SPECIAL SESSION OF THE CITY COUNCIL
MARCH 14, 1984
r-. The Schertz City Council convened in Special Session, Wednesday,
, . March 14, 1984, at 7: 00 P.M. in the Conference Room of the
Municiapl Complex, 1400 Live Oak Road with the following members
present: Mayor Earl W. Sawyer, presiding; Hal Baldwin; Ross
Hoover; Adolph Aguilar and Ken Greenwald. Absent: Charles B.
Sharpe. Staff were City Manager Jimmy G. Gilmore and City
Secretary June G. Krause.
11 HEARING OF RESIDENTS: There were none wishing to be
heard.

.2 Discussion of the following Zoning Changes:
A. Zoning Change 152 - Crow Development: Mr. Gilmore called
attention to the Planning and Zoning recommendation in which they
recommend approval of the rezoning request submitted by Haven
Stewart who represents Crow Development. They have been told
that should Council approve the recommendation, they will then
have to come back in with plat approval; and they will have to
address the entire drainage problems. A letter from the adjacent
property owners on drainage is not enough. The plans will have
to go to Mr. Ford and he will have to approve it. Mr. Ford, who
was present, said that the 100 year floodway has very specific
regulations and he has to have a total design for drainage; he
will have to maintain the flow that the drainage normally does.
The City of Schertz needs to have the FIA come in and redesign
the whole drainage problems. At the time of the original design,
they did not take into consideration the total buildout that we
are talking about now.
After Council discussion, Mayor Sawyer asked that this be an
agenda item for the next regular meeting.
At this time, Mayor Sawyer asked to skip over item 2 b. and allow
the City Engineer, Mr. Ed Ford, to give Council an update on the
water problems and solutions for the City, to include Cibolo.
Mr. Ford first explained that Schertz has two water pressure
zones - the high zone, which include all the area above East Live
Oak Road, IH 35, Northcliffe, Deer Haven and Oak Forest areas
aet. The Low Pressure Zone is covered from the U.C. wells and
includes the lower area of Schertz, Cibolo and Schaefer Road.
Mr. Ford had a graph which shows that right now Schertz dominates
the Low pressure zone but we do not have the lines, pumping or
storage capacity for Cibolo I s growth. Nacogdoches wells are
always going to be a backup system for this zone as you cannot
make water run up hill. With the new population figures for
Cibolo, in the year 2000 Cibolo will pass Schertz in everything
~ in this lower zone. Cibolo has two choices (1) put in their own
system or (2) commit money to the Schertz system for expansion.
The City Manager said that right now Schertz is in good shape for

water but if Cibolo stays with SChertz, they will have to pay for
the expansion necessary. Mr. Ford said that Schertz is at about
100% of design but Cibolo is drawing another 35%. Under the
State Health Department standards, both Schertz and Cibolo have
to meet guidelines and if Cibolo does not put storage in, they
will not meet the fire standards. Mr. Ford said the immediate
needs are to extend the 20 inch line and tie into it. Cibolo has
got to provide storage within their community - the storage will
be provided by each city but the transportation of water has to
be met by both.
After Council discussion, Mayor Sawyer said Council needs to talk
contract with Cibolo Council and tell them they need to come in
on our system and pay their share or we must limit the supply of
water to their current population.
Mayor Sawyer called for a recess at 9:06 pm.
The Special meeting was reconvened at 9:12 pm and at this time
Mr. Sawyer asked to return to item 2 b, which is zoning change
No. 53 - Oak Forest, Unit V request.
Mr. Gilmore said the vote of Planning & Zoning was 4 to 2 in
favor of recommending approval of the rezoning request submitted
by Coy Simmons. Mr. Greenwald, who had been at the meeting, said
that it seems everyone wants to legislate ascetics and you cannot
do that. This was zoned R-l in the early '60s and at that time
everyone wanted that size lots but now people don't necessarily
want that large a lot - they want large houses maybe but not
large lots. Mayor Sawyer said that Mr. Simmons is the only
developer that has stuck with the City tb~ugh thick and thin.
.3 General Discussion. Mayor Sawyer said he saw no reason
for this item as everything could be taken care of in items 5, 6,
and 7.

Before going on to the next item, Mr. Baldwin asked what if
anything was going to be done about the Oak Forest entrance. Mr.
Gilmore said the latest development is by the Highway Department.
They are discussing widening FM 3009 by about 20 feet, which
would make the right of way go beyond where the culvert is now.
Mr. Gilmore said the ideal would be to bring in a main entrance
through the middle between Circle Oak and Crest Oak and either
close the others or use as low water crossings.
Mayor Sawyer said we have money now to fulfill our agreement but
the Highway Department won't let us. Mr. Baldwin said Mr.
Simmons had said that he would let us out of our agreement if we
would give him the $60,000 for the frontage in question and name ~
it Coy Simmons Park. Mr. Aguilar corrected the statement saying {I
that Mr. Simmons said he would give us the land in the back and ,~~
we would give him the $60,000.

15 crTY MANAGER'S REPORT: A. Thursday Mr. Barshop is
br inging in some people from allover the country to view our
city and what we have to offer prospects. The City will not be
involved except for police help with their VIA bus and
helicopter.
B. Mr. Gilmore gave Council a handout explaining density and
showed where the development on the Kramer tract fits the
formula.
C. He said staff has been approached by the Democratic Party
Club who want to use the library meeting room for a get-together
free of charge. After Council discussion, concensus was not to
allow them free use of the meeting room.
D. There was an article in the morning Express newspaper about
development in our city or ETJ. Mr. Gilmore said he talked with
the gentleman to find out what was going on as no one had been in
to discuss this development with us and that water was one of the
concerns we would have in that area. The gentleman said he would
be in to talk with staff and our engineer when he gets back in
town. '
E. We have been fortunate in bond money, the third project was
the extent ion of water line from the tank in Deer Haven down to
,Live Oak Road. We have the money still left for what it was
planned for1 however, we also have saved enough on the project to
extend the 12 inch water line which stopped the other side of
Garden Ridge Pottery 13,000 feet to come under FM 1103, requiring
two borings on the north side. We have had inquiries wanting to
develop in this area but we do not have water. We have the money
if Council wants to pursue it. Council concensus was to go
ahead.
F . Mr. Gilmore presented a plan for Spring Clean Up which
includes putting a large dumpster in var ious areas of town for
one week at a time for citizens to bring their trash and dump.
Should they have large objects, just call and give us one day
notice and the items will be picked up.
G. Mr. Naylor wants to change his plat in the Tr i County
Industrial Park bordering FM 3009 and I 35. He wants to vacate
Doerr Lane and put in railroad spurs. It will be more in line
with the plans of the Barshop property.
H. In the past, the City has auctioned off all unclaimed
bicycles and get very little out of it after paying the
auctioneer. Our Chief came up with an idea and talked with
Guadalupe County Probation Department. They have received two Ot
three bikes in the past and have given them to some of the kids
as an incentive to straighten out. It has worked real well in
the past and we thought of disposing of our unclaimed bikes in
this manner. It will be a worthwhile project. Council agreed.

I. We have looked into the bumper sticker system wherein the
sticker would identify the vehicle as belonging in . - Schertz. 0
Mr. Gilmore suggested coming up with color coded stickers for
each area. The stickers have worked to a certain degree in other
cities. Mayor Sawyer asked for costs estimates on this.
J. The Planning and Zoning Members have asked ,for a Board of
Adjustment hearing on the George Barnard request. Be wants to
reduce the set back because if he uses the 20 foot set back, he
will lose a large percentage of land. This hearing will be
coming up in April.
.6 ITEMS BY COUNCIL: Mr. Greenwald said the City will be
getting a letter from BVYA concerning their Opening Day
Ceremonies on April 21st. Also they have bid on two
tournaments - the 6,7,8 of July will be the San Antonio Area
Tournament with 50, to 60 teams. Then the 27, 28, 29 of July is
the Interstate Tournament with r iqht now 55 teams. ,from allover
the U.S. They are looking at some way of crowd control and gate
admission to help defray some of the costs. They are wondering
if the, developer of the apartments on ElbelRoad would donate the
fencing or some portable fencing just for the tournaments. Mr.
Gilmore said he would check into it if BVYA will write him giving
the number of tournaments and dates.
Council discussed the needed repairs to the -ba-llfields, both
short and long range. It was suggested that one ballfield a year
be changed until they are all four replaced and turned around.
Mr. Greenwald said it was also brought to his attention that with
all the development in the area, should there be ~No ParkingW
signs on Live Oak Road. Mayor Sawyer said that P&Z should look
at the ordinance and come back with recommendation to Council.

.7 ITEMS BY MAYOR: Mr. Sawyer said that at a social
function on base he had been approached by Colonel Divitch and he
does not think the base should pay the per capata rate for
amulance service. Be seemed to want to try to work out some
type of contract. Mayor Sawyer said he could not see charging
them by the run when everyone else pays their per capata share.
If they do not want to pay their, fair share, then discontinue
service to Randolph. They have until the end of March to decide
what they are going to do.
Mr. Sawyer said called attention to the chairs in the reception
area of the building. Be said he felt Council should okay funds
to replace the chairs as they are in deplorable condition. Mr.
Gilmore is to get costs.

Congressman Patman sent the Mayor a flag that he had had flown
over the capitol, along with a letter of appreciation for use of
the Community Center.
.8 ADJOURNMENT: There being no further discussion, Mayor
Sawyer declared the meeting adjourned at 10:43 P.M.

The Schertz City Council convened in Regular Session, Tuesday,
March 20, 1984, at 7:00 P.M. in the Council Chambers, 1400 Live
Oak Road with the following members present: Mayor Earl W.
Sawyer, presiding; Hal Baldwin; Ross Hoover; Adolph Aguilar and
Ken Greenwald. Absent: Charles B. Sharpe. Staff were City
Manager Jimmy G. Gilmore and City Secretary June G. Krause.
After welcoming everyone to the meeting, Mayor Sawyer presented a
Proclamation to Mrs. Lillian Nelson, president of the V.F.W.
.8315 Auxiliary proclaming the week of March 26-31 as nLite-A-
Bike Weekn.
Mrs. Nelson then presented Certificates of Appreciation to Police
Chief James W. Keith, Police Sergeant Jeronimo Marin, Fire Chief
Ed Melton, Fire Marshal Fritz H. Rusch, SAFES Director Thomas
Funk and Asst. SAFES Director Carline Scott and City Secretary
June G. Krause.
Mayor Sawyer thanked Mrs. Nelson, adding that the City is proud
as always for the Auxiliary and V.F.W. for taking an active part
in our community and recognizing some of our employees.

the Regular Meeting of March 6, 1984, be approved. Mr. Aguilar
