ccreg 08-03-1982 200 REGULAR MEETING OF THE CITY COUNCIL AUGUST 3, 1982 The Schertz City Council convened in Regular Session, Tuesday, August 3, 1982 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the following members present: Mayor Earl W. Sawyer, presiding; Charles B. Sharpe; Jeff Duffield; and Jacqueline Lawler. Absent: Councilmembers William G. Courtney and Adolph Aguilar. Staff present were City Manager Jimmy G. Gilmore and City Secretary June G. Krause. #1 PUBLIC HEARINGS: Mayor Sawyer welcomed the citizens to the public meeting and turned the meeting over to John Linebarger, Chairman of the Planning and Zoning Commission. Mr. Line- barger explained the purpose of this public hearing was for the City Council and Planning & Zoning Commission to jointly consider the request of Mr. Donald Decker to rezone apprOXimately three acres of land at 1600-1700 Live Oak Road from R-l Single Family Dwelling District to R-4 Apartment/Multi-family Dwelling District. There were seventeen citizens present for the public hearings. Chairman Linebarger asked Mr. Decker to restate his request before having citizens speak on the zoning. He said they intend building 37 condominiums on this property, and as they will be sold, there will be a home owners association who will maintain the grounds and outside of buildgins as well as furnish water.iiJ"hey plan to start groundbreaking within 30 to 60 days; but if for some reason they had not started building within six months, the zoning would revert back to single family. Council discussed the planned complex with regards to size of individual units, parking and construction type. There were no citizens wishing to speak either for or against the requested rezoning; however, Mr. James Davidson of Marilyn Drive asked if this addi- tional residental building will affect the Schertz water supply. He was told that; the City's water problems had been solved and this should have no adverse affect on the system. Mr. Linebarger asked if there was any information on the improvements P&Z had discussed for Live Oak Road. Mr. Decker said they had talked with Mr. Wright, who said the people building the apartments across the street cannot afford to pay for both their half of the street widening and the sewer extension. Mr. Decker said he would continue to negotiate with them. There being no further questions or comments, Mayor Sawyer declared this public hearing closed at 7:11 P.M. He then called for a short recess in order for the members of the Planning and Zoning Commission to leave and reconvene in their meeting in the conference room. Mayor Sawyer reconvened the regular meeting of the City Council at 7:18 P.M~ He then announced the second part of the Public Hearings as being the City Manager's Revenue Sharing Proposed Use Hearing. He then turned the meeting over to Mr. Gilmore.. ; i i ! ~ l 201 Mr. Gilmore said the City is expecting $44,000 in revenue sharing funds for the next year. He said that the City Council has preferred, over the past few years, to include the revenue sharing funds in the regular budget to help offset taxes. He was proposing $1,500 in the Council budget, $6,000 in Legal department; $5,600 in the police department; $2,000 for inspection services; 10,580 in the streets and parks department; $500 for Animal Control facility maintenance; $6,466 for SAFES and $5,254 for the library - for a total of $44,000 planned expenses. He then opened the floor for questions or comments from either citizens or Council. Mr. Duffield asked how much of the $1,500 would be for Industrial Development and was told probably $500 or more. Mrs. Lawler asked if the proposed pur- chase of a police car would be from the Texas Highway Department and was told that it was. There being no further questions, Mayor Sawyer declared the public hearing on proposed uses for the revenue sharing funds closed at 7:23 P.M. #2 APPROVAL OF MINUTES: Mrs. Lawler moved the minutes of the regular meeting of July 20, 1982 and the Workshop Mr. Sharpe seconded the motion, which carried of July 28, 1982 be approved. with the following vote: AYES: Councilmembers Sharpe, Duffield and Lawler NAYS: None #3 HEARING OF RESIDENTS: Mrs. Ruth Tienor said that she was sure everyone had heard that the Library Board had been offered the old Thulemeyer house for a library. They had discussed the pros and cons and two meetings and the night before had made a decision not to accept the offer and would like to explain their reasons. She introduced Mr. Fred Ross, a board member who is a county representative. Mr. Ross is a contractor and had given much time and thought to the decision. He said the building, although in good shape, is an old building and two-story. The problems are that right now they have 1500 sq. ft of space and the first floor of this house is 1797 sq. ft; but when you deduct the stairwell, etc. you are down to less that 1400 sq. ft, which is less than available now. Also they would have to provide an elevator for the handicapped and so many of the volunteers are elderly and it would be a hardship for them to climb stairs. The cost of the moving, all new electrical wiring, alterations, etc. would be more than they have on hand and they still would not have any more space. They would rather use what money they have to gain more square footage. Mayor Sawyer asked the Library Board to so notify Dr. Richard, who had offered the building, as soon as possible of their decision. One of the board members asked if the City Council had any feed back. Mr. Sharpe reminded them that the law did not require an elevator in these remodeling of the older buildings. Mrs. Lawler said she felt it was a great mistake and that she thought the building was very beautiful. Mayor Sawyer said the point is that they decided to go with a larger building and with this one, they would not be gaining any space. He also agreedilt is a beautiful building and he would hate to see it leave Schertz. 202 Mrs Wanda Koch said she really thought it a shame that we can't save some of these old houses #4 APPOINTMENT: Mrs. Lawler moved to appoint Mr. Adolph Aguilar as ex-officio member to the Library Advisory Board. Mr. Duffield seconded the motion which carried with the following vote: t l AYES: Councilmembers Sharpe, Duffield and Lawler NAYS: None #5 ZONING REQUEST: Mayor Sawyer said that the Planning and Zoning had just met and after consideration recommended the Zoning.Change Request #39 as requested by Mr. Decker be approved. Mr. Duffield moved the recommendation of the P&Z regarding zoning change #39 be approved as made. Mrs. Lawler seconded the motion which carried with the following vote: I 0 S,1 Ir . ~. . AYES: NAYS: Councilmembers Sharpe, Duffield and Lawler None #6 EXECUTIVE SESSION: Mr. Sawyer called an executive session under Section 2 (e) of Vernons Texas Civil Statues No. 6252-17 with regard to possible litigation, at 7:21 Pi.M. The Regular Meeting was reconvened at 8:18 P.M. Mayor Sawyer explained the executive session did involve certain legal matters which Council had to discuss with our legal staff. #7 CITY MANAGER'S REPORT: While waiting for Mr. Gilmore to return, Mayor Sawyer suggested moving to the next ! i I i ----- item and coming back to this. #8 ITEMS BY COUNCIL: None #9 ITEMS BY MAYOR: Mr. Sawyer said he had requested the Library Board make a detailed report of the cost involved to the City and library in moving the Thulemeyer building. Mr. Ross needed more time for this - what he gave tonight was a rough estimate. #7 CITY MANAGER'S REPORT: Mr. Gilmore reported that he had personally turned the water back on after the completion of the renovation of V.C. well and the tank is now full so pressure should be completely restored. We are asking that citizens still conserve on water. He also reported we are back on our weed program, the animal shelter is oper- ating and we will continue to improve that as time goes on. We can now handle about 20 dogs and are in the process of getting some cat cages and more dog runs. The humane Society is working with the City on this project. Mayor Sawyer said that the city staff did an admirable job on the water situation. i I ~ . 203 #10 ADJOURNMENT: There being no further business, Mayor Sawyer declared the meeting adjourned at 8:25 P.M. ATTEST: SPECIAL SESSION OF THE CITY COUNCIL AUGUST 11, 1982 The Schertz City Council convened in Special Session, Wednesday, August 11, 1982 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the follow- ing members present: Mayor Earl W. Sawyer, presiding; Charles B. Sharpe; Jeff Duffield; and Jacqueline Lawler. Absent: William G. Courtney and Adolph Aguilar. Staff present were City Manager Jimmy G. Gilmore and City Secretary June G. Krause. #1 PUBLIC HEARING: The Mayor, after welcoming the citizens, gave the purpose of the public hearing as being to receive citizen input pursuant to the adoption of a budget for fiscal year 1982-83. Mr. Dick Chambless, 504 Aviation, said he had understood that there would be funds for seal coating of streets in the budget and he did not see any allocation for this. Mr. Gilmore said that he would estimate the Council could put in approximately $15,000 for seal coating right now and perhaps more later when he gets the report from the auditor. Mr. Walter Schneider asked if the City had received their tax rolls from the county appraiser, and if not what was being used to arrive at a tax figure for the budget. Mr. Gilmore said he used last year's figures plus the new properties brought onto the rolls in this past year to arrive at his estimate. Mayor Sawyer said the City has not as yet received an adequate tax roll. Mrs. Roberta Schneider asked about personnel and the need for assistants. Mayor Sawyer explained the Council, being working people, have to depend on the Council-Manager form of government and that most city employees have multiple jobs. Both Mr. and Mrs. Schneider also asked about street repair and what happened to the funds that had been set aside for that. Mayor Sawyer explained that since 1979 /80, when the alloted money was used for sealcoating, there has not been a budgeted line item for street repair; however, Council is putting it back in the budget this year.
