REGULAR MEETING OF THE CITY COUNCIL
MAY 1, 1984
The Schertz City Council convened in Regular Session, Tuesday,
May 1, 1984, at 7:00 P.M. in the Council Chambers, 1400 Live Oak
Road with the following members present: Mayor Earl W. Sawyer,
presiding, Charles B. Sharpe, Hal Baldwin, Ross Hoover, Adolph
Aguilar and Ken Greenwald. Staff were City Manager Jimmy G.
Gilmore and City Secretary June G. Krause.
Mayor Sawyer welcomed everyone to the meeting and then
recognized representatives of the Veterans of Foreign Wars Post
8315, who had a presentation to make. VFW Commander John Gravor
and Mr. Curtiss Cross presented a $500 check to Fire Chief Ed
Melton to purchase equipment for the new fire truck.
PUBLIC HEARINGS: Mayor Sawyer opened the first publ ic
hear ing, explaining the purpose was to receive citizen input
regarding the proposed annexation of approximately 296.78 acres
of land out of Comal County. Mr. Gilmore pointed out on the map
the location of this tract, being on the west side of FM 3009
between the Missour i-Kansas-Texas and Missour i Pacific Railroad
tracks.
There were no citizens wishing to speak either for or against
this proposed annexation. There were no questions from Council.
Mayor Sawyer declared this public hearing closed at 7:03 P.M.
B. The Mayor said the purpose of this second public hearing was
to receive citizen input regarding the proposed annexation of
approximately 51.852 acres of land out of Comal and Guadalupe
Counties. Again Mr. Gilmore pointed out the location of this
tract located on the west side of FM 1103 from IH35 to
Wieder stein Road. Mr. Gilmore said the City has received letters
from two property owners within this tract requesting annexation.
There was no citizen comments nor questions from Council. Mayor
Sawyer declared this public hearing closed at 7:05 P.M.
#1 APPROVAL OF MINUTES: Mr. Aguilar asked that the minutes
of the Workshop of Apr il 11, 1984 be corrected as follows: in
the first paragraph Mr. Hoover's name should correctly read
nRoss" rather than his first name "CarIn. In the first sentence
of item #1 the word naskn should be past tense, and in the third
paragraph of item #2 nETAn should correctly be nETJn. Mr.
Aguilar also asked that on page 240 of these minutes, under item
#8 D. the term nCounty politicians" be changed to nCounty
Officials".
Mr. Sharpe moved the minutes of the Workshop Session of March 28,
1984, the Regular Session of April 3, 1984, the Workshop Session
of April 11, 1984 and the Regular Session of April 17, 1984 be
approved as corrected. Mr. Baldwin seconded the motion which
carried with the following vote:

12 HEARING OF RESIDENTS: Mr. Anderson of Buffalo Valley
Youth Association said he would like to make Council aware that
they have signed contracts and will have two tournaments this
summer. The first will be July 6-8, the San Antonio Area City
Tournament, with 60 teams in a 60 mile radius. The second is the
Texas Interstate Tournament on July 28-29 and will have 70 teams
from Texas, Louisiana and Oklahoma. He said they will be coming
to the City for support in the form of additional services. BVYA
will try to have their request in writing to the City by the 2nd
of May. Mayor Sawyer invited Mr. Anderson to the next Council
Workshop to discuss their needs.
Mrs. Dorothy Hopkins addressed Council asking that they either
remove the nno parkingn signs in front of Val Verde Apartments or
at least make it a 30 minute parking zone. Mr. Gilmore reminded
Mrs. Hopkins and her sister that the apartments have parking
spaces and a temporary parking zone/turn around in front. It was
also explained to them about the hazards of parking on a
thoroughfare, especially now that the area is becoming more
congested with all the new building.
13 UNIT ROAD SYSTEM: Mayor Sawyer explained that Council )'
had asked the County Judge and our Commissioners to be present to 'I
br ief us on the progress being made to implement the Unit Road '---'
System in Guadalupe County. Judge Sagebiel was unable to come
but sent a letter explaining what progress has been made. They
have visited other counties that have already implemented the
unit road system and are in the process of interviewing an
engineer, which they hope to have employed by the end of May.
Both Commissioner Malford Ackermann and George Grein were present
but could add little to what the JUdge had wr itten. They
indicated they were waiting to hire an engineer and get his
recommendations before really getting started. They hope to have
the system implemented by the end of 1985.
.4 ZONING CHANGES: A. Zoning Change .54 - rezoning from
R-4 to Neighborhood Services (NS) frontage along FM 3009 of the
Oak Run Subdivision.
Mr. Greenwald moved to approve the rezoning from R-4 to
Neighborhood Service as requested in Zoning Change 154. Mr.
Aguilar seconded the motion, which carried as follows:
AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.

B. Zoning Change i55 - rezoning from predevelopment (PD) to
Industrial District (M-1) 10.5 acres. Mr. Gilmore explained this
is the area in Naylor Industrial Park that was recently reannexed
into the City.
Mr. Baldwin moved to adopt Zoning Change #55 rezoning from PD to
Industrial District (M-l) 10.5 acres on FM 3009. Mr. Greenwald
seconded the motion, which carried with the following vote:
AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.
NAYS: None
#5 RESOLUTION: Mayor Sawyer introduced a resolution and
read the caption as follows:
RESOLUTION NO. 84-R-8
A RESOLUTION SUPPORTING INCREASED STATE
HIGHWAY FUNDING, PASSAGE OF THE POTHOLE
BILL AND INCREASED HIGHWAY USER CHARGES
Mr. Sharpe moved to approve the resolution supporting funding by
user charges for the nPothole" bill. Mr. Aguilar seconded the
motion, which carried with the following vote:

#6 EXECUTIVE SESSION: None was needed.
#7 CITY MANAGER'S REPORT: Mr. Gilmore announced that on
May 8 at the P&Z meeting, there will be someone there to brief
P&Z on AICUZ.
#8 ITEMS BY COUNCIL: Mr. Aguilar said he had received a
compliment for the Inspection Department. They insisted a
contractor redo some work that did not pass inspection.
Mr. Baldwin thanked Councilmernbers for donating their April
Council meeting checks for the Senior Citizen Day activities.
Mr. Sharpe reminded everyone of the 25th Anniversary celebration
of the Auxiliary of the Fire Department to be held Sunday, May 5,
1984.
#9 ITEMS BY MAYOR: Mayor Sawyer asked the City Manager to
check on a complaint he had from a citizen in Deer Haven
concerning workers ru ining the grass on pr i vate property wh ile
working on lines there.

Mayor Sawyer thanked the County Commissioners for coming to our
meeting and thanked all the candidates as well. He said we are
vitally interested in what is going on in our ares.

.10 ADJOURNMENT: Mr. Hoover moved the meeting be adjourned
at 7:40 P.M., Mr. Baldwin seconded the motion which carried
unanimously.
