REGULAR SESSION OF THE CITY COUNCIL
APRIL 17, 1984
The Schertz City Council convened in Regular Session, Tuesday,
April 17, 1984, at 7:00 P.M. in the Council Chambers, 1400 Live
Oak Road with the following members present: Mayor Earl W.
Sawyer, presiding; Charles B. Sharpe, Hal Baldwin, Ross Hoover,
Adolph Aguilar, and Ken Greenwald. Staff were City Manager Jimmy
G. Gilmore and City Secretary June G. Krause.
PUBLIC HEARINGS: Mayor Sawyer said that tonight two public
hearings are being held jointly with the Planning and Zoning
Members. He then turned the meeting over to Mr. Beauchemin, Vice
Chairman of the Planning and Zoning, who explained the purpose of
the public hearings.
Mr. Beauchemin said that the purpose of the hear ings is to
receive citizen input from the public regarding the two requests.
After hearing the citizens input, the Planning and Zoning has ten
days in which to make their recommendation to Council and then
Council will vote on the issues at their next regular meeting.
The first hearing concerns the rezoning of approximately 35 acres
from an Apartment/Multi-Family Dwelling District (R-4) to a
Neighborhood Service District (NS). He then asked Mr. Johnson to
explain a little about his request for rezoning.
Mr. David Johnson said said he purchased 200 acres on FM 3009 and
is requesting the front part be rezoned from R-4 to Neighborhood
Services. There will be a flood plain area between this and the
housing area. He showed a plan of the basic idea of the layout,
saying they tried to conform to other areas on FM 3009 with the
buffer zone and limited entrances. There will be about 30%
retail and 60% offices - there will be no apartments in this
area.
There were no citizens wishing to speak either for or against
this request, and there were no questions from P&Z.
Council asked a few questions concerning the number of entrances
and the starting time frame, which Mr. Johnson said should be
within the year with the retail being built first.
There being no further questions, Mayor Sawyer declared this
portion of the public hearing closed at 7:15 p.m. and immediately
opened the second public hearing.

There were no questions from citizens, the Planning and Zoning
Commission or Council. Mayor Sawyer said this is land that 0
Council disannexed about four years ago on the promise that a ,
company would develop and since they did not commence building,
we have reannexed the land and it now needs to be rezoned
Industrial District as the surrounding area is already zoned.
Mayor Sawyer then declared the public hearing closed at 7:18 p.m.
The Mayor then ask P&Z members to remain to hear Mr. Steve
Simonson, Executive Director of the Schertz Housing Authority
discuss housing availability.
Mr. Simonson first explained the difference in subsidized and
non-subsidized housing. The Sabastian apartments are non-
subsidized and are low for to moderate income families. About 33
of the 60 units at Val Verde are partially subsidized and of
course the elderly housing at Clyde Ford Village is subsidized
housing. Mr. Simonson explained the process for determining the
different types of rent based on adjusted gross income.
After thanking Mr. Simonson for coming before Council, Mayor
Sawyer again asked P&Z members to stay for a presentation by our
Fire Chief, Ed Melton.
Fire Chief Melton gave a report on Fire Department response time,
saying that of the 145 runs within the city limits, the response
time was from 1 to 6 minutes - an average of 2 minutes 45
seconds. Of the 44 calls outside the city limits, the response
time was from 5 to 15 minutes. He said that does not count the 7
to 10 calls a month that he makes on his own that do not require
the trucks.

At 7:33 p.m., Mayor Sawyer called for a short recess.
The meeting was reconvened at 7:44 p.m.
11 APPROVAL OF MINUTES: Mr. Aguilar moved to table this
item as the minutes were not submitted in a timely manner. Mr.
Baldwin seconded the motion, which carried with the following
vote:
AYES: Councilmembers Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.
NAYS: None

ORDINANCE NO. 84-E-ll
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, CANVASSING THE RETURNS AND
DECLARING THE RESULTS OF THE CITY OFFICER
ELECTION HELD IN SAID CITY ON THE 7TH DAY OF
APRIL, 1984, AND DECLARING AN EMERGENCY.
Mr. Aguilar moved to approve as an emergency measure an ordinance
by the City Council canvassing the returns and declaring the
results of the April 7, 1984 election. Mr. Sharpe seconded the
motion which carried as follows:
AYES: Councimen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald
NAYS: None
#4 SWEARING-IN CEREMONIES: Mayor Sawyer said that in all
the years he has been associated with the City, it has been the
most pleasant experience working with the present City Council.
Mrs. Krause swore in Earl W. Sawyer as Mayor of the City of
Schertz, Texas.
Mayor Sawyer then swore in Mr. Charles B. Sharpe, Place 1, Mr.
_-- Hal Baldwin, Place 2, and Mr. Ken Greenwald, unexpired term of
Place 5.
#5 MAYOR PRO-TEM: Mr. Aguilar, Mayor Pro Tem, moved that
Mr. Charles B. Sharpe be Mayor Pro Tem for this year. Mr. Ross
Hoover seconded the motion, which carried as follows:
AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.
NAYS: None
#6 ORDINANCE: Mayor Sawyer introduced and read the caption
on an ordinance as follows:
ORDINANCE NO. 84-D-12
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF
ORDINANCES, CITY OF SCHERTZ, TEXAS BE AMENDED
BY REVISING SECTIONS 18-32 STOP, 18-35 YIELD,
18-76 SPEED, 18-91 PARKING PROHIBITED, OF SAID
CODE.

Mr. Greenwald moved to approve the ordinance by the City Council
providing the Code be amended by revising Sections 18-32, 18-35,
18-76 and 18-91. Mr. Aguilar seconded ,the motion which carried
with the following vote:

.8 CITY MANAGER'S REPORT:
A. Mr. Gilmore handed out samples of a new report that is to be
distributed monthly.
B. He handed out a packet from TML on the Pot Hole bill, which
will be discussed at the next workshop.
C. Also had a financial report submitted by BVYA.
D. Mr. Gilmore said he had been asked to inform Council of a
preliminary opening celebration Wednesday evening for the Bangkok
Restaurant on FM 78, price is $10 per person. County politicians
have been invited.
E. Also there will be a RMeet Houston MunsonR night in the park
on April 26th at the small pavilian and Council are invited.
.9 ITEMS BY COUNCIL:
A. Mr. Sharpe advised the Greater Randolph Area Chamber of
Commerce will have a general membership luncheon Apr il 26th at
11:30 a.m. at Northcliffe Country Club. It should be interesting
to Council and P&Z members as Mr. Thomas Van De Walle of Barshop
Industries will be guest speaker.

B. Mr. Sharpe said he would like to have a report from the
County on the progress of plans they are making on the Unit
System. Mayor Sawyer said he heard they are getting ready to
interveiw an engineer for the road work and that Judge Sagebiel
has been going to other counties to see how it works. Mr.
Gilmore suggested inviting the County Judge and our two
Commissioners to brief Council at the first meeting in May.
C. Mr. Sharpe also wondered when we are going to get someone
from the County Tax Assessor's office to come back down here to
sell license tags, etc.. He suggested writing them that we value
their service and would like to know their plans for the future.
D. Mr. Baldwin said he was appointed to the Budget Review
Committee for the County Appraisal District. He reported on the
first meeting where items such as the need for aerial mapping,
whether to contract service to reappraise or do the work in-
house, discussed about putting an Appraisal District satellite
office in Western Guadalupe County. He said they would be
meeting three or four more times and he would keep Council
informed.

E. Mr. Baldwin mentioned about tank trucks from Pleas Naylor
r getting water from fire hydrants. Mr. Gilmore said the meters
\ for the hydrants cost about $290 each. Mr. Baldwin said he
:, thought we should buy meters for all of the hydrants used for
this purpose. This to be discussed at workshop.
F. Mr. Hoover congratulated the Mayor and Councilmembers on
being re-elected to office, saying he has enjoyed working with
them and looks forward to future years.
G. Mr. Hoover also asked the City Manager to keep Council up to
date on the ordinance regulating businesses on FM 3009.
Mayor Sawyer called a recess at 8:25 p.m.
The meeting was reconvened by Mayor Sawyer at 8:30 p.m.
H. Mr. Aguilar said that at the last meeting of the Cor r idor
Committee, they named the cities that had sent in their money and
Schertz was not mentioned. Mr. Gilmore said our check would be
in the mail this week. '

J. Mr. Greenwald asked if the City had received anything on the
opening day ceremonies for BVYA. Mr. Gilmore said no. Mr.
Greenwald said it is this Saturday the 21st so he was sure
something would be coming in and to notify Councilmembers.
ill ITEMS BY MAYOR: Mayor Sawyer said Mr. Baldwin would
like to make an announcement.
Mr. Baldwin announced that Senior Citizen Day would be May 12th
and they have changed the location from the Community Center to
the Catholic Church hall because they have all the equipment
necessary to the dominoe tourneyment and bingo games they will be
having, plus the PA system, and are letting us have it at no
charge. The opening ceremonies will be in front of Municipal
Complex at 8:30 a.m., dominoe tourneyment at 9:00, lunch at 11:30
and bingo starting at 1:00 p.m. Mr. Baldwin said they are taking
contributions for bingo prizes and would prefer household items
the senior citizens could use daily.
