#6 ITEMS BY MAYOR: Mr. Sawyer mentioraed one of the seminar programs
he attended at TML concerning some of the problems
of liability both for the City and as individuals. He mentioned two specific
problems in the city that could possibly cause problems as mentioned. He
said we should let our citizens know how to report problems when they are
observed such as pot holes, obliterated traffic signs, etc.
Ms. Mueller mentioned the 45 mph speed limit on FM 1518 near to Scout Hut
and asked if it could be lowered. Mqyor Sawyer explained that was up to the
State but that we would asked them to consider it.
#7 ADJOURNMENT: There being no further discussion, Mayor Sawyer de-
clared the meeting adjourned at 9:15 P.M.

REGULAR MEETING OF THE CITY COUNCIL
OCTOBER 18, 1983
The Schertz City Council convened in Regular Session, Tuesday, October 18,
1983 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the follow-
ing members present: Mayor Earl W. Sawyer, presiding; Charles B. Sharpe;
Ross Hoover; Adolph Aguilar and Ken Greenwald. Absent Hal Baldwin. Staff
present were City Manager Jimmy G. Gilmore and Deputy City Secretary Alice
Austin.
MR. BALDWIN ARRIVED AT 7:02 P.M.
#1 APPROVAL OF MINUTES: Mr. Sharpe questioned the percentages used in
#6 City Manager's Report, page 121, of the
minutes of the Special Workshop meeting of September 28, 1983. After an ex-
planation by Mr. Gilmore, he agreed to no change in the minutes.
Mr. Baldwin requested the minutes of the Regular Meeting of October 4, 1983,
page 124, paragraph 3 of Public Hearing A be changed to Mr. James Hardin
instead of John Horton.

Mr. Hoover questioned the vote on #2, page 119 of the Minutes of the Special
Meeting of September 28, 1983. It was pointed out that there were two votes
taken concerning this item and each was reflected correctly.

Mr. Sharpe made a motion to accept the minutes of the Regular Meeting of
September 20, 1983; the Special Workshop Meeting of September 28, 1983, the
Regular Meeting of October 4, 1983 (with corrections) and the Special Work-
shop meeting of October 12, 1983. Mr. Aguilar seconded the motion which D.
carried with the following vote:

#2 HEARING OF RESIDENTS: None
#3 ORDINANCE: Mayor Sawyer introduced an ordinance and read the
caption as follows:
ORDINANCE NO. 83-S-l4
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, AMENDING ORDINANCE NO. 79-S-l5 IN ACCORDANCE WITH
ARTICLE XIX, SECTION 2-2.1 WHICH AUTHORIZES THE CITY
COUNCIL TO, FROM TIME TO TIME, AMEND, SUPPLEMENT, CHANGE,
MODIFY OR REPEAL THE REGULATION STANDARDS AND BOUNDARIES
OF THE CITED ORDINANCE; THIS ORDINANCE DOES AMEND ORDIN
ANCE 79-S-l5 BY DELETING ARTICLE XXI "PLANNED RESIDENTIAL
11 UNliT DEVELOPMENT II AND REPLACING ITI'WITHI rfPLANNED UNIT' ,
DEVELOPMENTII; AND REPEALING ALL ORDINANCES IN CONFLICT
WITH THIS ORDINANCE, SPECIFICALLY ORDINANCE NO. 8l-S-l8.
Mr. Baldwin made the motion to approve the ordinance to change PRUD TO PUD r~
for final consideration. Mr. Greenwald seconded the motion which carried U
with the following vote:

#4 ORDINANCE: Mayor Sawyer introduced an ordinance and read the
caption as follows:
ORDINANCE NO. 83-C-15
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS,
ADOPTING THE STANDARD MECHANICAL CODE, 1982 EDITION, TO INCLUDE
ALL FUTURE EDITIONS, REVISIONS AND AMENDMENTS, PUBLISHED BY THE
SOUTHERN BUILDING CODE CONGRESS INTERNATIONAL, AS THE MECHANICAL
CODE OF THE CITY OF SCHERTZ, TEXAS; DESIGNATING THE MECHANICAL
INSPECTOR; SETTING ALL BONDS AND FEES; PROVIDING FOR A PENALTY;
AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT.
Mr. Sharpe made a motion to approve this ordinance adopting the Standard
Mechanical Code on final consideration. Mr. Aguilar seconded the motion
which carried as follows:

#5 RESOLUTION: Mayor Sawyer explained it had been necessary to poll
Councilmembers earlier for approval for him to sign
the license for M.K.T. to bore under 135 for a new water line. Mr. Aguilar
confirmed that the Council had been polled and agreed.
Mr. Aguilar made a motion to passi this resolution authorizing the Mayor to
execute a license for M.K.T. boring for new water line. Mr. Greenwald seconded
the motion, which carried with the following vote:
AYES: Councilmembers Sharpe, Baldwin, Hoover, Aguilar and Greenwald
NAYS: None
#6 EXECUTIVE SESSION: Mayor Sawyer called an executive session under
Article 6252-17 V.T.C.S. Section 2 (g) at 7:14 PM
The Regular Session was reconvened at 7:30 P.M.
#7 CITY MANAGER'S REPORT: Mr. Gilmore announced that Garden Ridge
Pottery is working on having a grand opening
and as soon as the date has been set, Council will be notified. Seems to have
a good fire system in this building.

Mr. Gilmore also gave an update on the various construction projects in the
City as follows: Horseshoe Oaks Unit 1 has been approved; the building per-
mits have been issued for the apartments on Live Oak Road at Elbel; I 35 area,
between Garden Ridge Pottery and San Antonio Machine, San Antonio Shoe is
planning on using old buildings to fit in the sceme of things; have starting
digging for the 18" water-line; Water lines for Naylor property will be an
8" line down 3009 and along the access road.
Mr. Gilmore said that CPSB has been contacted with regard to the gross receipt
tax.
#8 ITEMS BY COUNCIL: Mr. Baldwin said he enjoyed the presentation by
Barshop - that it was very professional and
informative.
Mr. Hoover said that kids have found a way to beat the light system at the
park pavilion, they park cars and use those lights to play ball. He asked
that the police check this out.
Mr. Aguilar asked about the low milage on police vehicles P-2, P-6 and P-7
and Mr. Gilmore said these vehicles are giving some problems and they are
all the old gas guzzlers.

Mr. Aguilar reported on the San Antonio-Austin Corridor meeting he attended.
He said he felt the Mayor would have more clout at these meetings, the others
are just visitors. November 3 & 4 there will be a forum meeting at La Villita
Assembly Hall, the govenor will be there and it would be beneficial for some-
one to attend. The Mayor and Mr. Gilmore said they would go. They agreed to
meet six times a year with the next one being on the 13th of December in
Seguin and the following one in San Marcos.
Mr. Greenwald said that the Herald, along with Guy Chipmen, is sponsoring
a Ripe Pumpkin Day whereby kids can go by and p:ick up a reflective pumpkin
badge.

#9 ITEMS BY MAYOR: Mayor Sawyer welcomed Sandra Newell from the
Herald and Edward Leal to the meeting.
He had received a letter from Senator Benson stating that the General
Revenue Sharing has been reauthorized. He also received a letter on the
Texas 1986 Sesquicentennial, which will be discussed at the next workshop.
Also a letter was received from HCA thanking the Council for their support.
He then thanked Mr. Sharpe for representing us at the Austin meeting.
Mayor Sawyer said we need to act on the sign on William Street stating
"No Through Traffic"
#10 ADJOURNMENT: Mr. Aguilar made a motion to adjourn the meeting
at 7:52 P.M., said motion was seconded by Mr.
Baldwin and unanimously carried.
