ccswks 03-30-1983 24 SPECIAL WORKSHOP MEETING OF THE CITY COUNCIL MARCH 30, 1983 I l,J The Schertz City Council convened in Special Workshop Session, Wednesday, March 30, 1983 at 7:00 P.M. in the Conference Room of the Municipal Complex, 1400 Live Oak Road with the following members present: Mayor Earl W. Sawyer, presiding; Charles B. Sharpe; Adolph Aguilar and Jacqueline Lawler. Absent: Hal Baldwin. Staff present were City Manager JimmY G. Gilmore and City Secretary June G. Krause. #1 WORKSHOP DISCUSSION: A. Entex rate request. Mr. Robert Jones, District Manager of Entex gave a presentation substantiating their request for a rate increase. This included their 1982 operating report with Exhibits and a Cost of Service handout. He explained in detail how they had arrived at the requested 46t per customer per month rate increase request. They have already expended this money and are trying to recover the costs. This is a Customer Service Increase. Mr. Jones said that in 1979, Schertz Council asked for a full rate study and although Entex at that time had asked for a 12t increase; after the rate study, they received $1.15 increase. Council expressed their utter degree of frustration when they have no alter- native to a requested rate increase. However, they felt Mr. Jones had given the information requested in the resolution passed. B. Annexations. Mr. Gilmore reminded Council of the public hearing r-r at 6:30 P.M. on the 5th of April at CCMA Board Room I l on the proposed annexation of 127.627 acres of land our of Guadalupe County. ~ The second public hearing on the same annexation to be held at 7:00 P.M. in the Council Chambers. Also the resolution calling public hearings for the next proposed annexation consisting of 265.96 acres of land out of Comal County would be on the next agenda for consideration. C. General itesm. Mr. Gilmore also briefed Council on the Public hearing by the Industrial Development Corporation (IDC) for 6:00 P.M. on April 5, 1983 for the Southwest Precast project. Construction should start shortly after approval. He then gave a briefing on several proposed ~evelopments as follows: A. the 38 apartments north of Val Verde on Live Oak Road - the contracts are out for bids now and they will widen Live Oak Road in front of their site. the City Engineer is working on ROWand cost to complete road from Municipal Complex to apartment site. B. Schaefer Homes apartments - 200 units across from the high school. The Housing Finance Corporation to hold a public hearing on this project April 7, 1983 at 7:00 P.M.. They plan to start construction in June and may at a later date have a small shopping center on site. C. Oak Forest Unit IV - we have put a hold at that - the plan to change site to garden homes. This is the area fronting on FM 3009. This must be watched closely as it is in the flood plain. r lJ ~.,~~~ 25 r-I ! D. Oak Forest Unit V - holding, plans have not been received. We will have to modify Deerhaven water system for this project because of water pressure. E. Horseshoe Oaks~ the Jaroszewski project~ approximately 700 homes planned. This is the 200 acre tract on the wests ide of FM 3009. They plan a clubhouse and pool on site. Some zoning changes will have to be made from R-2 to R-5. F. Tomaco, Inc. - they have approached us and will be coming before Council The area is located between Aero and Mitchell on Live Oak Road - 16 apartments. They want to start in June, if approved. G. Naylor properties - we are starting talks on a motel and truck stop with restaurant - this will include 52 units. H. Greenfield III - back of CCMA on FM 3009 - under construction. This is included in the proposed annexation. Mr. Vaughn will be the builder. I. Don Decker condominiums - On hold~ the land has not been purchased, there seems to be financial problems. This is located north of the Municipal Complex on Live Oak Road. J. Schertz-Hoffman Commercial Park - We understand the property has been pur- chased and they have paid the fees for a preliminary plat but no plat has been presented as yet. K. Archie Heimer properties - East side of FM 3009 south of Green Valley Road. 230 acres - holding preliminary plat has not been submitted. Flood Plain management required on this. L. Doug Wise property - 230 acres south of Cibolo Creek in city limits. On hold pending zoning change and are having problems obtaining water from Schaefer Road Water Company. M. 42 acres, Bligh property - They want a mobile home park on the back portion - on hold pending zoning change request. N. The Kneupper property fronting FM 3009 but in Cibolo's ETJ. They were in today and wanted:to,'put in 700 units for modular home sites. They were told it would be best for the people that would move in to be annexed to Schertz but either way, we would work with them. They have a twenty day option. Mr. Gilmore said he just wanted to show Council some of the things we are being hit with right now. He also read several letters sent back and forth from GUADCO in which they want to interconnect their water system with Green Valley water. He first told them no because our ordinance says no; but we received another letter with the same request and he wanted Council concensus to go back again and tell them no. Concerisus of the Council was to again tell them no. The auditors will be present at the next Council meeting to present the audit for fiscal year ending September 30, 1982. He handed out copies of the audit and asked that any questions be directed to him so he could pass them on to the auditors. r . Mr. Gilmore also presented a letter from the superintendent of schools, enclosing a copy of a resolution concerning the County appraisal district. After consideration, Council concensus was to table this resolution. \1 ,/"- \ Mr. Gilmore then presented a request from the Library Advisory Board to consider the librarian for a full-time 40-hour work week status to include all benefits of other employees. Council concensus was for the City Manager to change the librarian from part-time to full-time employee with all benefits~ effective Apri 1 1, 1983. 26 The City Manager also called attention to a request from the Planning and Zoning Commission to include two items in the Animal Control Ordinance. These being a. no fowls, other than samll animals as defined in Article Oil' III of Ordinance 74-H-7 or live stock will be kept or raised within the city limits; and b. Citizens with fowl, other small animals or live stock within the city limits will dispose of such within 6 months from the date of this ordinance change. The only exception will be farmers or ranchers with fowls or live stock. c. A special permit will be required to raise fowls, other small animals or live stock within the city. Mr. Gilmore said he thought the city would be in more not water than they could take if we tried to pass such as this. He said he just didn't see how we could come up with an ordinance we could enforce. Mayor Sawyer asked the City Manager to get in touch with TML, tell them our problem and see what other cities have done. #3 CITY r~NAGERls REPORT: Mr. Gilmore said he had been contacted concerning a State Senior citizen employ- ment program. They have sent several citizens to UTSA for construction trades and computer operators. The gentlement has offered to place one of their trainees with us. The first two months saJary will be pair entirely by them, then we would try to place the person. Council concensus was to go ahead and work with them. Mr. Gilmore said he had again been approached by the school for Government Day. They would like it to be held April 19, 1983. We will start making plans for that day. Also the members of the Humane Society do not show up regularly on weekends when we should be available for adopting out animals. Another problem is they do not want to euthanize animals and we have about 40 down there now. Mayor Sawyer instructed Mr. Gilmore to write them a letter over his signature, citing some of the difficulties. If they can't do it, then maybe we need to remove control from them and just let them help. Council concensus was for Mr. Gilmore to get some part-time help for the weekends at the animal shelter. The City Manager announced that Mr. Walter Ehlers will meet with the Council on the 27th of April. He will be meeting with the Mayor and City Manager on April 6, 1983. #4 ITEMS BY COUNCIL: Mr. Sharpe asked the status of the purchase of Schaefer Road Water. Mr. Gilmore said the papers are at the attornies now. Mr. Aguilar said he noticed several poles in the ditch along FM 78 to keep traffic out; however there were none by the apartments and he noticed a big truck in there emptying trash. Mr. Gilmore was to contact the Highway Department. Also they only thing that is holding up the reworking of the drainage problem at the Circle K is the weather. #5 ITEMS BY MAYOR: Mr. Sawyer said he had visited Scenic Hills and it is very pretty property. Also he had an invitation for Mayor and City Council to participate in BVYA's opening on April 10, 1983. c [J 27 r I . Mayor Sawyer advised that he would chair the Community Council this month and asked if Council had anything they wished to be discussed. Council said the widening of the bridge on FM 78 and Becks concrete dumping on FM 78. He announced receiving a letter from IIMC president advising that the week of May 8-14 would be Municipal Clerks or in our case City Secretaries Week. Mr. Sharpe announced the Meet the Candidates for Schertz would be on Cable TV the next day at 10:30 ~M and 6:30 P.M. I #6 ADJOURNMENT: [h~re being no further business, Mayor Sawyer declared thr meeting adjourned at 8:58~ , . yor, City of Schertz, T ATTEST: ' r- PUBLIC HEARING OF THE CITY COUNCIL APRIL 5, 1983 The Schertz City Council convened to hold a public hearing Tuesday, April 5, 1983 at 6:30 P.M. in the Board Room of the Cibolo Creek Municipal Authority, 100 Dietz Road, with the following members present: Mayor Earl W. Sawyer, presiding; Charles B. Sharpe; Hal Baldwin; Adolph Aguilar and Jacqueline Lawler. City Secretary June G. Krause represented staff. Mayor Sawyer explained the purpose of the public hearing was to obtain the views of the public concerning the proposed annexation of a 127.627 acre tract of land out of Guadalupe County. He stated this tract was bordered by FM 3009, Dietz Road, Elbel Road and Borgfeld Road. The main benefit of the proposed annexation would be to the citizens residing in the tract who would receive cheaper water rates, police and fire protection and ambulance coverage. Mr. Rufus Barnes, president of the Board of Cibolo Creek Municipal Authority one of the properties involved in the annexation, said that as far as CCMA is concerned, they feel it will be a good deal. The already feel they are a part of this city as well as the others in their district. r' There were five citizens in attendance besides Mr. Barnes, but none wished to speak to the proposal.
