ATTEST: of Schertz REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 2, 1982 The Schertz City Council convened in Regular Session., Tuesday., February 2., 1982 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the following members present: Mayor Jack M. Stomack, Sr., presiding; Richard L. Howe; Barbara Taylor; Jeff Duffield; Earl W. Sawyer and Jacqueline Lawler. Staff present were City Manager Jimmy G. Gilmore and City Secretary June G. Krause. 'I I ~--' I' I #1 PUBLIC ZONING HEARING: The Mayor, after opening the public hear- ing, turned the procedings over to Mr. Linebarger, Chairman of the Planning and Zoning Commission. He explained the public hearing was to receive citizens views on the proposed change to the Zoning Ordinance No. 79-S-15 by adding a section on "Home Occupationsll. He said the P&Z had worked with City staff .' -on~['r. this ordinance section on home occupations to make it more definitive and easier to regulate. I' Among the questions by Council, one of the things asked was the effect this o.rdinance would have on those home occupation businesses, now in being. Mr. Lfnbarger explained that all businesses should make an application; however, most of these would be covered by the IIGrandfather Clausell. There being no citizens with questions on this subject, Mayor Stomackin declared the public hearing closed at 7:07 P.M. He then called a short recess in order for the P&Zmembers to reconvene in the conference room. The regular meeting was reconvened at 7:09 P.M. I I , ,--' ;. ' , q'~ .L'")' , #2 PUBLIC HEARING: Mayor Stomackin opened the public hearing and explained the purpose was to receive citizen input regarding the proposed disannexation of 48.733 acres of land out of Guadalupe County. There being no citizens wishing to speak or any questions from Council, the public hearing was declared closed at 7:10 P.M. #3 PUBLIC HEARING: The Mayor opened the public hearing and explained the purpose was to receive citizen input in con- nection with the proposed disannexation of 59.07 acres of land out of Guadalupe County. There being no questions from the audience, the Mayor declared the public hearing closed at 7:00 P.M. #4 APPROVAL OF MINUTES: Mrs. Krause explained she regretted that the minutes of the workshop session of January 27, 1982 were not available at this time. Mrs. Lawler moved to accept the minutes of the regular meeting of January 19 1982 as written. Mr. Sawyer seconded the motion which carried with the following vote: AYES: Councilmembers Howe, Taylor, Duffield, Sawyer and Lawler NAYS: None #5 HEARING OF RESIDENTS: None #6 ORDINANCE: The Mayor introduced and read the caption of the ordinance as follows: ORDINANCE NO. 82-T-3 AN ORDINANCE FOR CERTAIN AUTHORIZED COLLECTION EXPENSES IN CONNECTION WITH DELINQUENT AD VALOREM TAXES DUE THE CITY OF SCHERTZ, TEXAS. Mr. Howe moved this ordinance be adopted on final consideration. Mr. Sawyer moved this ordinance calling an election for April 3, 1982 to elect a mayor and two councilmembers be passed on first reading. Mrs. Taylor seconded the motion which carried as follows: AYES: Councilmembers Howe, Taylor, Duffield, Sawyer and Lawler NAYS: None #9 ORDINANCE: The Mayor introduced and read the caption on an ordinance concerning sewer rates, as follows: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS, BE AMENDED BY REVISING SECTION 19-38 AND SECTION 19-41 WHICH PROVIDE FOR RESIDENTAIL BASE RATE AND USER CHARGE, BUSINESS AND MULTI-FAMILY DWELLING UNITS BASE RATE AND USER CHARGE, AND PUBLIC SCHOOL BASE RATE AND USER CHARGE AND DEPOSIT TO ASSURE PAYMENT. He read a card received from Pat Jarvis thanking the Council, City Manager and City Secretary, for the prompt and courteous way their complaint regarding health cards was handled and for allowing the volunteer workers to receive their cards free. Mr. Gilmore showed Council a proposed news release he had drawn regarding the proposed increase in sewer rates. , \ \ ) - j . i"35 #12 ITEMS BY COUNCIL: Mrs. Taylor said she wanted to thank Council for taking care of Mrs. Jarvis' complaint so promptly. Mr. Duffield asked if the group (School District and Council representatives) that the Mayor agreed to serve on had met as yet. Mr. Stomackin said no. #13 ITEMS BY MAYOR: None ATTEST: #14 ADJOURNMENT: On a motion duly made5 seconded and unanimo carried the meeting was adjourned at 7:24 WORKSHOP MEETING OF THE CITY COUNCIL FEBRUARY 10, 1982 The Schertz City Council convened in Workshop Session, Wednesday, February 10, 1982 at 7:00 P.M. in the Conference Room of the Municipal Complex, 1400 Live Oak Road with the following members present: Mayor Jack M. Stomackin, Sr. presiding; Richard L. Howe; Barbara Taylor; Jeff Duffield; Earl W. Sawyer and Jacqueline Lawler. Staff present were City Manager Jimmy G. Gilmore and City Secretary June G. Krause. #1 LIBRARY BOARD: Donna Grainger, representing the Library Board. addressed the Council giving a little background information on the library as well as bring them up to date on statistical information - 3295 cards have been issued and they have 14,296 books on hand. She explained they have received grant monies from the Dobie, Halsell and Brown Foundations as well as many private donations. They are now ready to start building a new 6,000 sq. ft. library building. They had re- ceived a cost estimate of $125,000; however, have agreed to go at it piece- meal and hope to get the foundation built with a shell for approximately $48,000. They now have $12,019 of non-public funds and ask Council to advance the additional required to put in the $18,000 foundation, with much of the material being acquired at cost or below. They also have about $16,450 in County Revenue Sharing and budget money but this can only be expended if they would go out for bids, which they plan to do on the shell of the building itself. Mrs. Grainger also ask the Council to make the library a loan of the $485000 for the shell and if they would sell the building the library is now in and use that money toward the building fund of the library. Mr. Sawyer explained the reason they want to go with this particular con- tractor for the slab (rather than going out for bids) is that he is agreeable to using donated materials and labor.
