Mr. Howe said he would reiterate what both Mr. Duffield and Mrs. Taylor had
said regarding the police department, Mayor and Valley News. He also briefly
discussed the school tax billing.
Mr. Sawyer also welcomed back the Mayor and expressed appreciation to the Valley
News. He also mentioned that our computer expenses are extremely high and
wondered if we could rent time from a larger computer, we might save money
or else buy a larger computer and rent time on this. Mr. Gilmore said he would
like to say that he and Mr. Lawler, a computer analysis, are working together
to research this problem and hope to have some information shortly.
Mrs. Lawler expressed her thanks to the citizens who attended the first meeting
of the HUmane Society meeting and welcomed back Mayor Stomackin.
#11 ITEMS BY MAYOR: Mayor Stomackin mentioned that Mr. Fred Fleming
had passed away and that no citizen should go
unremembered. He also took this opportunity to that the City Councils of
Schertz and Selma for flowers he received while in the hospital. He ended by
saying that in the last month or so, he felt this city was really going for-
ward and with the help of the good Lord and our City Council we will make it.

The Schertz City Council convened in Regular Session, Tuesday, November 4,
1980 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the follow-
ing members present: Mayor Jack M. Stomakcin, Sr., presiding; Jeff Duffield;
Barbara Taylor; Richard L. Howe; Earl W. Sawyer and Jacqueline Lawler. City
Staff present were City Manager Jimmy G. Gilmore and City Secretary June G.
Krause.
#1 APPROVAL OF MINUTES: As the City Secretary did not have these minutes
ready, this item was canceled.
#2 HEARING OF RESIDENTS: There were none to be heard.

#3 ORDINANCE: The Mayor introduced an ordinance on the proposed
annexation of approximately 177.7 acres of land and
read the caption as follows:
ORDINANCE NO. 80-A-25
AN ORDINANCE PROVIDING FOR THE MODIFICATION OF THE BOUNDARY LINES
OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEXATION OF 177.7 ACRES OF
LAND MORE OR LESS IN THE C.M. GAHAGAN AND J.F. ZEPEDA SURVEYS OUT OF
COMAL COUNTY.
Mrs. Lawler moved to accept the final reading of this ordinance on the annexa-
tion of 177.7 acres of land out of Comal County. Mr. Sawyer seconded the
motion which carried as follows:

#4 ORDINANCE: Mayor Stomackin introduced an ordinance regulating rabies
control and eradication and read the caption as follows:
ORDINANCE NO. 80-H-26
AN ORDINANCE ESTABLISHING AND REGULATING A RABIES CONTROL AND
ERADICATION PROGRAM WITHIN THE LIMITS OF SCHERTZ; PRESCRIBING
THAT THE ANIMAL CONTROL OFFICER WILL PERFORM AS THE HEALTH
AUTHORITY FOR THE PURPOSE OF THIS ORDINANCE; PROVIDING FOR RE-
PORTING EXPOSURE TO RABIES; PROVIDING FOR THE QUARANTINE OF
ANIMALS; PROVIDING A SAVING CLAUSE; PROVIDING A PENALTY; AND
PROVIDING A REPEALING CLAUSE.

Mr. Sawyer moved the ordinance regulating rabies and eradication of same
be finally passed. Mrs. Lawler seconded the motion which carried with the
following vote:

#5 EXECUTIVE SESSION: None needed at this time.
#6 CITY MANAGER'S REPORT: Mr. Gilmore informed that Mr. Anderlitch
would like to meet with the Council at 6:30
P.M. on the 18th if there are no objections.
He also said that the Jupe case has been appealed to the State Supreme Court
and that Richard Harris has filed his brief. He will keep them informed of
progress.
He also briefed the Council of the regulation under the U.S. Department on
energy called IIPERPAII that requires the City Council to hold a public hearing
regarding turning off gas without proper notice and that no advertisement costs
be passed on to the citizens.
The Industrial Development Committee is setting up a briefing in Austin
with the Industrial Development Commission for either the 2nd or 3rd of

December. Mr. Sawyer and Mrs. Lawler said they would both like to attend.
Mr. Gilmore also reported that last year because of inflation only one police
car was purchased even though we had two in the budget. He said that he would
like to go to the Department of Highways and Public Safety and purchase cars
at $1750 each, 1978 models. Many departments are using them at present with
good results. He suggested getting two cars now and possibly a third car
later in the year. This will allow the surplus money to purchase the needed
equipment for the cars under the budgeted item. Council was in favor of this
suggestion.
#7 ITEMS BY MAYOR: Mayor Stomackin had nothing at this time.
#8 ITEMS BY COUNCIL: Mr. Sawyer asked the status of Mr. Edwards in
getting rids of the weeds etc. at the old Drive-In.
Mr. Gilmore said that he is working on it at the present.
Mrs. Lawler requested that Mr. Harris study the Open Records act and determine
how it relates to SAFES. She also suggested that some police departments
assign cars permanently to an officer and make it his total responsibility.
