ccreg 04-03-1984 n I l I l 227 REGULAR MEETING OF THE CITY COUNCIL APRIL 3, 1984 The Schertz City Council convened in Regular Meeting Tuesday, Apreil 3, 1984, at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the following members present: Mayor Earl W. Sawyer, presiding, Charles B. Sharpe, Hal Baldwin, Ross Hoover; Adolph Aguilar and Ken Greenwald. Staff present were City Manager Jimmy G. Gilmore and City Secretary June G. Krause. BOARD OF ADJUSTMENT HEARING: Mayer Sawyer welcomed everyone to the meeting and explained that the first thing to be taken up was a hearing before the Board of Adjustment, which is made up of the members of the Council. The purpose of the hearing is to hear a request by Mr. George Barnard for a variance to the 25 foot set back requirement on the joint property line on a 3 acre tract of land on Live Oak Road. Mr. Barnard said in reality is was a 2.4 acre tract of land North of City Hall and across from the Sabastian Apartments. The project is designed to make the highest and best use of the land. There will be 187 mini storage units and in front will be small offices. City ordinance requires a 25 foot set back on the sides, which would impact the property and makes it unfeaseable. If he could move the buildings back to the property line and use the back of the buildings instead of the 8 foot required privacy fence, it would look better and use the land to its best advantage. When questioned by Council about not having proper room for maintenance of the back side of the building, Mr. Barnard said he would be glad to leave a 3 to 5 foot area for this purpose. Mr. Barnard said he would prefer 3 foot. He also said he would be building in stages, depending on need. After completing discussion of the request, Mayor Sawyer called for a vote on the issue. Mr. Greenwald moved to approve the variance with a 3 foot set back, providing that all drainage is to the front. Mr. Aguilar seconded the motion. Mr. Sharpe questioned the need to put the question of drainage in the motion as it would be taken up with P&Z on plat approval but Mr. Greenwald wanted the motion left as originally made. The Mayor called for a vote on the motion, which carr ied as follows: AYES: Councilmembers Sharpe, Baldwin, Hoover, Aguilar and Greenwald. NAYS: None #1 APPROVAL OF MINUTES: Mr. Aguilar asked that the last sentence of the last paragraph on page 216 of the minutes of March 14, 1984 be changed to read as follows: 228 "Mr. Aguilar corrected the statement saying tha~ Mr. Simmons said 0 he would give us in trade the land in the back for frontage land and we would give him the $60,000." Mr. Hoover moved to approve the minutes of the Workshop of March 14, 1984, and the Regular Meeting of March 20, 1984 as corrected. Mr. Baldwin seconded the motion, which carried as follows: AYES: Councilmen Baldwin, Hoover, Aguilar and Greenwald NAYS: NONE ABSTAINING: Mr. Sharpe .2 HEARING OF RESIDENTS: None .3 POLICE RESERVE APPOINTMENTS: Mayor Sawyer said that two men had been recommended for Police Reserve appointments - Mr. Arthur Young, Jr. and Mr. Stephen Starr. Council studied their folders at this time. While Council was going over the folders, Mayor Sawyer introduced Mr. Bud K ~ rkendall who is running for Distr ict Attorney of the 23rd Judicial District. After Mr. Krrkendall addressed Council, Mayor Sawyer called for a short recess at 7:32 P.M. The Regular Session was reconvened at 7:38 P.M. Mayor Sawyer then called for a motion on the recommended appointments. Mr. Sharpe moved to appoint Mr. Arthur Young, Jr. and Mr. Stephen Starr as Police Reserve Officers for the City of Schertz. Mr. Baldwin seconded the motion, which carried as follows: AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and Greenwald. NAYS: NONE o 14 BID AWARD: Mr. Gilmore said that only two bids were received for the air compressor with only $1.00 difference in the two bids. He recommended awarding to the higher bidder as they are located in our City and repairs and down time would be less than having to go across San Antonio for repairs. Also the one recommended does meet our specifications. Mr. Baldwin moved to accept the bid from McKenzie Air Industries, in the amount of $9,900 for the air compressor. Mr. Sharpe seconded the motion, which carried as follows: AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and Greenwald. NAYS: None o n n l 229 #5 ORDINANCE: The Mayor introduced an ordinance and read the caption as follows: ORDINANCE NO. 84-S-9 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING THE ZONING ORDINANCE 79-S-15 OF THE CITY OF SCHERTZ, TEXAS, BY REZONING APPROXIMATELY 74 ACRES OF LAND OUT OF GUADALUPE COUNTY TO A PLANNED UNIT DEVELOPMENT (PUD); AND APPROXIMATELY 24 ACRES OF LAND OUT OF GUADALUPE COUNTY FROM R-l TO R- 2 SINGLE FAMILY DWELLING DISTRICT, AND REFLECTING SUCH CHANGES ON CERTAIN ZONING MAPS IN ACCORDANCE WITH THE SCHERTZ ZONING ORDINANCE. Mr. Aguilar moved to approve on final consideration the ordinance amending the zoning ordinance by rezoning 74 acres out of Guadalupe County to a PUD and 24 acres out of Guadalupe County to R-2. Mr. Baldwin seconded the motion which carried as follows: AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and Greenwald NAYS: None #6 ORDINANCE: Mayor Sawyer introduced an ordinance for emergency consideration and read the caption as follows: ORDINANCE NO. 84-A-lO AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEXATION OF A TRACT OF LAND CONTAINING 305.52 ACRES OF LAND OUT OF COMAL COUNTY AND DECLARING AN EMERGENCY. Mr. Greenwald moved to approve as an emergency an ordinance annexing 305.52 acres of land out of Comal County. Mr. Hoover seconded the motion, which carried with the following vote: AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and Greenwald NAYS: None #7 ORDINANCE: Mayor Sawyer introduced an ordinance and read the caption as follows: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING 230 SECTIONS 18-32 STOP, 18-35 YIELD, 28-76 SPEED, 18-91 PARKING PROHIBITED, OF SAID CODE. o Mr. Aguilar moved to accept the first reading of an ordinance amending the Code of Ordinances by amending Sections 18-32, 18=35, 18-76 and 18-91. Mr. Greenwald seconded the motion which carried with the following vote: AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and Greenwald NAYS: None .8 TRANSFER OF APPROPRIATIONS: Mr. Gilmore presented a list of modifications to the budget, that included areas in which the Council has approved additional funding. Mr. Sharpe moved to transfer appropr iations in the accounts in accordance with Section 7.07(a) of the City Charter as presented by Mr. Gilmore in the amount of $18,050 in Revenues and $14,720 in expenditures. Mr. Greenwald seconded the motion which carried with the following vote: AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and Greenwald. NAYS: None .9 RESOLUTION: Mayor Sawyer introduced a resolution . 0; setting a pUblic hearing and read the caption as follows: RESOLUTION NO. 84-R-8 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, SETTING THE TIME, DATE AND PLACE FOR PUBLIC HEARINGS PURSUANT TO THE PROPOSED ANNEXATION OF 296.78 ACRES OF LAND, MORE OR LESS, OUT OF COMAL COUNTY AND 51.852 ACRES, MORE OR LESS, OUT OF COMAL AND GUADALUPE COUNTIES. Mayor Sawyer explained the public hearings are being set for May 1, 1984 and the second to fall on May 15, 1984. Mr. Sharpe moved to approve the resolution calling for public hearings for annexation of 296.78 acres out of Comal County and 51.852 acres out of Comal and Guadalupe County. Mr. Greenwald seconded the. motion which carried with the following vote: AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and Greenwald. NAYS: None .10 EXECUTIVE SESSION: None needed o ,il' 231 r I I \. ill CITY MANAGER'S REPORT: In regards to the submission of application for consideration of the state Library Depository, they have invited Council to Sam Houston Center in Liberty Texas on April 14 to see their depository. The State Highway Department submitted a sample of a contract for skid testing on streets. They will come out and conduct test on our streets at no cost to the city. He asked if Council desires to participate in this testing. Mr. Gilmore presented articles from the New Braunfels Herald- Zeitung concerning present, planned and future industrial development in Schertz. Also articles where we received good reviews in the San Antonio papers. Mr. Gilmore reported that our Chief of Police had attended a Law Enforcement Instructors training course put on by the FBI. He did pass and received very good statements from instructors. This allows him to instruct at the college level or at the academy. The City's new fire truck should be arrIvIng within 10 to 14 days. The Fire Chief has extended an invitation to all Councilmembers to visit the fire station at any time. The Auxilliary has donated about $30,000 in equipment for the new truck. r \ #12 ITEMS BY COUNCIL: Mr. Sharpe mentioned the fire l protection agreement with Bexar County and wondered how we stand with Guadalupe County. Mr. Gilmore said that Guadalupe County provides us with $1,500 a year plus they pay for gasoline used by the fire department and are this year paying on the insurance. Bexar County is paying us $400 per month to cover that area of Bexar County in our ETJ that we have been covering as secondary all the time anyway. Every time the Judge of Commissioner's Court comes to Schertz he is approached about a contract by the Fire Chief, City Manager and sometime by the Mayor as well. Mr. Baldwin asked why we are contracting with Bexar County when other cities are dumping them right now. Mr. Gilmore said that Converse and Universal City should never have contracted with them in the first place. We are the only one in the area that can take care of it. Mr. Sharpe asked if there was anything new on the SAFES/Randolph contract. Mr. Gilmore said it was till on hold but negotiations are still going on. Mr. Baldwin asked if Council could discuss the Bell Ringer List at the next Workshop. \ Mr. Aguilar stated that the Library Board will support our application for the State Library Depository for Schertz. Their Booksale made about $1200 plus. 232 Mr. Greenwald said that the key chains recently received had really gone over well. He asked if the City could buy some more. 0 Wi th Council agreement, Mayor Sawyer instructed staff .to send in another order for key chains. 113 ITEMS BY MAYOR: Mr. Sawyer said he met with the Chamber of Commerce today concerning their 135 brochure. They are asking cities for $1,000 plus cost of an advertisement in the brochure. The city would receive about 50 books and the Chamber would distribute the rest. Council concensus was to authorize the $1,000 plus the cost of the ad expenditure. 114 ADJOURNMENT: adjourned at 8:24 P.M. unanimously carried.
