ccreg 09-04-1983 r l r ( r- I I \. 109 REGULAR MEETING OF THE CITY COUNCIL SEPTEMBER 6, 1983 The Schertz City Council convened in Regular Session, Tuesday, September 6, 1983 at 7:00 PM in the Council Chambers of the Municipal Complex, 1400 Live Oak Road, with the following members present: Mayor Earl W. Sawyer, presiding; Char1esB. Sharpe; Hal Baldwin; Adolph Aguilar and Ross Hoover. Staff were City Manager Jimmy G. Gilmore and Deputy City Secretary Alice Austin. #1 APPROVAL OF MINUTES: Mr. Sharpe moved to approve the minutes of the Special Workshop Meeting of August 10, 1983, the Regular Meeting of August 16, 1983 and the Special Workshop Meeting of August 31, 1982. Mr. Aguilar seconded the motion, which carried with the following vote: AYES: Councilmembers Sharpe, Baldwin, Hoover and Aguilar NAYS: None #2 HEARING OF RESIDENTS: None #3 RESOLUTION: The Mayor introduced a resolution supporting a general acute care hospital in the Randolph Region and read the caption as follows: RESOLUTION 83-R-11 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, SUPPORTING ADDITIONAL HEALTH CARE SERVICES AND THE CONSTRUCTION OF A GENERAL ACUTE CARE HOSPITAL BY HOSPITAL CORPORATION OF AMERICA IN THE RANDOLPH REGION. Mr. Sharpe made the motion to approve the resolution supporting the additional health care services and the construction of a general acute care hospital by Hospital Corporation of America in the Randolph Region. Mr. Baldwin seconded the motion which carried with the following vote: AYES: Councilmembers Sharpe, Baldwin, Hoover and Aguilar NAYS: None #4 ORDINANCE: The Mayor introduced and read the caption on an ordinance as foll ows: ORDINANCE NO. 83-T-I0 AN ORDDNANCE LEVYING AND ASSESSING ALL TAXABLE PROPERTY WITHIN THE CORPORATE LIMITS OF THE CITY Of SCHERTZ, TEXAS, FOR THE YEAR 1983, PROVIDING THE BASIS OF ASSESSMENT OF 100% APPRAISED VALUE AND PRO- VIDING FOR THE COLLECTION THEREOF AT THE RATE OF $0.42 ON THE ONE HUNDRED DOLLAR ($100.00) ASSESSED VALUATION AND DECLARING AN EMERGENCY. 110 Mr. Sharpe made the motion to approve the ordinance levying and assessing all taxable property within the city and setting a tax rate of $0.42 per hundred dollars evaluation. Mr. Aguilar seconded the vote. Mr. Baldwin O.J\ requested the amount in Section 2(A) and Section 2(B). Mr. Gilmore advised Section 2(a) was $0.34 and Section 2(B) was $0.08. The item carried with the following vote: AYES: Counci1members Sharpe, Baldwin, Hoover and Aguilar NAYS: None #5 ORDINANCE: The Mayor introduced and read the caption on an ordinance as follows: ORDINANCE NO. 83-T-11 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, LEGALIZING BINGO WITHIN THE CITY OF SCHERTZ, TEXAS, IMPOSING A ONE PERCENT GROSS RECEIPT TAX UPON LEGALIZED BINGO CONDUCTED BY EACH LICENSEE AUTHORIZED TO CONDUCT BINGO WITHIN THE CITY OF SCHERTZ, TEXAS; REPEALING CONFLICTING ORDINANCES: AND STIPULATING AND EFFECTIVE DATE AND DECLARING AN EMERGENCY. / Mr. Baldwin made the motion to approve 'the ordinance legalizing bingo and imposing a one percent gross receipt tax. Mr. Hoover seconded the motion which carried with the following vote: AYES: Counci1member Sharpe, Baldwin, Hoover and Aguilar NAYS: None #6 ORDINANCE: The Mayor introduced and read the caption on an ordinance as fo 11 ows : o AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS, BE AMENDED BY REVISING SECTIONS 18-32 STOP AND SECTION 13-25 YIELD OF SAID CODE. Mr. Aguilar made the motion to approve on first reading the ordinance pro- viding that the Code of Ordinances, City of Schertz, Texas, be amended by revising Sectfons 18-32 Stop and Section 13-25 Yield of said code. Mr. Baldwin seconded the motion which carried with the following vote: AYES: Counci1member Sharpe, Baldwin, Hoover and Aguilar NAYS: None #7 WATER LINE EXTENSION: The Mayor explained that this would be the extension of a 2 inch line in the Maria Subdivision where currently one meter was servicing several families. Mr. Harris explained that if the city decided to do this they would have to notify the customers involved and give them the opportunity to have a hearing if they requested one. Mr. Baldwin made the motion that we go ahead and extend the 2 inch water line into the Maria Subdivision and that we set a rate 2 times the standard rate for those members of that subdivision until such time as the $3,600 has been o '.,,~;i .i~ ,j r- ( 111 repaid or whatever the amount is and that the 13 individual 'members pay for their meters and the cost of hooking them up. Mr.'Hoover amended the motion to include that those people who owed an arrears should pay that before we turn them on. Mr. Hoover seconded the motion which carried with the following vote: AYES: Councilmembers Sharpe, Baldwin, Hoover and Aguilar. NAYS: None. #8 EXECUTIVE SESSION: Mayor Sawyer call ed for an executive session under Article 6252-17, as amended, V.T.C.S. Section 2(g), at 7:34 PM. The meeting was reconvened by Mayor Sawyer at 7:47 PM. #9 CITY MANAGER'S REPORT: Mr. Gilmore read a letter of appreciation written by Salvatore Previtera and comple- menting SAFES personnel Nan Soper, Nancy Scott and Diann Fisher and Officer Steve Judd for their actions when answeri1g a call to attend Mrs. Previtera for recent stroke. Mr. Gilmore also advised Council of a complaint by a citizen that the City did not give over/65 exemptions on proper~y taxes. The City has been giving over/65 exemptions for many years, but th~ person must be 65 on January 1 of the year claimed and show proof to the County Appraisal District. Mr. Gilmore said that the fire on IH 35 had shown hoW" professional the Fire r-- Department, Police Department and SAFES Ambulance Service are. He also I complemented the other area towns on their outsta~ding cooperation. f , r- (' '-#10 ITEMS BY COUNCIL: Mr. Aguilar, advised that he had attended a Task . Force"eetingof the IH 35 Corridor Committee. He said if this evolves it will be a good thing but we must keep our finger in or the larger cities will take over. i All of the Council complemented the Fire Department, Police Department and SAFES on the great job they had done at the Garden Ridge Fire. #11 ITEMS BY MAYOR: Mayor Sawyer said how proud he was of the profes- sionalism of our people and that he was proud to live in a community where everyone comes out and helps when needed. #12 ADJOURNMENT: On a motion by Mr. Sharpe, duly seconded the meeting was adjourned at 8:02 PM.
