The Schertz City Council convened in Regular Session, Tuesday, May 17, 1983,
at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the following
members present: Mayor Earl W. Sawyer, presiding; Charles B. Sharpe; Hal
Baldwin; Ross Hoover; Adolph Aguilar and Jacqueline Lawler. Staff were
City Manager JimmY G. Gilmore and City Secretary June G. Krause.
#1 APPROVAL OF MINUTES: Mr. Baldwin had a correction to the minutes
, of the Workshop Session of April 27, 1983
the second sentence of the fifth parapraph under item #7 on page 43 shou~d
be changed to read as follows: "A ticket was issued on Elbel Road at 12:30
A.M., why should the police ticket people on Elbel Road late at night. II
Mrs. Lawler moved to accept for approval the minutes of the Special Session
of April 13, 1983, the Regular Meeting of April 19, 1983, the Special Meeting
of April 27, 1983 and the Regular Meeting of May 3, 1983. Mr. Hoover
seconded the motion which carried with the following vote:
AYES: Councilmembers Sharpe, Baldwin, Hoover, Aguilar and Lawler
NAYS: None
#2 HEARING OF RESIDENTS: Mr. Mike Yelland of 615 Main Street addressed
Council concerning the disapproval of his
request for a 60 foot curb cut on Main Street. He mentioned there are 21
residences and 11 businesses between First Street and Live Oak Road that
do back out onto Main Street at the present time. He also said that
according to the police department, there have been no accidents on Main
Street because of backing out onto Main Street. After hearing his side
of the story, Mr. Sharpe, Mr. Baldwin and Mr. Aguilar all three gave their
reasons for disapproving his request, based on the present ordinances.

#3 ORDINANCE:
The Mayor introduced an ordinance on proposed annexation
and read the caption as follows:

AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY
LINES OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEXATION
OF A TRACT OF LAND CONTAINING 127.527 ACRES MORE OR LESS
OUT OF GUADALUPE COUNTY.
Mr. Baldwin moved to go ahead and adopt the ordinance annexing a 127.527
acre tract of land out of Guadalupe County. Mr. Aguilar seconded the motion
which carried with the following vote:
AYES: Councilmembers Sharpe, Baldwin, Hoover, Aguilar and Lawler
NAYS: None
#4 ORDINANCE: Mayor Sawyer introduced an ordinance on a zoning change
and read the caption as follows:

ORDINANCE NO. 83-S-6
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, AMENDING THE ZONING ORDINANCE NO. 79-S-15, OF THE
CITY OF SCHERTZ, TEXAS, BY REZONING A 1.031 ACRE PARCEL
OF LAND FROM GB, GENERAL BUSINESS, TO R-4, APARTMENT/
MULTI FAMILY DWELLING DISTR[CT; AND REFLECTING SUCH CHANGE
ON CERTAIN ZONING MAPS IN ACCORDANCE WITH THE SCHERTZ
ZONING ORDINANCE NO. 79-S-15. .
Mr. Aguilar moved that the Council approve the ordinance amending the Zoning
Ordinance by rezoning a 1.03 acre tract on Live Oak Road from general busi=
ness to R-4 Multi-family. Mr. Baldwin seconded the motion, which carried
with the following vote:
AYES: Councilmembers Sharpe, Baldwin, Hoover, Aguilar and Lawler
NAYS: None
#5 BID AWARD: The Mayor explained this item of consideration of
awarding bids on a microcomputer was discussed at
the last workshop.
Mr. Sharpe said he had an opportunity to discuss the specification with at
least two outsride personnel who have experience in computer programming
and based on information received, he moved to reject all bids and rewrite
the specifications. Mrs. Lawler seconded the motion.
Mr. Sharpe said a number of things were brought out, one being that the
specifications were written so that they would eliminate most of the hard-
ware manufacturers. He listed some of the items iin,'question.

Mrs. Lawler said she felt that a committee from the people from the City
of Schertz that are familiar with computer systems be set up and be given
a certain amount of time to finish their work, with the employees telling
them what they want from the computer. She mentioned that the City Manager
and City Secretary needs are not address in this plan until phase 3 or 4.

Discussion followed on the pros and cons of the bid specifications and
whether or not to reject all bids. After which, Mayor Sawyer called for
a vote on the motion before Council, with the following results.
AYES: Councilmembers Sharpe and Lawler
NAYS: Councilmembers Baldwin, Hoover and Aguilar
Mayor Sawyer declared the motion failed.
Mr. Baldwin then moved to accept the bid on the Burrpughs from TSSI for
a number of reasons, the total price is within our budget and we have
done business with them for a number of years; we have a competent pro-
granmer in our city; it is a good bid and we would be doing business
with a local businessman. Mr. Aguilar seconded the motion.
Mr. Sharpe said it was never implied that what we have did not do the job
but when you go out for bids that will eliminate some venders, we should
look at the way we write specifications.
Mayor Sawyer called for a vote of the Council with the following results:
AYES: Councilmembers Hal Baldwin, Ross Hoover and Adolph Aguilar
NAYS: Councilmernbers Charles Sharpe and Jacqueline Lawler
The Mayor declared the motion carried.
#6 RESIDtUTJON: Mayor Sawyer introduced a resolution approving bonds
for Southwest Precast, Inc. and read the caption as ~

RESOLUTION NO. 83-R-10
RESOLUTION AUTHORIZING CHANGES TO AN INDENTURE OF TRUST
WITH RESPECT TO SCHERTZ INDUSTRIAL DEVELOPMENT CORPORA-
TION INDUSTRIAL DEVELOPMENT REVENUE BONDS (SOUTHWEST
PRECAST, INC. PROJECT) SERIES 1983.
Mr. Richard Harris explained this was merely a formality since the original
resolution has already been approved for the bonds. Ii'!:going over the project
it was found the bonds included some expenses which could not be capitalized.
This resolution will allow Southwe~t Precast to pay for the deleted items
in another ma~ner.
Mr. Sharpe moved to approve the resolution approving bonds for Southwest
Precast, Inc.. Mrs. Lawler seconded the motion which carried as follows:

Mr. Baldwin moved to accept the first reading of an ordinance governing
the water and sewer system. Mr. Aguil ar seconded the moti on which carried

#8 SEWER RATES: After studying information provided~ Mr. Baldwin
said he was not sure he was ready to vote for a
rate increase. He said he was not suggesting that we don't need to raise
rates but he felt the need for a rate study.
After further discussion by the Council, Mr. Sharpe moved to approve the
sewer rate increase to $1.02 residential and $1.05 for commercial. Mr.
Aguilar seconded the motion.

Mr. Sharpe then said there may be a need for an overall study of the Water
and Sewer but we don't need to delay this increase.
Mayor Sawyer called for a vote and the motion carried 'as follows:
AYES: Councilmembers Sharpe, Hoover, Aguilar and Lawler
NAYS: Councilman Baldwin
#9 SEASON POOL PASSES:
Before starting discussion of this item, Mayor Sawyer called for a short
recess at 8:10 P.M.
The Regular Meeting was reconvened at 8:18 P.M.
Mayor Sawyer said that in the past we have not invited people from outside
our city to buy pool passes. This year we are proposing this be done. We
are not proposing a change for the inside city patron cost but suggested
rates for those living outside the city are proposed.
In answering Council questions, Mr. Gilmore said that now the daily rate
is for all people regardless of place of residence; and that allowing
citizens from outside Schertz to purchase family passes should not put a
hardship on the pool capacity. There may be a few times when patrons
woudl have to wait a short time.

Mr. Sharpe moved to establish season pass rates as indicated for citizens
living outside the City of Schertz.
The motion died for lack of a second.

Mr. Hoover moved that the consideration of pool passes for citizens outside
of Schertz be disapproved because the citizens of Schertz pay for the pool.
Mr. Baldwin seconded the motion, which carried with the following vote:

#10 ORDINANCE: The Mayor introduced and read the caption on an
ordinance as follows:
AN ORDINANCE
PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ,
TEXAS, BE AMENDED BY REVISING SECTION 18-76 OF SAID
CODE; PROVIDING FOR SPEED LIMIT IN SCHOOL ZONE ON ELBEL
ROAD.
Mr. Baldwin moved to adopt this ordinance establishing speed limit at
40 MPH on Elbel Road between Live Oak and FM 3009. Mrs. Lawler seconded

Council discussed the speed limit change at length, with Mr. Aguilar ending
the discussion by saying that we are discussing th~ tolerance of the grace
instead of the speed limit.
Mayor Sawyer called for a vote on the motion before Council, which motion
carried as follows:

NAYS: Council members Sharpe and Aguilar.

#11 TRANSFER OF APPROPRIATIONS: ~fter the Mayor introducing this item
Mr. Sharpe moved to transfer the
appropriations in accordance with Section 7.07 of the City Charter, as
submitted by Mr. Gilmore. Mr. Hoover seconded the motion which carried
as follows:
AYES: Councilmembers Sharpe, Baldwin, Hoover, Aguilar and Lawler
NAYS: None
The transfer of appropriations submitted by Mr. Gilmore included revising
the General Fund Revenues by increasing them by $24,900; increasing the
Water & Sewer Revenues by $13,000. And by increasing various dep~rtments
of the General Fund Expenditures for a total of $18,000 and increasing
the W&S Fund Expenditures by $13,000.
#12 EXECUTIVE SESSION: None needed
#13 CITY MANAGER'S REPORT: A. You will notice that in changing the
Bell Ringer list, the item of social
security was left off. We were advised today that we can no longer withdraw
from the program due to the recent change in the law.
B. Received a card thanking the Council and staff for the fine par~y
Saturday,from the Schertz Area Senior Citizen Club.

C. Mr. Gilmore called attention to a letter received from the Guadalupe
County Appraisal District, which included a resolution that had been sum-
mitted to them. He'lalso referred to a information received from TML on
legislation that may affect the city. It was noted the information was not
received in time to take appropriate action; therefore, the Mayor suggested
writing TML with the request that in the future we would like their request
to be timely so that we can take action. \
D. He announced that SAFES personnel would be at the next workshop to
answer any questions pertaining to their proposed budget.
#14 ITEMS BY COUNCIL: Mr. Baldwin said he really enjoyed the Saturday
Senior Citizen Day activities and would like
to thank Mrs. Lawler, saying we owe herl a debt of gratitude. Mr. Gilmore
said he would like to add that she put it all together without cost to the
Ci ty too.
Mr. Aguilar added his thanks to Mrs. Lawler.

Mrs. Lawler presented a donation from Commission Grein for next years Senior
Citizen Day; adding that they served 150 seniors and 25 helpers at noon and
75 senior citiznes and 10 helpers that evening. She said that although
no money was spent from City funds, she would like the City Manager to
include a little money in the next budget for this event just in case.
She then publicly thanked all the committee chairmen.
#15 ITEMS BY MAYOR: Mayor Sawyer also congratulated Jackie for a fine
time on Saturday, saying letters should be sent
to those helping and the dignataries.
He also mentioned a letter received from the Guadalupe County Appraisal
District Board. They are looking for candidates for the position of Chief
Appraiser - will be interviewing this month. If Council has suggestions,
he would be happy to go to! the Board meeting or write them a letter.
#16 ADJOURNMENT: On a motion by Mrs. Lawler, duly seconded and
unanimously carried, the meeting was declared
adjourned by the Mayor at 8:47 P.M.
