SPECIAL SESSION OF THE CITY COUNCIL

The Schertz City Council convened in Special Workshop Session
Wednesday, February 29, 1984, at 7:00 P.M. in the Conference Room
of the Municipal Complex, 1400 Live Oak Road with the following
members present: Mayor Earl W. Sawyer, presiding; Charles B.
Sharpe; Hal Baldwin, Ross Hoover; Adolph Aguilar and Ken
Greenwald. Staff were City Manager Jimmy G. Gilmore and City
Secretary June G. Krause.
.1 HEARING OF RESIDENTS: None
.2 Discussion of proposed ordinance regulating
abandoned large appliances.
Mr. Gilmore presented a sample ordinance and asked if Council
desired to put this ordinance on the next agenda, receiving an
affirmative answer.
.3 Discussion of proposed Entex rate increase.
Mayor Sawyer asked if we could have a resolution as we did last
year saying that we object to the increase, after Council had
discussed the proposed increase. The only alternative would be
to ask for a rate hearing. We have done this in the past and had
a very good person doing the presentation and still Entex won.
Council agreed to have the resolution on the next agenda.
.4 Discussion of water service to non-residents.

The Mayor called attention to a letter Mr. Gilmore had written to
Mr. Brooks in Cibolo discussing the need to expand our existing
water system to meet the non-resident projected growth demand.
Mr. Gilmore said it has come to the point that in order for them
to continue to get water for their new development, they are
going to have to participate in our expansion of lines. Either
they participate or we will have to limit the amount of growth
they can have.
Mr. Baldwin asked if the same applied to Northcli.ffe and Schaefer
Road. Mr. Gilmore explained that the City has an agreement with
Northcliffe where they have priority on the 12" line. We furnish
them a certain number of gallons at so much pressure. As far
Schaefer Road, that should be transferred to the City by the 15th
of April. Mr. Gilmore said he has told Mr. Brooks that the two
Councils should meet together with our engineer but they have
been procrastinating.
After thorough discussion by Council, it was decided to have Mr.
Ford meet with our Council at the next workshop session to get a
thorough briefing and then the next workshop have the Cibolo City
Council meet with our Council and engineer.

15 Discussion of public hearings on Crow Development and
Oak Forest unit V rezonings.
Mr. Gilmore showed a plat of Crow Development giving the various
lot sizes and placement within the development. There are plan-
ned 59 R-2 lots and 282 R-5 lots. There will definitely be no
apartments. The larger lots are placed around the per imeter
backing up to the same size lots in existing housing. The small-
er lots will all be on the inside of the subdivision. The area
will need a l2n water main to support it. If we extend the 20n
main through to Live Oak Road, the estimated cost of oversizing
will be between $20,000 and $30,000. The City Manager said he
feels that Cibolo should share the cost of the oversizing.
Randolph Avenue will be stubbed out so that in the future it can
go through to Maske Road or even further.
Mr. Coy Simmons is asking for smaller garden home size lots for
the back of his subdivision in Oak Forest Unit v.
16 Discussion of Personnel compensation.
Mayor Sawyer explained that past Councils did not include Mr.
Gilmore and Mrs. Krause in the general pay plan with scheduled
raises since they work directly for the Council.
Mr. Gilmore presented a 1984 Managers' salaries comparison chart
but said it is hard to get figures on Mrs. Krause as City Secre-
taries have such varying duties. Mrs. Krause carries three dif-
ferent types of duties now.
The Mayor asked ~f any thought had been given to hiring an assis-
tant City Manager and relieving Mrs. Krause of at least those
duties when the Manager is gone. Mr. Gilmore said it would take
about two years for someone else to obtain the knowledge she has
of this city. Mr. Gilmore said instead of an assistant manager
we could use personnel in other areas to better advantage as he
feels the designation would be restrictive.
Several types of increases were discussed by Council, who came to
the conclusion that a 6% increase retroactive to October 1 would
be appropriate. This to be an agenda item for the regular
meeting.
17 EXECUTIVE SESSION: none needed.
t8 CITY MANAGER'S REPORT: A. Mr. Gilmore called attention
to a planning brochure in Council packets advising of a short-
course conference on planning to be held in Corpus Chr isti in
April. At last night's P&Z meeting, at least four members said
they would very much like to go if Council were willing to pay
for them to go.

B. Also in the Council packets is a Zoning Report on mobile
homes outside mobile home parks and a report on .Downsizing
Gracefully. showing the trend across the nation of smaller lots.
C. Mr. Gilmore showed some possible designs for the extension of
Li ve Oak Road. These included an 80 foot right of way with a
median - that way if a developer comes in on only one side of the
road, we could make them put in that one side and that could be
used until the other side is developed.

D. A letter was received from CCMA advising that at their Board
meeting of April 12, 1984, Financial Advisor Tom Anderlitch is
to discuss their proposed rate increase.
E. Mr. Gilmore also included for Council perusal a letter about
nA Night in Ole Live Oak. and a bimonthly Fire Department
Inspection Report. Council was very pleased with the new fire
inspector's reports.
F. Mr. Gilmore announced that Rope's Garage, which has been such
an eyesore on Live Oak and Curtiss Avenue, has moved and left the
City.
G. There is to be a meeting in Austin on March 22nd on Police
Risk Management-covering topics such as liability of City, etc.
Mr. Gilmore and tbe Chief of Police plan to attend this seminar.
H. There was an EMS incident on the 24th of February. We had ur-l
six calls in one hour. We were able to handle the first five and
then asked Randolph to backup on the sixth and they refused. In
the past, we have had a verbal agreement for reciprocal service
with Randolph. SAFES wrote a letter to them saying that in order
for us to serve them, they will have to pay the per capata cost.
Mr. Baldwin said he attended an EMS meeting that included Tom
Funk and Bobbie Dilworth as well as the Base and Hospital
Commanders to try to work something out. He said the committee
gave then 30 days to work things out. Mr. Baldwin said he thinks
they should pay a per capita share for their nighttime
population.
I. The deliquent tax attorney contract will be coming up for
renewal in March. Mr. Gilmore said he feels they are doing a
good job and it does not cost the City anything as we recoup from
the deliquent customers. This is the same firm the School
District uses. This is to be an agenda item for next meeting.
J. Mr. Gilmore had some recommendations for amending the fees on
several ordinances, which he plans to have for the next workshop.
K. Mr. Willman's term on the P&Z is expiring and he and the P&Z
are requesting that he be reappointed. Council agreed and ask
this also be on the next agenda. rl

19 ITEMS BY COUNCIL: Mr. Sharpe asked if anyone knew the
locations of the two annexations being considered by Cibolo. Mr.
Gilmore said he was fairly sure one was in the vacinity of Dobie
School but wasn't sure of the location of the other one.
Council discussed the right of way or easement through the Dean
property for our sewer line. Mr. Gilmore said our attorney was
trying to work out an agreement with the owners but if it wasn't
concluded within two weeks, he would go ahead with the condem-
nation. Mr. Dean has indicated that he would like to be annexed
by Schertz because he wants to get water and sewer from us;
however, Mr. Harris said that since there is ETJ agreements
between Schertz and Cibolo by ordinance, the only way it could be
broken is if Cibolo backs out of the agreement.

Mr. Aguilar suggested that at the pUblic hearings we have some
type of drawings to show what type of homes that will be built.
Mr. Gilmore said we would try to have him give a full present-
ation. He also said that if Council desired, he could have
Negley Paint peopel come in right after the public hearings for a
briefing.
Mr. Baldwin said he had received a phone call from a man in
Seguin pertaining to the hospital indigent care. It seems some
twenty year ago the hospital borrowed money from the federal
government and one of the provisions was that they would have to
provide indigent care for the full time of the loan. In two
years their budget cost for indigent care has jumped from about
$50,000 to $70,000 to a sum of $230,000. This is of great con-
cern to all the tax payers. Mr. Baldwin suggested inviting
either our area representative or Hospital Administrator to one
of our meetings to explain what the $230,000 would be used for.
The Mayor suggested the administrator and Mr. Tatum, who had
called Mr. Baldwin. Council concensus was to have them come to
the Workshop Session of March 28th and give their views when the
Cibolo Council was also present.
Mr. Aguilar wondered about the density of the Crow Development
and the effect it would have on water and how it would affect the
rest of the City. Mr. Gilmore said there would be no problem if
we oversized the line to a 20ft.
Mr. Baldwin said he had heard good comments about the roof job
the Two Sergeants did on the BVYA building.
110 ITEMS BY MAYOR: Mayor Sawyer said he had been informed
by Ms. Dilworth of SAFES that they would like to honor Tom Funk
on their tenth anniversary by having a ftTom Funk Dayft. Mr. Funk
is one of the original members that started SAFES and is the only
one remaining active in the organization.
r Mr. Sawyer said he had received a letter from the Turnpike
i Authoity and they will look into our request for help with IH 35.

Mr. Sawyer reported on a meeting he attended with the Scouting
Association regarding their building. It is not in as complete
disrepair as he had been led to believe. He told them to come to
the Council as an organized group and ask for help if they needed
it. They may be approaching us in the near future.
Mayor Sawyer said the City Fire Chief is in negotiation with the
City of San Antonio for mutual aid agreement - as we have with
all other surrounding cities. Sounds like a real good deal for
both, they really want the expertise that Ed Melton has gained on
chemical hazards. Mr. Melton is considered the expert in the
area.
Mr. Baldwin asked if something could be done about the one block
on Randolph Avenue where there is no sidewalk on either side of
the road.
.11 ADJOURNMENT: There being no further business to come
before Council, Mayor Sawyer declared the meeting djounred at
9:54 P.M.
