REGULAR MEETING OF THE CITY COUNCIL
OCTOBER 27, 1980
The Schertz City Council convened in Regular Session, Monday, October 27,
1980 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the
following members present: Mayor Jack M. Stomackin, Sr., presiding; Barbara
Taylor; Richard L. Howe; Earl W. Sawyer and Jacqueline Lawler. Absent: Jeff
Duffield. Staff present: City Manager Jimmy G. Gilmore and City Secretary
June G. Krause.
#1 APPROVAL OF MINUTES: A. Mrs. Lawler moved the minutes of the Regu-
lar Meeting of October 7, 1980 be approved
as written. Mrs. Taylor seconded the motion which carried with the following
vote:
AYES: Councilmembers Taylor, Howe, Sawyer and Lawler.
NAYS: None
B. Mrs. Taylor moved the minutes of the Special Session of October 20, 1980
be approved. Mrs. Lawler seconded the motion which carried as follows:
AYES: Councilmembers Taylor, Sawyer and Lawler
NAYS: None
ABSTAINING: Mr. Howe
#2 HEARING OF RESIDENTS: Mayor Stomackin requested Police Officer
Dennis I. Reed to come forward. The Mayor'
explained that Officer Reed had received a trophy for being No. 1 in the
280 hour class on Basic Law Enforcement Training Course just completed. Mayor
Stomackin also presented Officer Reed with a certificate of commendation
from the City Council and citizens of Schertz for this achievement.

#3 GUADALUPE COUNTY HOSPITAL DISTRICT: As Mr. Richey was not present
this item was passed at this
time.
#4 CIBOLO VALLEY ALCOHOL & ABUSE COUNCIL: Mr. Robert J. Jernigan gave
a progress report and current
evaluation report of the Cibolo Valley Alcohol Drug Abuse Council statlng they
had provided service to approximately 31 people. They have merged with the
Family Life Crisis Center; have established a 24-hour assistance, information
and referral network and have launched an area-wide IIAwareness Campaignll
involving the School District, the media and local law enforcement.
Mr. Jernigan said, that since donations had not come in in the amounts antici-
pated, the CVAOAC would like to ask the City Council to continue to let them
use the office at 401 Oak Street for at least an additional 6 month period..
After Council discussion, Mr. Howe made a motion to extend this organization
use of the building for another six months. Mrs. Taylor seconded the motion
which carried as follows:

#5 BID AWARD: Mrs. Lawler asked to be excused from this discussion
because of the possible conflict of interest - she then
Mr. Gilmore explained that only one bid was received, that of the Herald News-
paper system. Mayor Stomackin informed Council that the Herald had agreed to
increase the size of type for legal notices.
Mrs. Taylor moved the Weekly Herald be awarded the bid as the City's official
newspaper for the coming year. Mr. Sawyer seconded the motion which carried
with the following vote:
AYES: Councilmembers Howe, Taylor, Sawyer.
NAYS: None

#6 ORDINANCE: Mayor Stomackin introduced the following ordinance and
read the caption as follows:
ORDINANCE NO. 80-A-25
AN ORDINANCE PROVIDING FOR THE MODIFICATION OF THE BOUNDARY LINES
OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEXATION OF 177.7 ACRES OF
LAND MORE OR LESS IN THE C.M. GAHAGAN AND J.F. ZEPEDA SURVEYS OUT
OF COMAL COUNTY.
Mr. Sawyer moved the first reading of this ordinance on the proposed annexa-
tion of 177.7 acres of land out of comal county be approved. Mrs. Lawler
seconded the motion which carried with the following vote:
AYES: Councilmembers Taylor, Howe, Sawyer and Lawler.

#7 ORDINANCE: Mayor Stomackin introduced the following or'dinance- as
an emergency measure and read the caption as follows:

ORDINANCE NO. 80-F-24
AN ORDINANC~ OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE
CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS, BE AMENDED BY REVISING
SECTION 19-37 (a) OF SAID CODE; PROVIDING A UNIFORM MONTHLY RATE
FOR THE USE OF CITY WATER WITHIN THE CGRPORATE LIMITS OF THE CITY;
PROVIDING AN EFFECTIVE DATE; AND DECLARING AN EMERGENCY.
Mrs. Taylor moved the emergency consideration of an ordinance regulating
water rates be accepted. Mr. Sawyer seconded the motion which carried as

#8 ORDINANCE: The Mayor introduced the following ordinance and read the
caption.

AN ORDINANCE
ESTABLISHING AND REGULATING A RABIES - CONTROL AND ERADICATION
PROGRAM WITHIN THE LIMITS OF SCHERTZ; PRESCRIBING THAT THE ANIMAL
CONTROL OFFICER WILL PERFORM AS THE HEALTH AUTHORITY FOR THE PUR-
POSE OF THIS ORDINANCE; PROVIDING FOR REPORTING EXPOSURE TO RABIES;
PROVIDING FOR THE QUARANTINE OF ANIMALS; PROVIDING A SAVING CLAUSE;
PROVIDING A PENALTY; AND PROVIDING A REPEALING CLAUSE.

Mrs. Lawler moved to accept the first reading of this ordinance. Mr. Sawyer
seconded the motion which carried with the following vote:
AYES: Councilmembers Taylor, Howe, Sawyer and Lawler
NAYS: None
#9 EXECUTIVE SESSION: None needed at this time.
#10 CITY MANAGER'S REPORT: Mr. Gilmore reminded Council that Dr. Richard
is scheduled to meet with the P&Z on the 28th
and if for some they do not schedule a joint public hearing, then the City
Council will have to call one on their own. He also reported that Southern
Pacific Railroad has been notified by letter of the prOblems in Schertz, as
discussed at the last workshop; a traffic study on FM 3009 is almost completed
by the State and that Tom Anderlitch is scheduled to meet with the Council in
WorkshOp Session on November 17th to give them an update on the Bond market.
MR. DUFFIELD ARRIVE AT 7:38 P.M.
The City Manager went on to report that the refrigerator problems in Schertz
have been eliminated. He also asked Council desires in pursueing possible
annexation of the planned use development in Northcliffe - Council gave their
permission to continue study of this proposal. .
~r. Gilmore also called attention to letter from Mr. John Reeder, Regional
Director Bureau of the Census and some conversations had with his office
in which a review of records indicate Schertz area would be considered one
of the boon areas in the State. We should have a preliminary count in November
and another in April but until then should continue to use the 1977-78 figures.
He also discussed a sample ordinance on room occupancy tax for motels for
Council discussion. It was requested this item be placed on the next agenda.
He also read a letter from a Schertz citizen commending Officers Bowman and
Maldonado for the help in a recent burglary attempt.
#11 ITEMS BY MAYOR: Mayor Stomackin asked that his report be considered
after Council comments.

#12 ITEMS BY COUNCIL: Mr. Duffield apologized for being late and wel-
comed the Mayor back.
Mrs. Taylor offered congratulations to the police officers and to the appre-
ciation to the Valley News for coverage we received last year I

Mr. Howe said he would reiterate what both Mr. Duffield and Mrs. Taylor had
said regarding the police department, Mayor and Valley News. He also briefly
discussed the school tax billing.
Mr. Sawyer also welcomed back the Mayor and expressed appreciation to the Valley
News. He also mentioned that our computer expenses are extremely high and
wondered if we could rent time from a larger computer, we might save money
or else buy a larger computer and rent time on this. Mr. Gilmore said he would
like to say that he and Mr. Lawler, a computer analysis, are working together
to research this problem and hope to have some information shortly.
Mrs. Lawler expressed her thanks to the citizens who attended the first meeting
of the HUmane Society meeting and welcomed back Mayor Stomackin.
#11 ITEMS BY MAYOR: Mayor Stomackin mentioned that Mr. Fred Fleming
had passed away and that no citizen should go
unremembered. He also took this opportunity to that the City Councils of
Schertz and Selma for flowers he received while in the hospital. He ended by
saying that in the last month or so, he felt this city was really going for-
ward and with the help of the good Lord and our City Council we will make it.

Barbara Taylor; Richard L. Howe; Earl W. Sawyer and Jacqueline Lawler. City

#1 APPROVAL OF MINUTES: As the City Secretary did not have these minutes
ready, this item was canceled.
