ccreg 06-01-1982 178 REGULAR MEETING OF THE CITY COUNCIL JUNE 1, 1982 The Schertz City Council convened in Regular Session, Tuesday, June 1, 1982, at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the following members present: Mayor Earl W. Sawyer, presiding; Charles B. Sharpe, Jeff Duffield, Adolph Aguilar, and Jacqueline Lawler. Absent: William G. Courtney. Staff present City Manager Jimmy G. Gilmore and Deputy City Secretary Alice Austin. Mayor Sawyer welcomed everyone to the meeting and advised that before starting he would like to present a proclamation to Mr. Rick Reeves of the Cibolo Valley Jaycees. Mayor Sawyer read and presented the proclamation which designated the week of June 13, 1982 as IIShooting Education Week." Mrs. Reaves explained that the Shooting Education program was designed as a safety program for children 8 to 14 years of age and that the state shooting championships would be held here in Schertz. #1 APPROVAL OF MINUTES: The Mayor asked for a motion regarding the minutes of the Regular Meeting of May 18, 1982 and the Special Meeting of May 26, 1982. Mrs. Lawler moved these minutes be approved as written. Mr. Duffield seconded the motion which carried with the following vote: AYES: Councilmembers Sharpe, Duffield, Aguilar and Lawler NA,YS : None. #2 HEARING OF RESIDENTS: None LI #3 ORDINANCE: Mayor Sawyer introduced and read the caption on an ordinance as follows: ORDINANCE NO. 82-0-14 AN ORDINANCE OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS, BE MAENDED BY REVISING SECTION 18-19 OF SAID CODE: PROVIDING THAT THE ENTIRE LENGTH ON THE WEST SIDE OF DOWMAN STREET BE DESIGNATED AS A NO PARKING AT ANY TIME. Mr. Duffield moved this ordinance amending Section 18-19 of the Code of Ordinances be approved as presented. Mrs. Lawler seconded the motion which carried with the following vote: GqfL ~ AYES: Councilmembers Sharpe, Duffield, Aguilar and Lawler NAYS: None #4 ORDINANCE: Mayor Sawyer introduced and read the caption on an ordinance as follows: I i I' I I 11 ,~ '"'79 1 ORDINANCE NO. 82-M-15 AN ORDINANCE OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES BE AMENDED BY REVISING SECTIONS 12!-3 AND 12t-4 OF SAID CODE TO RESTRICT THE POSSESSION AND/OR CONSUMPTION OF ALCOHOLIC BEVERAGES IN CITY PARKS AND RECREATION AREAS DURING CERTAIN HOURS WITHOUT PRIOR AUTHORIZATION; BY REVISING RESERVATION POLICY FOR SMALL GROUPS (15 OR LESS PERSONS); AND DECLARING AN EMERGENCY. Mrs. Lawler moved to approve the ordinance amending the Code by revising Sections 12t-3 and 12t-4 as an emergency measure. AYES: Councilmembers Sharpe, Duffield5 Aguilar and Lawler NAYS: None #5 ORDINANCE: Mayor Sawyer introduced and read the caption on an ordinance as follows: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING THE ZONING ORDINANCE (NO. 79-S-15) OF THE CITY OF SCHERTZ, TEXAS; CHANGING THE CLASSIFICATION OF 124.5 ACRES OF LAND FROM PRE-DEVELOPMENT TO GENERAL BUSINESS; AND REFLECTING SAID CHANGE ON CERTAIN ZONING MAPS IN ACCORDANCE WITH ARTICLE II AND III OF SAID ZONING ORDINANCE. Mr. Sharpe moved to approve the first reading of the ordinance amending the zoning ordinance and changing the classification of 124.5 acres of land from pre-development to general business. Mr. Duffield seconded the motion which carried with the following vote: AYES: Councilmembers Sharpe, Duffield, Aguilar and Lawler NAYS: None ':.- i #6 RESOLUTION: Mayor Sawyer introduced and read the following captioned resolution: RESOLUTION NO. 82-R-5 A RESOLUTION TO ADOPT AN EMERGENCY OPERATIONS PLAN TO BE IMPLEMENTED IN THE CASE OF AN IMPENDING OR RECENT DISASTER OCCURING IN THE CITY OF SCHERTZ; SAID PLAN SETTING FORTH THE AUTHORITY, PURPOSE5 OBJECTIVES, SITUATIONS AND ASSUMPTIONS, ASSIGNMENT OF RESPONSIBILITIES, SUPPORT, RESOURCE MANAGEMENT, IMPLEMENTATION, AND OTHER RELATED FUNCTIONS TO BE PERFORMED IN THE EVENT OF A DISASTER. Mr. Aguilar moved to accept the Emergency Operations Plan. Mr. Duffield seconded the motion which carried with the following vote: AYES: Councilmembers Sharpe, Duffield, Aguilar and Lawler NAYS: None :r ' c " #7 REZONING REQUEST: Mayor Sawyer explained that the request under consideration was to rezone approximately 3 acres of land at 1600-1700 Live Oak Road from R-l to General Business. 180 , I 1- : 01' ~n ~ Mr. Gulmore read Planning and Zoning Commissions recommendation to dis- approve the zoning change request by Mr. Hoover Edwards. Mrs. Lawler moved that City Council Accept Planning and Zonings recommen~ dation to deny Hoover Edwards request to rezone approximately 2 acres at 1600-1700 Live Oak Road from R-l to General Business. Mr. Aguilar seconded the motion which carried with the following vote: AYES: Councilmembers Sharpe, Duffield, Aguilar and Lawler NAYS: None #8 APPOINTMENTS: Mayor Sawyer explained that the Crime Stoppers Committee would be having a meeting on June 7 and were requiesting that Council appoint two representatives to serve on the committee. Mayor Sawyer asked Mr. Sharpe if he would be willing to serve as a representative and Mr. Sharpe agreed. Mr. Sharpe also agreed to contact some other people and make a recommendation to Council on the second representative. Council agreed to approve Mr. Sharpes recommendation when made. #9 EXECUTIVE SESSION: None needed at this time. canvas Flea Markets. #10 CITY MANAGER'S REPORT: Mr. Gilmore advised Council that Mr. Bob Bullocks office would be in the area to He advised that a location had been selected for a temporary animal shelter. This would be on a small strip of land which is not in the city limits and is adjacent to the Smoke Pit where the city has a lift station. He advised construction will begin as soon as possible. He also advised that Mr. John Lund had upon hearing of the City's problem in obtaining land for an animal shelter offered to sell the city some land he has on 1518 for $3,000.00. He has the land for sellon the open market for $5,000.00. I I , , I '---' Mr. Gilmore advised Council and requested a consensus to allow the Heart of Texas swim team to use the city pool from 8:00 to 8:30 AM for practice. Council agreed that prior to making a decision they would like information on the group, what kind of insurance they carry and the amount they are willing to pay to use the pool. Mr. Gilmore briefed Council on the status of Direct Oil. He advised that the parent company was ceasing all capital improvements until the oil situation improves. Mr. Gilmore advised Council that CCMA was requesting that they be allowed to come before Council at the next workshop meeting and present the Corp of Engineers "Cibolo Creek Project". They also requested they be allowed to invite persons from Universal City and Edwards Aquifer to the meeting. Council agreed to inviting CCMA to the next workshop at 6:00 PM. Mr. Gilmore explained the letter received from Mr. Schoolcraft regarding sewer lines on property abutting Lovaca right of way. Council consensus was that this would be Mr. Schoolcraft's responsibility. : I I' '.~.-/ ''11 I 181 #11 ITEMS BY COUNCIL: Mr. Duffield asked if the Corp of Engineers were responsible for keeping Cibolo Creek clean and that Mr. Gilmore should contact the Corp and try to establish good relations with the group. Mr. Sharpe wished to acknowledge the letter he had received concerning Lynn Landis of the Library. He also seconded the need for cleaning the debris from Cibolo Creek. #12 ITEMS BY MAYOR: Mayor Sawyer advised that he had attended an Award and Recognition Dinner with the Jaycees and had been presented a certificate to the City of Schertz. Sharpe and Adolph Aguilar. Absent: Mayor Earl W. Sawyer, William G. Courtney and Jeff Duffield. Staff present were City Manager Jimmy G. Gilmore and Deputy City Secretary Alice Austin. Others present were Mr. Tom Weaver and Mr. David Dennis of CCMA. #1 CCMA PRESENTATION: Mrs. Lawler opened the meeting and then turned it over to Mr. Dennis for a presentation concerning the Cibolo Creek Project which had been prepared by the Corp of Engineers. Mr. Dennis explained the different types of flooding which could occur in Schertz. He also outlined the Corp of Engineers recommendations on ways and cost to remedy this flooding.
