ATTEST: REGULAR MEETING OF THE CITY COUNCIL JANUARY 19, 1982 The Schertz City Council convened in Regular Session, Tuesday, January 19, 1982 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the following members present: Mayor Jack M. Stomackin, Sr., presiding; Richard L. Howe; Barbara Taylor; Earl W. Sawyer and Jacqueline Lawler. Absent: Jeff Duffield. Staff present were City Manager Jimmy G. Gilmore and City Secretary June G. Krause. #1 APPROVAL OF MINUTES: Mr. Sawyer moved the minutes of the Regular Meeting of January 5, 1982 and the Workshop Session of January 13, 1982 be accepted. Mrs. Lawler seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Taylor, Sawyer and Lawler NAYS: None #2 HEARING OF RESIDENTS: Mrs. Pat Jarvis, who works for the Senior Citizen Meals on Wheels program questioned the Council about the requirement on the City's application for a health card calling for a blood test for serology. She had contacted the County Health Officer in both Guadalupe and Comal Counties and they both advised they no longer required this test for a health card. Mr. Gilmore advised that Mrs. Krause had called this same day and was told that it is still a state requirement; however we would call the State Health Department and would so notify Mrs. Jarvis of the results the following day. Council agreed that if there is no state requirement, the City should repeal that section of the requirements. #3 ORDINANCE: Mayor Stomackin introduced and read the caption on the following ordinance: ORDINANCE NO. 82-E-l AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, CANVASSING THE RETURNS AND DECLARING THE RESULTS OF A BINGO LEGALIZATION ELECTION HELD IN SAID CITY ON THE 16TH OF JANUARY 1982 AND DECLARING AN EMERGENCY. ~ . .... Mrs. Lawler seconded the motion which carried with the following vote: AYES: Counci1members Howe, Taylor, Sawyer and Lawler NAYS: None #4 ORDINANCE: The Mayor introduced and read the caption on the fo110w= ing ordinance: ORDINANCE NO. 82-E-2 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, LEGALIZING BINGO WITHIN THE CITY OF SCHERTZ, TEXAS; IMPOSING A TWO PERCENT (2%) GROSS RECEIPT TAX UPON LEGALIZED BINGO CON- DUCTED BY EACH LICENSEE AUTHORIZED TO CONDUCT BINGO WITHIN THE CITY OF SCHERTZ, TEXAS; AND STIPULATING EMERGENCY ACTION. Mrs. Lawler moved this ordinance be adopted as written. Mr. Sawyer seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Taylor, Sawyer and Lawler NAYS: None #5 ORDINANCE: The Mayor introduced and read the caption on the follow- ing ordinance: AN ORDINANCE FOR CERTAIN AUTHORIZED COLLECTION EXPENSES IN CONNECTION WITH DELINQUENT AD VALOREM TAXES DUE THE CITY OF SCHERTZ, TEXAS Mr. Sawyer moved the first reading of this ordinance be approved. Mrs. Lawler seconded the motion which carried with the following vote: ~ AYES: Councilmembers Howe, Taylor, Sawyer and Lawler NAYS: None #6 ORDINANCE: Mayor Stomackin introduced and read the caption on the following ordinance: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING SECTIONS 7, 11 AND 17 OF ORDINANCE NO. 78-F-7 GOVERNING CONNECTION TO THE WATER AND SEWER SYSTEM AND REGULATING SAME; REPEALING ORDINANCE NO. 78-F-ll; AND PROVIDING AN EFFECTIVE DATE. Mr. Sawyer moved the first reading of this ordinance amending ordinance No. 78-F-7 concerning sewer tap fees be approved. Mrs. Lawler seconded the motion which carried as follows: AYES: Council members Howe, Taylor, Sawyer and Lawler NAYS: None 130 Mr. Gilmore explained to the audience that CCMA has increased the tap fees to the cities and we are now increasing accordingly to our customers need- ing new taps. #7 EXECUTIVE SESSION: Mayor Stomackin recessed the regular meeting at 7:18 P.M. and immediately called an executive session under Article 6252-17, V.T.C.S., Section 2 (g). The regular meeting was reconvened at 8:14 P.M. #8 CITY MANAGER'S REPORT: Mr. Gilmore passed out a sewer charge analysis and asked Council to study it and discuss it at the next workshop session on January 27th. He recommended option #4. The City has received a letter from GVEC stating that the Greater Randolph Area Chamber of Commerce had advised them they could no longer support the upkeep on the billboard sign near the Cibolo Creek bridge on F.M. 78. GVEC was asking the City join them in this project to make the sign an attractive asset to the Schertz area. Council had no objection to this request. Mr. Gilmore said that Dr. Mays supplies the electricity for the sign free. The City Manager also had received the nominees for the Library Advisory Board and said he would present them for vote at the next meeting. He handed out a leaflet entitled "Requirements for Growth of a City", which explains how our city stands now and the Council's responsibilities in the future. ---., #9 ITEMS BY COUNCIL: Mr. Howe asked if he could get a break-down on sewer as to what it is costing the City to replace sewer lines etc. - in other words what is the sewer system costing us to operate. Mr. Gilmore pointed out that all he has is what the auditor gave on table #3 of the breakdown on water and sewer. Mrs. Taylor asked if Mr. Gilmore had received any compliments or complaints from Mobile Villa residents. Mr. Gilmore said he had received several ~alls from people who thanked the City Council on several occasions.
