ccreg 02-03-1981 7 REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 3, 1981 r--- The Schertz City Council convened in Regular Session, Tuesday, February 3,1981, at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the following members present: Mayor Jack M. Stomackin, Sr., presiding; Richard L. Howe; Barbara Taylor; Jeff Duffield; Earl W. Sawyer and Jacqueline Lawler. Staff present were City Manager Jimmy G. Gilmore and City Secretary June G. Krause. #1 APPROVAL OF MINUTES: A. Mr. Howe moved to approve the minutes of the Regular Meeting of January 20, 1981. Mr. Sawyer seconded the motion which carried with the following vote: AYES: Councilmembers Duffield, Taylor, Howe, Sawyer and Lawler NAYS: None B. Mr. Duffield moved to approve the minutes of the Special Meeting of January 27, 1981. Mrs. Lawler seconded the motion which carried as follows: AYES: Councilmembers Duffield, Taylor, Howe, Sawyer and Lawler NAYS: None #2 HEARING OF RESIDENTS: There was no one wishing to be heard. #3 ORDINANCE: The Mayor introduced an ordinance on a proposed annexation and read the caption as follows: ORDINANCE NO. 81-A-4 AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS BY THE ANNEXATION OF A TRACT OF LAND CONTAINING 124.5 ACRES MORE OR LESS OUT OF COMAL COUNTY. Mr. Sawyer moved to approve the ordinance and this 124.5 acres out of Comal County be annexed by the City of Schertz. Mrs. Lawler seconded the motion which carried with the following vote: AYES: Councilmembers Duffield, Taylor, Howe, Sawyer and Lawler NAYS: None " I , IW~ #4 RESOLUTION: Mayor Stomackin read the following captioned resolution stating the Public Hearing date has been set for March3, 1981. RESOLUTION NO. 8l-R-l A RESOLUTION OF THE CITY OF SCHERTZ, TEXAS, SETTING A TIME, DATE AND PLACE FOR A PUBLIC HEARING PURSUANT TO THE PROPOSED ANNEXATION OF 103.65 ACRES OF LAND MORE OR LESS OUT OF THE COUNTIES OF COMAL AND GUADALUPE. Mrs. Lawler moved to pass this resolution setting a date for the public hearing on the propos'e annexation of this 103.65 acres of land out of Comal and Guadalupe County for March 3, 1981. Mr. Howe seconded the motion which carried with the following vote: 8 (~ AYES: Councilmembers Duffield, Taylor, Howe, Sawyer and Lawler \--' NAYS: None #5 RESOLUTION: The Mayor read the following captioned resolution: '---' RESOLUTION NO. 81-R-2 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS SETTING A TIME, DATE AND PLACE FOR A PUBLIC HEARING PURSUANT TO THE PROPOSED ANNEXATION OF 130.3 ACRES OF LAND MORE OR LESS OUT OF THE COUNTY OF COMAL. Mrs. Lawler moved to approve the resolution setting a public hearing on the proposed annexation of 130.3 acres of land out of Comal County, for March 3, 1981. Mr. Duffield seconded the motion which carried with the following vote: '1 \ \ lP,b AYES: Councilmembers Duffield, Taylor, Howe, Sawyer and Lawler NAYS: None #6 RESOLUTION: Mayor Stomackin read the following captioned resolution: RESOLUTION NO. 8l-R-3 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, SETTING A TIME, DATE AND PLACE FOR A PUBLIC HEARING PURSUANT TO THE PROPOSED ANNEXATION OF 331.35 ACRES OF LAND MORE OR LESS OUT OF THE COUNTIES OF COMAL AND GUADALUPE. Mrs. Lawler moved to approve the resolution setting a public hearing for March 3, 1981 on the proposed annexation of 331.35 acres of land out of Comal and Guadalupe Counties. Mr. Howe seconded the motion which carried with the following vote: c--' '. , ,1/ ~\ \ AYES: Councilmembers Duffield, Taylor, Howe, Sawyer and Lawler NAYS: None #7 AUDIT REPORT: City Auditor Carlos Melick presented the 1979-80 audit and explained some of the features of the audit. He pointed out the excellent statement in the front from the City Manager. He also said that the City has applied for a Certificate of Performance on the audit. This is a National Certificate and will be a credit to the City and will add prestige by showing the City is meeting requirements of good financial procedures. Q ,~\ 1 Mr. Howe moved to accept this audit report, adding that it is the best one he has received in five years. Mrs. Taylor seconded the motion which carried with the following vote: AYES: Council members Duffield, Taylor, Howe, Sawyer and Lawler NAYS: None #8 ORDINANCE: The Mayor introduced and read the caption on the follow- ing ordinance: ,i 9 AN ORDINANCE - I BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, CALLING AN ELECTION TO BE HELD ON APRIL 4, 1981, FOR THE PURPOSE OF ELECTING THREE (3) COUNCILMEMBERS. Mrs. Lawler moved to approve this ordinance on the first reading. Mr. Howe seconded the motion which carried with the following vote: -I AYES: Councilmembers Duffield, Taylor, Howe, Sawyer and Lawler ) I'~ NAYS: None #9 EXECUTIVE SESSION: None needed at this time. #10 CITY MANAGER'S REPORT: Attorney Richard Harris reported that he had reviewed the bond papers and although he did not know when they could be sold, the paper work is being readied. Mr. Harris had to leave for other commitments at 7:37 P.M. City Manager Jimmy Gilmore reported that since the Municipal Complex was built many employees have passed through and during the process some of the keys had been lost therefore, security of the buildings needs to be upgraded. He had investigated several companies and processes that could be followed if the Council was in agreement it should be done. Council concurred with pursuing the subject. Mr. Gilmore also present an Annual Report explaining it tells what the City has been doing, what it plans for this year, what is planned for the near and far future. He also mentioned that the 16th (normal workshop date) is a holiday and asked Council if they would like to reset the workshop date. Council agreed on Monday, February 9th. Mr. Gilmore said that after the subject was brought up by a citizen at the last meeting, he had done a comparison of San Antonio's and Schertz' weed ordinances. Most of what the citizen said concerning San Antonio's ordinance was false and Schertz' ordinance is more restrictive. Mr. Harris said that the time span could not be shortened by State Law. Council agreed to leave our ordinance as it now is. The City Manager also advised that several citizens have asked about a dis- ability exemption other than the over 65 and Disabled Veterans exemption now given. Council agreed ---r, the City Manager should work up an ordinance for study. #11 ITEMS BY COUNCIL: Mr. Duffield mentioned that on his present electric bill, he noticed that the reading cycle went along with the date the company got the PUC okay and he wondered if they would be prorating the increase. Council briefly discussed this and Mr. Gilmore said he would ask Mr. Barnard of GVEC to be present at our next Workshop Session to answer any questions Council might desire. 10 Mr. Sawyer told Council of his visit at the Utility Yard and what a great improvement that has been done in that Department. ATTEST: c:k:. _ ~ ~retarY"City of Schertz SPECIAL MEETING OF THE CITY COUNCIL FEBRUARY 9, 1981 The Schertz City Council convened in Special Workshop Session, Monday, February 9, 1981 at 7:00 P.M. in the Conference Room of the Municipal Complex 1400 Live Oak Road with the following members present: Mayor Jack M. Stomac- kin, Sr., presiding; Richard L. Howe; Barbara Taylor; Earl W. Sawyer and Jacqueline Lawler. City Staff present: City Manager Jimmy G. Gilmore and City Secretary June G. Krause. #1 G.V.E.C.: Mr. George Barnard, representing Guadalupe Valley Electric Cooperative, was present to answer questions of the City Council. The questions mainly concerned the recent rate increase approved by the PUC and City Council and the effective date of the increase. Some members of the Council was of the opinion the rate increase was reflected as being retroactive on the recent February 1st billing by GVEC. Mr. Gilmore was asked to get the City Attorney's opinion concerning the wording of the ordinance as passed on March 27, 1981. #2 ORDINA~CE: The Mayor introduced and read the following captioned ordinance: AN ORDINANCE ESTABLISHING SPEED LIMITS ON FM 3009 FROM THE NORTHWEST CITY LIMITS OF SCHERTZ SOUTHEASTERLY TO THE INTERSECTION OF FM 78 IN THE CITY OF SCHERTZ, TEXAS, AND REPEALING ALL ORDINANCES IN CONFLICT. f I I I I , I.
