REGULAR SESSION OF THE CITY COUNCIL
AUGUST 21, 1984
The Schertz City Council convened in Regular Session, Tuesday
August 21, 1984, at 7:00 P.M. in the Council Chambers, 1400 Live
Oak Road with the following members present; Mayor Ear 1 W.
Sawyer, presiding, Charles B. Sharpe, Hal Baldwin, Ross Hoover;
Adolph Aguilar and Ken Greenwald. Staff were Jimmy G. Gilmore
and City Secretary June G. Krause.
Before opening the BOA hear ing, Mayor Sawyer wished to welcome
and congratulate members of Scout Troup 18 and their leader Bob
Sawyer. Mayor Sawyer introduced Mike Sawyer, Stephen Savoy and
Darrel Bent, who had just completed the requirements for Fifty
Miler Badge. Mr. Bob Sawyer explained the Scouts had to hike
fifty miles and perform ten hours of conservation either on the
trail or in their community. They chose to do both. They took a
sixty-three mile backpack trip in New Mexico and did their
community service work by cleaning the area along FM 1518 of
trash. Mayor Sawyer thanked the scouts for remember ing their
city and said the City really appreciates their time and effort.
We are very proud of these fine Scouts..
Mayor Sawyer then presented Mrs. Harriett Lipps with a Certifi-
cate of Appreciation from the City of Schertz. Mrs. Lipps spent
many hours helping the library get started and has served on the
Library Board for many years.
BOARD OF ADJUSTMENT HEARING: After opening the hear ing, Mayor
Sawyer explained the purpose of the hear ing was to consider an
appeal for a special exception to the height requirement for a
sign for the Church of Christ at the southeast corner of Pecan
Drive and FM 1518.
Mr. Baldwin moved to approve this special exception to the Zoning
Ordinance. Mr. Aguilar seconded the motion.
On being questioned by Mr. Sharpe, Mr. Jackson representing the
church said the sign will be located on their property 12 feet
from the right of way on Pecan and 15 feet from FM 1518 right of
way. Mr. Sharpe also wanted to know if they could put the sign
at least eight feet up so you could see under it at that
intersection. Mr. Jackson said the trees would interfer with
visibility and they did not want to cut down the trees.
When Mayor Sawyer called for a vote, the motion carried as
follows:

#1 APPROVAL OF MINUTES: Mr. Sharpe moved to approve the
minutes of the Regular Meeting of August 7, 1984 and the Special
Meeting of August 14, 1984. Mr. Aguilar seconded the motion.

Mr. Aguilar called attention to two typographical errors on page
8 of the minutes of August 7, 1984. Mr. Sharpe asked that the
phrase 'by Bexar County' be deleted from the second paragraph on
page 13 of the minutes of the Special Meeting of August 14, 1984.
Also the date under Item #7 of these minutes should correctly be
October 1, 1984.
Mayor Sawyer called for a vote on the motion, which carried as
followed:
AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.

#2 HEARING OF RESIDENTS: Mrs. Liz Mueller said the Schertz
Humane Society would like to have a nGrand Openingn of the Animal
Shelter the first week of October. They plan to invite Universal
Ci ty and Converse City Councils and Animal Shelter people. In
order to do this, there is still some work to be done at the
shelter - the two open septic tanks in particular. Mr. Gilmore
said this repair is on the schedule and parts are on order, but
he will push to get the work done.
#3 RESOLUTION: The Mayor introduced a resolution and read
the caption as follows:
RESOLUTION NO. 84-R-12
A RESOLUTION BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, SETTING A TIME, DATE AND
PLACE FOR PUBLIC HEARINGS PURSUANT TO THE
PROPOSED ANNEXATION OF 850.53 ACRES OF LAND,
MORE OR LESS, OUT OF GUADALUPE COUNTY.
Mr. Sharpe moved to approve this resolution setting public hear-
ings for September 4, 1984, on the proposed annexation of 850.53
acres of land out of Guadalupe County. Mr. Baldwin seconded the
motion.
Mr. Sharpe amended his motion to include the date of the second
public hearing - September 18, 1984. Mr. Baldwin seconded the
amendment, and the motion carried with the following vote:
AYES: Councilmembers Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.

AN ORDINANCE
ESTABLISHING SPEED LIMITS ON FM 3009 FROM THE
NORTHWEST CITY LIMITS OF SCHERTZ SOUTHEASTERLY
TO THE INTERSECTION OF FM 78 IN THE CITY OF
SCHERTZ, TEXAS, AND REPEALING ALL ORDINANCES
IN CONFLICT.

Mr. Gilmore said that although Council wanted the speed limits
lowered the entire length of FM 3009 in our city limits, the ones
shown on the strip map are the only ones the Highway Department
will go along with at this time.
Mr. Baldwin as~ed if the City has complete traffic jurisdiction
within our cityc limits. Could the City place speed signs and
enforce them within our city limits? Mr. Gilmore said he would
check with the att9rney and let him know.
Mr. Baldwin moved to approve the first reading of an ordinance
establishing speed limits on FM 3009 from the northwest city
limits to the intersection of FM 78. Mr. Greenwald seconded the
motion.
Mr. Sharpe said that some"months ago the Council asked the High-
way Department to decrease the speed limits because there are
already about 33 driveways' and more to come. The charts
furnished by them and the one ~o~ 1979 show no fatalities and Mr. Ul \
Sharpe said he remembered there were some. In comparing the two
charts, they come up with the same counts on vehicles counted as
well as percentile speed count ,and the number of top speed
measured, which seems strange as the charts were made four years
apart. Mr. Sharpe said he felt Council should go back to them
and ask for reduced speed all the waytrom FM 78 to FM 3009.
Mr. Aguilar suggested Council accept wh.t.~hey have presented and
at least get that protion lowered and then keep after them to
lower the rest. '
Mr. Gilmore was instructed to contact the Highway Department
again with the request to lower the speed all..:the 'way to FM 3009.
Mayor Sawyer then called for a vote and the motion carried as
follows:

#5 ZONING CHANGE 158: Mayor Sawyer said this is a' request
by Charlie Kucherka to rezone approximately 2.7 acres' of land
from Single Family Dwelling District (R-l) to Neighborhood
Service Distr ict (NS). The Planning and Zoning Commission has O'
recommended approval of this request.

Mr. Baldwin moved to approve the request for rezoning approxi-
mately 2.7 acres of land from Single Family Dwelling District to
Neighborhood Services. Mr. Greenwald seconded the motion.
Mr. Baldwin and Mr. Sharpe both said we should ask Mr. Kucherka
to consider Office and Professional zoning rather than Neighbor-
hood Ser ices. Based on information at the public hear ing, he
said he would have space for doctors, lawyers, dentists and real
estate people.
Council then discussed this request as it would be effected by
the overlay zoning and set back requirements of other development
in the same area, the driveway between the two pieces of property
owned by Mr. Kucherka, the entrances and exits planned, etc.
After discussion, Mr. Baldwin withdrew his motion and Mr.
Greenwald withdrew is second.
Mr. Baldwin then moved to zone this property Office and Profes-,
sional District if Mr. Kucherka gets Mr. Beck's written consent
to use Mr. Beck's driveway for ingress and egress to both pieces
of property, with provision for fifty foot setback from FM 3009
and twenty-five foot setback from the property currently zoned
residential and the fence requirements as in the zoning
ordinance. Mr. Aguilar seconded the motion, which carried with
the following vote:

#6 ZONING CHANGE t59: Mayor Sawyer said this is a request
from Planning and Zoning to rezone approximately 513 acres of
land from Predevelopment Distr ict to Industr ial Distr ict. The
Commission recommends approval. He then asked Mr. Gilmore to
point out the area under discussion on the map.
Mr. Sharpe moved to approve the Planning and Zoning recommenda-
tion to rezone approximately 513 acres of land from Predevelop-
ment District to Industrial District (Ml). Mr. Baldwin seconded
the motion, which carried as follows:

#7 P&Z APPOINTMENT: Mr. Sawyer said the Planning and
Zoning members have recommended James Harden be selected to fill
the position being vacated by Mr. Boswell.
Mr. Greenwald moved to appoint Mr. James Harden to f ill the
vacancy of Lee Boswell on the Planning and Zoning Commission.
Mr. Aguilar seconded the motion, which carried as follows:

#8 EXECUTIVE SESSION: Mayor Sawyer called an Executive
Session under Article 6252-17 on personnel Section 2(g) at 8:05
P.M.
The regular session was reconvened at 8:27 P.M. and Mayor Sawyer
said Mr. Gilmore was given certain instructions, which he will
comply with.
#9 CITY MANAGER'S REPORT: A. Concerning the water mains
on Lindberg, the lines are at least 30 years old and were put in
with at least 30 year old techniques. To repair them and get
them back on line, we need to bring in an outside contractor.
Mr. Gilmore asked Council's permission, as an emergency measure,
to br ing in the contractors at an approximate cost of $8,600 to
$8,700 to get it repaired with the next few days.
Mayor Sawyer received concensus from Council for the City Manager
to expend funds of approximately $8,700 to bring in contractors
to do this work.
Mr. Baldwin asked the City Manager to also get the piles of dirt
out of the street along Lindberg, which Mr. Gilmore said he
would, as he thought it had already been done.
B. SAFES has received a letter from the City of Converse saying
that they are planning to start their own ambulance service as of
October 1, 1984, and would approach us for backup services. Mr.
Funk wrote them that we could only back them up in case of a
disaster, not on a routine basis.

C. Some time ago, Council asked if they were covered under our
insurance on civil rights issues. We have received a letter from
our liability policy carried stating civil rights issues are not
excluded.
D. Have received a letter from Carline Scott saying that she is
resigning from SAFES as of September 1, as the number of hours,
etc. has gotten too much for her, but she will assist as a
volunteer nights and weekends for another year.
E. Council has received an invitation from the Schertz Business
Club to attend an outing on Saturday August 25th at 4:00 P.M at
Dr. Richard's lake house. There is no cost to paid members and
one guest.
F. Concerning the Zoning Change .60 on Leon Parker's request to
rezone to Mobile Home District, the question came up about
ingress/egress in back. There is on file a 30 foot ingress to [;
the property. Mr. Har r is said that even if it is on file, he \
would recommend that it only be used in cases of emergency. One

of the misconceptions was that people would be hauling mobile
homes out on this road but it will only be used for emergencies.
G. The work on the over lay for FM 3009 is going well. Have
received input from some of the developers that were at the
meeting. They all support the overlay and are all in favor of
making FM 3009 a first-class right of way.
110 ITEMS BY COUNCIL: Mr. Sharpe asked that the Overlay
Zoning be added to the Bell Ringer List.
Mr. Sharpe said the Greater Randolph Trailriders had their first
Chili Cookoff in our park last weekend and it was very success-
ful. They plan to make this an annual event.
Mr. Sharpe also recommended sending a letter from the Mayor to
the new super intendent of Schools welcoming him and suggesting
that we get together to work out any problems that may exist.
Mr. Aguilar asked the outcome between Randolph and SAFES. Mr.
Gilmore said Randolph came back and said they could not accept
our last proposal and made some recommendations. We followed
their recommendations and made another proposal and they again
came back and said no.
Mr. Sharpe wanted to be sure our dispatchers know that we no
longer cover Randolph for ambulance service. He also suggested
that something be put in the newspaper as to who we do serve.
III ITEMS BY MAYOR: Mr. Sawyer agreed with Mr. Sharpe that
the Chili Cookoff was very enjoyable and we did ask them to come
back here again next year. Mr. Sawyer said that he and Mr.
Sharpe were judges and also Mayor Betty Jean Jones from Seguin
was a judge and he believes it is the first time she has been in
Schertz.

at 9:14 P.M. Mr. Baldwin seconded the motion, which carried
unanimously.
