion is the two pieces Mr. Baldwin talked about at the last meeting. We should ask 0 Richard Harris for some kind of time table as to when we should begin. Mr. Gilmore said the developers are going to come in with a letter saying they want to build the road, etc.. Mr. Gilmore said he would like very much to wait until after they come in before we start anything. They should be in by the 30th. Mr. stanhope said he was in favor of doing this but where are we going to get the $300,000 that is our part. Mr. Gilmore said he had several ways in mind but was not sure of the legality yet. #4 Discussion of nominee for the Guadalupe County Appraisal District directors. Mayor Sawyer reminded Council that Schertz has to go with the School Board and Cibolo if we expect to get anyone elected. Mr. Baldwin said that to the best of his knowledge, the School Board is going to nominate Dick Howe for Appraisal Distr ict Director. Mr. Baldwin also said there is a rumor that Commissioners Court would be amenable to placing another man from our area as a director. If we could get a nominee and get three of the Commissioners (Grein, Brannon and the Judge) then we can get two from our area. ~ Mr. Gilmore suggested contacting Commissioners Brannon and Grein and Judge Sagebiel and see if they will support a person from our area. Mayor Sawyer said he got a letter from a man that lives in a condominium and wants to put in a swimming pool and is unhappy with the treatment he says he has gotten from staff. The Mayor said he would have copies of that letter for Council at the next meeting. Mayor Sawyer called for a recess at 6: 37 p.m. in order for Council to move to the Samuel Clemens High School Cafeteria for the Joint City Councils meeting at 7:00 p.m.. MR. SHARPE JOINED COUNCIL FOR THIS PORTION OF THE MEETING. 1. The Joint Councils Meeting, sponsored by the Greater Randolph Area Chamber of Commerce, was called to order by Frank McNiff at 7:00 p.m. in the Samuel Clemens Cafeteria, 1001 Elbel Road, Schertz Texas. 2. After everyone giving the Pledge of Allegiance, Rev. Bob Creasey gave the invocation. 3. Mr. Paul Davis, Greater Randolph Area Chamber of Commerce Chairman of the Board welcomed everyone to the meeting. Mr. Davis mentioned that this is the first time the Councils of this area has ever gotten together under one roof and that he hopes it ~ 286 will be an annual meeting. Mr. Davis recognized some of the people from the Chamber and introduced the head table guests and speakers. 4. At this time, the Moderator asked for a roll call of the cities for a quorum check as follows: ~ Qf Cibolo: Mayor William Little introduced his five Council members Bauder, Bishop, Niemietz, Nirider, Wiederstein and Administrator David Harp. ~ Qf Converse: Mayor Bruce Friesenhahn had three Councilmen present: McFadin, Novack and Wear, along with City Manager Kent Myers. ~ Qf Garden Ridge: Mayor Pro Tem Neil Craigmile and one member of the Council was present, Bobbie Landum - no quorum. ~ Qf Kirby: Councilman Duffek was the only one present. ~ o .c.i.U Qf ~.QAk.: Mayor Ralph E. Cullip introduced Council members Conway, Martin, McConnell, Tremblay and City Manager Pinto, City Secretary Marian Elbel and three staff members. ~ Qf Marion: Mayor Clarence Jackson had one Council member present - Debra Krueger - no quorum ~ Qf Schertz: Mayor Earl W. Sawyer introduced Council members 0 Baldwin, Greenwald, Sharpe, Stanhope and City Manager Jim Gilmore ' and City Secretary June Krause. ~ Qf Selma: Mayor Steve Gose introduced Councilmembers Calle, Fleenor and Mayo and City Secretary Margie Lubianski. ~ Qf Universal~: Mayor Bruce Barnard introduced Council members Burlingame, Jordon, Kerkow, Stine, Shelby and City Manager Mike Tanner. ~ Qf Windcrest: Mayor Robert Whitmore was the only member present - no quorum. 5. Frank McNiff then recognized several guests and visitors: Guadalupe County Commissioner Jim Brannon, Representative Ed Kuempel, Representative Allan Schoolcraft, Representative Tommy Adkisson, SCUC School District Superintendent Byron Steele and School Board President Malford Brehm. 6. Mr. Lynne Cooke, representing Hospital Corporation of America gave a progressive report on the new Village Oaks Regional Hospital, whJ.ch opened June 15, 1985. Mr. Cooke said he had never seen before the amount of agressive interest from all the cities in the area to make it possible to have an emergency Oi facility and hospital in an area. ! ~ .0, " , '~, . -;: ~~I'; ~./>. F; '7 /!'" ..,.;; ~ ~ ., 7. Ms. Stephanie Coleman of the San Antonio Economic Development .-- Foundation spoke on economic development along the Austin- San Antonio Corridor. 8. Mr. Davis introduced Mr. Bill Chadwick, the new Director of the Greater Randolph Area Chamber of Commerce. A. Mr. Chadwick asked each of the City Councils to vote on a resolution of support, the caption is as follows: A RESOLUTION FROM THE CITIES OF THE RANDOLPH METROCOM ENCOURAGING AND SUPPORTING THE ECONOMIC DEVELOPMENT EFFORTS OF THE GREATER RANDOLPH AREA CHAMBER OF COMMERCE. Mr. Sharpe moved to accept the resolution supporting economic development of the Greater Randolph Area Metrocom. Mr. Greenwald seconded the motion, which carried with the following vote: AYES: Councilmen Sharpe, Baldwin, Stanhope and Greenwald NAYS: None 9. Presentation and/or consideration of resolutions. A. Funding Procedures - General Law Cities - Cibolo ~ City Administrator David Harp introduced a resolution, the caption of which follows: A RESOLUTION BY THE JOINT CITY COUNCILS OF THE GREATER RANDOLPH AREA SUPPORTING THE SEPARATION OF COMPETITION FOR FEDERAL AND STATE GRANTS FUNDING AS ADMINISTERED THROUGH THE TEXAS DEPARTMENT OF COMMUNITY AFFAIRS; ESTABLISHING SEPARATE COMPETITION FOR FUNDING FOR GENERAL LAW CITIES (UNDER 5,000 POPULATION), AND CITIES OF HOME RULE CHARTER (5,000 POPULATION AND OVER) . Mr. Sharpe moved to support this resolution for separate funding for home rule and general law cities. Mr. Baldwin seconded the motion, which carried as follows: AYES: Councilmen Sharpe, Baldwin, Stanhope and Greenwald NAYS: None Roll call of cities: r Cibolo - passed Converse - felt the resolution should be amended, there could be confusion. Overtime Pay Texas cities - Cibolo o Mr. Harpe explained this resolution was to solicite support to repeal that portion of the Fair Labor Standards Act that applies to cities. A RESOLUTION BY THE JOINT CITY COUNCILS OF THE GREATER RANDOLPH AREA STRONGLY ENCOURAGING LEGISLATIVE ACTION BY OUR STATE AND FEDERAL ELECTED OFFICIALS TO EXEMPT CITY, COUNTY, AND STATE EMPLOYEES FROM THE FEDERAL LABOR LAW PROVISIONS FOR OVERTIME PAY, RESULTING FROM THE SUPREME COURT'S CONTROVERSAL DECISION IN GARCIA VS. SAN ANTONIO METROPOLITAN TRANSIT AUTHORITY. Mayor Cullip moved to accept the Mayor Bruce Friesenhahn seconded unanimously. resolution by acclimation. the motion, which passed C. Mayor Sawyer introduced a resolution supporting passage and U' i implementation of the Texas Water Plan. A RESOLUTION SUPPORTING PASSAGE AND IMPLEMENTATION OF HOUSE JOINT RESOLUTION 6 (TEXAS WATER PLAN) A PROPOSED AMENDMENT TO THE TEXAS CONSTITUTION STATED TO APPEAR ON THE NOVEMBER 5TH BALLOT. Mayor Bruce Barnard moved unanimous support of the Texas Water Bill. Mayor Bill Little seconded the motion, which car r ied unanimously. D. Mayor Bruce Friesenhahn of Converse said he did not have a resolution but information and comments regarding extending VIA bus service to the area. Mayor Friesenhahn said Converse bad a total of 9 public meetings before this issue could even go to the City Council and them be put up for vote of people. He asked the cities to look at what VIA could do for them.
