SPECIAL SESSION OF THE CITY COUNCIL
NOVEMBER 9, 1983
The Schertz City Council convened in Special Workshop Session, Wednesday, 0
November 9, 1983, at 7:00 P.M. in the Conference Room of the Municipal
Complex, 1400 Live Oak Road, with the following members present: Mayor
Earl W. Sawyer, presiding; Charles B. Sharpe; Ross Hoover; Hal Baldwin;
Adolph Aguilar and Ken Greenwald. Staff were City Manager Jimmy G. Gilmore
and City Secretary June G. Krause.
#1 HEARING OF RESIDENTS: Mr. Merwin Willman said that in June 1983
the Planning & Zoning Commission had sent
a memo to the City Council in regards to drainage, this covered problems of
the entire city. Todate, they have not received a reply from the Council.
Mr. Gilmore said that the Water Quality Board is going to meet here on the
21st of November from 6 to 9:00 P.M. to discuss flood plain and flood-way.
There has been a lot of new laws passed recently and we will be briefed
on these laws and how they affect us.
Mayor Sawyer summed up the Council discussion by saying we know what needs
to be done regarding drainage and could put it to the citizens to vote on
some bonds. It is hard for Schertz to do anything with the Dietz Creek
drainage because neither the Dietz Creek or that part of the Cibolo Creek
is in our Jurisdiction. It was suggested a letter be sent to the Corps of
Engineers,: making them aware of the lack of flow in the Dietz and beyond.
Also, Mr. Baldwin suggested having representatives from the Edwards Acquifer
brief Council on their predictions.

Mrs. Margaret Riley reported the Library Board met Monday to discuss their
progress and it was brought out there and at every chance they have that
the new library was a reality only because of the backing of our progressive
Council.
#2 Discussion of a resolution authorizing AACOG to purchase police
radios through a Criminal Justice grant.
Mr. Gilmore said this is on on-going 50-50% grant through Alamo Area Council
of Governments with the Criminal Justice Division to purchase, with a contract
made about eight years ago, communications equipment. This will probably
be the last of the on-hand equipment available through this grant.
Council agreed this should be an item on the next agenda.
#3 Discussion of an ordinance updating charges for warrant fees.
Mr. Gilmore informed Council that Senate Bill #1034 increased the fees on
warrants from $7.50 to $25.00 and took effect last September. This ordinance
will bring our fees in line with state law. Another thing on this bill
is that the maximum on Municipal Court has been increased from $200 to
$1000. This'iwill be brought before Council to discuss changing our ordinance
at a later date.

#4 Discussion of the public hearing on the proposed annexation of 10.5
acres of land out of Guadalupe County.

Mr. Gilmore explained that this is the property in Naylor's Park that was dis-
annexed approximately four years ago; with the stipulation that if construction
had not been completed in four years, the property would be reannexed.
Mr. Baldwin suggested trying to compress the time schedule for this annexation
in order for it to be completed prior to January 1,1984, in order to be in-
cluded in the 1984 tax roll.
#5 EXECUTIVE SESSION: None was needed.
#6 CiTY MANAGER'S REPORT: A. Mr. Gilmore announced again the Grand
Re-opening of Garden Ridge Pottery is
scheduled for the next day at 11:00 am.
B. Calkwas received from County Commissioners saying that the City does not
have enough votes to get Mr. Tilgman elected to the Appraisal District Board
of Directors. Cibolo has changed their vote in favor of Mr. Howe. Mayor
Sawyer said he had talked with the County Judge and both our Commissioners
and asked them to cast any left over votes for our man and the three of them
seemed to be more or less willing to do so.
C. Judge Sagebiel will be in Schertz at the Municipal Offices on the 17th
from 1:30 on.

D. Mr. Gilmore and Mayor Sawyer then gave a briefing on the meeting they
attended on the I35 Corridor. They said it was aimed more at the academia.
as they are looking at trying to encourage research centers - biotech, med-
tech and computer technology. It was brought out that traditional zoning is
on the way out, PUD type zoning is what will be needed. Homes to be placed
on smaller lots, garden homes, etc. They both said all in all it was a
worthwhile meeting.

#7 ITEMS BY COUNCIL: Mr. Sharpe said he would like to follow up on
what was said about inventory of our assets.
We have to look at additional water supplies. Mrl. Gilmore said that Cibolo
has in mind that they will develop their well but they really can't afford
that or to develope a water system of their own. Right now they are asking
to tie into the 12" line off Green Valley Road. Mr. Gilmore said he thought
that would be a mistake as they would then be drawing off our high pressure
line and they need to be drawing off the low tier water. He went on to say
we have got to get with Cibolo Council and decide how much we can and are
willing to furnish them. Mr. Gilmore also said he had talked again with
Richard Harris and there were two items have to be changed before HUD will
approve of our purchase of the Schaefer Road Rural Water Supply Corporation.
Mr. Baldwin suggested looking for water in that area also.
Mayor Sawyer instructed the City Manager pursue this and get some estimates
on locating well sites in the Scheafer Road area as well as above 135.
Mr. Sharpe requested Council look at what areas would be beneficial for
annexation. Mr. Gilmore said we are already looking at the area between
the railroad tracks off FM 3009.
Mr. Sharpe also said that some people are thinking along the lines of com-
bining the cities of Cibolo and Schertz. Mr. Gilmore said he had researched

some of the old files on this and of course one gripe was the loss of
identity. He went on to say that you can have a central government and
call it whatever you want; but the individual cities could still be
called by their individual names.
Mr. Aguilar asked the status of the new water line in Rittimann Addition.
Mr. Gilmore said he received the plans this week and work should start
very soon.
Mayor Sawyer called a recess at 8:50 P.M.
The Workshop Session was reconvened by Mayor Sawyer at 8:57 P.M.
Mr. Aguilar also asked the status of the Live Oak Road project from the
apartments around to FM 3009. Mr. Gilmore reported the staff are working
on acquiring right of way now. The only problems will be in back of Green-
field Subdivision. It may require a slight curve in the road.
Mr. Aguilar also brought up the vandalism that has been taking place in the
cemetary back of Reidel's. He said the people are doing the best they can
to maintain the cemetary and now it is being ruined. The police have been
asked to patrol that area more often.
Mr. Hoover reported that a man from Converse that was present at the last
meeting when the Kiwanis Club members were present, said he was really
impressed with the way the Schertz City Council conducted the meetings and
themselves.
Mr. Baldwin asked if the City had a full contingent of police officers.
Mr. Gilmore said we are interviewing at the moment and have one that is
finishing up school, which should bring us up to full force.
Mr. Greenwald asked if Mr. Baldwin had approached the School Board about
the possibility of government entities getting together and hiring a publicity
man. Mr. Baldwin said he spoke to his boss and he wasn't too receptive.
Mr. Gilmore said he had received copies of the letter the Chamber of Commerce
President sent out - one to Houston and one to New Mexico - to companies
showing interest in our area. Mr. Gilmore said he would follow up with
literature from the City. He also suggested asking the Executive Director
of the Chamber over and giving him a tour of our city.
Mr. Greenwald said that about 3 to 5 months ago, there was a recommendation
that the City do away with part of a utility easement, what is the current
status. Mr. Gilmore said that in order for it to work, all the people along
the easement had to agree to accepting their part of the easement. Todate
only two wanted to do it.
Mr. Greenwald said that at the last P&Z meeting, they had discussed having
a joint meeting with Council and talking about the possible extension of
Live Oak Road to 135. Mayor Sawyer said he thought it would be wise to be
acquiring right of way. Mr. Gilmore said some of the right of way can be
obtained when we get the easement for the water line down from Deer Haven.
Mayor Sawyer asked that two items be added to the bell ringer list: site
location for future wells and planning.
#8 ITEMS BY MAYOR: Mr. Sawyer said he had been getting calls about
the Police Chief being fired. He said he would

appreciate it if Council would help squelch the rumor; that there are no
plans in the city to fire the police chief.
Mr. Hoover asked if anything had been done about removing the paving equipment
from the church property on Oak Street. Mr. Gilmore said we have not had any
luck in finding anything big enough to move it.
Mayor Sawyer asked Councilmembers to keep in contact with the different
organizations and cmmmittees of which they are ex-officio members because
people don't come to meetings and we need to know what people want from
City officials.
#9 ADJOURNMENT: There being no further items to come before Council,
the Mayor declared the meeting adjourned at 9:25 PM.

REGULAR MEETING OF THE CITY COUNCIL
NOVEMBER 15, 1983
The Schertz City Council convened in Regular Session, Tuesady, November 15,
1983 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the follow-
ing members present: Mayor Earl W. Sawyer, presiding; Charles B. Sharpe, Hal
Baldwin; Ross Hoover; Adolph Aguilar and Ken Greenwald. Staff were City Mana-
ger Jimmy G. Gilmore and City Secretary June G. Krause.
PUBLIC HEARING: After welcoming all the citizens to the meeting, Mayor
Sawyer explained that the purpose of the public hearing
was to receive input from the public for rezoning request submitted by Barshop
Enterprises on approximately 178 acres out of A-153 T. Herrera Survey, Guada-
lupe County, located at the southwest corner of IH 35 and FM 3009 and approxi-
mately 18 acres out of A-299 John Saladin Survey, Guadalupe County, located
at the southeast corner of IH 35 and FM 3009 for rezoning to be established
as a Planned Unit Development (PUD). He then turned the public hearing over
to Planning and Zoning Chairman, John Linebarger. Mr. Linebarger said he
would first like Mr. Risinger, representing Barshop Enterprises, to give a
briefing and explain their plans.

Mr. David Risinger, architect, said he welcomed the opportunity to come before
the Council and P&Z members to present their plans and program. He said they
have worked extensively with the homeowners near the project and have taken
their concerns into consideration. They began their preliminary planning
in May through August. In September they initiated informal meetings with
City staff and had a preliminary meeting before Planning and Zoning. On
October 17 they had a meeting with homeowners, where about 60 people attended.
On October 24th the submitted their application to the City. After that they
