SPECIAL MEETING OF THE CITY COUNCIL
AUGUST 29, 1984

The Schertz City Council convened in Special Workshop Session,
Wednesday, August 29, 1984, at 7:00 P.M. in the Conference Room
of the Municipal Complex, 1400 Live Oak Road with the following
members present: Mayor Earl W. Sawyer, presiding; Charles B.
Sharpe; Hal Baldwin; Ross Hoover and Ken Greenwald. Absent was
Mr. Aguilar. Staff present were City Manager Jimmy G. Gilmore
and City Secretary June G. Krause.
#1 HEARING OF RESIDENTS: None
#2 Discussion of Animal Shelter Policy.
Mr. Gilmore enumerated the main points of concern as being:
over-crowded conditions; location of shelter; and control of the
Animal Shelter. The shelter we have is going to cost approxi-
mately $12,000 to $15,000 to correct the problems, which includes
new runs. The old runs have the wooden shelters on the back and
they need to be replaced. The problem of the open septic tank -
it was dug out to repair, and we have burned out three pumps
working on it. We recently obtained a $4,000 pump for about
$250.00 and this is a larger pump. We are looking at every 15 to
24 months spending about $12,000. As to euthanasia - the problem
of over-crowding is more prevalent during the months from May to
September. Mr. Gilmore said he has checked with other shelters 0
in the area and San Antonio is the only one that euthanizes
animals and they do it within three days. In the event of needed
euthanasia, selection should be based first on illness or
cr ippled animals then on first in-first out. We need to set a
population limit and start an euthanasia program. If that
happens, then we do not need the additional runs.
Mayor Sawyer agreed we have problems with overcrowding, filth,
dirty runs and the cat house smells.
Council discussed with members of the Schertz Humane Society the
recommended number of animals, an euthanasia program, fees
charged, whether the shelter should be expanded or not, the lack
of communication or cooperation between the Humane Society
members and the Animal Control Officer. Mr. Gi~more said that if
Council limits the size of the shelter, that will. allow Council
to put the budgeted money into improvement of the shelter rather
than expansion and it should be a cleaner better run unit.
After a thorough discussion, Mayor Sawyer listed the the items
Council seemed to be in agreement on as follows:
1. size - same as is now, 16 runs
2. number of dogs - 40
3. number of cats - 25 0
4. active enforcement by the Animal Control Officer through- .
out the city - give more tickets, etc.

Mayor Sawyer said that Council expects the Humane Society to get
complaints in writing or bring someone forward who will put it in
writing.

Mrs. Mueller suggested replacing the wooden dog shelters with
cement ones and making them high enough to walk in so they would
be easier to clean.
Mr. Wilmann said the fence surrounding the shelter is beginning
to look like a billboard.
#3 Discussion of Zoning Change #60
Mr. Gilmore said that the legal opinion, issued by more than one
attorney in regards to the ingress/egress road the people living
in the area were concerned about, is that the 30 foot road
easement and can be used by anyone. The mobile homes are going
to be placed out of the flood plains and will not be moving in
and out on this road.

Council discussed some of their concerns about this proposal and
the concerns of the people that live nearby. Mr. Gilmore
reminded Council that this would clean up the present facility;
and with proper controls by ordinance can be a good development.
#4 EXECUTIVE SESSION: None needed.
#5 CITY MANAGER'S REPORT: A. Coming before Council is a
request by Sherman Davis to maintain the flashing light in front
of his business on FM 78. We have an ordinance prohibiting a
flashing sign because of traff ic interference. Planning and
Zoning has asked that this request be denied.
B. We are propos ing a resolution approving a Risk Control
Management Program. We have already implemented the program but
our insurance carrier has asked this resolution be adopted. Mr.
Sharpe suggested adding another 'whereas' saying that employees
also are suppose to work toward safety. Perhaps we should have
some type of incentive for employees.
C. Morton Southwest has written a letter with some very good
suggestions concerning naming both FM 3009 and Live Oak Road. It
was brought out that FM 3009 has already been named Greenfield
r- Road. We should also ask the Highway Department about the signs
on 135 again - they do not say SCHERTZ exit.

#6 ITEMS BY COUNCIL: Mr. Baldwin gave a report on the
latest EMS Randolp Region meeting, with regards to Carline Scott
resigning from SAFES when she has been the training coordinator
for the whole area for a number of years. The Committee is
talking about having a full-time paid position in connection with
the Community Education program and let that person handle the
school training for the whole area. The thing that brought this
up is that SAC has been the source of most of the medical
training and it does not look as if SAC will continue. We would
like to be responsible for our own training. In the event that
membership and enrollment does not pay the whole cost of the
employee, the committee wants the cities to take up the loss. It
should be a break-even deal. All they need is for the cities to
commit to taking up the loss should it become necessary.
Mayor Sawyer said he thought it a good idea. Mr. Gilmore said
that in talking with the new hospital administrator, he said that
they would help in things like training. Mr. Sharpe added that
the administrator also said he could possibly provide medical
supplies much cheaper.
Mr. Greenwald said that several months ago Council had ask about
finger annexation on either side of 135 at our city limits. Mr.
Gilmore said that we are into the annexation of the 850.53 acres
now and that we usually start another one when we are about half
through with the present one.
IIr. Greenwald also ask about the car stickers discussed pre- [JI
viously. They were to be color coded for different sections of
the city for identification purposes. Mr. Gilmore is to get cost
figures.
Mr. Greenwald said that the Street Department did an outstanding
job by GVEC. He also asked about the dumping of cement on
FMl5l8. Mr. Gilmore said he had checked with every agency he
could and they all say they cannot do anything about it because
it is on private property.
Mr. Sharpe said the Chamber of Commerce will be sending out dues
statements very shortly, based on the same formula used last
year - a percentage of the city's sales tax. Mr. Sharpe also
said that Carlos Melick is going to California with the South
Texas Chamber of Commerce group to represent our area.
Mr. Sharpe announced an Economic Development Committee meet ing
Thursady at 7:30 a.m. at Rotama to discuss what they are trying
to do in the area.

Mr. Sharpe said he noticed in the paper where there will be a
public hearing on a request by Clyde Dishong for a TV dish. Mr.
Greenwald said it is a P&Z public hearing and P&Z want to try to
get some information. Do we want them on top of houses so that
if the wind blows them on the neighbors house, who get sued. n
They are think ing about descr ibing them as building structures ,I
and using the guidelines for that in the zoning ordinance. ~

Mr. Baldwin suggested looking at our Cable TV contract in this
regards. Mr. Greenwald said P&Z is looking at location more than
anything else.
Mr. Sharpe also asked the status of getting the sewer line under
135. Mr. Gilmore explained some of the problems the contractor
is having and that the City is meeting with him tomorrow to tell
him if he doesn't have the equipment or men to get the job
finished, to either contract it out or get out himself. It has
been a fiasco from the beginning. Richard Harris says to give
him as much as we can because of economics. He is into the
$20,000 range on penalties now. We are on him daily.
Mr. Gilmore said that he had talked today with Mr. Ott and he is
very susceptible to making a deal for land for a new well site
for the city.
Mr. Sharpe asked if we would have to move any water lines on East
Live Oak Road when the State starts construction. Mr. Gilmore
said no, that we would just extend the fire hydrants that are so
close.
#7 ITEMS BY MAYOR: Mr. Sawyer said he and one or two
Councilmen have been invited to judge a "Boss of the Year" award
for the Randolph secretar ies. Mr. Sharpe has already accepted
and any other Councilman can also serve as judges. Universal
City Council was asked to do the judging last year.
The Mayor said we had to close Garden Ridge Pottery on Saturday
during his busiest time. Someone called in a bomb threat and it
was closed for about three hours. We want to send letters to the
Lackland personnel who brought out the dogs to help locate the
bomb if any. We are trying to keep this very low key.
Mayor Sawyer mentioned that the City has cleaned up the dirt
piles on Lindberg.
Mr. Sawyer said that those that missed the Library party Tuesday
night and the Sycamore Creek party Wednesday night, sure missed
some good times.
#8 ADJOURNMENT: There being no further business to come
before Council, Mayor Sawyer declared the meeting adjourned at
9:51 p.m.
