I ; \ ATTEST: SPECIAL SESSION OF THE CITY COUNCIL OCTOBER 14, 1981 The Schertz City Council convened in Special Session, Wednesday, October 14, 1981 at 7:00 P.M. in the Conference Room of the Municipal Complex, 1400 Live Oak Road with the following members present: Mayor Jack M. Stomackin, Sr., presiding; Richard L. Howe; Barbara Taylor; Jeff Duffield; Earl W. Sawyer and Jacqueline Lawler. Staff present City Manager Jimmy G. Gilmore and Deputy City Secretary Alice Austin. #1 WORKSHOP DISCUSSION: Mayor Stomackin opened the meeting and advised Council that a meeting between the Schertz-Cibolo-Universal City School Board and Councils from surround- ing cities had been scheduled for November 10, 1981 in Schertz City Council room. Mayor stomackin the turned the meeting over to the City Manager. I \ I r Council discussed seven ordinances which are scheduled to be on the next regular meeting agenda. Council requested a change be made in the proposed ordinance adopting Standard Swimming Pool Code to change from a 6 foot fence requirement to a 4 foot fence and to make provisions governing prOXimity of fence around a pool in a multi-family or apartment complex. Council requested news items be published prior to holidays to notify citizens about strict enforcement of fireworks ordinance violations. Council discussed curb-cut request made by Mr. Cowart and Mr. Johnson. Item will be on next regular meeting agenda. Mr. Gilmore advised Council that he would like to have their permission to rule on curb-cut requests instead of bringing them before. He advised that investigations were done by the Chief of Police and Public Works Director on all requests for curb- cuts. And that no decision would be made without an investigation. A consensus of the Council was that Mr. Gilmore is authorized to rule on curb-cuts without bringing them before Council. #2 GENERAL DISCUSSION: Mr. Gilmore read a letter from the Texas State Library Board advising that the City of Schertz Library had been accredited as a fully qualified member of the Texas Library system. I : i I , , j nry i Mr. Gilmore advised Council he had received a letter from Ed Ford, City Engineer estimating cost for moving the water line on 2252 at approximately $30,000.00. Mr. Gilmore requested Councils permission to go out for bids and was given the go ahead by Council. Council were advised that the County.s Public Hearing was scheduled for October 20, 1981 which is Council IS regular meeting night. A consensus of Council was to reschedule the regular meeting to October 19, 1981 at 7:00 P.M. Mr. Gilmore advised Council that the Business Club wanted to hold the Fourth of July Picnic again this year. Council requested he set up a meet- ing with the Business Club for sometime in January. Mr. Gilmore advised Council that there was a problem in the Zoning Ordinance concerning M-l and M-2 zoning. Since the criteria for determining whether an industry was a light or heavy industry was vague and companies considering coming into the city were in some instances pushed for time because of the money market, Mr. Gilmore requested council IS permission to make the deter- mination as to whether the company was a light or heavy industry and qualified for construction in the area they were considering. A consensus of Council was that Mr. Gilmore should be permitted to make the determination concerning industry. Mr. Gilmore advised Council that a large business was investigating locating within the City of Schertz. The prime location being considered would require the City to go ahead with running the water line under IH 35 near l103. Cost to run a 12 inch line is estimated at $62,000.00. Mr. Gilmore requested Councils permission to have design made up on this project. Council concensus was that Mr. Gilmore proceed with having the design made. The Aid Association to Lutherans has received a grant and will be building 22 tables and 44 benches for the Fire Department. The City is sending as many employees as possible to TML as it is being held in San Antonio and the program covers information needed by all the City departments. Mr. Howe advised that he had a battery charger that he would donate to the Public Works Department. Mr. Gilmore advised council that one of the newer patrol cars had blown an engine and cost for repairs would be approximately $1,100.00. Mr. Gilmore requested permission to transfer funds as this amount was not budgeted for. Councils concensus was for Mr. Gilmore to transfer the funds. Mr. Gilmore advised Council that the sewer line project under IH35 had a completion date scheduled for February, he also advised the l3 acres in back of Mobile Villa had been purchased. He explained that the purchase of Mobile 98 Villa water system was completed but that the work on the system was not completed. Gilmore and Deputy City Secretary Alice Austin. #1 APPROVAL OF MINUTES: A. Mr. Sawyer moved to approve the minutes of the Regular Meeting of October 5, 1981. Mr. Howe moved to approve the minutes of the Special Meeting of October 14, 1981. Mr. Sawyer seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Taylor, Duffield, Sawyer and Lawler NAYS: None #2 HEARING OF RESIDENTS: None #3 CURB-CUT REQUEST: Mr. Sawyer made the motion that the curb~cut request for 225 and 301 Maple Drive made by Mr. Cowart and Mr. Johnson, who were attending the meeting, be approved.
