to City Council and by City Council in considering final action on a requested specific use permit
(the "Conditions"); and
WHEREAS, on June 12, 2019, the Planning and Zoning Commission conducted a public hearing
and, after considering the Conditions, hereby makes a recommendation of approval of a Specific
Use Permit for an Automotive Repair, Major land use; and
the Criteria and recommendation by the Planning and Zoning Commission, determined that the
requested Specific Use Permit be approved as provided for herein.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
THAT:
Section 1. A Specific Use Permit for 5702 FM 1103, more particularly described in the
attached Exhibit A is herebw roved to allow an Automotive Re r M

am _LvaL_ for land use conditioned
upon the following occurring:
a) A building permit is approved within one year of the adoption of this ordinance; and
b) The use begins operation within two years of the issuance of the necessary building
permit(s).
c) The Texas Department of Transportation (TxDOT) approves the Storm Water
Management Plan.
Section 2. The recitals contained in the preamble hereof are hereby found to be true, and
the judgment and findings of the Council.
Section 3. All ordinances and codes, or parts thereof, which are in conflict or inconsistent
with any provision of this Ordinance are hereby repealed to the extent of such conflict, and the
(trovisions of this Ordinance shall be and remain controlling as to the matters resolved herein. —_
Section 4. This Ordinance shall be construed and enforced in accordance with the laws
the State of Texas and the United States of America.
Section 5. If any provision of this Ordinance or the application thereof to any person
circumstance shall be held to be invalid, the remainder of this Ordinance and the application
mch provision to other persons and circumstances shall nevertheless be valid, and the City herebi
ieclares that this Ordinance would have been enacted without such invalid provision. M
