ccreg 04-07-1981 28 REGULAR MEETING OF THE CITY COUNCIL APRIL 7, 1981 The Schertz City Council convened in Regular Session, Tuesday, April 7, 1981 at 7:00 P.M. in the Council Chambers, 1400 Live Oak Road with the following members present: Mayor Jack M. Stomackin, Sr., presiding; Jeff Duffield; Barbara Taylor;' Richard L. Howe; Earl W. Sawyer and Jacqueline Lawler. Staff present: City Manager Jimmy G. Gilmore and City Secretary June G. Krause. .--. : \ ! I .----- #1 APPROVAL OF MINUTES: A. Mrs. Lawler moved the minutes of the special meeting of ~arch 12, 1981 be - approved. Mr. Howe seconded the motion which carried with the following vote: AYES: Councilmembers Duffield, Taylor, Howe, Sawyer and Lawler NAYS: None B. Mr. Sawyer moved to approve the minutes of the Special Meeting of March 16, 1981. Mr. Duffield seconded the motion which carried with the following vote: AYES: Councilmembers Duffield, Taylor, Howe, Sawyer and Lawler NAYS: None C. Mr. Sawyer moved the minutes of the Regular meeting of March 17, 1981 be approved. Mr. Howe seconded the motion which carried with the following vote: AYES: Councilmembers Duffield, Taylor, Howe, Sawyer and Lawler NAYS: None j i I J ----' Mayor"Stomackin asked to switch item #2 and #3 at this time. #3 PRESENTATIONS: Mayor Stomackin called Mr. Adolph Aguilar forward and presented him with a plaque to help show the City's appreciation for the five years he volunteered on the Planning and Zoning Commission, four of them as Chairman. The Mayor then presented Certificates to the following named employees for their participation and completion ofa continuing education course sponsored by the Texas Education Agency and San Antonio College entitled IIWhat Manager's Doll. This was a four weeks course with the following receiving certificates: Assistant City Secretary/Court Clerk Alice R. Austin; Assistant City Manager/ City Secretary June G. Krause; Chief Dispatcher/Police Office Manager Verla Galloway; Patrolman Jack G. Morris; Patrolman Thurman L. Roberson and Streets and Parks Worker Dennis S. Little. #2 HEARING OF RESIDENTS: None wishing to be heard. #4 ORDINANCE: The Mayor introduced an ordinance as an emergency measure authorizing the issuance and confirming the sale of Certificates of Obligation. He then read the caption as follows: .----, " ;~ 29 - , ORDINANCE NO. 81-B-9 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AOTHORIZING THE ISSUANCE OF $150,000 PRINCIPAL AMOUNT OF CERTIFICATES OF OBLIGATION OF SAID CITY TO BE KNOWN AS "CITY OF SCHERTZ, TEXAS, COMBINATION TAX AND JUNIOR LIEN REVENUE CERTIFICATES OF OBLIGATION, SERIES 1981" FOR THE PURPOSE OF PAYING CONTRACTUAL OBLIGATIONS TO BE INCURRED IN CONSTRUCTING IMPROVEMENTS, EXTENSIONS, ENLARGEMENTS AND REPAIRS TO THE CITY'S WATERWORKS SYSTEM; PRESCRIBING THE MATURITIES OF SAID CERTIFICATES AND THE INTEREST RATES PROVIDING THAT SAID CERTI- FICATES SHALL BE PAYABLE FROM THE PROCEEDS OF AD VALOREM TAXES AND CERTAIN NET REVENUES OF THE CITY.S UTILITY SYSTEM; PROVIDING THE FORM OF SAID CERTIFICATES; CONFIRMING THE SALE OF SAID CERTIFICATES; AND MAKING OTHER PROVISIONS PERTAINING TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE, AND DECLARING AN EMERGENCY.. Mr. Howe seconded the motion which carried with the following vote: AYES: Councilmembers Duffield, Taylor, Howe, Sawyer and Lawler ::) :_' - , NAYS: None #5 ORDINANCE: The Mayor introduced and read the caption of an ordinance on the proposed annexation of 103.65 acres of land out of Comal and Guadalupe Counties as follows: ORDINANCE NO. 8l-A-10 AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEXATION OF A TRACT OF LAND CONTAINING 103.65 ACRES OF LAND, MORE OR LESS, OUT OF THE COUNTIES OF COMAL AND GUADALUPE. Mr. Sawyer moved tnis-ordinance on the proposed annexation of 103.65 acres of land out of Comal and Guadalupe Counties be approved on the final reading. Mr. Duffield seconded the motion which carried with the following vote: AYES: Councilmembers Duffield, Taylor, Howe, Sawyer and Lawler NAYS: None :. 3 'j, , #6 ORDINANCE: The Mayor introduced the following ordinance and ;1 read the caption: ORDINANCE NO. 81-A-ll AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEXATION OF A TRACT OF LAND CONTAINING 331.35 ACRES, MORE OR LESS, OUT OF COMAL AND GUADALUPE COUNTIES. Mr. Sawyer moved this ordinance be approved on the final reading. Mrs. Lawler seconded the motion which carried with the following vote: AYES: Councilmembers Duffield, Taylor, Howe, Sawyer and Lawler / / NAYS: None 30 #7 ORDINANCE: Mayor Stomackin introduced an ordinance on the pro- posed annexation of 130.3 acres of land and read the caption as follows: , I ORDINANCE NO. 8l-A-12 AN ORDINANCE PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES OF THE CITY OF SCHERTZ~ TEXAS~ BY THE ANNEXATION OF A TRACT OF LAND CONTAINING 130.3 ACRES MORE OR LESS, OUT OF COMAL COUNTY. Mr. Sawyer moved this ordinance be approved on the final reading. Sawyer and Place 5 Jacqueline Lawler. #9 MAYOR PRO TEM: Mayor Stomackin turned the meeting over to Mayor Pro Tem Howe for this one item. Q \ 11 0 /) Mr. Howe nominated Jeff Duffield for Mayor Pro Tem for, the year April 1981 through April 1982. Mrs. Taylor seconded the nominatlon. Mr. Howe then called for any additional nominations. There being none he declared the nominations closed and asked for a vote on the one nomination of Mr. Jeff, Duffield, with the vote being as follows: AYES: Mrs. Taylor, Mr. Howe, Mr. Sawyer and Mrs. Lawler NAYS: None ABSTAINING: Mr. Duffield ,.--... i \ ' Mr. Howe then declared Mr. Duffield as Mayor Pro Tem for the coming year and relinquished his seat to the new Mayor Pro Tern. #10 EXECUTIVE SESSION: None needed at this time. #11 CITY MANAGER'S REPORT: Mr. Gilmore reported that the Municipal Court Judge had resigned as of'this date and that the Council needed to review and appoint a new Judge. Mr. Paul Finley, Assistant District Attorney in Gonzales has indicated he is interested in the position. Council agreed to an emergency meeting for Wednesday at 7:00 P.M. to interview Mr. Finley. I. #13 ITEMS BY COUNCI[: Mrs. Taylor congratulated the newly elected Council members. Mr. Duffield wished to thank Mr. Aguilar for his service to the City and the the employees receiving certificates for their interest in continuing their education. #13 ITMES BY MAYOR: Mayor Stomackin called attention to a letter from the Student-Body President of Samuel Clemens High School for the City.s interest in the young people for having \'. a Student Government Day. : I .. .a 31 He also said that he had sent a letter to Rep. Allan Schoolcraft in relation ,- to a bill concerning animal shelters and the State's control over same. I He had also sent letters to Both Sen Traeger and Bock but received no reply from them. Stomackin, Sr., presiding; Richard L. Howe; Barbara Taylor; Jeff Duffield; Earl W. Sawyer and Jacqueline Lawler. Staff present: City Manager Jimmy G. Gilmore. #1 CALL TO ORDER: The meeting was called to order at 7:00 P.M. #2 EXECUTIVE SESSION: The Mayor immediately called an executive session under Article 6252-17, V.T.C.S. Section 2-(g). The emergency meeting was reconvened at 7:25 P.M. #3 MUNICIPAL JUDGE: Mr. Sawyer moved to hire Mr. Paul Finley as Municipal Judge.
