The Schertz City Council convened in Regular Session~ Monday, October 19,
1981 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the
following members present: Mayor Jack M. Stomackin, Sr. presiding;
Richard L. Howe, Barbara Taylor; Jeff Duffield; Earl W. Sawyer and
Jacqueline Lawler. Staff present were City Manager Jimmy G. Gilmore
and Deputy City Secretary Alice Austin.
#1 APPROVAL OF MINUTES: A. Mr. Sawyer moved to approve the minutes
of the Regular Meeting of October 5,
1981. Mrs. Lawler seconded the motion which carried with the following
vote:

#3 CURB-CUT REQUEST: Mr. Sawyer made the motion that the curb~cut
request for 225 and 301 Maple Drive made
by Mr. Cowart and Mr. Johnson, who were attending the meeting, be approved.

#4 ORDINANCE: The Mayor introduced an ordinance and read the
caption as follows:
AN ORDINANCE
ADOPTING THE STANDARD HOUSING CODE, 1979 EDITION, WITH 1980
AND 1981 REVISIONS AS THE HOUSING CODE OF THE CITY OF SCHERTZ,
TEXAS AND PROVIDING A PENALTY.
Mrs. Lawler moved that this ordinance be approved on first reading.

#5 ORDINANCE: The Mayor introduced an ordinance and read the
caption as follows:
AN ORDINANCE
ADOPTING THE STANDARD SWIMMING POOL CODE, 1979 EDITION, AS
AMENDED, AS THE SWIMMING POOL CODE OF THE CITY OF SCHERTZ,
AS HEREIN MODIFIED AND REPEALING ALL ORDINANCES IN CONFLICT.
Mrs. Lawler moved that this ordinance be approved on first reading.

#6 ORDINANCE: The Mayor introduced an ordinance and read the
caption as follows:
AN ORDINANCE
DEFINING FIREWORKS; DEFINING TERRITORIAL APPLICABILITY;
PROHIBITING THE MANUFACTURE, ASSEMBLY, STORING, TRANS-
PORTATION, SALE OFFER OR HAVE IN POSSESSION WITH THE
INTENT TO SELL, USE, DISCHARGE, IGNITE OR OTHERWISE SET
IN ACTION; PROVIDING FOR SEIZURE AND DISPOSAL OF FIRE-
WORKS; REGULATING PUBLIC DISPLAYS; PROVIDING CERTAIN
EXCEPTIONS; PROVIDING PENALTIES FOR THE VIOLATION OF
THE PROVISIONS OF THIS ORDINANCE; AND SEVERABILITY.
Mr. Sawyer made the motion that this ordinance be approved on first
reading. Mrs. Lawler seconded the motion.
Mr. Howe asked if Mr. Harris, City Attorney had checked over the
ordinances. Mr. Gilmore explained that copies had been forwarded
to Mr. Harris but he had not commented on the ordinances. He also
explained that the ordinances were patterned after ordinances obtained
from TML which had already been upheld in court.
The Mayor called for a vote on the motion which carried with the following

#7 ORDINANCE: The Mayor introduced an ordinance and read the caption
as foll ows:
AN ORDINANCE
OF THE CITY OF SCHERTZ, TEXAS, ADOPTING THE NATIONAL ELECTRIC
CODE, 1981 EDITION, AS THE ELECTRICAL CODE OF THE CITY OF SCHERTZ,
TEXAS. DESIGNATING THE ELECTRICAL INSPECTOR, SETTING AMOUNT OF
LICENSE FEES AND FONDS; REPEALING ALL ORDINANCES IN CONFLICT
AND SETTING A PENALTY.
Mr. Howe moved that this ordinance be approved on first reading. Mrs.
Taylor seconded the motion which carried with the following vote:

#9 ORDINANCE: The Mayor introduced an ordinance and read the
caption as follows:
AN ORDINANCE
OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF
ORDINANCES OF THE CITY OF SCHERTZ, TEXAS, BE AMENDED BY
REVISING SECTION 16-38 OF SAID CODE TO AUTHORIZE THE CITY
MANAGER TO APPROVE VARIANCE REQUESTS ON CONSTRUCTION, REPAIR,
ETC. OF SIDEWALKS, CURBS, AND DRIVEWAYS WITHIN THE CITY OF
SCHERTZ; AND BY PROVIDING AN EFFECTIVE DATE.

#10 ORDINANCE: The Mayor introduced an ordinance and read the
caption as follows:
AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, ESTABLISHING
AND PROVIDING FOR THE ASSESSMENT AND RENDITION OF TAXABLE PRO-
PERTY IN THE CITY OF SCHERTZ, TEXAS, COMMENCING WITH THE CALENDAR
YEAR 1982, AND FOR EACH CALENDAR YEAR THEREAFTER; PROVIDING WHEN
CITY TAXES BE AND BECOME DUE AND PAYABLE; PROVIDING THAT NO
DISCOUNT SHALL BE ALLOWED FOR EARLY PAYMENT OF CURRENT TAXES
NOR SHALL ANY SPLIT TAX PAYMENTS BE ALLOWED ON CURRENT TAXES;

#ll ORDINANCE: The Mayor introduced an ordinance and read the
caption as follows:
ORDINANCE NO. 8l-S-30
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS,
AMENDING THE ZONING ORDINANCE (ORDINANCE NO. 79-S-l5) OF THE
CITY OF SCHERTZ, TEXAS: CHANGING THE CLASSIFICATION OF A 54.25
ACRE TRACT OF LAND FROM PRE-DEVELOPMENT (PD) TO GENERAL BUSINESS
(GB); AND REFLECTING SAID CHANGE ON CERTAIN ZONING MAPS IN
ACCORDANCE WITH ARTICLE II AND III OF SAID ZONING ORDINANCE.
Mrs. Lawler moved that the Zoning Ordinance be so amended and this
ordinance be passed on final consideration. Mr. Howe seconded the
motion which carried with the following vote:

#12 EXECUTIVE SESSION: None needed at this time.
#l3 CITY MANAGER1S REPORT: Mr. Gilmore advised Council of the
upcoming meeting on the Southwestern
Bell rate case. Meeting will be held in San Antonio Convention Center
on Sunday, October 25, 1981 at 6:00 P.M.
Mr. Gilmore requested councils feelings on passing a resolution supporting
Constitutional Amendment #4 which authorizes use of State funds for water
resources development in Texas. Consensus of Council was to make up a
resolution.
Mr. Gilmore advised council that the next workshop would be held
on October 28th the day after the TML Meeting was over. Council favored
having the workshop on the regular scheduled date.

Mr. Gilmore also requested councils desires in regards to the November
11 workshop which is to be on Veterans Day. Council requested that
he bring the date up at the next meeting and they would know better if
the workshop should be rescheduled.
Mr. Gilmore advised Council that he had been recelvlng calls from
developers concerning the area where the new sewer line is being installed.
#14 ITEMS BY COUNCIL: Mr. Howe asked Mr. Gilmore if he had any
additional information on the sale of land
to Universal City. Mr. Gilmore explained that Universal City wanted to
trade for a piece of land belonging to them which is located in the middle
of a residential zoned area.
Mr. Howe also requested information on the status of the garbage situation.
Mr. Gilmore advised that Mr. Gutierrez had been given an extension.
Mr. Sawyer advised he thought it would be a waste of the City's money
to have the City Attorney study every ordinance written, as the format
was taken from eXisting ordinances obtained from TML and that Mr. Gilmore
11ad educational background in law.
Mr. Sawyer requested that BVYA be placed on the October 28, Workshop
Agenda to meet with Council.
