REGULAR MEETING OF THE CITY COUNCIL
SEPTEMBER 4, 1984

The Schertz City Council convened in Regular Session Tuesday,
September 4, 1984, at 7:00 p.m. in the Council Chambers of the
Municipal Complex, 1400 Live Oak Road with the following members
present: Mayor Earl W. Sawyer, presiding; Charles B. Sharpe; Hal
Baldwin; Ross Hoover; Adolph Aguilar and Ken Greenwald. Staff
were City Manager Jimmy G. Gilmore and City Secretary June G.
Krause.
PUBLIC BEARING: Mayor Sawyer opened the public hearing and
explain the purpose was to receive citizen input regarding the
proposed annexation of approximately 850.53 acres of land out of
Guadalupe County. He stated this is a fact gathering hearing and
then asked the City Manager to point out on the map the location
of the proposed annexation.
The following seven citizens asked questions of Council
concerning the annexation:

4. Fritz Rusch
5. Bob Mays
6. James Bindseil
7. Jiggs Biegert
Their concerns pertained to
available, could they continue

the land. Also the maps sent to
and several people were not sure
proposed for annexation.

Mayor Sawyer and Council explained that all services provided the
citizens currently in the city limits would be made available to
the new area, including police, fire, ambulance, water, sewer and
garbage. Computing taxes on County values of the land as it is
now, the City taxes would be from about $4.39 to $5.50 per year
for those in the Live Oak Hills Subdivision. Mr. Sawyer said the
reason for the expansion is that we know a lot of land in the
area is being sold for development and we would like to have it
in our city to get a route through to 135. All the ordinances
and laws that apply to our present citizens would also apply to
the newly annexed area.
There being no further questions from the citizens, Mayor Sawyer
declared the public hearing closed after assuring everyone that
at the next public hearing on this subject we would have better
maps of the area. The hearing closed at 7:17 p.m., at which time
Mayor Sawyer called a short recess.
The Regular meeting was reconvened at 7:27 p.m.

#l APPROVAL OF MINUTES: Mr. Baldwin moved to accept the
minutes of the regular meeting of August 21, 1984. Mr. Greenwald
seconded the motion, which carried as follows:
AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.
NAYS: None
#2 HEARING OF RESIDENTS: Mrs. Burgess and her attorney
reserved time for item #4
#3 ORDINANCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:
ORDINANCE NO. 84-D-19
AN ORDINANCE ESTABLISHING SPEED LIMITS ON FM
3009 FROM THE NORTHWEST CITY LIMITS OF
SCHERTZ SOUTHEASTERLY TO THE INTERSECTION OF
FM 78 IN THE CITY OF SCHERTZ; TEXAS, AND
REPEALING ALL ORDINANCES IN CONFLICT.
Mr. Aguilar moved to approve on final consideration an ordinance
establishing speed limits on FM 3009. Mr. Baldwin seconded the
motion.
Mr. Sharpe recalled that Council had discussed the traffic count
in 1979 and 1983 on which there were no fatalities listed, when
there really were some. Also the miles-per-hour count was the
same for both years.
Mr. Aguilar said we should go back to the Highway Department and
request them to take another survey and to lower the speed limits
as first requested.
The Mayor then called for a vote on the motion, which carried as
follows:
AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.
NAYS: None
#4 ZONING CHANGE #60: Mayor Sawyer said this is to
consider a request by Leon Parker to rezone approximately 70
acres of land from Predevelopment to Mobile Home District, with
permission for a low water crossing at Cibolo Creek.
Mrs. Burgess' attorney said that although the City is claiming
there is a 30 foot easement across Mrs. Burgess' land, it is not
necessarily 30 feet wide in all places - just because Mr. Parker
has a 30 foot easement on some land, he can't make Mrs. Burgess'
easement 30 feet.

Mr. Gilmore explained that ingress/egress is secondary, that it
does not have anything to do with zoning.
After Council discussion, Mr. Sharpe moved to approve Zoning
Change No. 60 as recommended by Planning and Zoning with
restrictions as discussed at the public hearing as far as streer
and low water crossing are concerned. Mr. Greenwald seconded the
motion, which carried as follows:
AYES: Councilmen Sharpe, Aguilar and Greenwald
NAYS: Councilmen Baldwin and Hoover
.5 RESOLUTION: Mayor Sawyer introduced a resolution and
read the caption as follows:
RESOLUTION NO. 84-R-13
A RESOLUTION BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, APPROVING A RISK CONTROL
MANAGEMENT PROGRAM FOR THE CITY OF SCHERTZ.

Mr. Sharpe asked that the last sentence of the third paragraph be
changed to read ftEach employee of the City must make every effort
to reduce the costly and unnecessary burden of accidentsft.
Mr. Sharpe then moved to approve the resolution approving a risk
control management program as corrected. Mr. Greenwald seconded 0
the motion, which carried with the following vote:
AYES: Councilmen Sharpe, Baldwin, Hoover, Aguilar and
Greenwald.
NAYS: None
.6 EXEUCTIVE SESSION: None was needed.
.7 CITY MANAGER'S REPORT: Mr. Gilmore had received a
letter from Mrs. Helen Wright requesting to hold a Bike-a-thon in
Schertz. He said he would like for Council to allow it to take
place but with a safer route than the one she had listed. This
to be worked out with the police department. Mayor Sawyer, after
checking, said the City Manager has a concensus of Council to
approve the bike-a-thon and work out a better route.
Mr. Gilmore also had a letter from Quincy Lee regarding work
staff has done in working with him on the Barshop tract.
#8 ITEMS BY COUNCIL: Mr. Sharpe said he was disappointed
in staff presentation on the proposed annexation, saying that it
is important for Council to get clear information.
.9 ITEMS BY MAYOR: Mr. Sawyer said he agreed with Mr.
Sharpe and asked that the proposed annexation be placed on the 0
areal map before the next meeting.

Mr. Sawyer said he had received a letter from Mrs. Sylvester
concerning bus service; but he does not believe VIA leaves Bexar
County.
Mr. Sawyer reminded those Council members who had agreed to help
judge the nBoss of the Year", that the information should be
received this week and he would get in touch.
He reported that he had lunched with the "Friends of the Library"
who were honoring their volunteer workers. If you know of anyone
interested in library work, have then join this group.
tlO ADJOURNMENT: On a motion by Mr. Baldwin, seconded by
Mr. Greenwald and unanimously carried, the meeting was declared
adjourned at 7:53 p.m.
