REGULAR SESSION OF THE CITY COUNCIL

The Schertz City Council convened in Regular Session, Tuesday, January 20,
1981 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the follow-
ing members present: Mayor Jack M. Stomackin, Sr., presiding; Barbara Taylor;
Richard L. Howe; Earl W. Sawyer and Jacqueline Lawler. Absent: Jeff Duffield.
City Staff present were City Manager Jimmy G. Gilmore and City Secretary June
G. Krause.
#1 APPROVAL OF MINUTES: A. Mr. Howe moved the minutes of the Special
Workshop Session of January 5, 1981 be
accepted. Mrs. Taylor seconded the motion which carried with the following
vote:
AYES: Cou~ilmembers Taylor, Howe, Sawyer and Lawler
NAYS: None
B. Mr. Sawyer moved to approve the minutes of the Regular Session of Jan-
uary 6, 1981. Mr. Howe seconded the motion which carried as follows:

#2 HEARING OF RESIDENTS: 1. Mr. Chuck Sharp addressed the Council con-
cerning the use of the Community Center.
He ended by saying he thought the Council just might want to look at better
ways to utilize the Center.
2. Mr. James Bohan of 112 Dearborn addressed the problem of the conditions
of some vacant lots in Greenfield Village, saying the tall weeds were a fire
and health hazard. He suggested the City strengthen our ordinance by putting
a 611 height limit on grass and weeds and firmer enforcement such as the City
of San Antonio does.
It was requested this be an item for the next Workshop session.
#3 ORDINANCE: The Mayor introduced and read the caption of the following
ordinance:

AN ORDINANCE PROVIDING MINIMUM STANDARDS FOR MOBILE HOME PARKS
AND MOBILE HOME SUBDIVISIONS; ESTABLISHING REQUIREMENTS FOR THE
DESIGN, CONSTRUCTION, ALTERATION, EXTENSION AND MAINTENANCE OF
MOBILE HOME PARKS AND RELATED UTILITIES AND FACILITIES; AUTHOR
IZING THE ISSUANCE OF PERMITS FOR CONSTRUCTION, ALTERATION AND-
EXTENSION OF MOBILE HOME PARKS; AUTHORIZING THE LICENSING OF
OPERATORS OF MOBILE HOME PARKS; AUTHORIZING THE INSPECTION OF
MOBILE HOME PARKS AND FIXING PENALTIES FOR VIOLATIONS; PROVIDING
AN EFFECTIVE DATE.
Mrs. Lawler moved to approve this ordinance on the final reading.

#4 ORDINANCE: Mayor Stomackin introduced and read the caption on
the following captioned ordinance:
ORDINANCE NO. 81-F-3
AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 77-F-13
BY REVISING RATES CHARGED BY GUADALUPE VALLEY ELECTRIC
COOPERATIVE, PROVIDING AN EFFECTIVE DATE AND DECLARING
AN EMERGENCY.

Mr. MD Hines, General Manager for GVEC was present to answer any questions
Council might have concerning this ordinance.
Mr. Howe moved to approve this ordinance on an emergency basis. Mr. Sawyer
seconded the motion which carried with the following vote:
AYES: Councilmembers Taylor, Howe, Sawyer and Lawler
NAYS: None
#5 CHARTER AMENDMENTS: The Mayor introduced the recommendations of
the Charter Review Committee for consideration.
Mr. Sawyer said he did not agree with the first two recommendations which
covered increasing the number of councilmembers and limiting terms of office
for same. He also pointed out that these two recommendations, if accepted,
would require lengthy clearance from the Justice Department. Mr. Howe and
Mrs. Lawler concurred with his views.

Mr. Sawyer moved the recommendations of the Charter Review Committee be
carried forth with the exception of Section 4.01 and 4.09. Mr. Howe
seconded the motion which carried as follows:

#6 BVYA CONTRACT: The Mayor introduced for consideration the renewal
of the contract with BVYA for use of ballfields
in G. W. Pickrell Park for the coming season.
Mr. Gilmore explained that the contract presented is the same as has been
granted the last two years.
Mr. Howe moved to approve the renewal of this contract for 1981. Mr. Sawyer
seconded the motion which carried with the following vote:

#7 SWIMMING POOL & PARK RESERVATION RATES: The Mayor introduced this
item and called on Mr. Gilmore
to give his recommendations. His recommendations included lowering the swim
lesson course fees, with decreasing fees for additional family members. He
also recommended raising the daily rate from 85t to $1.00 as he had received
numerous complaints from parents about their children losing the 15i change
or older children taking it away from the younger ones. He also recommended
a slight increase in individual and family pass rates. As for reservation
fees for park usage of small and large pavilion, he recommended

increasing to $15 per day and eliminating the electric charge rate, which
were time consuming to figure and having a flat rate charge for electricity.
Mr. Howe moved to approve the recommended rates set out by the City Manager.
Mr. Sawyer seconded the motion which carried with the following vote:

#8 APPOINTMENTS: After introducing this item, the Mayor turned the
floor over to Mr. Sawyer, who is an exofficio member
of the Library Advisory Board. Mr. Sawyer explained the dedicated and long
service given by the Board recommendations for Chairman and Vice-Chairman,
saying he concurred with the recommendations.
Mrs. Lawler moved to approve the recommendations of the nominating committe
of the Library Advisory Board. Mrs. Taylor seconded the motion, which carried
with the following vote:
AYES: Councilmembers Taylor, Howe, Sawyer and Lawler.

#9 TRANSFER OF APPROPRIATIONS: Mr. Gilmore explained that it is much
too early in the year to determine levels
of expenditures in each line item. This request is merely to accomodate the
actions that the Council has already acted upon, mainly in order for the
Public Works Director to purchase the high pressure sewer cleaner.
Mr. Sawyer moved these funds be transferred as outlined by the City Manager.
Mrs. Taylor seconded the motion which carried with the following vote:

#10 EXECUTIVE SESSION: None needed at this time.
#11 CITY MANAGER's REPORT: Mr. Gilmore asked if the Financial Report
he was submitting is suffiGient_ for Council
information. (2) He also advised that two bids had been received on the
new well too late to get on this agenda. He requested calling a special meet-
ing for January 26th to consider these bids. He explained the low bidder had
been thoroughly checked out by the Engineer, Public Works Director and himself
and not only is he highly thought of in the business but has a thorough
knowledge of the Edwards Aquifer. (3) He reminded Council that the bus trip
is scheduled for this coming Saturday morning for the IDC, P&Z and Council
to look at what the City has to offer to entice new industry. (4) He also
advised that Mr. McClure, of the County Tax Appraisal Board is scheduled to
meet with the Council at the February Workshop. (5) In discussing the control
tower for a repeater system, Mr. Simonson of the Communications Committee,
had this date advised him that he had a firm that would put up a 190 foot
tower for about $3780, less foundation,which could be done in house. He also
had a building that could be used for the equipment for this system for free.
The City would just have to paint and move it, as it is already wired.
He was to put his recommendations in writing, as the Council will have to take
action on this item shortly.

#12 . ITEMS BY COUNCIL: Mr. Howe read a letter from the Mayor setting
out council meeting procedures and commending
the Council on the progress being made in the City.
He also said he had heard that the Southern Pacific had purchased new lines
and would shortly be moving trains directly from Dallas to El Paso, which
would cut down on rail traffic through Schertz. Both Mr. Gilmore and Mrs.
Lawler commented on trains recently going through Schertz at excessive
speeds.
Mrs. Taylor reminded the citizens of the discussion with representatives of
the railroad, in which they stated they would monitor themselves and would
accept the responsibility of fires started by trains. She asked all citizens
to observe the trains and if either speeding trains or fires were started,
for the citizens to note the day and time and turn the information in.
Mr. Sawyer expressed his thanks to Mr. Simonson for all the work he has
done on the Communications problems in the city, along with the other
committee members. He also stated he agreed with Mr. Bohan and the Council
should take a good look at our weed ordinance.
Mrs. Lawler asked the City Manager if he had any recent word from the County
Tax Assessor concerning the sale of license plates in our city. Mr. Gilmore
said he had not. She also asked the status of the direct telephone line to
New Braunfels and was told that we had obtained pricing on about three ways
it could be accomplished and were working on that end of the problem at this
time. She also referred to the speeding trains and experiences she had
observed. Mr. Gilmore said the first thing the city needs is an ordinance
regulating the speed limits and he is working with the other cities down
the line to coordinate this.

Mrs. Lawler said she had seen an article in the morning Express that a
public hearing was to be held on Feb. 5 at 7:00 in Bexar County by the
Comino Real for funding for a clinic in Guadalupe County. Council discussed
the need to write voicing our opinion and recommending citizens do the same,
about having a meeting in Bexar County that would effect Guadalupe County.
#13 ITEMS BY MAYOR: Mr. Stomackin said he was getting together with
other cities to establish speed limits for the
railroad. Mr. Sawyer suggested penning our own ordinance and say this is
a suggested ordinance and do you concur. This would cut down on some of the
delay.
