' - i I ~ -- . t 253 REGULAR MEETING OF THE CITY COUNCIL MAY 15, 1984 The Schertz City Council convened in Regular Session, Tuesday, May 15, 1984, at 7:00 p.m. in the Council Chambers, 1400 Live Oak Road with the following members present: Mayor Earl W. Sawyer, presiding, Mayor Pro-Tern Charles B. Sharpe; Hal Baldwin, Ross Hoover; Adolph Aguilar and Ken Greenwald. Staff were City Manager Jimmy G. Gilmore and City Secretary June G. Krause. PUBLIC HEARINGS: A. Mayor Sawyer explained the purpose of this public hearing was to receive citizen input concerning the proposed annexation of approximately 296.78 acres of land out of Comal County. Mr. Gilmore pointed the area out on the map stating that the area is bordered by F.M. 3009, the Missouri-Kansas-Texas and Missouri Pacific Railroad tracks and what would be Lookout Road if it was extended. There were no citizens wishing to speak on this proposal nor did Council have any questions. Mayor Sawyer declared the public hearing closed at 7:01 P.M. B. Mr. Sawyer said the purpose of this second public hearing was also to obtain citizen input regarding the proposed annexation of approximately 51.852 acres of land out of Comal and Guadalupe Counties. Again Mr. Gilmore pointed the area out on the map, saying it is on the West side of F.M. 1103 from IH 35 to Wiederstein Road. There being no comments from citizens or Council, Mayor Sawyer declared this public hearing closed at 7:02 P.M. Before continuing with the regular agenda, Mayor Sawyer read a Proclamation proclaming the week of May 13th through 19th, 1984 as nMunicipal Clerk's Weekn, presenting the document to City Secretary June Krause and Deputy City Secretary Alice Austin. He then read a Proclamation proclaming the week of May 21st through 26st, 1984 as npublic Works Week n and presented the proclamation to Streets & Parks Superintendent Jerry Graham and Water & Sewer Superintendent John Bierschwale. #1 APPROVAL OF MINUTES: A. Special Meeting of April 25, 1984 and B. Regular Meeting of May 1, 1984. Mr. Aguilar asked that the fourth paragraph under 16 on page 426 be corrected to read as follows: n In answer to Mr. Aguilar's question regarding Cibolo's water distribution system and water agreement, Mr. Gilmore said he had talked with Mr. Brooks of Cibolo and they have a letter on its way asking for a meeting of the two city's Mayors, City Managers and attorneys.n 254 Mr. Greenwald asked that his name be listed correctly in the second paragraph of page 247 and that the last word on page 251 O. of the minutes of May 1, 1984 be corrected to read -area-. Mr. Aguilar moved to accept the minutes of the Special Meeting of April 25, 1984 and the Regular Meeting of May 1, 1984 as corrected. Mr. Baldwin seconded the motion, which carried with the following vote: AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and Greenwald. NAYS: None .2 HEARING OF RESIDENTS: Mr. Anderson reserved time for item No.5. Mr. Jack Warren of the Cibolo Valley Jaycees said the newly elected Board of Directors of their organization would like to assist the City in any and all endeavors where they could. He said he personally wanted to offer his services to the City. Mr. Daniel Jameson of 1045 Richmond Drive addressed Council concerning the drainage ditch in back of his parent's property. He said he had personally measured the ditch in several places. He then referred to a letter received by them and signed by the Mayor stating the City engineer said the drainage ditch could not be altered. Mr. Jameson said in his opinion it could be altered, that according to his measurements, it could be made smaller. Mayor Sawyer asked Mr. Jameson if he was an engineer, to which Mr. Jameson replied no. The Mayor said that our engineer says it cannot be altered and that we have to take the word of the engineer, since none on the Council are engineers. Mr. Sawyer said the City is in the process of replacing the posts that were removed, which will prohibit parking or driving in the ditch and that is about all the City can do. Mr. Sawyer asked if Mr. Jameson could have his engineer talk with Mr. Ford, the City engineer, about this problem. The City is bound to go with the man that we are paying to do the engineering for the City. Mr. Jameson said that through a verbal mutual agreement between his family and their neighbnor, the neighbor has put up an eight foot fence on the Jameson property. He wanted to know why the City gave this man permission to build a fence on other people's property. Mr. Gilmore explained that the City sells the permits but does not determine property ownership. .3 ORDINANCE: Mayor Sawyer introduced and ordinance prohibiting glass containers in city parks. read an AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING ORDINANCE NO. 80-M-16 (PARK ORDINANCE) BY ADDING A SECTION PROHIBITING GLASS CONTAINERS WITHIN THE PARK AREAS. U 255 r I . , Mr. Hoover moved to approve the first reading of an ordinance amending the Park Ordinance by prohibiting glass containers in city park areas. Mr. Baldwin seconded the motion, which carried with the following vote: AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and Greenwald. NAYS: None 14 GRA-TRAil REQUEST: Mr. Gilmore said that the Greater Randolph Area Trail Riders Association had previously asked to hold a chili cook-off in the large pavilion at the park. Now they find that overnight camping for the cooks is necessary for their affair to be State sanctioned. Our ordinances prohibit over-night camping without specif ic approval, so they are now asking Council for that approval. The Mayor and City Council agreed to their request for over-night camping, the details to be worked out with the Parks Superintendent. #5 BVYA: Before commencing discussion on this subject, Mayor Sawyer called for a short recess at 7:32 p.m. The regular meeting was reconvened at 7:38 p.m. -- \ , Mr. Gilmore had presented a memo from the Park Super intendent regarding the requests made previously by BVYA. Mayor Sawyer explained to Mr. Gene Anderson that the City does not forsee any great problems with their request with the exception of lighting. ! Mr. Anderson said that Mr. Graham's recommendations on camper parking and traffic were excellent. He also said that he believed BVYA could solve the electric problems themselves. One additional request they would like to make is for swimming pool passes for the participants. Last year these went over with great success. Council agreed to this request. Mr. Gilmore said he should have information on BVYA's request for SAFES and police coverage by the 30th of the month. #6 AUDITOR: Mayor Sawyer said that at the last workshop meeting the City Manager had a recommended proposal from Melick and Thorpe for auditing service for the coming fiscal year. Council had requested getting proposals from other firms as well. Mr. Gilmore wanted to know if Council wished to ask for proposals through the newspapers or just solicit proposals from several auditors. He said for professional services, you don't have to . ask for bids but you ask for proposals. Council agreed to just ask auditors for proposals rather than go through the newspapers. 256 .7 EXECUTIVE SESSION: None needed. o .8 CITY MANAGER'S REPORT: A. A letter was received from the Community Council of the Randolph Region regarding the need for long-term landfills in this area. Gordon Blake asked if Schertz would support their statement to the Commissioner of Health, which says -It is critically important in keeping hauling costs reasonable that long term landfills be available in or close to our Region such as the Tessman Road landfill. We urge you to keep this in mind when dealing with appropriate permit applications.n Council said they would support this statement. Mr. Gilmore said he had talked with Henry Gutierrez and they are selling their business to a large firm, but Henry and his brother will stay on and manage the business. The new firm will be checking for a new site and they are large enough to compete with the two large San Antonio firms, who practically have a monopoly in the solid waste field. B. Mr. Gilmore has received SAFES' proposed budget for next fiscal year and would like to discuss it at the next workshop. By Council receiving it this early, it will give them time to study it. If possible, Mr. Funk could be at that workshop. C. The City Manager recommended, with Planning and Zoning acceptance, that Council consider a change to the Height Restr iction in Industr ial Distr icts and General Business along 135 frontage. Lifting this restriction would prohibit delays on developers in the future. Also should consider incorporating the AICUZ into the zoning ordinance. Both of these to be discussed at workshop. F. Mr. Gilmore briefly explained our four well readings, which shows the current water levels of our wells is considerably higher than those reported for San Antonio. Mr. Bierschwale has been taking readings every morning and it looks like the City is in good shape as far as water is concerned. We have an ordinance on the books that governs conservation if it becomes necessary. Mr. Bierschwale recommended the City Manager be allowed to order the lower ing of the pumps when the water level has dropped to forty feet from the base of the pump. If Council desires, Mr. Bierschwale can be at the next workshop to answer questions and brief Council. .9 ITEMS BY COUNCIL: Mr. Sharpe said there has been a lot of discussion in other cities about conserving water and we Ur-'\i' should encourage our citizens to conserve water. ... ~"..!!~i;";;';4~"",........';;'-~" '!!t'~4 ': I'l,.....,"~.'''~~.:ili ,~. ''''~,:~,~,'~'.~..;.~..'~ - r 1 I , r ( r- ! , 257 Mr. Baldwin thanked all the Councilmembers and their spouses for their help during Senior Citizen Appreciation Day. Mr. Hoover said he was looking forward to receiving a letter from Cibolo concerning a mutual water agreement and was disappointed that one had not been received. He felt that if something has not been received by the next workshop, we should consider some other signals to them. Seems they are just ignoring us. Mr. Aguilar said that with all the construction going on, most have good landscape programs going, with the exception of the appartments across the street and they look terr ible. Mr. Gilmore said the problem is with the owners splitting up. We have given them 10 days, action has been initiated plus two phone calls. Mr. Aguilar asked about the condition of Main Street with the repairs being done. Mr. Gilmore said it was Entex doing the work and they will be resurfacing the street. They were contacted today and were told to get out here and fix it. Mr. Greenwald said he would like to see something in the paper regarding unscrupulous roofing firms. With the recent hail damage, people should be warned to be sure the companies they are dealing with are responsible firms. 110 ITEMS BY MAYOR: Mr. Sawyer mentioned a letter being sent out to three trailer parks asking them to give us input and telling them what they are doing wrong. Maybe we will receive some good input from them. The Baptist Church is having a Citizenship Day in July and the Council is invited.
