REGULAR MEETING OF THE CITY COUNCIL
JUNE 21, 1983
The Schertz City Council convened in Regular Session, Tuesday, June 21,
1983 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the
following members present: Mayor Earl W. Sawyer, presiding; Charles B.
Sharpe; Hal Baldwin; Ross Hoover; Adolph Aguilar and Jacqueline Lawler.
Staff present were City Manager Jimmy G. Gilmore and City Secretary June
G. Krause.

#1 APPROVAL OF MINUTES: Mayor Sawyer introduced for motion the
minutes of a Workshop Session of June 1;
Regular Meeting of June 7 and Workshop Meeting of June 15.
Mr. Aguilar asked that the third sentence of #1 of the workshop meeting
of June 1 be changed to read as follows: "SAFES are asking for immediate
change from the flat rate of $50.00 per ambulance run to a flat rate of
$60.00 per run and in addition charge for certain supplies, such as
oxygen - $10; IV Therapy $15; Drugs $5 each, etc. II
Mr. Baldwin referred to page No. 69 of the minutes of the meeting of June 15
in which the first four paragraph discussed an additional person being re-
quested for SAFES. He asked if Council was in the same position he had
brought out before of management hiring a person for a new position, which
in his opinion should be voted on by the Council. Mr. Aguilar and Mr.
Gilmore explained that Council concensus was for SAFES to add a person on
a contract basis for the remainder of the year with the funding coming from
SAFES own funds.
Mr. Sharpe moved to approve the minutes of the Workshop of June 1,1983;
Regular Meeting of June 7, 1983 and Workshop of June 15, 1983 as amended.
Mr. Baldwin seconded the motion which carried with the following vote:
AYES: Councilmembers S~arpe, Baldwin, Hoover, Aguilar and Lawler

#2 HEARING OF RESIDENTS: None Wishing to speak
#3 ORDINANCE: The Mayor introduced an ordinance for final considera-
tion and read the caption as follows:

ORDINANCE NO. 83-An6
AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES
OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEXATION OF A TRACT OF
LAND CONTAINING 265.96 ACRES MORE OR LESS, OUT OF COMAL COUNTY.
Mayor Sawyer explained that the two required public hearings had been held
according to law and that this property is on F.M. 3009 at the M-K-T rail-
road tracts.
Mrs. Lawler moved to accept the final consideration of this ordinance
on annexation of 265.96 acres of land out of Comal County. Mr. Hoover
seconded the motion which carried with the following vote:
AYES: Councilmembers Sharpe, Baldwin, Hoover, Aguilar and Lawler
NAYS: None

#4 FREEWAY MANOR: Mr. Gilmore said this item is on the agenda for
informational purposes only. He showed a plat of
Freeway Manor, explaining it is located on IH 35 just past Bussy's Flea Market.
It was platted in 1958 long before the city was anywhere near this area. In
fact, part of the front is already taken in by the widening of IH 35. The
only reason for bringing it up, is that it is another area like Live Oak Hills
where a developer came in, put in streets, etc. and left after selling lots.
Now these people are coming in asking for city services. It is becoming a
real problem for the city. We cannot put water in because part of the area
is outside our city limits and not only that but the streets have deteriorated
long before any part of it was annexed into the city. There are several
different size lots and not all meet our subdivision requirements. Also the
deed restrictions expired in 1975. The only part in our city is zoned general
business.
Council discussed several aspects of the subdivision. One being, they cannot
put in mobile homes because State law says the lots have to have 10,000 sq.
ft. to put in septic tanks. Also Green Valley water lines are further away
from the property than the City's are.
It was determined that Mrs. Hopkins, one of the owners wanting a variance for
mobile homes since her lot already has a septic tank, will have to go to
P&Z with her request and then come back to Council with P&Z recommendations.

#5 POLICE RESERVE: Mayor Sawyer explained that the Chief had submitted
Mr. Bundy for appointment as a police reserve
officer and Council had seen his file at the previous meeting.
Mr. Baldwin moved to appoint Mr. Russell Bundy as a Police Reserve Officer
for the City. Mr. Aguilar seconded the motion which carried as follows:
AYES: Councilmembers , Baldwin, Hoover, Aguilar and Lawler
NAYS: None
Mr. Sharpe was out of the Council room at the time of this vote.
#6 EXECUTIVE SESSION: Mayor Sawyer called an executive session under
Article 6252-17 V.T.C.S. Section 2 (g) at
7:24 P.M. ,
The regular session was reconvened at 8:05 P.M. with the Mayor explaining
the executive session was on personnel.
#7 CITY MANAGER'S REPORT: A. A request for water has been received
by a family in Freeway Manor outside
the city limits by about 600 feet. This can be on the next agenda. Mr.
Aguilar requested it be on the next workshop to include all possibilities
of furnishing water.

B. Mr. Haeker, who is located between the two railroad tracks off FM 3009
has requested water. As this is in the next area to be annexed into the
city. There is a stand up well in the area and he would be amendable to
selling it to the city if we would run a road to it. The Mayor said our
general concensus is that we can sell him water, since by the time it would
be put in, his land would be a part of the city.

C. AACOG is having a semi-annual meeting at their office on July 5 at
1:30 P.M. with a reception following at the newly remodeled St. Anthony
, Inter-Continental Hotel. Mayor Sawyer asked Mr. Aguilar to attend in
behalf of the city.
D. On July 5th we have announced a public hearing by the City Council
on designation of the entire Schertz area as business blighted area.
At 7:30 P.M. the Industrial Development Corporation will meet to pass a
resolution of intent and later in the Council meeting they will pass
the resolution to allow industrial bonds for commercial property anywhere
in Schertz. Hoffman and Decker Commercial Park on FM 1518 is interested
in these bonds.
E. Mr. Gilmore presented the printed copies of the City Plan and explained
we have bound copies to sell to the developers for $20.00 each.
#8 ITEMS BY COUNCIL: Mr. Sharpe said there are a number of public
hearings scheduled for the 5th and 6th of July.
One is for the school system. The 67th Legislator repealed all laws per-
taining to education - the public hearings for S-C~UC ISD is scheduled
for July 5th and 6th in San~;Antonio.
Mr. Baldwin said that in the minutes of the workshop he missed, there was
mention of 6 positions in the city that were unfilled. He asked what
positions these were. Mr. Gilmore said three in the police department,
a Finance Clerk, part-time dispatcher and he couldn't remember off hand what
else.
Mr. Baldwin also asked the status of the Live Oak Road work. Mr. Gilmore
said the paper work is in Austin and Mr. Ehlers hopes to have it back
by the end of July or early August. The States feels strongly that it will
go through. Should be able to start work this winter or early spring.
Mr. Baldwin also asked the status of the grants. Mr. Gilmore said he has
an appointment with Dr. Leary for 3:00 P.M. the 22nd and invited any of the
Council to join the meeting.
Mr. Hoover asked what is the status of tree limbs over traffic signs, etc.
Mr. Gilmore said letters had been sent allowing the citizens a specific
number of days to correct, then going back out with another letter. If
on the city right of way and are fruit or pecan trees, we try to get the
property owner to cut them before we go out and do it.
Mr. Hoover also reported he had been contacted by some happy citizens,
concerning the cleaning of the drainage ditches. The problem was taken
care of within a week and he expressed his gratitude to Mr. Gilmore for
acting so quickly.
Mr. Baldwin said the School District is conducting an election on the 13th
of August to fill an unexpired term on the Board. Filing for a place on
the ballot will take place between June 13th and July 13th. The last
three days of filing the whole School District will be closed down and
Mrs. Krause has consented to accept the filings for those days.
Mr. Aguilar said he wondered what is the answer to Mr. Hoover's question
concerning nurf balls and goggles in the swimming school. Mr. Gilmore
said the nurf balls get stuck in the intake valves but he wasn't sure
about the goggles.

Mrs. Lawler advised Council that on the 6th of July at 10:00 AM in the
Community Center there will be an open house birthday party honoring
Mrs. Agusta Wuest. Mrs. Ann Richards is in charge of that. Then the City's
proclamation will be read on the 5th at our Council meeting and then on
the 7th at 6:00 p.m. the Mayor, Mr. Kuempel, The City Council and their
spouses are to take Mrs. Wuest and her daughter to dinner at Country Corner.
#9 ITEMS BY MAYOR: Mayor Sawyer advised that the lady from the County
Tax office is back at our office and will be here
each Monday and Tuesday selling license plates etc.
He also reported the library construction is going great with donations for
cement, etc. still coming in.
When talking about the resolution designating the entire'area of Schertz as
a blighted area be sure and stress that it is for business only so that the
businesses can get the low cost loans.
#10 ADJOURNMENT: Mrs. Lawler moved the meeting be adjourned at 8:27 PM.
Mr. Baldwin seconded the motion, which carried
unanimously.

SPECIAL SESSION OF THE CITY COUNCIL

The Schertz City Council convened in Special Workshop Session, Wednesday,
June 29, 1983, at 7:00 P.M. in the Conference Room of the Municipal Complex,
1400 Live Oak Road with the following members present: Mayor Earl W. Sawyer,
presiding; Hal Baldwin, Ross Hoover, Adolph Aguilar and Jacqueline Lawler.
Absent: Charles B. Sharpe. Staff were City Manager Jimmy G. Gilmore and
City Secretary June G. Krause.

#1 Hearing of Residents. There were none wishing to speak
#2 Discussion of Budget for FY 83-84.
Mr. Gilmore advised that concerning the proposed SAFES budget, he and Tom
Funk met with City Managers of Converse, Live Oak and Universal City to
discuss the Safes budget. When then left, they understood the budget and
at that time had no questions before taking it to their Councils. He
said the Universal City Manager was amazed at the type of facilities. They
were all satisfied with the collection ratio of about 87% as this is higher
than any in this area.
