SPECIAL SESSION OF THE CITY COUNCIL
JANUARY 13, 1982
The City Council convened in Special Workshop Session, Wednesday, Jan-
uary 13, 1982 at 7:00 P.M. in the Conference Room of the Municipal
Complex, 1400 Live Oak Road with the following members present:
Mayor Jack M. Stomackin, Sr., presiding; Richard L. Howe; Jeff Duffield;
Earl W. Sawyer; and Jacqueline Lawler. Absent: Mrs. Barbara Taylor.
Staff present were City Manager Jimmy G. Gilmore and City Secretary June
G. Krause.
#1 AUDIT REPORT: Mr. Gilmore introduced Mr. Carlos Melick and Mr.
Ed Thorpe, who formally presented the audit report
for FY 1980-81. Mr. Melick first thanked the Council for being selected
to audit Schertz. He explained that the audit is divided into three
sections; namely, the introductory, financial section and statistical
sections. Each sections also includes their explanations and comments at
the beginning of each. Mr. Melick said they continue to find improvements
every yea r.
Mr. Thorpe then gave a slide presentation relative to possible water or
sewer rate increases. The outcome of the presentation seemed to be that
in order for the City to maintain their 1.5 bond rating, it would be nec-
essary to increase sewer rates or decrease expenses. There followed a
question and answer period.

Mr. Sawyer moved to accept the audit as presented. Mrs. Lawler seconded
the motion which carried with the following vote:

Mr. Duffield suggested that when the City Manager was ready to present
his recommendation on a sewer rate increase, that he include what CCMA
charges other cities and what those cities charge their customers.
Mr. Gilmore called attention to the auditors recommendation of the City's
need for a new computer.
#2 WORKSHOP ITEMS:
A. Personnel Board; Mr. Gilmore said that in 1974 the then City Manager
Mr. Arnold, wrote TML on Advisory Boards. He read from TML's letter answer=
ing that no city in Texas had a Personnel Board - some were covered by
Civil Service Boards. Mr. Gilmore again called TML and this still holds
true. Out of 255 cities contacted, Schertz is the only one with a Personnel
Board.
Council agreed that perhaps this ordinance (on Personnel Board and duties)
should be repealed, especially since it is in conflict with our charter.
B. Discussion of Delinquent Tax Charge: Mr. Gilmore presented a proposed
ordinance containing the 15%
charges on delinquent taxpayers, as he had discussed with Council at their
last meeting.

C. Discussion of proposed ordinance on sewer tap fees. Mr. Gilmore
explained this proposed ordinance would follow the same lines of the CCMA
ordinance, in which they are doubling their tap fees.
Mike Lawler showed Council some charts he had compiled from our audit to
show a sampling of what could be obtained from a new computer.
At this time, Mayor Stomackin called for a ten minute recess - 8:12 P.M.
The meeting was reconvened at 8:21 P.M. and immediately an Executive
Session was called under Article 6252-17, Section 2 (g) of Vernon's Texas
Civil Statutes.
The general session was reconvened at 9:04 P.M.
#3 GENERAL DISCUSSION: Mr. Gilmore polled Council on returning
to the practice, as outlined in our ordinance,
of charging $2.00 for each animal tag issued. The eliminating of this charge
was to assure that more people would license their animals but that has not
proven to be the case. As we have been notified by Universal City of the
probable closing of their shelter at July and therefore the cancelling of
our mutual contract, this charge will become even more necessary. Also Mr.
Gilmore advised that the Humane Society would be addressing Council about
a shelter for Schertz.
The City Manager also had a request from the Chief of Police to reappoint
George Bowman (an exemployee) as a Reserve Police Officer. Council agreed
that he should hold off on any appointment of exemployees.
The City has received our annual bill for 911 service, in the amount of
$1,190.49, and we are committed to pay for this year. However he submitted
some complaints from the Fire Department, as well as the police department,
and suggested that we might want to look at this further before committing
for next year. Mr. Duffield suggested that when paying this bill, we give
our intent to terminate service with the final decision to made at a later
date.
Mr. Howe asked what was to be done about removing the concrete by the purchaser
of the house that was on the land to be used for a new library building. Mr.
Gilmore again advised that the concrete would be removed prior to the library
pouring their foundation.
Mr. Howe also asked about street sweeping. Mr. Gilmore said they have a
regular schedule and the sweeper is in fine working order.
Mr. Gilmore advised that the City came close to being without water recently.
The CPS had outages on the north side of San Antonio that affected our
pumps.
In answer to Mr. Duffields question, Mr. Gilmore said that he had today
received a diagram along with work orders to replace the city limit signs
on I 35.
Mr. Duffield also wanted to know about Autumn Winds sewer problems. Mr.
Gilmore said that both CCMA and our people are investigating this problem.

#4 ADJOURNMENT: On a motion by Mrs. Lawler, duly seconded and
unanimously carried, the meeting was adjourned
at 9:28 P.M.

The Schertz City Council convened in Regular Session, Tuesday, January 19,
1982 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the
following members present: Mayor Jack M. Stomackin, Sr., presiding; Richard
L. Howe; Barbara Taylor; Earl W. Sawyer and Jacqueline Lawler. Absent: Jeff
Duffield. Staff present were City Manager Jimmy G. Gilmore and City Secretary
June G. Krause.
#1 APPROVAL OF MINUTES: Mr. Sawyer moved the minutes of the Regular
Meeting of January 5, 1982 and the Workshop
Session of January 13, 1982 be accepted. Mrs. Lawler seconded the motion
which carried with the following vote:
AYES: Councilmembers Howe, Taylor, Sawyer and Lawler
NAYS: None
#2 HEARING OF RESIDENTS: Mrs. Pat Jarvis, who works for the Senior
Citizen Meals on Wheels program questioned
the Council about the requirement on the City's application for a health
card calling for a blood test for serology. She had contacted the County
Health Officer in both Guadalupe and Comal Counties and they both advised
they no longer required this test for a health card. Mr. Gilmore advised
that Mrs. Krause had called this same day and was told that it is still a
state requirement; however we would call the State Health Department and
would so notify Mrs. Jarvis of the results the following day. Council
agreed that if there is no state requirement, the City should repeal that
section of the requirements.
#3 ORDINANCE: Mayor Stomackin introduced and read the caption on the
following ordinance:
ORDINANCE NO. 82-E-l
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS,
CANVASSING THE RETURNS AND DECLARING THE RESULTS OF A BINGO
LEGALIZATION ELECTION HELD IN SAID CITY ON THE 16TH OF JANUARY
1982 AND DECLARING AN EMERGENCY.
